General The coverage of the WSHA will initially focus on the sectors with the highest accident and fatality rates namely construction sites, shipyards and metalworking factories. The coverage will be extended to all workplaces in stages, in consultation with the industry. Anew performance based and iabilty regime will be defined so as to reduce risk at source as follows'~ 1. The WSHA will assign legal responsibilities to the following parties:- © Occupiers © Employers who employ the service of any person fo do work © Seltemployed persons © Principals who engage another person other than under a coniract of service to either ‘supply labour orto do any work for gain or reward; © Persons at work Manufacturers or suppliers of machinery, equipment or hazardous substances used at work in the workplace; and; © Owners, installers or erectors of machinery for use at work inthe workplace. 2. The duty required under the WSHA for all stakeholders is to take reasonably practicable steps to ensure the safety & health of person who may be affected by the work, including the public. The burden is on the party responsible to show that he has taken such reasonably practicable measures. 3. The WSHA holds managers and directors of companies accountable for safety and health practices at their workplace. They must show that they have taken active steps to implement sound OSH management systems (including proper risk assessments), provide adequate resources, and ensure that full information is disseminated to workers and other persons exposed to risks. 4.
