19 Pending on the January 16, 2007 law and motion calendar is a

20 motion for entry of final judgment as to defendants Broadspire

21 Services, Inc. and Kristine Blas. Plaintiff filed a statement of

22 non-opposition. The court decides the matter based on the papers

23 and without oral argument.

24 On October 26, 2006, the court dismissed defendant Kristine

25 Blas as fraudulently joined. On November 16, 2006, the court

26 granted Broadspire's motion to dismiss. Therefore, all claims

1 asserted against Kristine Blas and Broadspire have been finally

2 resolved.

3 Accordingly, final judgment is entered in favor of defendant

4 Broadspire. Defendant Kristine Blas is deemed to no longer be a

5 party to this case. Plaintiffs shall take nothing by their

6 complaint and said defendants shall recover their costs of suit

7 according to proof.

8 The hearing set for January 16, 2007 is hereby VACATED.

9 IT IS SO ORDERED.
