Christmas Light Extravaganza Photo Contest

The 2012 Christmas Light Extravaganza photo contest (hereinafter the Contest) is being conducted by Excelsior Apparel LLC. Theme The goal of the Contest is to highlight the New York spirit of not just doing something, but doing something better than anyone else by celebrating the most over the top Christmas light displays that the Empire State has to offer. The contest is taking place on our Facebook page. Eligibility The Contest is open to everyone* at least 18 years of age. There is no entry fee; however, to be considered a valid entry, participants must post their entry on our Facebook page, have liked our Facebook page, and be available for us to contact via Facebook message. Deadline for Entry To be considered a valid entry and be eligible to win the prize, entries must be posted to our Facebook Wall by 9 PM on December 14th, 2012. All submissions will be downloaded and saved to a file as they are received so that they may all be uploaded at the same time to our Christmas Lights Extravaganza 2012 Facebook Album to ensure that all photos start the judging period with 0 likes. Submissions 1) Participants may submit no more than one (1) photo for consideration. Photographs should depict a large-scale Christmas light display the entrants house, or property owned by the entrant, that is located in New York State. 2) By submitting the photo the entrant is agreeing to allow Excelsior Apparel LLC to have exclusive limited use of the photo for promotional purposes on our website and social media outlets. 3) Entries cannot contain any profanity or obscene material, or be otherwise inappropriate in our opinion.* We absolutely reserve the right to determine in our sole discretion whether a submission is obscene or inappropriate for any reason. In the event of such a determination, a submission will not be accepted for the contest and will be removed from out Facebook page. All decisions are final and there is no appeals process. Excelsior Apparel LLC is under no obligation to disclose why an entry has been disqualified other than the entry was ineligible under these Contest Rules.

4) Each photo must be accompanied by a caption that describes the light display, the location the image was taken, and the name of the photographer(s). 5) Entries that are digitally enhanced, manipulated or a composite of multiple images must be based on the entrant's original photos or photos for which the entrant is the copyright holder. Images that are judged to be primarily computer illustrations rather than photo-based work will be disqualified. Deciding whether a photo is primarily a computer illustration is the sole discretion of Excelsior Apparel LLC and Excelsior Apparel LLC is under no obligation to disclose why they have determined a photo is primarily a computer illustration. 6) Entry materials may not contain brand names or trademarks. 7) We reserve the right to request additional information to verify conformity with contest rules. 8) We reserve the right to publish any photo entries in the Contest on our website and social media outlets. 9) Entrants grant the Excelsior Apparel LLC a royalty-free, worldwide, perpetual, non-exclusive license to reproduce, display, distribute, and create derivative works of the entries, in whole or in part, in any media now existing or subsequently developed, for any reason. Excelsior Apparel LLC will not be required to seek any additional approval in connection with such uses. No Confidentiality Photographs submitted to Excelsior Apparel LLC will not be treated as confidential, and by entering this contest and submitting photographs, you represent and warrant that the photographs do not include or disclose any trade secrets, proprietary information or other confidential information. Judging All photos that are submitted and accepted for the competition will be posted on in a Facebook album entitled Christmas Light Extravaganza 2012. The album will be created by midnight on Friday, December 14th 2012. Individuals that visit the site can vote for their favorite picture by liking it. Judging will end at midnight on Friday, December 21st 2012. The picture that receives the most likes overall by midnight on December 21st, 2012 will be declared the winner and will receive the prize of two Excelsior Apparel LLC shirts of their choosing. Winner Notification Winners will be finalized by Monday, December 24th, 2012 and will be notified via Facebook message shortly thereafter. It is the winners responsibility to respond to our initial Facebook message to notify us of the two shirts that they would like along with their address. The winner will be posted on our Facebook wall, our other social media outlets (Twitter, Tumblr, Instagram), and also on the home page of our website (excelsiorapparel.us). If the individual who won a prize does not respond within 20 business days, he or she forfeits the right to their prize and we reserve the right to assign the prize to the entrant that had the second most likes during the specified time period. Disclaimer Excelsior Apparel LLC will not be liable for any technical difficulties that may arise in the administration of the Contest and reserves the right to make changes to the Contest Rules as it deems necessary in its sole discretion. Any such rule changes will be posted on this page. Contestants are urged to submit their photos well ahead of the deadline to ensure that any internet/website difficulties do not prevent a timely entry. but is under no obligation to do so. If an inadequate number of entries are submitted, we reserve the right to modify the submission dates. The decisions of Excelsior Apparel LLC shall be final on all matters concerning the contest. This offer is void where prohibited by law. *Partners of Excelsior Apparel LLC and their immediate families are not eligible to participate. **Examples of profanity and or obscenity include the use of curse words, sexually explicit language, suggestive poses or gestures, nudity, and any other material that we, in our sole discretion, deem otherwise inappropriate.
