In the fall of 2000 Pat Smith was working nights to support his way through

college at a fast food place. At 11.00 p.m., Nov. 12, 2000. James McCree entered the
establishment and demanded money from Mr. Smith. After Mr. Smith gave the defendant
all of the cash in the register the defendant James McCree became angry that he was only
robbing the store of $200.00. He than placed the victim on the floor face down and hit
him several times after that he shot him point blank in the back of the head. After several
days Mr. McCree was arrested for another robbery and charged with murder of Pat Smith.
He finally went on trial in Dec. of 2002 for the Smith murder.
At his trial he stated that he was a drug addict and was very sorry for what he had
done. He apologized to the family of Pat Smith and asked them to forgive him. He was
later convicted of the murder and during his sentencing Pat Smith’s mother and father
spoke. Pat’s father had announced that the couple separated. Pat’s mother had become
addicted to pain killers. The couple’s only other child who was very close to Pat had
attempted suicide two months after the murder. When Mrs. Smith took the stand seemed
out of it as she held a picture of Pat to show the jury. She added that she had not worked
since the shooting and had begun to question her faith.
