The employer is obligated: 1. To include a plan of action for ensuring occupational safety and health and for working conditions improvement into annual plan for development of production and business of the undertaking; 2. To provide the workers with sufficient personal protective devices and to carry out other measures ensuring occupational safety and health for them in conformity with laws and regulations; 3. To assign an officer to supervise the implementation of regulations, work rules and measures ensuring occupational safety and health in the undertaking; to co-ordinate with the undertaking's Trade Union in setting up and maintaining a network of worker's safety and health representatives. 4. To draw up appropriate rules and processes of occupational safety and health for different kinds of machinery, equipment and material, even in the case of change in technology, machinery, equipment, material and workplace in conformity with the national standards; 5. To undertake, education and training for the workers on standards, regulations and measures ensuring occupational safety and health; 6. To strictly observe the regulations on declaration and investigation of all the cases of occupational accidents and diseases and duly submit the mid-year and annual reports on the actual status of occupational safety and health matters in the undertaking to the local Department of Labor, Invalids and Social Affairs. The employer has the rights: 1. To compel the worker to observe regulations, work rules and measures ensuring occupational safety and health; 2. To accord praises and rewards to those who duly observe, and to sanction those who fail to observe regulations, work rules and measures on occupational safety and health; 3. To appeal to competent authorities for reconsideration of the decisions imposed by Safety or Health Labor Inspector, while duly observing them in practice. The worker has the obligations: 1. To observe regulations and rules on occupational safety and health while performing work or task assigned to him/her; 2. To use and maintain provided protective clothing and personal protective devices, and other protective equipment at the workplace, and to compensate for the losses or damage incurred; 3. To report in time to the persons in charge on the risks of industrial accidents, occupational diseases or of harmful and dangerous hazards, and to take part in the emergency aid and the activities to overcome the consequences of an accident under the directives of the employer. 7. To request the employer to ensure safe and healthy working conditions, to improve labor conditions, to provide sufficient personal protective devices and training, and to implement measures ensuring occupational safety and health. 2. To refuse to perform the work or leave the workplace that clearly presents an imminent and serious threat to life or health, and has the obligation to report immediately to the persons directly in charge; and to refuse to return to the workplace in question if the danger is not eliminated. 3. To complain or to expose to the competent authorities any act of the employer breaching the provisions of law and regulations or failing to implement duly his/her obligation on occupational safety and health committed in labor contracts or in collective agreements. HEALTH AND SAFETY MANAGEMENT: Observance of occupational safety and health standards Article 3 of Decree 06/CP provides that. The observance of occupational safety and health standards referred to in Paragraph 2, Article 96 of the Labor Code is stipulated as follows: 1. The occupational safety and health standards are compulsory. The employer must, in pursuance to the national and industrial occupational safety and health standards develop a rule on occupational safety and health for each kind of machinery, equipment and material, and an occupational safety and health rule for the workplace. 2. HEALTH AND SAFETY TRAINING: According to Circular 37/2005/TT-BLDTBXH dated December 29,2005 Responsibility of Employer: 1. Annually establishments shall make a plan and organize occupational safety and health training. The plan shall clearly state the content and the number of each trainee group, lecturers, date, expenses and facilities available for training. 2. A record book shall be filed for occupational safety and health as referred to a form enclosed with Annex IV of this Circular. The record book, training materials and tests shall be kept at the establishment and presented at request. 3. Establishments located in the same locality or operating in the same business sector can cooperate with one another or with organizations, agencies licensed in training occupational safety and health to provide training for their employees. According to Article 102 of Vietnam Labor Law, When recruiting or placing the employees, the employer must base on health standards stipulated for each type of work, and provide the workers with training, guidance, and information on regulations and measures relating to occupational safety and hygiene, and on the possible accidents which may occur for each particular job for arising from the work of each worker and measures for its prevention. 2. Occupational safety card: 1. Occupational safety cards shall be printed, issued and administrated by Departments of Labor, Invalids and Social Affairs as referred to a given form in Annex III of this Circular. The training organizer shall be responsible for issuing occupational safety cards to employees including self-employed persons who perform jobs with strict requirements on occupational safety and health after the employees are trained for the first time and meet requirements of the tests. Cases issued with occupational safety cards shall include: Employees recruited and arranged the first job; Employees transferred to new jobs with strict requirements on occupational safety and health; Changes of machinery, equipment and technology with strict requirements on occupational safety and health. Cards shall not be re-issued for annually periodic training. Cards of employees violating regulations on occupational safety and health or having stopped the job since 6 months shall be revoked by employers. The validity of an occupational safety card shall be 5 years. When a card is expired the employee shall be issued with a new card if requirements of the tests are satisfied. Failures shall be re-trained and re-tested. The re-testing shall be arranged by the establishment recruiting labor. Employees whose cards are lost or damaged can apply for consideration of card reassurances. Employees at work shall wear occupational safety cards and demonstrate their cards at the request of employers and inspecting, checking groups on occupational safety and health.

HEALTH AND SAFETY COUNCIL: According to Joint Circular 14/1998/TTLT-BLDTBXH-BYT-TLDLDVN of Ministry of Labor, Ministry of Health and Vietnam General Confederation of Labor. The Enterprise Health and Safety Council shall be established. Enterprise Labor Protection Council is a co-coordinating and advisory unit on labor protection activities of Enterprise and is to ensure the participation and supervision of trade union in Labor Protection work. The establishment of the Enterprise Labor Protection Council shall be decided by the employer. The number of the council members is shall depend on the number of workforce and the size of Enterprise but should at least include competent representatives of the employer and trade union, labor protection officers, and health officers. For the large enterprises, technical experts are also invited. 8

The employer representative shall be the Council Chairperson; Representative of the trade union shall be the vice Chairperson; Labor Protection Chief officer or officer in charge of labor protection shall be the standing member and concurrently the secretary of the Council. Section XIV, Article 3 of Circular 04/2004/TT-BCA provides that: Drill on fire-fighting schemes must to be organized periodically at least once a year. Each drill may dwell on one or several diffent circumstances, but all circumstances envisaged in the schemes must be practiced one after another. When drills are organize, the comperent fire-fighting schemes approvers may mobilize forces and means for the drill on fire-fighting schemes and decide on the drill scales. Packages, barrels and tanks carrying dangerous chemicals shall be sealed with the name and warning on hazardousness of the chemical inside Storing dangerous chemicals: According to Article 16 of Decree 68/2005/ND-CP 1. Dangerous chemicals shall be stored in special warehouses and equipment managed by qualified officials who are appointed. The storing form, storing method and stored quantity shall follow safety codes of practice and relevant legal documents. Conditions of the chemicals stored in warehouses shall be periodically checked. 2. Warehouses and equipment for dangerous chemicals shall meet the requirements of legal codes of practice on safety, fire and explosion prevention. There shall be a notice board listing regulations and guidance on safety measures for the working staff of warehouses in accordance with the properties of chemicals. The notice board shall be located at a convenient and fixed place. The equipment of a warehouse shall be periodically checked for safety requirements. 3. Persons coming in and out a warehouse shall be checked and registered in a registration book. 4. If the storing of strongly hazardous chemicals with other dangerous chemicals can lead to a new source of danger or an increased risk level, the chemicals shall be stored separately. Ordinary solid waste from all different generation sources are separated into two principal groups: a. Enterprise or Private own who dealing with the high risk of food safety have to be authorized and certified by the Local Authority Agency. According to Decree No.163/2004/ND-CP, Article 15, Point 1, dated September 7, 2004 by the Vietnamese Government to guide the implementation of some articles regarding the State law of food hygiene and safety. Organizations, family, and private business that trade in high risk food poisoning have to submit relevant document to the authorized government agencies for obtaining qualified certificate about trading in high risk food poisoning. According to Decree No.163/2004/ND-CP, Article 34, dated September 7, 2004 by the Vietnamese Government to guide the implementation of some articles regarding the State law of food hygiene and safety. Organizations, family, and private business which trade in food service have the responsibility to implement guidance, requirements about food hygiene and safety, and to keep food sample in 24 hours for inspection purpose. Sanitation of the water supply sources: Establishments themselves shall send water samples to the provincial/municipal Prophylactic Medicine Centers (called collectively as provincial) for testing at least once every quarter, or once every month if they receive notices that their areas are affected by dangerous digestive epidemics and at the same time disinfect such water sources according to regulations of the health service. 2. It is strictly forbidden to use food additives, colorings or synthesized sweeteners not on the list of food additives prescribed by the Health Ministry. 3. Stale, spoiled or crushed foodstuffs, foodstuffs originated from diseased animals must not be used for food processing. 4. Cooked foods on display for sale or serving must be covered from flies, dust and other contaminating insects; cloth must not be used to cover directly food. 5. Cooked food containing animal meat or aquatic products, if not stored cool (under 10oC), must be re-cooked before being served. 6. Fresh vegetables and fruits must be soaked well and washed at least three times with clean water or washed under a running water tap.
