The radio assignment was then- upgraded to the report of a stabbing. Upon arrival on the scene, officers discovered the decedent unconscious and unresponsive suffering from apparent sharp force injuries to his body on the floor of the WMATA subway car #3045. Members of the DCFD/EMS responded to the scene and found no signs consistent with life and left the decedent's remains on the scene. The decedent was pronounced dead at 4:15pm by MLI Leigh Fields of the DC Office of the Chief Medical Examiner. The decedent's remains were transported to the DC Office of the Chief Medical Examiner pending a post mortem examination, ‘The decedent has been identified as KEVIN JOSEPH SUTHERLAND. ‘The decedent's remains were observed by this affiant, who notated multiple sharp force trauma injuries to his chest, abdomen, upper right back, left side, right side, left arm and right arm. The decedent also sustained several superficial injuries to his body along with apparent defensive wounds to his right hand and fingers. ‘Asa result of this assault, members of the Metropolitan Police Department's Homicide Branch responded to the scene ‘and initiated an investigation and several witnesses were interviewed. One such witness was interviewed and will be hereinafter referred to as W-1. W-1 reported that it was riding on the subway train when it observed the defendant walk over to the decedent and attempt to take an item from the decedent's waist area. W-1 reported that decedent and defendant began to struggle over the item and the defendant was observed punching the decedent repeatedly until he fell to the floor. W-1 reported the decedent cries out for help and W-1 observed the defendant brandishing something in his right hand. W-1 reported the defendant continued assaulting the decedent who was now bleeding. W-1 reported it observed the defendant throw the decedent's cellphone at him as he lay on the floor of the train. W-1 described the DOS CRW 233 Gefendant has black male wearing wk clothing, 5-11, 160 pounds, black sung es, with a hat and bandana on bis head. ‘Assecond witness was Interviewed and will be hereinafter referred to as W-2. W-2 reported that while on WMATA subway it suddenly observed four guys, runs towards it. W-2 reported that as a result it looked and observed the decedent and the defendant tussling. The decedent was then on the ground, but right before the decedent went down it observed the defendant hit him in the chest with a black object. W-2 reported that the defendant then tore something apart and threw itdown, |W-2 reported the defendant went to the front of the train and then walked back to the decedent and stomped on him. W-2 reported it then observed the defendant then encounter an older man and a waman and stole their money. W-2 described the suspect as a black male, approximately S'9-5'10, red bandana, gold Ray Ban aviator sunglasses, dark pants, dark shirt, short dreads, and high top sneakers. Over the course of the interview with W-2 it was presented a sequential nine color photo array by Detective Jeffrey Weber and Jeramiah Mendez for the purpose of identification. In this photo array Defendant JASPER SPIRES photograph was positioned in photo #3. W-2 reviewed all nine photographs and stated “S and 8 look like him. He had sharp features.” W-2 reviewed the photo array again and stated “That guy.. ‘That's what he looked like to me while tapping photograph #5. W-2 then reported to detectives “if had to testify | would say #5, but 'm not 100%.” W-2 did not describe the four men initially running towards it as a being involved in the assault. [A third witness was interviewed and will hereinafter be referred to as W-3. W-3 reported that it was on the WMATA ‘subway train when It observed the defendant knock the decedent to the ground and was stabbing him. The defendant then kicked the decedent and threw a cellphone towards the decedent. ‘After stabbing the decedent, the defendant walked down the metro car towards it. W-3 reported that the defendant approached it and stated, “What do ya'll got?” The suspect then proceeded to rifle through W-3's packets and took 3 farecard out of its front pocket and its wallet out W-3's back pocket. W-3 reported that the defendant threw its farecard and its wallet to the ground, but not before the defendant went through its wallet and took the money that was in the wallet which W-3 estimated to be approximately 65 dollars and a sum of US currency from another female robbery victim. W-3 reported that the defendant was the first passenger off the train where the decedent was located when the train came to a stop at NOMA-Gallaudet Metro station and was last seen going down the escalator of the aforementioned station. |W-3 described the defendant as a black male, short curly hair, stubble on his face, cap or scarf, dark t-shirt with a graphic design, black jeans, bloody hands and arms, armed with a folding knife with a black handle. ‘A fourth witness was interviewed and will be hereinafter referred to W-4. W-4 reported that it was inside the NOMA- Gallaudet Metro station booth located at the Florida Ave side of the metro station, when it observed an individual jump the turnstile in what it believed to evade fair, W-4 reported as the defendant jumped the turnstile, he dropped a black book bag as well as a pair of camouflage pants further past the turnstiles. W-4 reported that the defendant briefly paused asif he was going to retrieve the items; however, he fied the station carrying with him another bag. W-4 reported he observed the defendant run westbound on N Street NE along the north sidewalk out of sight. W-4 reported that the black book bag was retrieved from the ground and put iton top of a turnstile, W-4 reported that it utilized a paper towel to gather the camouflage pants and put them Inside the black book bag the defendant dropped. W- ‘A notified Metropolitan Transit Authority police of the recovery of the bag and its contents and the bag was safeguarded by law enforcement until processing and seizure by MPD Mobile Crime technicians, W-4 could only describe the defendant as a black male in this early 20's. During the processing of the black book bag dropped by the defendant technicians from the MPDC Mobile Crime unit conducted a preliminary inventory of the bags contents along with Detective Gabriel Truby. Detective Truby notated that contained in the bag were a pair of camouflage pants (as described by W-4), a beige or brown wash cloth which contained suspected serological (blood) evidence, and an AmeriHealth health insurance card with the name JASPER SPIRES, member 20/9 tee 10# 70711502, and DOB: 9/21/1996. ; ; ‘Aaquery of law enforcement databases on JASPER SPIRES revealed that on Thursday July , 2045, Defendant JASPER SPIRES, black male, DOB: 9/21/1996, and MPDC PDID# 672493 was placed under arrest in the 5200 block of Wisconsin ‘Avenue, Northwest, Washington DC, by officers assigned to the Second District and charged with Robbery Force and Violence and misdemeanor assault on police officers. This affiant learned that on July 3, 2015, JASPER SPIRES was presented on charges of simple assault along with misdemeanor assault on police officers in DC Superior Court. Defendant SPIRES was released on his own personal recognizance in DC Superior Court in case # 2015CMD008904. This affiant learned from law enforcement officers that during arrest the numerous items of personal property were recovered from defendant SPIRES and held as prisoners property, they included a black book bag and assorted personal items which induded clothing and a pair of glasses. ‘Afifth witness was interviewed and will hereinafter be referred to as W-5. W-S reported that it was on the metro train car when it observed the stabbing of the decedent. W-S described the suspect as being a black male, approximately 28-30 years of age, dark complexion, 5-8 to 5-10 n height, low haircut, wearing an orange and red bandana, white shirt, and black pants. W-5 was being interviewed utilizing the services of an interpreter. ‘On Saturday July 4, 2015, between the hours of 6:00am-6:15am, Defendant SPIRES responded to the MPDC Second District and retrieved his book bag and assorted personal items from the police custody. During this interaction with law enforcement, Defendant SPIRES entire interaction to include taking possession of a black book bag was captured on video footage from the 2" District station area. The black book bag recovered from the NOMA-Gallaudet metro station appeared to be the same bag turned over the defendant at the Second District. ‘Asthis investigation progressed, Detectives reviewed footage fram several Washington Metropolitan Area Transit ‘Authority cameras from both the Rhode Island Avenue and NOMA- Gallaudet subway stations. Detectives were able to determine that the decedent entered the Rhode Island Avenue Metro station at 12:38 pm prior to boarding WMATA subway train, Detectives also determined that WMATA subway train left Rhode Island Avenue Metro station at 12:46 pm ‘with the next stop being NOMA-Gallaudet station and the train arrival time being approximately 12:49 pm. In the video footage from the Rhode Island Avenue Metro station detectives observed the defendant who Is described asa black male, medium complexion, red bandana on his head, dark long sleeve shirt, dark pants, black sneakers, and holding a red and black Nike backpack enter the Rhode Island Avenue station shortly after the decedent had entered the station. During the review of the video footage, Detectives observed the WMATA subway train arriving at the NOMA-Gallaudet statlon. The defendant is seen walking from the second train car where the decedent's body is found, which is consistent with W-3's description of events. In addition, the defendant is observed wearing gloves on both hands and immediately walked down the nearby steps to the street level. The defendant is then observed running on the ground level toward the exit on the Florida Avenue side of the train station. The defendant abruptly stops and turns around in the opposite direction and is out of sight of the camera before continuing to run toward the Florida Avenue exit. The defendant Is observed exiting the NOMA-Gellaudet station dropping an article of clothing (camoutage pants) from an additional red Nike bag he possessed. Detectives C, Bastian, J. Weber, and J, Mendez recanvassed the NOMA-Gallaudet metro station, specifically the area where defendant Spires was observed going out of camera view on the video footage. As a result of that canvass) 2016 Chw 2% 3 detectives located a trashcan. Ache. the trash contents revealed a small blac ‘ding knife that was submerged in liquids from the trash can. The knife was recovered as evidence In this ‘ongoing investigation. During the evening of July 4, 2015, Officer Bruce Paige of the MPDC 2™ District was interviewed by Detective Joshua Branson regarding this homicide investigation. Over the course of that interview, Officer Paige was shown video footage from the Rhode Island Avenue metro station. Prior to pul ling Officer Paige with the video he was asked to determine if ‘he could recognize anyone in the footage. Upon viewing the video footage, Officer Paige indicated to Detective Branson that he was 100 percent certain he recognized JASPER SPIRES, a defendant he arrested on July 2, 2015. Officer Paige reported that in addition to the arrest on July 2, 2015, he had at least two previous law enforcement contacts with defendant SPIRES for suspicious activity in the 2™ District, PSA 202. Officer Paige reported that during his previous ‘encounters with the defendant SPIRES he acted as if he was under the influence and would talk to himself. Officer Paige indicated that in the video footage from the Rhode Island Avenue station defendant SPIRES was wearing red bandana, ‘sunglasses with white trim, a red and black back pack, dark shirt, and black multi-color tennis shoes. Based on the on facts set forth in this affidavit, your affiant believes probable cause exists and respectfully requests that a Judge of the District of Columbia Superior Court issue an arrest warrant charging JASPER SPIRES, and MPDC PDID#672493 with this offense. JASPER SPIRES On July 5, 2015, a District of Columbia Superior Court Arrest Warrant for First Degree Murder While Armed (Felony Murder) was issued for the defendant, Jasper Spires. Defendant Spires was arrested by members of the Metropolitan Police Department on July 6, 2015, at approximately 8:55 a.m. in the 4800 block of Georgia Avenue, Northwest. He was wearing a dark, short-sleeved t-shirt, dark jeans, and black socks. He was not wearing shoes On July 5, 2015, Dr. Nikki Mourtzinos, a deputy medical examiner with the Office of the Chief Medical Examiner for the District of Columbia, conducted an autopsy on the decedent. On July 6, 2015, the undersigned spoke with Dr. Mourtzinos about her preliminary findings and conclusions. Dr. Mourtzinos observed approximately 30-40 stab and cutting wounds on the decedent. Approximately 20 of those wounds were stab wounds. Some of the most significant stab wounds included a 3-inch-deep stab wound to the chest, which struck the decedent's heart; a 3.5-inch-deep stab wound to the chest that penetrated the decedent's pericardial sac; and a stab wound to the right side of the decedent’s chest, which penetrated 5.5 inches into his body, striking and fracturing one of his ribs and puncturing his lung. Dr. Mourtzinos also observed what she described as “defensive wounds” to the decedent's arms and hands and blunt force injuries to his head, including a large abrasion to the left side of his face and contusions between the eyebrows, on the bridge of the nose, and on his right ear. Dr. Mourtzinos anticipates that she will conclude that the cause of the decedent's death was multiple sharp force injuries with blunt force injuries, and the manner of his death was a homicide. The arrest warrant affidavit describes how W-5 described the suspect. In addition to what is in the warrant, W-5, through an interpreter, stated that the bandana on the suspect’s head was red, purple and orange.
