As part of the settlement of these cases, Plaintiffs are permitted to seek attorneys fees in the

amount of 25% of the total settlement fund, which amount has been considered the benchmark in

California for attorney fee requests from class action recoveries. Plaintiffs counsel hereby states

that, in order to provide additional benefit to the class, she is reducing the requested fees by $10

million.1

This reduction would come off of the fees from the guaranteed portion of the settlement fund
($84 million). Thus, the reduction is not contingent on whether the additional $16 million
contingency is triggered. Whether the ultimate monetary settlement is $84 million or $100
million, Plaintiffs are seeking $10 million less in fees than the agreed upon 25%.
