This DEED OF AGREEMENT FOR ALLOTMENT OF A RESIDENTIAL FLAT


is made this the ---------------, two thousand -------- of the Christian Era.
BETWEEN

1. QUANTUM PROPERTIES LIMITED, House # 8/A, Road # 2/B, Sector #


11, Uttara, Dhaka-1230, represented by its Managing Director, Mr Mahboob
Morshed, hereinafter referred to as the builder (which expression where the context
so admits shall Include its successors in interest and assigns) of the FIRST PARTY.

Whereas the Builder is engaged in the development of Flats on a land of ------ (--)
Kathas situated at Plot # ----------------------------------------------------------- . for the
purpose of constructing and selling the Developer portion of flats to the interested
Parties, who have agreed to the allotment on the following terms and conditions:
01.That the Builder have allotted the applied flat No. ------------ of the project

etc. The price has been mutually agreed and settled at Tk.-------------------/= (Taka

any requirement of installation of Solar Panel, apartment owner should
participate with the cost.
02. Apartment size will be finalized and confirmed at the time of floor brick layout.
But there will be no change at common space.

03. That the Allottee shall pay to the Builder the total consideration money on
installment basis, which shall be paid on or before the dates, mentioned below:

4. That if required the Builder shall arrange to form a Building Owners


Co-operative Society and the Allottee shall be a member of that CoOperative Society. The Builder shall arrange to transfer and register
undivided and undemarcated proportional part of the land more or less ------Sft in the name of the flat owner Allottee. But in all cases the related costs
such as registration, transfer costs etc of the land and building from
respective departments of the Government or any other organization will be
born by the Allottee.
5. That for regular maintenance and servicing of the common utilities such
as Lift (S), Pump (S), Generator, Common lights/fans, Water & Sewerage,
Security guards, Receptionist etc. the Allottee shall pay monthly
maintenance and servicing charges to the 'Flat Owners Co-operative
Society' mentioned earlier.
6.

Any delay will make the allottee liable to pay charge of 0.1% per day on that
amount of payment delayed. If the payment is delayed for 60 days, the
company shall have the right to cancel the allotment without any notice to the
allottee, in such case buyers deposited amount will be refunded after sale out
the same apartment to a new buyer. Also an amount of Tk. 50,000.00 (Taka
Fifty thousand only) will be deducted from the buyers deposited amount for
incidental charges.

7. That the Builder shall complete the construction of the demised flat and
handover the physical possession of the flat to the Allottee by --------- after
full payment by the Allottee. If there is any delay, Builder shall pay to the
Allottee Tk.---------- /= per month as compensation till handover the flat.
8. That the Builder reserves the right to amend the design plan and
specifications of the flats for the better benefit of the clients, which shall be
approved by the Allottee.
9. That the Builders responsibility to preserve, protect and maintain the
demised flat shall entirely cease after the dispatch of 30 day's notice to the
Allottee to take vacant possession of the demised flat. After the said period
the Builder will not be liable for any damage, pilferage, theft, loss, etc. of
the flat.
10. No Allottee shall, before the payment of final installment and all other
bills due to the Builder and certificate of handover, keep any belonging or
any other material within the premises of the complex.
11. That the Builder will not be held responsible for any delay in
completion of construction of the flat due to political unrest, Army
movement, Act of God and in such reasons beyond the control of the
Builder.
12. That in case of any dispute between the parties it must be settled by
arbitration under the 'Arbitration Act' prevailing in the country.

13. The Allottee covenant that he / she shall not use his / her Apartment or
any part thereof for any purpose other than as a residence nor use at in such
manner as is likely to cause nuisance or inconvenience or annoyance of any
kind to other Allottees and that he/she shall not use his / her Apartment for
any illegal or immoral purpose.
14. Allottee may change any fixture and fittings of his/her choice. In that
case additional cost over the standard cost of the developer will be borne by
the Allottee and payment must be made in advance.
15. One year free service after handover of the project/Apartment will be
done by the Builder without replacement of any fittings or its price.
IN WITNESS WHEREOF this Deed of Agreement is signed and sealed on
the Date, Month and Year written above.
