AFFIDAVIT
I, IANO RAQUEL, of legal age, Filipino citizen, single, and a resident of Fr. Gomez St., Davao City, Philippines, after having been duly sworn to an oath in accordance with law, do hereby aver and say THAT: 1. That I am a professional driver holding a professional drivers license with ID Number ------------ issued on -------------- in ; 2. That I was employed as driver by Ms. _________ Abing, of legal age, Filipino, married, and a resident of San Rafael, DIHO, Maa, Davao City; 3. That she is the registered owner of a Mistubishi Lancer bearing Plate Number LVA 706; 4. That as driver of Ms. Abing, I have the full control and custody of the car when she is not around; 5. That on March 1, 2014 around nine (9) oclock in the morning, I left the said car to Mitsubishi Service Center (Davao Branch) for its monthly maintenance; 6. That due to backlogs of cars being serviced, I left the car in their custody, since Ms. Abing is in Manila for a business trip;

7. That it is my practice to leave the car in their custody for the past three (3) years, and was always assured that nothing will happen to the cars;

8. That in the following day when I was about to take the car from the Service Center, even before I could say anything, the manager approached me and told me that the car was involved in a vehicular collision;

9. That the manager said that one of their new employee, by the name of NOLY TUGCO, took the car for a joy ride after office hour when everyone was out;

10. That after being informed by the manager about the fact and circumstances about what happened to Ms. Abings car, I immediately called Ms. Abing, where at that time she was still in Manila, about what happened;

11. That Ms. Abing was duly informed about what happened and after learning she immediately instructed me to find the car and procure the police report;

12. That neither me nor Ms. Abing has knowledge of the said incident and neither we gave our consent for NOLY TUGCO to use the said car, furthermore, we do not know him personally; FURTHER AFFIANT SAYETH NAUGHT,
