It has come to my attention that a bill is being
sponsored by Senator Roy Goodman (S-1282) that would
reverse the April 1990 court decision allowing street
peddling in formerly restricted Midtown Manhattan
locations.
As a member of the Fifth Avenue Association, as well
as one of this City's biggest boosters, I am writing
to let you know that I strongly support this new
bill and hope that you will do everything in your
power to help expedite its passage.
At stake is an issue critical to the New York business
climate. Do we support and encourage a legitmate
economy that contributes to the growth and flourishment
of our City, or do we allow the underground economy
created by the Kaswan vs. Aponte decision to undermine
an already shrinking tax base?
On a more visible level, do we allow Fifth Avenue,
one of the world's finest and most luxurious shopping
@istricts, to be turned into an outdoor flea market,
clogging and seriously downgrading the area? How can we
allow merchandise that is of extremely poor quality and
either counterfeit or mislabled to be sold on our streets
and very often in front of the very store thet owns the
copyright or trademark?

While disabled veterans should be given every
opportunity to earn a living, is it fair to
do so to the detriment of the City as a whole
or its tax paying citizens and businesses?
Surely, our government could come up with
a better plan.
In closing, I would like to reiterate my
strong endorsement for passage of S-1282,
and I hope you will give this letter of
support every consideration.
