The complainant states thd the fllorng fats establish PROBABLE CAUSE: | ‘Your Complainant, Patrick Myslajek, is a Sergeant with the Minneapolis Police Department, and in that capacity hhas investigated the facts and circumstances of this case and believes the following establishes probable cause: ‘On March 5, 2011, at approximately 8:00 a.m., Minneapolis Police Officers were dispatched to 18" Street East and 10" Avenue South, located in the City of Minneapolis, Hennepin County, Minnesota, on a report that a female had thrown a baby into a snow bank. ‘The temperature outside was 16 degrees Fahrenheit with winds at 12 m.p.h. Upon arrival, officers located ASHLEY RENEE COUCH, DOB 11/08/1989, the Defendant herein, walking down the street holding a newborn baby. ‘The baby was positively identified as the victim, Child A herein, who was born on February 15, 2011, just eighteen days prior. Officer spoke to Witness 1, 2 known adult male, at the scene who reported that as he got off the bus he observed the Defendant arguing with a male, later positively identified as Child A’s father, D.T. Witness 1 reported that he observed the Defendant throw Child A into a snow bank on the side of the road. He observed that a blanket had fallen to the ground and Child A was lying in the snow with nothing covering her, Witness 1 called 911, picked up Child A, who was red in color and only wearing a t-shirt, from the snow bank and wrapped her in his jacket as he waited for the police to arrive, Witness 1 reported Child A was unresponsive and cold to the touch. He stated he rubbed Child A’s chest area for approximately ten seconds before she eventually responded, Officers also spoke to Witness 2, a known adult male, who reported that as he walked down the street he observed the Defendant slam Child A into the snow bank. FORM-I i REV. 12/95 Page 2 D.T. was also at the scene and responding officers observed he was visibly upset and crying, D.T. reported to law enforcement that the Defendant had slammed their baby, Child A, into the snow bank. D,T. continually yelled, “I can’t believe you did that to my baby!” Ing post-Miranda statement the Defendant stated that after an argument, D.T. took some money from her and fled their residence, She admitied that she then grabbed Child A and a blanket from inside the home and chased after D.T. The Defendant claimed that when she caught up to D.T. she pushed him and Child A fell out of her hands into the snow bank. At the hospital, treating physicians noted Child A was lethargic and had cool Child A was (reated for hypothermia with a temperature of 95.8, She was placed in an incubator, which gradually caused her temperature to rise. ‘The Defendant is presently in custody. STAT. § 609.378, SUBD. 1(a)(1) PENALTY: 0-1 YEAR AND/OR $3,000 That on or about March 5, 2011, in Hennepin County, Minnesota, ASHLEY RENEE COUCH, a parent, legal guardian or caretaker of « child, did willfully deprive the child of necessary food, clothing, shelter, health care or supervision appropriate to the child's age, when ASHLEY RENEE COUCH was reasonably able to make the necessary provisions and which deprivation harmed or was likely to subsiantially harm the child's physical, emotional or mental health.
