1 The motion of defendant West Publishing Corporation (“West”) to dismiss


2 plaintiffs’ Complaint pursuant to Federal Rules of Civil Procedure 12(b)(6) and
3 12(b)(1) (the “Motion”), which was joined by defendant Kaplan, Inc., came on
4 regularly for hearing at 10:00 a.m. on April 7, 2008, in Courtroom 8 of the above-
5 entitled Court, the Honorable Manuel L. Real, presiding. James P. Tallon of
6 Shearman & Sterling LLP and Heather H. Gilhooly of Liner Yankelevitz Sunshine &
7 Regenstreif LLP appeared on behalf of moving party West. Stuart N. Senator of
8 Munger Tolles & Olson LLP appeared on behalf of joining movant Kaplan, Inc. Joel
9 R. Bennett and Fredricka Ung of the Disner Law Corporation appeared on behalf of
10 the plaintiffs.
11 Having read and considered the papers submitted in support of and in
12 opposition to the Motion, and having considered the arguments of counsel and the
13 pleadings and records on file, the Court GRANTS the Motion. Plaintiffs’ Complaint
14 is hereby dismissed, as to all defendants, with prejudice.
15 IT IS SO ORDERED.
