Conditions of Engagement

Please note that our fee bid does NOT include for the following;

Structural engineers fees this will be dependent on the type and extent of the proposed works, usually once
an initial assessment has been made we will obtain a quotation on your behalf. Please note that any
appointment of consultants is made directly by the client as a guide

Statutory authority application fees these are not included as they are paid directly to the council and are
subject to change depending on the proposed works and which authority.
As a guide planning applications are currently 172 for an extension and 385 for a new dwelling or non
habitable applications, building control fees vary according to proposed works and sizes (this will be confirmed
once detailed proposals are agreed)

Party wall act


the party wall act applies if the proposals are within 3m of a neighbouring property the extent
and implications of this will be discussed once detailed proposals are agreed

Drafting Attendance of planning committees, major redraughting and subsequent applications are not included
as this would unfairly inflate this quotation based on information unknown at this point. These issues will be
handled on an hourly rate of basis of 55.00 per hour

Site inspections and visits these are not included as with most projects the client manages the works once all
statutory authority permissions have been obtained. We would usually recommend this be handled on an
hourly rate of basis of 75.00 per hour

Payment
Payments under this Agreement shall become due to the Architect on issue of the Architects invoice. Payments will be
requested as indicated above. The final date for such payments by the Client shall be 14 days from the date of issue of
an account.
Late payment
Any sums due and remaining unpaid at the expiry of 14 days after the date of issue of an account from the Architect shall
bear interest. Interest shall be payable at 8% over Bank of England base rate current at the date of issue of the account.
Please be aware that all invoices are issued on the submission of applications and it is anticipated that payment will be
received according to the above terms if payment has not been received by a date of two weeks prior to the
decision date you will be notified and the application will be withdrawn
For the avoidance of doubt the Architects entitlement to interest at the expiry of 14 days after the date of issue of an
account shall also apply to any amounts that an Adjudicator decides should be paid to the Architect.
Copyright
The Architect owns the copyright in the work produced by him in performing the Services and generally asserts the right to
be identified as the author of the artistic work/work of architecture comprising the Project.
Licence
The Client shall have a licence to copy and use and allow other Consultants and Contractors providing services to the
Project to use and copy drawings and documents produced by the Architect in performing the Services hereinafter called
the Material, but only for purposes related to the Project on the Site or part of the Site to which the design relates.
Such purposes shall include its operation, maintenance, repair, reinstatement, alteration, extending , promotion, leasing
and/or sale, but shall exclude the reproduction of the Architects design for any part of any extension of the Project and/or
for any other project.
Provided that:

the Architect shall not be liable if the Material is used for any purpose other than that for which it was
prepared;

in the event of any permitted use occurring after the date of the last Service performed under the Agreement
and prior to practical completion of the construction of the Project, the Client shall:
(a) Where the Architect has not completed Detailed Proposals (Work Stage D), obtain the Architects consent,
which consent shall not be unreasonably withheld; and/or
(b) Pay to the Architect a reasonable licence fee where no licence fee is specified in Schedule 3;

in the event of the Client being in default of payment of any fees or other amounts due, the Architect may
suspend further use of the licence on giving 7-days notice of the intention of doing so. Use of the licence may
be resumed on receipt of outstanding amounts.Signature
