IFYOUDONOTHAVESUCHAUTHORITY,ORIFYOUDONOTWISHTOBEBOUNDBY THETERMS,THENYOUMUSTNOTUSETHESOFTWAREONTHISSITEORANYOTHER MEDIAONWHICHTHESOFTWAREISCONTAINED. 1.DEFINITIONS.

"Software"meanstheidentifiedaboveinbinaryform, anyothermachinereadablematerials(including,butnotlimitedto, libraries,sourcefiles,headerfiles,anddatafiles),anyupdatesor errorcorrectionsprovidedbySun,andanyusermanuals,programming guidesandotherdocumentationprovidedtoyoubySununderthis Agreement."GeneralPurposeDesktopComputersandServers"means computers,includingdesktopandlaptopcomputers,orservers,usedfor generalcomputingfunctionsunderendusercontrol(suchasbutnot specificallylimitedtoemail,generalpurposeInternetbrowsing,and officesuiteproductivitytools).TheuseofSoftwareinsystemsand solutionsthatprovidededicatedfunctionality(otherthanas mentionedabove)ordesignedforuseinembeddedorfunctionspecific softwareapplications,forexamplebutnotlimitedto:Software embeddedinorbundledwithindustrialcontrolsystems,wirelessmobile telephones,wirelesshandhelddevices,netbooks,kiosks,TV/STB,Blu rayDiscdevices,telematicsandnetworkcontrolswitchingequipment, printersandstoragemanagementsystems,andotherrelatedsystemsare excludedfromthisdefinitionandnotlicensedunderthisAgreement. "Programs"means(a)Javatechnologyappletsandapplicationsintended torunontheJavaPlatformStandardEdition(JavaSE)platformon JavaenabledGeneralPurposeDesktopComputersandServers,and(b) JavaFXtechnologyapplicationsintendedtorunontheJavaFXRuntimeon JavaFXenabledGeneralPurposeDesktopComputersandServers. 2.LICENSETOUSE.Subjecttothetermsandconditionsofthis Agreement,including,butnotlimitedtotheJavaTechnology RestrictionsoftheSupplementalLicenseTerms,Sungrantsyouanon exclusive,nontransferable,limitedlicensewithoutlicensefeesto reproduceanduseinternallySoftwarecompleteandunmodifiedforthe solepurposeofrunningPrograms.Additionallicensesfordevelopers and/orpublishersaregrantedintheSupplementalLicenseTerms. 3.RESTRICTIONS.Softwareisconfidentialandcopyrighted.Titleto Softwareandallassociatedintellectualpropertyrightsisretainedby Sunand/oritslicensors.Unlessenforcementisprohibitedby

applicablelaw,youmaynotmodify,decompile,orreverseengineer Software.YouacknowledgethatLicensedSoftwareisnotdesignedor intendedforuseinthedesign,construction,operationormaintenance ofanynuclearfacility.SunMicrosystems,Inc.disclaimsanyexpress orimpliedwarrantyoffitnessforsuchuses.Noright,titleor interestinortoanytrademark,servicemark,logoortradenameof SunoritslicensorsisgrantedunderthisAgreement.Additional restrictionsfordevelopersand/orpublisherslicensesaresetforthin theSupplementalLicenseTerms. 4.LIMITEDWARRANTY.Sunwarrantstoyouthatforaperiodofninety (90)daysfromthedateofpurchase,asevidencedbyacopyofthe receipt,themediaonwhichSoftwareisfurnished(ifany)willbefree ofdefectsinmaterialsandworkmanshipundernormaluse.Exceptfor theforegoing,Softwareisprovided"ASIS".Yourexclusiveremedyand Sun'sentireliabilityunderthislimitedwarrantywillbeatSun's optiontoreplaceSoftwaremediaorrefundthefeepaidforSoftware. AnyimpliedwarrantiesontheSoftwarearelimitedto90days.Some statesdonotallowlimitationsondurationofanimpliedwarranty,so theabovemaynotapplytoyou.Thislimitedwarrantygivesyou specificlegalrights.Youmayhaveothers,whichvaryfromstateto state. 5.DISCLAIMEROFWARRANTY.UNLESSSPECIFIEDINTHISAGREEMENT,ALL EXPRESSORIMPLIEDCONDITIONS,REPRESENTATIONSANDWARRANTIES, INCLUDINGANYIMPLIEDWARRANTYOFMERCHANTABILITY,FITNESSFORA PARTICULARPURPOSEORNONINFRINGEMENTAREDISCLAIMED,EXCEPTTOTHE EXTENTTHATTHESEDISCLAIMERSAREHELDTOBELEGALLYINVALID. 6.LIMITATIONOFLIABILITY.TOTHEEXTENTNOTPROHIBITEDBYLAW,IN NOEVENTWILLSUNORITSLICENSORSBELIABLEFORANYLOSTREVENUE, PROFITORDATA,ORFORSPECIAL,INDIRECT,CONSEQUENTIAL,INCIDENTALOR PUNITIVEDAMAGES,HOWEVERCAUSEDREGARDLESSOFTHETHEORYOFLIABILITY, ARISINGOUTOFORRELATEDTOTHEUSEOFORINABILITYTOUSESOFTWARE, EVENIFSUNHASBEENADVISEDOFTHEPOSSIBILITYOFSUCHDAMAGES.Inno eventwillSun'sliabilitytoyou,whetherincontract,tort (includingnegligence),orotherwise,exceedtheamountpaidbyyoufor SoftwareunderthisAgreement.Theforegoinglimitationswillapply eveniftheabovestatedwarrantyfailsofitsessentialpurpose.Some statesdonotallowtheexclusionofincidentalorconsequential damages,sosomeofthetermsabovemaynotbeapplicabletoyou. 7.TERMINATION.ThisAgreementiseffectiveuntilterminated.You mayterminatethisAgreementatanytimebydestroyingallcopiesof Software.ThisAgreementwillterminateimmediatelywithoutnotice fromSunifyoufailtocomplywithanyprovisionofthisAgreement. EitherpartymayterminatethisAgreementimmediatelyshouldany Softwarebecome,orineitherparty'sopinionbelikelytobecome,the subjectofaclaimofinfringementofanyintellectualpropertyright. UponTermination,youmustdestroyallcopiesofSoftware. 8.EXPORTREGULATIONS.AllSoftwareandtechnicaldatadelivered

underthisAgreementaresubjecttoUSexportcontrollawsandmaybe subjecttoexportorimportregulationsinothercountries.Youagree tocomplystrictlywithallsuchlawsandregulationsandacknowledge thatyouhavetheresponsibilitytoobtainsuchlicensestoexport,re export,orimportasmayberequiredafterdeliverytoyou. 9.TRADEMARKSANDLOGOS.Youacknowledgeandagreeasbetweenyouand SunthatSunownstheSUN,SOLARIS,JAVA,JINI,FORTE,andiPLANET trademarksandallSUN,SOLARIS,JAVA,JINI,FORTE,andiPLANETrelated trademarks,servicemarks,logosandotherbranddesignations("Sun Marks"),andyouagreetocomplywiththeSunTrademarkandLogoUsage Requirementscurrentlylocatedat http://www.sun.com/policies/trademarks.AnyuseyoumakeoftheSun MarksinurestoSun'sbenefit. 10.U.S.GOVERNMENTRESTRICTEDRIGHTS.IfSoftwareisbeing acquiredbyoronbehalfoftheU.S.GovernmentorbyaU.S. Governmentprimecontractororsubcontractor(atanytier),thenthe Government'srightsinSoftwareandaccompanyingdocumentationwillbe onlyassetforthinthisAgreement;thisisinaccordancewith48CFR 227.7201through227.72024(forDepartmentofDefense(DOD) acquisitions)andwith48CFR2.101and12.212(fornonDOD acquisitions). 11.GOVERNINGLAW.AnyactionrelatedtothisAgreementwillbe governedbyCalifornialawandcontrollingU.S.federallaw.Nochoice oflawrulesofanyjurisdictionwillapply. 12.SEVERABILITY.IfanyprovisionofthisAgreementisheldtobe unenforceable,thisAgreementwillremainineffectwiththeprovision omitted,unlessomissionwouldfrustratetheintentoftheparties,in whichcasethisAgreementwillimmediatelyterminate. 13.INTEGRATION.ThisAgreementistheentireagreementbetweenyou andSunrelatingtoitssubjectmatter.Itsupersedesallprioror contemporaneousoralorwrittencommunications,proposals, representationsandwarrantiesandprevailsoveranyconflictingor additionaltermsofanyquote,order,acknowledgment,orother communicationbetweenthepartiesrelatingtoitssubjectmatterduring thetermofthisAgreement.NomodificationofthisAgreementwillbe binding,unlessinwritingandsignedbyanauthorizedrepresentative ofeachparty. SUPPLEMENTALLICENSETERMS TheseSupplementalLicenseTermsaddtoormodifythetermsofthe BinaryCodeLicenseAgreement.Capitalizedtermsnotdefinedinthese SupplementalTermsshallhavethesamemeaningsascribedtotheminthe BinaryCodeLicenseAgreement.TheseSupplementalTermsshall supersedeanyinconsistentorconflictingtermsintheBinaryCode LicenseAgreement,orinanylicensecontainedwithintheSoftware.

A.SoftwareInternalUseandDevelopmentLicenseGrant.Subjecttothe termsandconditionsofthisAgreementandrestrictionsandexceptions setforthintheSoftware"README"fileincorporatedhereinby reference,including,butnotlimitedtotheJavaTechnology RestrictionsoftheseSupplementalTerms,Sungrantsyouanon exclusive,nontransferable,limitedlicensewithoutfeestoreproduce internallyanduseinternallytheSoftwarecompleteandunmodifiedfor thepurposeofdesigning,developing,andtestingyourPrograms. B.LicensetoDistributeSoftware.Subjecttothetermsand conditionsofthisAgreementandrestrictionsandexceptionssetforth intheSoftwareREADMEfile,including,butnotlimitedtotheJava TechnologyRestrictionsoftheseSupplementalTerms,Sungrantsyoua nonexclusive,nontransferable,limitedlicensewithoutfeesto reproduceanddistributetheSoftware(exceptfortheJavaFXRuntime), providedthat(i)youdistributetheSoftwarecompleteandunmodified andonlybundledaspartof,andforthesolepurposeofrunning,your Programs,(ii)theProgramsaddsignificantandprimaryfunctionality totheSoftware,(iii)youdonotdistributeadditionalsoftware intendedtoreplaceanycomponent(s)oftheSoftware,(iv)youdonot removeoralteranyproprietarylegendsornoticescontainedinthe Software,(v)youonlydistributetheSoftwaresubjecttoalicense agreementthatprotectsSun'sinterestsconsistentwiththeterms containedinthisAgreement,and(vi)youagreetodefendandindemnify Sunanditslicensorsfromandagainstanydamages,costs,liabilities, settlementamountsand/orexpenses(includingattorneys'fees)incurred inconnectionwithanyclaim,lawsuitoractionbyanythirdpartythat arisesorresultsfromtheuseordistributionofanyandallPrograms and/orSoftware. C.JavaTechnologyRestrictions.Youmaynotcreate,modify,or changethebehaviorof,orauthorizeyourlicenseestocreate,modify, orchangethebehaviorof,classes,interfaces,orsubpackagesthatare inanywayidentifiedas"java","javax","sun"orsimilarconvention asspecifiedbySuninanynamingconventiondesignation. D.SourceCode.Softwaremaycontainsourcecodethat,unless expresslylicensedforotherpurposes,isprovidedsolelyforreference purposespursuanttothetermsofthisAgreement.Sourcecodemaynot beredistributedunlessexpresslyprovidedforinthisAgreement. E.ThirdPartyCode.Additionalcopyrightnoticesandlicenseterms applicabletoportionsoftheSoftwarearesetforthinthe THIRDPARTYLICENSEREADME.txtfile.Inadditiontoanytermsand conditionsofanythirdpartyopensource/freewarelicenseidentifiedin theTHIRDPARTYLICENSEREADME.txtfile,thedisclaimerofwarrantyand limitationofliabilityprovisionsinparagraphs5and6oftheBinary CodeLicenseAgreementshallapplytoallSoftwareinthis distribution. F.TerminationforInfringement.Eitherpartymayterminatethis AgreementimmediatelyshouldanySoftwarebecome,orineitherparty's

opinionbelikelytobecome,thesubjectofaclaimofinfringementof anyintellectualpropertyright.
