Bylaw 17400 - Vehicle for Hire Bylaw Revised aN Purpose ‘To amend Vehicle for Hire Bylaw to provide for improved service standards. Readings Bylaw 17400 is ready for three readings. If Council wishes to give three readings during ‘single meeting, Council must unanimously agree “That Byiaw 17400 be considered for third reading.” Advertising and Signing ‘Advertising is not required for this Bylaw. Position of Administration ‘Administration supports this Bylaw Report Summary Revised Bylaw 17400 incorporates the changes to the proposed new Vehicle for Hire Bylaw directed by City Council through Part 1 of the September 22, 205, motion. Previous CounciliCommittee Action Atthe September 22, 2015, City Council meeting the following motion was passed: 41, That Administration return to Council in November 2015 with a revised draft Bylaw 47400 - Vehicle for Hie Bylaw as outined in Attachment 1 ofthe September 16, 2015, Sustainable Development report CR_290', with the change to include the following 2, Creation of a distinct licence class for Transportation Network Companies with ‘appropriate vehicle license fees (per afflated driver, for instance) A driver licence fee (nominal amount! for Private Transportation Provider drivers who are Transportation Network Company-affiated (.e., $50/ year) .. Non-discrimination on pickups that could be applied to Private Transportation Provider (expansion of section 12) {Maintaining the number of accessible vehicle licenses, ¢. Creation of a new fund, supported by proportional contributions from ‘Transportation Network Companies, that could support future conversion of existing Vehicle licenses to accessible vehicle licenses, and or addtional accessible vehicle licenses. A driver licence fee (nominel amount) for Private Transportation Provider drivers ‘who are Transportation Network Company-affiated (L0., $50/ year) ‘The fee schedule (Schedule B) of proposed Bylaw 17400 has been amended to include ‘$60 per year fee for a one-year driver's licence. The fee fora standard two-year Givers Teence remains at $100. There are administrative and financial benefits to having drivers only attend at the City once every two years to obtain a licence, so the ‘proposed licence fee for a one-year option is sightly higher than half the standard fee to feflect the increased costs of having individuals receive a licence annually. The one~ year option with a $60 per year fee is available to all vehicle for hire drivers. . ‘Non-disoriminaton on pickups that could be appli to Private Transportation Provider expansion of section 12) ‘Section 12 of the proposed Bylaw has besn expanded to include private transportation providers as vehicles for hire that cannot refuse service requests. 4. Maintaining the number of accessible vehile licenses Section 23 of proposed Bylaw 17400 has been expanded to include a limit on the number of accessible tax licences that may be issued (95). This limt corresponds to the limit contained in the current Vehicle for Hire Bylaw, Bylaw 14700. Accessible taxi licences and tax licences may be transferred, as is currently permitted, ©. Creation of @ new fund, supported by proportional contributions from Transportation Network Companies, that could support future conversion of ‘existing vehicle licenses fo accessible vehicle licenses, and or additional accessible vehicle licenses ‘As described above, dispatch licences have been divided into two types ~ general and private transportation provider. The fee for a general dispatch licence is unchanged from the current bylaw, however proposed Bylaw 17400 increases the annual ivence fee for private transportation provider dispatchers by $500 per year. This addtional {$500 would be retained in a newly created accessibilly fund that could support the future conversion of existing taxi vehiles to accessible taxis, or provide grant funding to offset the purchase cost of new accessible taxi. In addition, the two-year vehicle icence fee for private transportation provider vehicles hhas been increased to $920, compared to $820 forall other vehicles for hire. This, ‘additonal $100 per private transportation provider vehicle licence wil also be retained in the new accessibility fund. Options forthe administration ofthis new fund, cluding options for any necessary changes to the limits on taxi and accessible tai licenses, wil be presented to Executive Committee in the frst quater of 2016. SEIZURE OF 10 (2) Ka bylaw enforcement officer has reasonable grounds to believe LICENCE that vehicle for hire is being driven in manner contrary to this bylaw, the bylaw enforcement officer may seize and take possession ofthe vehicle licence issued for that vebicle and/or the {river's licence ofthe driver ofthe vehicle for hie. (@) Alicence seized pursuant to this section must be returned tothe Cty Manager as soon as practicable, along with written sommary ofthe basis of te bylaw enforcement officer's reasonable beiefin support ofthe seizure.
