ANA LIM KALAW, petitioner, vs.

THE HONORABLE INTERMEDIATE APPELLATE COURT, THE HONORABLE RICARDO B DIAZ AND ROSA LIM KALAW, respondents. [GR NO 75618, 1992-09-02, NOCON, J.] FACTS: 1. Carlos Lim Kalaw died intestate

2. Victoria Lim Kalaw filed an amended petition for the issuance of Letters of Administration with the CFI of Manila, naming the following as the surviving heirs of Carlos a. Ana Lim Kalaw b. Victoria Lim Kalaw c. Pura Lim Kalaw d. Rosa Lim Kalaw 3. TC appointed Ana Lim Kalaw as special administratic a. Ana Lim filed a preliminary inventory of all the properties of the deceased. b. Tc also appointed her as the judicial administratix of the estate and a Letter of Administration was issued 4. Jose Lim filed a motion to require Ana to render an accounting of her aministration of estate = GRANTED 5. Judge Diaz issued another order requiring petitioner to render an accounting of her administration but such order was not received by Ana Lim Kalaw. 6. Respondent Rosa with sisters Victoria and Pura filed a motion to remove Ana as administratix on the ground of negligence of her duties. 7. Judge Diaz issued another order for Ana to render an accounting within 30 days from receipt which she did. 8. Tc decided that Administratrix Ana Lim Kalaw violated the provisions of Section 8, Rule 85 of the Rules of Court for not rendering an account of her administration within one (1) year from date of receipt of the letters of administration and this constitutes negligence on her part to perform her duty as Administratrix 9. CA denied petition of Ana Lim Kalaw.

ISSUE: W/N it was correct to remove Ana Lim Kalaw as judicial administratix.
