Tobacco Usage

• In FY2010 New York spent $57.0 million on tobacco prevention, which is 22.4% of the CDC
Best Practices recommended minimum.1

• The CDC estimates that 51.5% of adult smokers in New York tried to quit smoking in 2008.2

• New York received $2.13 billion in tobacco settlement payments and taxes in FY10.3

• New York has not securitized any of its Master Settlement Agreement (MSA) dollars.4

Excise Tax: There is a tax of $2.75 per pack on cigarettes.

Clean Indoor Air Ordinances


• Smoking is prohibited in all child care centers, government buildings, health facilities,
restaurants, bars, schools and private workplaces.

Youth Access Laws


• The minimum age requirement for the purchase of tobacco products is 18, and penalties
exist for merchants who violate this law.

• Establishments are required to post signs stating that sales to minors are prohibited.

• Only sales clerks are allowed access to tobacco products prior to sale.

• The sale of bidis is prohibited to minors in all establishments, and is prohibited to adults
except in tobacco stores.
