Wegner #4784. /My partner Paul Buzicky and I were in full police uniform, in a fully marked squad car (1891), and assigned as a Green Line Rail Squad. Officer Buzicky and I were W/B on University Avenue in St, Paul. 1 was driving and Officer Buzicky }was riding in the front passenger scat. As we were approaching Lexington Parkway I noticed a male standing adjacent to the platform on the Light Rail tracks for E/B trains. I pulled our marked squad into the turn lane and yelled out my driver side window "Hey!" The male ignored me. As I junbuckled my seatbelt and put the squed in park so I could get out of it, he jumped back up onto the platform. Officer Buzicky and I crossed the tracks on foot and stepped up onto the platform with the suspect. 1 jasked him if he had an ID. He asked what for? I told him that it was illegal for him to be on the tracks. He made no movements to obtain an ID for me so I asked him again if he had an ID. He responded loudly "I'm 17!" I told him lots of people have ID's at 17. He again made no movements {to retrieve any ID. 1 told him to turn around and put his hands behind his back. He refused to follow verbal commands. [He started to move backwards away from us and T reached out with my left hand and grabbed hold of his outer clothing (puffy vest). His left hand started to come up from his waist. I grabbed onto his left [wrist with my right hand to prevent him from striking me. | told him to stop resisting and again told Ihim to put his hands behind his back. He continued to refuse to comply, In fact he was able to cock his loft hand by his left ear while looking right at me telling me not to touch him. I still had control of the wrist and he was unable to strike, even though he was trying. I (old him he was under arrest and to stop resisting, He just looked at me and continued resisting, T could see that Officer Buzicky was attempting to control the subjects other hand. I was offset from {the suspect slightly and in good position to attempt a leg sweep takedown. I felt that it would be Jeasier for us to control him on the ground. [The suspect continued to resist and was now kicking at Officer Buzicky and trying to punch me in the jhead/face. Since he was lying on his back and ] was on top of him, I used my left arm to encircle the suspects neck, placing him in a level-one front vascular neck restraint, I heard Officer Buzicky yelling at the suspects friend who was also on the platform and moving toward us to stay back. The ‘suspect was still kicking and trying to hit us so I transitioned into a level-two front vascular neck restraint with compression. He seemed to stop fighting and Officer Buzicky was able to get one ‘handcuff on him, T released the suspect and was trying to roll him over onto his stomach so we could get him Hhandcuffed behind his back. When he got onto his side I keard him take a deep breath. Officer Buzicky and I were not able to get the suspect handcuffed behind his back and had to settle for handcuffing him with his hands in front, ‘As soon as the second handouff was applied, I released the suspect completely. It was then I noticed that he seemed semiconscious. 1 informed Officer Buzicky of this and immediately moved the suspect to the recovery position on his side, He seemed to come to but was very grogey. Iasked dispatch to start medics. We kept him handcuffed in front for our safety and his comfort. I had Officer Buzicky unzip the suspects puffy vest because I could see that he was sweating and I didn't want any of his clothing restricting his breathing or recovery. 1 tried to talk to the suspect in a calm reassuring voice. He would look at me, but did not say anything, An ID card was located in one of his pockets and it identified hin: Medics arrived and I gave them a brief synopsis of the incident. They took over primary care for , eventually transporting him to Regions Hospital. Officer Buzicky rode along in the ambulance as security for the medics. ‘Sgt. Peterson arrived on the scene and was briefed as well. Sgt. Peterson spoke with = friend who stayed on scene. Sce Sgt. Peterson's report for further information. Use of Foree Created By: Peter Peterson| STATEMENT OF SGT. PETERSON#5028 }On 8-31-15 at approximstely 1903 hours MTP#203 was monitoring the radio when #258 checking out [with one at LRT Lexington platform. A short time later they put a help call that they were fighting ‘with one. ‘TCC advised ECC and they dispatched SPPD to the platform. MTPD#242 & 216 also responded to the scene. MTPD#258 also requested SPFD ambulance to the scene. Upon arrival I could see a crowd jon the end of the platform and a crowd across the street at Popeye's. SPPD was on scene on the platform, I could see the suspect on the platform, handcuffed in front and on his side, I noticed that his lip was bloody. I spoke with Officer Wegner who advises on they were w/b on University and saw a the party standing on the LRT tracks at Lexington Platform. Seeing this misdemeanor violation the Officers advised this party to get off the tracks and get on to the platiorm. Upon exiting the squad officers went to ID the suspect and became upset and one point clenched his fist and attempted to strike at officers. [Officer then took him to the ground. While on the LRT Platform Officer Wegner udvises that 1 spoke with Officer Buzicky who advises that he saw the party standing on the LRT tracks and that when dealing with him he became uncooperative and clenched his fist officers than brought him to the ground and at one point during the incident he was kicking at officers. See Officers Buzicky & ‘Wegner report for further details. This party was ID I — ‘SPPD had located a witness on this incident. party was ID as JOSE LUIS BOSCH DOB 12-3-99. T asked what happened? He advises that [IM was on the tracks and were play fighting. Officer then | got out of the their squad and asked him for his ID. He said that Mftold him that he didn't have an| id and then was resisting them. | asked if he heard anymore of the discussion between the officers? He ladvises no because he was listening to his music. I asked if he knew of {ED had problems? He advises that he has anger issues. SPED arrived on scene and transported party to Regions. Officer Buzicky rode with the ambulance to {the Regions. Upon arrival to Regions I had Officer Buzicky photograph this parties injuries from t his incident. te V4 photograph of [EE was taken. While at Regions | was approached by staff who advises IE mother is at the ER waiting 100m area and wants to see him, I advised I would be over to talk with her. Upon going there T was met by a RCSD who advises they are loud and that might have to leave if they can't quiet down. I located | EE anid she had her daughters now present who were loud. I advised that I would bring her back now to see her son but her daughters can't go due to their behavior. 1 than brought| back to the ER room where her son was. During this incident I attempted to talk with Jand wouldn't respond to me. I gave her my business card and advised that this incident would be further reviewed for charges against her son. i’ did sign a medical release for this incident only for Regions. \f the 1T then went into another. to check on Officer Wegner. I checked with SPPD to see if CCTV picked up 1! incident on their camera's they advise no. DVR download has been requested for platform. Buzihy ‘On 08/31/2015 at approximately 1900 hours, Officer Wegner and I observed a male standing on the tracks in front of the EB Lexington Platform. Officer Wegner yelled twice at the male to get off the tracks. ‘The male continued to stand on the tracks and made no effort to get off the tracks, |Officer Wegner parked the car in the left tum lane facing WB on University. As we approached the male Officer Wegner asked him for his ID. The male stated he did not do anything wrong and did not need to identify himself. Officer Wegner explained to him that since he was standing on the tracks he ‘was trespassing and therefore needed to identify himself. ‘The male yelled at Officer Wegner, "I'm ‘only 171" Officer Wegner stated lots of 17 ycar olds have identification. The male did not make any motion to retrieve an ID or state if he had one. The male tured left and I believed he was going to |walk away. I grabbed the male's right wrist and attempted (o pull it behind his back. The male began strugeling with us and Officer Wegner was able to perform a take down maneuver. [Once the male was on the ground he started to kick both feet and swing his right arm, I was attempting to hold him down and the male continuously was kicking me and hitting me with his hand. It should be noted the male's left arm was trapped under Officer Wegner and cauld not move. Another male who was later identified as Jose Louis Bosch was walking up on Officer Wegner and 1 as we were fighting with the male. I yelled at Bosch multiple times to back up and he would not. I pulled out my department issued taser X2 and told Bosch to back up or he was going to be tased, Bosch yelled at me, "Your not my parents! You didn't make me! You can't talk to me like that!" [Bosch took a few steps away and I continued helping Officer Wegner restrain the male on the ground. [Bosch again started walking up and I again took out my taser and told him to back up. Bosch [complied after I made multiple requests for him to back up. [After Bosch backed up the second time T was able to put a handouff on the male's right hand. I heard (Officer Wegner tell the male that we were going to let up on him and he needed to put his left hand on his abdomen when we released it. After Officer Wegner started to let up the male began swinging and kicking again. Officer Wegner }was able to get the male on his side and I put the other handcuff on the male. At this time officers Inoticed the male was unconscious and he was placed in the recovery position. | Medics were contacted and responded to the scene. The male was eventually identified as | G97). eas transported to Regions Hospital by medics (Medic Run#). 1 rode with medics and [IMJ in the back of the ambulance to Regions.
