The Governments flagship Green Deal policy gets going later this year enabling participating businesses to set up as Green Deal Providers and offer consumers the finance to carry out energy efficiency retrofit work on their property, but what are the legal implications? The Government expects the Green Deal scheme to kick start 14bn investment over the next decade and support at least 65,000 new insulation and construction jobs by 2015. Theft and vandalism on UK construction sites is estimated to cost the industry over 1m per day, a figure which is expected to rise as organised criminal gangs continue to target what they consider to be softer, easier targets such as building sites. SURVEY REVEALS CONTRACTOR HEALTH AND SAFETY COMPLIANCE THE BIGGEST HEADACHE FOR SAFETY MANAGERS
In a recent survey conducted by PICS Ltd at the IOSH Conference and Exhibition, health and safety compliance was overwhelmingly voted the biggest issue facing managers. This was particularly true for multiple site organisations with a large contractor base. In fact, 65% named health and safety compliance as the most difficult contractor issues to manage. Similarly, a high-level safety management programme was cited as being difficult to maintain, and 67% did not have contractor prequalification or accreditation software. For these companies, risk mitigation can be the easiest place to enhance safety management plans. The PICS programme is flexible and simple to implement on a global level, allowing clients and contractors to experience a simplified compliance programme. All contractor data is available live and on demand in the PICS system with a proactive customer service. PICS is already supporting a client base of some of the safest and most successful firms in the world. Encouragingly, despite the difficult economic times, just under half of those
who completed the survey were positive about the economic climate with 40% not anticipating any cuts in health and safety spending within their organisations in the next 12 months and only 4% anticipating extensive cutbacks. In fact delegates typically have strong backing from their senior management with 58% saying their management considers health and safety a key part of the way their organisation is run. With contractor health and safety compliance one of the most difficult issues to deal with, safety managers could benefit from using an established, simplified contractor prequalification service to improve performance and reduce risk, says Ian McKinnon, Executive Director, PICS EMEA. The results of our survey provide crucial insight into the current views of safety professionals in the UK. Whilst it would seem that the majority feel secure in their jobs and do not anticipate any real difficulties arising from proposed regulatory changes, there are key areas of health and safety management that can be improved and the services that PICS offers could provide that solution.

INNOVATIVE BARRIER AND SURFACE MOUNTED PRODUCTS PROVIDE A NEW OPTION FOR NATIONAL BARRIER STOCK
security solutions has arisen. Currently solutions available include the ellipsoid shaped barriers made from Corus bi-steel and are mass filled with substances such as sand. These barriers successfully secure access points surrounding temporary events or provide a barrier which can be moved if needed. Although fit for purpose, these barriers involve complex, logistical requirements often involving multiple transporting vehicles for both the temporary barriers and the substance to fill the barriers. Road closures are also more often than not enforced earlier than necessary due to the barriers logistical implications and cranes are needed to put the barriers into position. The market requires a more flexible, temporary high-security solution to be deployed faster and more easily. The aptly named, Barrier-in-a-Box, meets this criterion. The innovative product can be transported in a small container, in a light vehicle and can be deployed quickly and effectively providing high-class security, temporarily. This not only minimises logistical costs but it is also more practical when cordoning off areas within a busy city centre during high profile events. The revolutionary barrier system can be deployed in just over seven minutes and as the barrier is dynamic, the mechanism can be positioned without being implemented until the crucial moment it is needed. This not only minimises traffic disruption and lengthy road closures but also allows the barriers to be removed quickly permitting entrances to be permeable by vehicles in a medical, fire or police emergency. The Barrier-in-a-Box is constructed from a high-tech, synthetic fibre which is secured over bollards at both ends. The system works using a tension method with the rope and fibre structure being winched taut once positioned on top of bollards. Cutting edge technology means that this new product has successfully arrested a 7,500kg truck travelling at 30mph. The product has been tested when mounted over two ATG Access Westminster bollards but can also be utilised in conjunction with cylindrical, highsecurity bollards which is a successfully tested engineered solution. Along with the pioneering surfacemounted bollard system which has been developed also for the temporary highsecurity market and installed in some wellknown shopping centres, the Barrier-in-aBox represents a new option for nationalbarrier stock. Both products provide greater flexibility in implementation and are far more pedestrian permeable than existing solutions. Interserve, the international support services and construction group, has handed over a bespoke new building for St Helens College in Merseyside, which forms a landmark structure for the city centre next to its high profile, listed Beecham factory building. As part of the areas regeneration programme, the project, with a total value of 57m, was designed by Ellis Williams Architects, and took the form of two build phases totalling 17,500 sq.m. The two buildings consist of three and four floors, housing world-class training facilities and resources that provide students with contemporary learning environments. The mechanical and engineering elements of the project were delivered by SPIE Matthew Hall. The Town Centre Campus buildings were completed nine weeks ahead of schedule and within the budget allocation for the project. The ambitious redevelopment was completed in two phases, with phase one opening in September 2009. The second phase of the project has now opened its doors and accommodates facilities for the teaching of sport, health, social care, hairdressing, beauty and spa therapy. It was critical that the project provided value for money in order to secure funding from the Learning and Skills Council. Working in collaboration with the college and design team, a value engineering exercise was undertaken and as a result, 2.3m of savings were made from the initial project cost. In order to reduce the predicted build costs, a number of innovations were introduced to the design. These included using a steel frame rather than concrete; developing innovations in planning and site management; and design

DIXON JONES WINS THE PRESTIGIOUS BUILDING PROJECT OF THE YEAR AWARD 2012
Dixon Jones Ltd has won the prestigious UK Building Magazine Project of the Year Award, 2012 with the redeveloped Grade 2 Listed Regent Palace Hotel. The redevelopment of the hotel retains the finest elements of the existing building as well as introducing new facades. The three streets surrounding the hotel include retail and mixed use units to reinvigorate the Quadrant which is now a prime area of Regent Street for the Crown Estate. Corners of the original faience clad hotel building have been kept, and new faience has been introduced into the additional elevations using a variety of colours. By blending imperfect and perfect reflective surfaces, the new elevations make a play between the contrasting appearance of faience and glass. One of Dixon Joness concerns was that there was a service entrance needing to be secured with an unusually large height span for which there was no standard product. The client had very demanding requirements for the product of choice bifolding speed gates which were to be used to secure the entrance of the main service and delivery yard. The specification was for aesthetically pleasing speed gates which are reliable and safe in functionality. Dixon Jones spent a long time researching the different solutions available and were finally directed to HTC Ltd and CoBaCo Barriers (a division of ATG Access) by their security consultants QCIC.The gates supplied by these companies had already been installed at various banks across Europe so were deemed to be more than appropriate for this project. The brief for the speed gates were that they had to open and close rapidly, quietly and safely. The service yard is located opposite both a theatre and residential scheme. The clients wanted the gates to be kept closed at all times (important to stop members of the public wandering in off the street), so with the high volume of deliveries expected it was essential that the gates were really well engineered and reliable. Dixon Jones collected several references to satisfy themselves in this respect. It was also important that they could be acoustically sealed and thermally insulated, this being necessary to ensure adequate performance under Part L of the Building Regulations (loss of heat). Any noise inside the service yard also had to be contained. Finally there was considerable concern about safety aspects given recent high profile accidents involving automatic gates. Much discussion took place about the orientation, controls and cut-out devices in order to eliminate any possibility of an accident occurring. Finally the gates had to be aesthetically pleasing.The building is Grade 2 Listed and situated in a high profile part of the West End. Dixon Jones worked closely with HTC Ltd to design attractive cladding to the exterior and used a bronze paint which harmonised the speed gates with the real bronze shop fronts surrounding the building. This can be easily maintained should the gates get damaged in use. Dixon Jones worked closely with the speed gate manufacturuers, HTC Ltd, and with the preferred installation company CoBaCo Barriers (a division of
ATG Access) in order to improve and adapt a product to perform even better in these demanding circumstances.The speed gates are now fully installed and maintained under a customer care agreement with CoBaCo Barriers (a division of ATG Access). NEW SOCIAL HOUSING DEVELOPMENT TO BENEFIT FROM INNOVATIVE FLOOD ALLEVIATION SCHEME

When complete, it will provide a new extra care housing facility comprising of 27 units that will cater for residents with learning difficulties, and people with physical and sensory disabilities. Steve Dawson, Quantity Surveyor for Seddon Construction, commented: With the north west of England accustomed to significant levels of rainfall, new developments are required to address the collection of surface water. Its also particularly pertinent to safeguard vulnerable residents from potential flooding and the associated disruption. When choosing a solution it was imperative that we sourced United Utilities approved products. After much research and planning, Weholite presented itself as not only the best but most cost-effective solution for the project. Weholite attenuation tanks are designed to manage peak flow rates, by storing excess flow on site during heavy rainfall and then releasing it gradually via an outfall. The tank, which is being installed under the sites car park, has a storage capacity of 300m3 and is made up of five parallel runs of 2.4m diameter Weholite pipe, with six integral 1.2m diameter access shafts. Steve Dawson continued: Weholite also has many other benefits. The pipes lightweight design enabled us to reduce the amount of lifting equipment required and as a result we were able to keep disturbance to a minimum, which was vital because of the residential area adjacent to the site. All in all, I would say that Weholite proved to be a highly cost-effective solution. Weholite pipes unlike traditional materials can be moved in 14m lengths as opposed to 2.5m sections, meaning the amount of tracking across the site from the delivery area to the tank excavation was also reduced, enabling the use of a single machine. The pipes also nest inside each other for transportation, eliminating the need for multiple lorry loads saving a considerable amount of disturbance to the local area. Polish contractor Termo was appointed to apply over 100 of the specially-designed Digimark graphics to roads and pavements across the city, which is hosted the Group A games during the tournament in June. The markings provide a simple, yet eye-catching display. DigimarkTM is a self-adhesive, digitallyimaged display sheet, designed for temporary or permanent placement on hard surface areas. Digimark enables full colour graphics to be applied to practically all vehicular and pedestrian ground surfaces. Since virtually any high resolution graphic or image can be reproduced, Digimark is suitable for a wide range of applications from advertising and decoration, to playground markings and floor plans or maps. The DigimarkTM system is incredibly easy to use and provides an instant, high quality, visually-impacting area. It can be applied or removed in minutes on any area that is dry, free from debris and in good repair. Contractors simply prime the application area with a suitable primer,

LANE RENTAL SCHEME PROMPTS CONTRACTORS TO SEEK INNOVATIVE SOLUTIONS TO WORKING OFF-PEAK CONFIRMS NOISE EXPERT
Transport for Londons (TfL) controversial scheme to charge utility firms up to 2,500 to dig up Londons main roads during peak times is already sparking a new way of working for capital-based contractors. Just two weeks since the initiatives launch, utility companies have been swiftly reacting to the implication of having to achieve more overnight and off-peak operation to reduce traffic congestion. For most contractors, the biggest issue with meeting overnight-working obligations, is how to reduce noise levels and avoid disrupting residents. Huge sums are paid out every year by contracting firms in penalties for noise complaints. This complicated but necessary demand has seen a huge rise in enquiries from contractors in the last fortnight to companies like Echo Barrier, a specialist in noise reduction for commercial sites. Ainscough Crane Hire was selected to provide four heavy-duty cranes to CEVA Showfreight in a complex operation to lift a 1,350 sq metre roof structure at the Farnborough International Airshow. The operation created a temporary steel structure for Italian global aerospace company, Finmeccanica. Commenting on the project, Ian Chapman, Sales Manager at Ainscough Crane Hire said: The Farnborough roof lift was one of the most complex operations we undertook this year. As we were operating in a live airfield, we were restricted to the size of the cranes we could use and the height we could lift at. As the steel roof was also very complex, the cranes needed to be carefully positioned to spread the 45 tonne load. With a flex tolerance of only +/- 50cms, it was imperative that each crane lifted at the same speed to avoid damage. The project was coordinated by CEVA Showfreight. Ray Myles, Compliance Manager at CEVA Showfreight, said: We checked our calculations for the lift and build for about three weeks before implementation. It is imperative to get the cranes lifting in sync for projects like this and we had a number of checks during the lifting process to ensure that this happened. Each winch motor was set the same and each crane was reeved identically. We monitored and recorded the lift height at half metre increments to make sure

A building materials buyer for Persimmon Homes is still savouring an experience that money could never purchase, after carrying the Olympic torch through Gateshead. Bob Tingle, aged 60, revelled in the most humbling experience of his life when he ran with the flame through his home town, where he has lived for 40 years. He was nominated by his employer Persimmon Homes, who were offered one leg of the journey on behalf of official Olympic partners Lloyds Bank. He said:The run was one of the most uplifting,
inspirational moments of my life and I enjoyed every minute. When I think of the amputees, charity workers and pillars of the community that also did the run, I feel so, so humble and so, so unworthy. I have been at Persimmon for 24 years and have always done my best. I feel Ive gone the extra mile for my colleagues and for the business at all times. The board decided the honour would go to me, and I really savoured every minute of the moment. Bob said he thought his workmates were
winding him up when he was told the news, and laughed off the invitation as a joke. I thought it was a wind-up because I didnt know anything about it until the call came through. I told human resources to try a bit harder next time! The Gateshead man of 40 years also said that hed never contemplate selling his torch. It will be something to hand down to generation after generation. I know some people have sold them and I can understand why in some situations, but Ill be keeping it and treasuring it forever.

Penny + Giles a business unit of Curtiss-Wright Controls and a designer and manufacturer of position sensors, solenoids, and joystick controllers has introduced the JC8000, a new heavy-duty electronic joystick controller that has been specially engineered with a number of high-strength features to make it ideal for applications in physically demanding working conditions such as skid steer loader controls or where operators traditionally use hydraulic joysticks. The increased strength of the new heavyduty JC8000 joystick controller has been achieved by increasing the body material around the area that supports the operating lever; increasing the operating levers diameter; and changing the levers pivot geometry. These fundamental changes have enabled the joystick to handle increased torque and improve the levers bending and applied loads. Designed for the most challenging applications, the JC8000 can withstand a 380Nm overload on the X and Y axes and 2000N on the vertical. It has also been tested to more than 60 million operations (15 million cycles) under laboratory conditions. With an under-panel depth of 70mm, the JC8000 is more compact than

A major 2.2m school extension and refurbishment project has recently been completed using a combination of Marley Eternits Birkdale and Thrutone fibre cement slates. The specification of these products has enabled the new design to settle seamlessly into the local built environment and has supported the delivery of the projects environmental objectives. As part of Bridgend County Borough Councils ongoing school modernisation programme, the project at Litchard Primary School has seen the merging of the infant and junior school buildings with a number of improvements including a new nursery, teaching areas, refurbished swimming pool and enhanced school hall. The Birmingham-based architectural practice was awarded the 5 million contract by Accor Group to develop a 169-bedroom ibis budget hotel on Whitechapel Road,
London. A former office tower block was transformed into the budget hotel, which has achieved BREEAM Very Good status. The privately-funded, developer-led scheme saw Webb Gray handle everything from the initial feasibility study to the full internal fitout.

The structure, part of a development known as Centurion Symbio-City, will soar to 447 metres, or 110 storeys, more than double the Carlton Centre and higher than the Empire State Building. It would become the 14th-tallest freestanding structure on the planet. Located in Centurion between South Africas administrative capital, Pretoria, and its commercial capital, Johannesburg the development will have one residential and two office towers.

Siemens has announced it was recently awarded $1.6m in development funding from the Department of Energy (DoE) to support research aimed at significantly reducing the current costs of electrical vehicle (EV) chargers and developing smart charging capabilities that support power grid efficiency and consumer demand. The grant, awarded to Siemens Corporation, Corporate Research and Technology (SCR&T) will be supported by nearly $750,000 in matching research funding: an investment shared with Siemens Low Voltage Electronics, the group responsible for Residential Electric Vehicle Supply Equipment and a business unit of Siemens Infrastructure and Cities. The research funding is intended to provide manufacturers with a financial incentive to set aside winner-take-all competitive imperatives and set a clearer path to align commercial EV charging technology development that supports integration with the power grid and ultimately provides substantial benefits to consumers. Collaborating with Siemens in the overall development effort are Duke Energy and Ford Motor Company who will focus its efforts on validating concepts intended for their respective industries and markets. The research is also intended to help utilities manage the transition to a national EV charging infrastructure and the growing demand it would place on the grid and generation capacity. In addition to validating concepts, Duke Energy will provide input and help guide communications development. This will ultimately provide ways for utilities to
manage increasing demand without having to add costly generation and distribution capacity that would be passed on to consumers and increase carbon emissions. Ford and Siemens have a long history of shared EV development, Siemens technology being present in their early hybrid and all-electric designs. Car manufacturers have made a huge investment in EVs, but the market cant reward this investment unless deployment expands. Deployment cant expand unless demand grows by consumers. According to the DoE, the intent of the research grants is to improve the functionality and affordability of electric vehicle chargers. In addition to supporting energy security, said U.S. Energy Secretary Steve Chu, Developing smart electric vehicle chargers will provide more options to consumers and accelerate the build-out of the charging infrastructure in ways that strengthen the grid. The governments investment will expedite collaboration, said Barry Contrael, Director of Low Voltage Electronics for Siemens Infrastructure and Cities. If any company were to endeavour to go it alone, they would have to create and let the market accept or reject solutions for all the possible combinations of EV chargers, utility communication protocols and networks that exist. The resources required to take on this task would be prohibitive, even with companies like Siemens that have the necessary scaling and infrastructure. By teaming up, the companies chosen by the DoE will be able to develop standardised solutions faster and at a greatly reduced overall cost.

MERIDIAN ANNOUNCES NZ WIND PROJECT
The construction of the first major wind farm to be built in New Zealand for two years has been announced by Meridian Energy. The 60MW Mill Creek project, north of capital city Wellington, will start construction in August. It will be the first major wind farm start since Mahinerangi in September 2010.
Subsequent to signing an agreement with Al Dana Development LLC, Cristal Hotels and Resorts has announced its arrival in Qatar with the opening of its second international branch office: Cristal Hotels and Resorts Qatar. Cristal Hotels and Resorts Qatar follows on from the Lebanon Office, which opened in February 2012. The development is another example of the aggressive expansion plan being carried out by Cristal Group which, agreed upon last year, will increase the companys portfolio and brand presence in the region significantly. Dubai has been voted the best city in the Arab world to live in for 2012. Arab business publication Saneou Al Hadath ranked Dubai the most popular living destination in the Middle East and North Africa for the third time. The report is supported by several indices and figures disclosed from international research institutions across the following sectors: business and economy, health, education, telecom and transportation, security and human rights, culture and leisure. With results released every March, Saneou Al Hadaths annual study has become one of the leading indicators of where to live in the Middle East and North Africa region. Closely examining 19 Arab cities across the region, the study provides general knowledge and insight into local standards of living and acts as a platform for governmental institutions, businesses and academia for research, analysis and decision making. Commenting on the study, Osama Al Renna, Managing Editor of Saneou Al Hadath, says: The study this year came under exceptional circumstances where the wave of Arab revolutions swept over many countries, which impacted negatively on a large number of indicators that we adopt in our study. He added: Gulf countries still lead the first ranks in most of the indicators addressed in the study. And the high competition remains, as usual, between Dubai, which came first, and Abu Dhabi, which came second. Doha came third in the overall standings. THEFT AND VANDALISM ON UK CONSTRUCTION SITES IS ESTIMATED TO COST THE INDUSTRY OVER 1M PER DAY, A FIGURE WHICH IS EXPECTED TO RISE AS ORGANISED CRIMINAL GANGS CONTINUE TO TARGET WHAT THEY CONSIDER TO BE SOFTER, EASIER TARGETS SUCH AS BUILDING SITES.
The incidence of theft and vandalism has an immediate negative impact with direct costs due to loss and damage of valuable assets and associated costs such as interruption to work or in extreme cases the halting of all site operations. When you take into consideration the cost of materials, plant and equipment stored on most sites, can you afford not to have these sites properly secured? We ask industry insiders for their advice on how you can best safeguard your site from vandals and thieves.
Depending on where the site is and the size of the project budget, many firms engage security companies who have a presence on-site when it is unattended, or at least make periodic and preferably irregular visits. Other steps to consider include having the site as open as possible so unauthorised entry and criminal activity is easy to spot. Only allowing goods and materials onto the site, which will be used during the next day or two so the tempting targets are kept to a minimum. Make sure all your own expensive equipment is clearly and distinctively marked, put in an additional secure compound when not in use, and all keys taken off-site overnight. Last but not least, some insurers impose specific requirements for site security, so make sure all your site agents are made aware of them and do comply with the requirements.
out works is subject to the provisions of the Occupiers Liability Act 1984. The contractor would be liable if a trespasser even a vandal - was to be injured on the site as a result of the state of the site in general, or through actions done or omitted from being done on it. Such liability can be avoided if the occupying contractor takes reasonable steps to give warning of the danger concerned or to discourage the trespasser taking such a risk. For example, a warning

sign or an area being fenced off and it being established that the trespasser had willingly accepted such a risk. In the event of any visitor being injured on site, even as a result of dangers arising from vandalism, the occupying contractor can find itself liable because of the provisions of the Occupiers Liability Act 1957. Section 2(2) of that Act places a duty on the occupier of premises to take such care as is reasonable in the circumstances to ensure that a visitor will be reasonably safe whilst on the premises for the purposes for which he has been invited or permitted to be there by the occupier. In the case of Peskett v Portsmouth City Council, the Claimant tripped on a paving slab located on a well-used shortcut between two paths. The Council were found to be liable by way of the duty under the Act as they had known of the trip hazard but had not taken reasonable care for a visitors safety. This duty, however, does not extend to any injury suffered by such a visitor as a result of an activity conducted by a third party on the premises, for example work conducted by an independent contractor.

Those with experience of conducting redundancy exercises will be mindful of the old (but still relevant) case of Williams & Others v Compair Maxam which sets out a number of principles employers should follow with regards to conducting a fair redundancy process. In particular, when deciding what selection criteria to use following a pooling exercise criterion should always be measurable and objective. As a result, selection criteria such as disciplinary and sickness records are routinely used. So too, however, are attributes like skills/experience and performance, the idea being that these can be objectively assessed even though it involves making judgements about individuals based upon managerial opinions. Consequently it used to be the case that an employees best chance of challenging his unfair selection for redundancy would be to allege subjective decision-making by management. The recent case of Mitchells v Tattershall concerned a small company in financial difficulty. The managing director had a senior management team of five individuals. The board mooted an idea about whether cost savings could be achieved by making one of its five managers redundant. At a subsequent board meeting each manager was discussed and it was decided that the property manager was the most expendable as he wasnt in a role that generated revenue by the same token losing any of the others would have had more of a detrimental impact. A decision was made to make the

Bill introduces some significant changes. In order to reduce the number of employment tribunal claims, the Bill will require employees to submit claims to ACAS before presenting them to the tribunal. This is to allow for early conciliation in the hope and expectation that many claims will be resolved at this early stage. The Bill also removes the loophole which allows employees to claim a breach of their own employment contract is a contravention of any enactment, which has allowed seemingly unmeritorious whistleblowing claims to proceed, and introduces a discretionary provision which will allow tribunals to require unsuccessful employers to pay a financial penalty of between 100 and 5,000 to the Treasury and a rapid resolution scheme for small value claims. All of these provisions had been consulted about and were not a particular surprise to
employment law watchers. However, perhaps as a test to see who was still awake, the Government introduced an unexpected but potentially significant change. This provision allows the Government to change the calculation of the maximum award for unfair dismissal. Historically, the cap has increased in line with inflation. However this new power would allow the Government to cap compensation at a specified amount between median annual earnings (currently 26,000) and three times the median (78,000), or 52 weeks pay for the individual concerned (this could be a significant increase in the case of a high earner but is arguably fairer) or the lower of these in any case. This Bill is due to have its second reading on 11 June. And from what we can tell this is only the start!
EMPLOYEE OR SELF-EMPLOYED?
Whether someone is an employee or selfemployed person is one of the biggest legal grey areas in both UK tax law and employment law. The employment / self-employment status of a person is incredibility important: both to a business and to the person engaged. For a business, if they get this wrong they could be hit with an unexpected tax bill or employment tribunal litigation which has the potential to be ruinous for the business. And for the individual; they too can be subjected to an unexpected tax bill and/or miss out on valuable employment rights such as the protection from unfair dismissal as well as rights to holiday and sick pay. There is such a grey area because there is no mathematical formulae for identifying status. Just because there is a written contract stating that an individual is self-employed, and are paying tax under the CIS system, does not mean that they are in fact legally classed as a self-employed person.The Courts and Tribunals will look past this and analyse the underlying relationship between both parties to identify whether there is in fact a relationship of employment. It will essentially come down to the way in which the business and individual conduct themselves. We say dont get it wrong; take expert legal advice at an early stage and make sure you are protected.

DRUG TESTING
Drug taking or alcohol abuse can be a common concern for employers and it is often more worrying for those in the construction industry given the many dangers of working on building sites. Drugs and alcohol can seriously hamper work performance and pose serious safety risks. Employers can be prosecuted for breaches of health and safety or sued for damages if employees or third parties are injured or even killed as a result of the conduct of an employee under the influence of drugs or alcohol whilst at work. It is therefore advisable for an employer to
have a Drugs and Alcohol Policy in place. Employers can then ensure they comply with health and safety obligations and they can also clearly set out to employees the standards of behaviour required of them and make it clear that disciplinary action may be taken against them if they do not comply with the Policy. Being under the influence of drugs or alcohol at work will normally constitute gross misconduct entitling the employer to summarily dismiss the employee. However, in some circumstances, dismissal may not be appropriate particularly where there is an underlying health or other cause for substance misuse or dependency. In those circumstances, the employer may consider offering support and possible counselling. Screening and drug testing by employers is
becoming more common, but an employer requires consent from the employee to undertake this. Where a company is introducing testing for the first time, it is advisable to consult with the employees. Testing can be used during a recruitment process or after an accident or incident on site. It can also be used in the normal course of employment, for example a random spot check. However employers must take care not to single out employees without justification. If an employee refuses to take a test, then this may be grounds for disciplinary action and possible dismissal. Testing could be deemed unreasonable and amount to infringement of an employees right to privacy if drug taking is unlikely to have any impact on public safety or on the employers reputation. This could give rise to
a claim under Human Rights legislation. Employers must also ensure that they comply with the requirements of the Data Protection Act 1998, with regards to any information which is obtained from drug and alcohol testing as this information is deemed to be sensitive personal data. CONSULTANT OR EMPLOYEE?
Courts are frequently asked to consider whether or not a relationship between a contractor and the hiring organisation is a sham arrangement. Usually this comes about because an individual, having entered into a contract as a self-employed contractor, subsequently wishes to argue that they are, in reality, an employee with statutory rights such as the right to holiday pay and the right not to be unfairly dismissed. Case law makes it clear that even if your written documentation sets out a relationship of self-employed contractor, if it does not reflect the reality of the relationship in practice, then it is likely to be viewed as merely an attempt to avoid liability under employment legislation. Previously it was thought that the written documentation could only be overlooked where the parties intended to mislead. This is no longer the case. In the case of Protectacoat the Court of Appeal held that it is for the Court to determine the true legal relationship. Written documentation will usually provide the answer unless it is alleged that the documentation does not describe the true relationship, in which case a court will look at the parties conduct. In the recent case of Autoclenz Limited v Belcher & Others the Supreme Court held that a group of car valeteers were employees. This was the case even though the written agreements they had signed stated they could allow substitutes and that there was no obligation for them to provide work. The Tribunal found that in fact the valeteers were expected to turn up for work unless they had given appropriate notice and they had not been aware of the right of substitution. on a bi-annual basis to ensure that the nature of the relationship has not changed since the contract was signed. The Government state that they are keen to stimulate growth and have promised to cut the unnecessary bureaucracy surrounding the UKs employment framework. This has been highlighted as a significant issue impacting growth of businesses, particularly for small businesses. John Hayes, Partner at Irwin Mitchell LLP considers the potential impact on the construction industry of two of the Governments recent ideas: Stemming from the recommendations of the Governments Beecroft Report was the concept of no fault dismissals (the termination of employment with an enhanced severance payment and without the need to provide an explanation) for firms with fewer than 10 staff. The reasoning was that the current dismissal process for underperforming staff is arduous deterring employers from hiring staff. No fault dismissals were met with staunch criticism as they could create a two tier system in which businesses are encouraged to stay small to be able to hire and fire at will. Some also said that no fault dismissals would undermine the economy by creating fear of unemployment. In any event, the Enterprise and Regulatory Reform Bill, currently going through Parliament, makes no reference to no fault dismissals. It is unclear what impact this proposal would have had on the construction industry as a whole, benefitting only

Todays construction industry is dependent on the latest tools, plant and machinery in order to complete increasingly complex projects. These tools of the trade are, inevitably, hugely expensive and will therefore be covered by insurance should they be damaged or lost. However, what if one of your employees causes the damage through their own carelessness? Such a situation may not be covered by your insurance, meaning you could face a substantial bill to repair or even replace an essential piece of equipment. At a time when many businesses, including those in the construction industry, are looking to reduce costs, this could leave your company considerably out of pocket. So, what can you do to protect your tools of the trade under such circumstances? This exact situation happened to one of our clients, a haulage and plant hire firm. One of the firms heavy goods vehicle drivers had driven a lorry until it ran out of fuel, meaning that the vehicle required a new starter motor, resulting in repair costs and lost profits for the day that the vehicle was out of service. To add insult to injury, the driver then sued our client for unfair dismissal. We looked into the terms of his contract of employment, as well as the hire companys own policies and procedures. The above case suggests that one route open for employers faced with a claim by an individual alleging they have employment status with accompanying rights to claim say, unfair dismissal or a redundancy payment, would be to consider how the individual holds himself out to HMRC. Employers should take care to consider if there is an employment relationship by looking at the practical arrangements in place and, if in doubt as to the employment status of a person working for them, take specialist legal advice. The Protection of Employees (Temporary Agency Work) Act, which transposes the EU Directive on Temporary Agency Work 2008/104/EC, was signed into law recently. The main provisions of the Act entitle agency workers to: Receive the same basic working and employment conditions as those which the agency worker would have received if employed directly by the hirer to do the same or similar work. To access collective facilities of the hirer (to include canteen, child care and transport services), on the same basis as employees of the hirer. To be informed about employment opportunities with the hirer on the same basis as those who are employed by the hirer, for the purpose of enabling the agency worker to apply for vacant positions with the hirer. Agency workers are defined in the Act as individuals employed by an employment agency under a contract of employment, under which the agency worker may be assigned to work for, and under the direction or supervision of, a person other than the employment agency. A hirer is defined as an entity engaged in economic activity for whom, and under the direction and supervision of, an agency worker carries out work pursuant to an agreement (whether in writing or not), between an employment agency, the employer of the agency worker, and that entity. After a fatal or serious incident, the HSE will investigate your business and individuals within it. Inspectors can and usually will interview witnesses, seize documents and issue Prohibition/Improvement Notices. If corporate manslaughter is a possibility, the Police can take the lead in investigations and may choose to interview key Managers/Directors under caution on day one. Shell shocked businesses (and their Insurers) fail to recognise the legal process of potential prosecution has already begun and are often too preoccupied to consider legal representation or assume that comes later if and when the matter proceeds to Court. That is a mistake. Involving the right lawyer from day one can make all the difference to the outcome. Here are some key issues which should be addressed from the start: Should your Manager/Directors attend a tape recorded interview unrepresented? What information should you be volunteering to the HSE? What about your accident investigation? The inspector will be talking to shocked and aggrieved colleagues and family members. Non-compliance with health and safety legislation can be a very costly affair. In the recent prosecution of a large retailer and three of its contractors, the retailer was fined 1m and ordered to pay prosecution costs of 600,000 for placing employees and others at risk of exposure to asbestos containing materials. The introduction of the Corporate Manslaughter and Corporate Homicide Act 2008 has also increased the risk of prosecution where a death has occurred at a workplace. The conviction of Lion Steel Limited on 3 July 2012 for corporate manslaughter is the third company to be convicted of the offence under the Corporate Manslaughter and Corporate Homicide Act 2007. The company pleaded guilty at the conclusion of the prosecution case in a trial which started in June. As this case demonstrates, the representation of companies accused of criminal wrongdoing raises particularly complex issues that need to be handled carefully. The company pleaded guilty in an agreement reached with the prosecution whereby all remaining charges against the companys directors charges which on conviction might well have resulted in custodial sentences were dropped. The conflict between the interests of the company and those of its directors is obvious to see. Similar issues can arise where the police, as part of their investigation into corporate manslaughter, invite a human representative of the company to attend an interview under caution that is an interview in which answers provided can be used
against the company in a subsequent criminal trial. Should the company put forward such an individual? If so, who is able to answer for the company in every area into which police questioning may go? What if the person who may be suitable is themselves a potential criminal suspect in respect of the same event for example, the director with overall responsibility for health and safety? Wider complications can arise in the aftermath of a fatal accident. Urgent consideration must be given to issues such as the involvement, alongside the police, of the Health and Safety Executive with their different powers, the implications of any civil claim arising, the companys representation at the inquest, as well as the more practical concerns about managing internal and external communications and reputational damage. IN 2010, FERMI LTD, A LEADING UK FIRE ENGINEERING CONSULTANCY BASED IN ST ALBANS, CARRIED OUT RESEARCH ON BEHALF OF CIRIA INTO MAJOR HAZARDS IN CONSTRUCTION SITES. SEVERAL OF THE CASE STUDIES INVOLVED THE ISSUES SURROUNDING TIMBER FRAME CONSTRUCTION ISSUES BROUGHT INTO SHARP RELIEF FOLLOWING A SERIES OF MAJOR FIRES WHICH LED TO THE DESTRUCTION OF THE CONSTRUCTION SITES, AND ALSO CAUSED DAMAGE TO SURROUNDING BUILDINGS, INCLUDING OCCUPIED HOMES.
FERMI ltd Engineers involved in the research realised that life safety risk was not only to workers on-site and firefighters, but also to people living in the surrounding area. The HSE decided to take action and began to clamp down on schemes they considered to present a danger to the surrounding area should a fire occur. Given the benefits of Timber Frame Construction lower cost, quicker build time, and its indisputable environmental credentials, this state of affairs could not continue. The UK Timber Frame Association concluded that new guidance needed developing to ensure that current schemes could move forward, and that the future of the industry was not threatened by the negative press coverage that might ensue should further fires take place. FERMI were engaged as part of a team which included not only the UKTFA, but also academic experts and representatives from the HSE, with a brief to produce new guidance to satisfy the regulatory authorities that Timber Frame Construction was a safe and viable option going forward. FERMI developed a strategy which enabled the UKTFA to approach the problem from a new theoretical angle. FERMI designed and attended large-scale testing programmes which produced detailed data on radiant heat flux the temperature fluctuations in a timber frame fire, and the effect on surrounding buildings. Also tested were methods to prevent the frame catching fire in the first place such as the application of flame retardant chemicals to the frame, and the use of fire-proof sheeting to prevent fire spread around the site. FERMI ltd analysed the data in detail, and produced the FERMI RT model, which can be used on timber frame sites to calculate the level of radiant heat flux. The results produced by FERMI RT can then be applied in order to designate fire safety solutions on any timber frame site to avert risk to the site itself and surrounding buildings, allowing construction to be completed without
significant risk to life safety or indeed business continuity. Last year, guidance was rolled out which can be downloaded from the UKTFA and FERMI ltd websites (fermiltd.com). Research continues in conjunction with the UKTFA, and FERMI are at the forefront of work regarding the use of cross laminated timber frames. If, at the end of the tax year, there are excess CIS deductions that have not been able to be set off, you should write to HMRC and ask for a refund or for HMRC to set them against another tax liability, e.g. Corporation Tax or VAT.

Employment status is not just a problem in the construction industry; almost every business sector is affected. In 2000, legislation known as IR35 was issued to counter the perceived problem of individuals setting up a business in order to be paid gross. The legislation seeks to charge PAYE and class 1 NIC on income received by a company, LLP or partnership for the provision of the services of an individual, which had the business not been there, would have been employment income. The rules are complicated, and require an employment status check to be carried out on every contract undertaken by the business, and because of this, there is no guarantee that the businesses are getting it right. HMRC has consulted with interested
parties in the last couple of years and come up with a risk assessment that businesses can use to find out how likely it is that their business will have an IR35 investigation. The risk assessment comes in the form of questions and answers, and appears to set out a framework for deciding if someone is employed or in business on their own account. If HMRC is successful in its pilot scheme, it would be logical to assume that the framework would be extended to cover other sectors where employment status is of key importance, such as the construction industry. Adjudication, the legal process of resolving a dispute, was initially conceived as a statutory quick fix to resolve interim cash flow disputes essentially a supposed cure for the particular ills of the construction industry. 14 years on and it has essentially become the default form of construction dispute resolution. Many practitioners in this field avidly recommend this procedure to clients without considering the suitability or effectiveness of the process itself. Adjudication tends to work fairly well when there is a reasonably large sum of money in dispute and the issues are straightforward. However, where the dispute is complex or more pertinently where the dispute comprises a large number of issues (think of the 50 page Scott Schedule worth 100k) the process grinds to a shuddering halt. All considerations of cost effectiveness evaporate and the professional fees and those of the Adjudicator often dwarf the award. So what can be done about this? Its too glib to suggest that the parties really ought to sort these types of dispute out by themselves. If they could do that, they would not be at adjudication. Someone still needs to decide the dispute for them. Whisper it, but there is an answer. However, its one that most lawyers will recoil in horror from. The reality is that expert determination is the most appropriate way to resolve these types of dispute - but not as we know it. Essentially, lawyers need to put to one side their notions of jurisdiction challenges, the burden of proof, sufficiency of evidence and all of the concepts that we hold dear and be pragmatic. Many construction disputes simply need parties to be put in a room with an independent man who is empowered to make decisions there and then. Its about clients and lawyers realising that they are not going to be able to argue every point and have the last word. To some extent, its about the decision maker using his skill and judgement (and dare I say it, experience). Aside from the most basic notions of procedural fairness, the lawyers need to pause and reflect in order to make focused arguments in a time and cost
effective manner. How many submissions are made at adjudication that are bound to fail and frequently do? If all of the wasted words and effort are excised, a one or two day hearing will realistically see these types of disputes resolved. Somewhat ironically, the process can be completed within the originally conceived period of 28 days outlined for adjudication. I know this because I have recently done it. CM: What has been the most beneficial development in the renewable energy industry during your time of involvement?
Ross: The introduction of the Feed In Tariff would be the most significant development. It has sparked a whole new era and platform for creating thousands of jobs and in my opinion a great way of encouraging clean energy generation, which we can all be a part of and benefit from.
CM: If you could employ anybody from the business world who would it be and why?
Ross: I would have to choose Mark Zuckerberg of Facebook. I find him a really interesting character who breaks the mould of a typical Company Director. I follow the same belief that developing relationships with the people you work with and striking a healthy balance between knowing your position in a business and working as a team is vital. Mark would bring a technical development side mixed with a creative ability to the table and like my business partner and I, encourages ideas and input. After all two heads are better than one, three better than two...

FETA aims to enable their members to compete on favourable terms in an improved national and international business climate, acting as the representative voice of the UK HVACR industry to promote and defend its interests and those of their members. Split into six principle associations ADCAS, BCIA, BFCMA, BRA, HEVAC and HPA the organisation works closely with Government bodies and other associations nationally, in Europe and in the US. Parts of FETA can trace their origins back to the early days of fan manufacturing, and the expansion of refrigeration in the UK as part of the war effort in the 1940s. Over time additional groups formed as technology changed and they combined into associations, which agreed to band together to form FETA. This cost-effective model then attracted further associations to join. The long history of representing diverse commercial interests continues to this day, as does the tradition of forming new specialist groups to match advances in products and technology. Firms within FETA trade associations have made a positive decision to
differentiate themselves by belonging to a reputable trade body. They also take specific action on sustainable practices, such as: Partnering with local schools to rework company wood and copper waste into goods for sale that benefit the school. PHS Besafe are the only stockist and laundry company to provide a service for
high visibility Arc garments. We provide a 12-point procedure for each Arc garment, says Tony McGovern, National Sales Director, which consists of a document that goes back with the cleaned garment confirming that everything to do with the garment is fit for purpose at the point of handover to the end user. The complex make-up and care requirements of specialist arc work wear need a highly specified maintenance solution and PHS Besafe was part of the process to trial the cleaning performance of a developmental arc fabric. Impressed by the results they went on to develop their own Arc:Gear work wear system, which is made up of three layers of many differing garments, not a one piece system of three tiers. In 2010 a fabric provider who told them they had some unique fabric that could protect workers from arc flashover approached PHS Besafe. They were asked to carry out trial work to see if the material would withstand the rigorous washing processes that the utility, construction and rail PPE product has to go through. It took them four trials until they finally got to a finished process where the fabric could withstand the washing cycle. Luke Evdemon of Shield 360, whose product technology is used for arc-resistant
protection, also approached the company. He wanted to conduct some washing cycle trials, and at the same time, they became aware of Gore-Tex Paris PPE equipment that was also undergoing trials. The PHS Besafe experts believed that if they could combine the base layer special fabric with a coverall suit which used breathable Gore-based PPE technology they would have a product that could protect workers from arc flashovers. It would also help against electric shocks whether it was from OLE, third-rail or electricity sub-stations or any sector relating to potential arc flash. Washing trails took nine months, but once they were complete PHS Besafe took the three-layer clothing to Network Rail: garments were immediately specified for 500 substation workers. Using a properly laundered three-layer garment will give the best protection against arc flash. Standard polyester-cotton PPE will not give adequate protection as the waterproof layer will melt and any fabric next to the skin will catch fire. A specialist workwear system such as Arc:Gear, designed for the job, is the best way to protect people working close to live equipment. Although accidents have reduced dramatically in quarrying in the UK over the past decade, quarrying remains a dangerous industry. Accident incidence rates remain well above the all industry average. Target Zero is an initiative run under the Quarries National Joint Advisory Committee (QNJAC) with the ultimate aim of making quarrying a zero-harm industry. QNJAC is essentially a tri-partite committee made up of industry representatives, employee representatives

quarries and pits across Europe. This makes aggregates the largest non-energy extractive sector in Europe, and the direct value of this production amounts to over 20bn. Recent years have shown a dramatic decline in numbers of producing companies, down from nearly 30,000 in 2006 to about 16,000 in 2009, an indication both of the severity of the economic crisis and of ongoing consolidation in the industry. Annual aggregates production peaked in 2006 at about 3.7 billion tonnes.

HOWEVER, CHANGES IN SECURITY STANDARDS, DESIGN AND PRODUCTS HAS MEANT THAT PREVENTING CRIME IS NO LONGER THE SOLE RESPONSIBILITY OF THE POLICE. BUILDERS, ARCHITECTS, DEVELOPERS AND SPECIFIERS ALL NOW PLAY THEIR PART IN REDUCING CRIME AND THIS IS NOTICEABLE BY THE REDUCTION IN BURGLARIES IN THE UK SINCE 1995 (BCS FIGURES) .
Higher security levels in new developments and refurbishments as well as higher security standards in products such as windows and doors, have played an integral part of this decline in burglary. Secured by Design has been a part of this, working with architects, test house and the industry to improve standards and raise awareness. Independent research verifies Secured by Design standards can help reduce crime by up to 75%. Secured by Design is a non for profit organisation owned by the Association of Chief Police officers and is the UKs official Police initiative proven to reduce crime and the fear of crime as well as criminal damage. These products are more resilient to attack and will reduce the opportunity for burglaries and crime. Burglary, by its nature is opportunistic and by addressing the security requirements to deter burglars and putting in higher quality security products into homes, there is also the benefit of increasing the longevity and lifetime of the development and the community and making it more sustainable. Research by two national estate agents, Halifax Property Services and Sequence (formerly Royal and Sun Alliance shows that home owners are prepared to pay more for a property that has higher security with an average of 63% being prepared to pay more for a secured home. Secured by Design and designing out crime deals with the design and layout of a building as well as product specification. The right windows, doors and locks can
make a difference between someone gaining access to a property.
