1 Jacob orcutt roxbury, Massachusetts revolutionary war 1775 engraved Powder horn, 22" length, with engrailed edge and raised ring. Wood plug with wood pins. Deep yellow-tobrown color. Heavily engraved with buildings, trees, cannons, ships, cannons firing at other ships, birds, and military figures. Horn is inscribed Jacob Orcutt His Horn Which He Gives a Present To His Brother John Orcutt Rocksbury Septy 26, 1775. This horn comes to Cowans via an estate and has never been photographed nor offered for sale before. This is a spectacular horn has a beautiful, untouched yellow patina. $6,000 - 8,000

Engrailed edge with flats on double throat, raised ring, and spout. Wood plug. Nice yellow-to-brown color. A fresh to the market horn. A small crack from plug up ca 1.5". 3 tomahawk style halberd, 10.25" spear with raised edge. 5" beak with raised edge. Crescent shaped blade measures 6.25". 3.5" conical base secured by two rivets and welded to the other metal regions. 21" haft. This halberd was exhibited at the Senator John Heinz Pittsburgh Regional History Center in 2005 in a display entitled Clash of Empires: The British French and Indian War 1754-1763. This halberd was purchased from the Angel family of Franklin, N.C. The Angel family is the namesake of the Angel hospital. The Angel family found this ax in an Indian smokehouse around 1880. All of this information related to the purchase of this item comes with a signed letter attesting to the purchase of this halberd from the Angel family. Tip of spear is broken off. All metal surfaces are uniformly pitted. $7,000 - 9,000

Brass pommel, knuckle bow, quillon with eagle, crossed cannons, and cannon balls embossed on blade. Checkered handle, metal scabbard. Guard is loose and slightly bent. 13 mexican war sword Presented to col. william b. roberts, 2nd Pennsylvania volunteers, 30" blade with etched military motifs. Gold gilt handle. Guard and metal scabbard with nicely decorated bands. A very attractive Model 1840 staff officers sword of the pattern generally associated with Medical officers and Paymasters, but this specimen was presented to an infantry officer and bears no departmental designation whatsoever. Beautifully engraved on the larger shield shaped languet is the following inscription: Presented To Col. Wm. B. Roberts by his friends as a testimonial of their respect and confidence in his gallantry as a Soldier. Pittsburgh Jan. 7th, 1847 Most interesting is another presentation . on the smaller shield languet on the opposite side, this being a posthumous presentation from the widow Roberts to another Pittsburgh officer. It reads Presented by Mrs. Roberts to Lieut. Kane Dec. 17th, 1847 . The sword was presented to Roberts just days before he left with his regiment for Mexico. In late 1846 Roberts and a large number of men from Fayette County (in Southwest PA, now part of Greater Pittsburgh) enlisted for the war with Mexico. The Fayette company left on the 2nd of January, 1847 for Pittsburgh, where it was mustered into service on the 4th of the same month and designated Company H of the Second Regiment of Pennsylvania Volunteers. Roberts was immediately commissioned as Colonel of the regiment. He received this sword three days later. The Second Regiment proceeded by way of New Orleans to Mexico, and landed at Lobos Island, near Vera Cruz, which was invested by the American forces and fleet. The regiment entered the city after its surrender, and moved thence to the interior by way of Puebla and Perote, being assigned to Quitmans division. During its term of service it took part in the engagements of Tobasco, Cerro Gordo, Contreras, Cherubusco, San Pascual, and at the storming of the Belen Gate. After surviving numerous adventures on the battlefield, Col. Roberts took ill along with many dozens of others in the 2nd Regiment and he died of disease in the city of Mexico, on the 3rd of October, 1847. The command of the regiment was assumed by Lieutenant-Colonel John W. Geary, afterwards Civil War General and Governor of Pennsylvania. The body of the dead Colonel Roberts was embalmed, and, with that of Lieutenant John Sturgeon of the Fayette County company, was sent back to Uniontown. The funeral procession was escorted by the Union Volunteers and the Fayette Cavalry. The remains of Col. Roberts were interred in the Methodist graveyard in the borough of Uniontown, and a marble monument erected over his grave. In December of this same year (1847) the newly-widowed Mrs. Colonel Roberts gave this same sword to Lieutenant James Kane (also shown as Kean), also of the 2nd Pennsylvania Regiment.

Kane served as Lt. Co. H 2nd PA Vol. Infantry enlisting on Dec. 20th 1846 at Pittsburgh at the age of 20. He was given a furlough from October 29th, 1847, and was on recruiting duty from Dec 1847 through May 1848 in Pittsburgh when he received his late colonels beautiful sword as a gift from the widow. He mustered out with his company July 20th, 1848. The condition of the sword is extremely fine with no damage nor defects. The blade is mostly shiny etched steel with vestiges of factory luster mixed with some darkening in recessed areas. The brass handle, guard, and scabbard are absolutely beautiful with a nice luster melded with gilt and a hint of patina. The handle is adorned with an early pattern eagle, oak leaves, and acanthus. The languets are adorned with laurel leaves and stars in addition to the engraved presentation inscriptions. The blade is profusely etched with all etching strong including a wonderful early pattern U.S. eagle under patriotic ribbon. All detail is fine on the scabbard and mounts as well. While expensive Civil War presentation swords are relatively common, finding an example from the Mexican War is a truly memorable and rare event. Finding one that bears an additional posthumous re-presentation is unique in our experience. A wonderful battle weapon of the War with Mexico carried by two separate Pennsylvania officers. Blade is smooth and grey. Scabbard, handle and guard retaining most of the gold gilt finish. $10,000 - 15,000

colonel, later taking command of the regiment in August when the regiment was posted at Harpers Ferry. The untried 3rd Wisconsin joined N.P. Banks army in the Shenandoah Valley in the late spring of 1862 and was roughly handled by the rising Stonewall Jackson at Winchester and Cedar Mountain. Commanding a brigade in the 12th Corps at Antietam, Colonel Ruger was slightly wounded on September 17. Showing mettle on the battlefield, Ruger earned his first star on November 29, 1862 and led a brigade in Alpheus Williams division at Chancellorsville and Gettysburg. At Gettysburg, Ruger temporarily commanded Williams division when the latter took over the 12th Corps replacing Slocum who acted as Right Wing commander. On July 3 Rugers troops were positioned along the southern portion of Culps Hill in view of what General Slocum took to be a shaky Rebel flank. Slocum ordered Ruger to mount an immediate attack. Instead, Ruger sent a mounted aide, cautiously ordering two regiments of Silas Colgroves brigade out to probe the smoke shrouded line as skirmishersthe ill-fated 2nd Massachusetts and 27th Indiana. What transpired was one of Gettysburgs enduring tragedies. Upon receiving the order to advance, an incredulous Colonel Mudgewith a clearer view of the terrainremarked, Well, it is murder, but its the order. Quickly the regiments formed one after the other and charged over the open ground into the leveled sights of a riled Virginia brigade. The audacious Colonel Mudge was killed instantly and the probe was completely smashed with 250 killed and wounded in just a few short minutes. Despite the glaring misfortune, Rugers handling of the division was recorded as exemplary and in March 1867 he would be awarded his second gallant and meritorious brevet to brigadier for Gettysburg. Following Gettysburg Ruger was directed to New York City where he assisted in suppressing the civil mayhem inflamed by the draft riots. In October 1863 the hard-luck 11th and 12th Corps were ordered to the Western theatre as strategic reinforcements and consolidated as the 20th Corps in April 1864 for operations against Atlanta. The corps was then commanded by Hooker with Ruger retaining a brigade in Williams division assigned to Shermans army. With the unprecedented assembly of nearly 120,000 men, the goliath advance began in May and saw the 20th Corps engaged non-stop for the next four months. The scale and tempo of the action rendered reports at brigade level nearly superficial with the thrust and parry of division and corps size attacks dominating the battlefield and capturing

Twice-brevetted Thomas H. Ruger was an 1854 West Point graduate and distinguished regular army officer who started the war as colonel of the 3rd Wisconsin and earned accolades for gallant and meritorious service on the distant fields of Franklin and Gettysburg in command of a division. Less effusive than many of his contemporaries, Rugers career spanned an incredible thirty-seven years encompassing the thorny Reconstruction era as an able departmental administrator and military governor followed by the plum assignment as Academy superintendent during the 1870s. As the inexorable tide of Manifest Destiny linked the continent with iron rail, Ruger endured the dusty routine of frontier post and garrison duty which in due time led to a regular brigadiers star in March 1886. The permanent rank of major general was achieved only in February 1895 with statutory retirement following in April 1897 on the eve of the Spanish-American War. By all accounts a straightlaced, studious cadet, Ruger graduated third in the West Point Class of 1854 that included future Confederate luminaries Custis and Stephen D. Lee, Pender, Pegram, and J.E.B. Stuart. Commissioned in the elite Corps of Engineers that July, the young second lieutenant had a change of heart after brief duty in New Orleans and, soon abandoning his fledgling career, returned to Wisconsin to practice law. With the advent of war in April 1861 Ruger was among the first to volunteer. He raised the 3rd Wisconsin organized at Fond du Lac and became lieutenant

newspaper reports. The 20th Corps particularly distinguished itself at Resaca, adding battle honors for Rocky Face Ridge, New Hope Church, Dallas, Pine Knob, Kennesaw Mountain, and Peach Tree Creek culminating in the siege of Atlanta. Atlanta cost the 20th Corps alone over 7,000 casualties, while Hood had still escaped with the prideful Army of Tennessee wounded and bleeding, but intact. While Sherman marched to the sea Ruger was detached with General Thomas back to Tennessee and given command of the Second Division in the 23rd Corps. On November 30, 1864 Rugers division met the tragic Hood at the bloody battle of Franklin taking part in a singular spectacle described by an eyewitness as an unforgettable martial display. It was here that the entrenched Union army under John Schofield held off Hoods repeated frontal attacksIn near perfect alignmentwell over 100 regiments strong, bands playing, bayonets flashing, and scores of tattered battle flags flying in the late afternoon sunbleeding the Army of Tennessee to death. Rugers division had held the middle portion of the main line west of the Franklin Turnpike against the initial assault of Bates division and then after dark repulsed a hammer blow launched by Alleghany Johnsons fresh division, large numbers of Confederate troops becoming pinned down in the ditch fronting the main line Hoods insanity notwithstanding, Rugers heroism at Franklin was the pinnacle of his Civil War combat career recognized by an immediate commission to brevet major general to date from November 30, 1864. Sick during the battle of Franklin, Ruger was not present at Nashville where his division was held in reserve. The 23rd Corps ended the war back east with Sherman. Ruger had assembled a fresh division at Nashville and in February 1865 took the field for final operations in North Carolina. The division fought at Kinston and occupied Goldsboro and Wilmington in the final days before Joe Johnstons surrender. Ruger left the division in June when he was elevated to the command the military Department of North Carolina, a position he held until June 1866. General Ruger was retained in the regular army and promoted to colonel of the short-lived 33rd Infantry on July 28, 1866. Ruger would never again see active campaigning. Henceforward, his duties would entail the command of various important military departments and posts during and after Reconstruction as well as the plum assignment as Superintendent of West Point. He mustered out of volunteer service on September 1, 1866 and received his Gettysburg brevet on March 2, 1867. In January 1868

General Meade appointed Ruger provisional governor of Georgia, an emergency measure necessitated by a constitutional lapse on the part of the elected civilian predecessor. On March 15, 1869 Colonel Ruger transferred to the 18th Infantry and remained the regiments commander for the next 17 years until April 1886. From 1871 to 1876 he served in the prestigious billet of U.S. Military Academy Superintendent followed by command of the Department of the South in 1876-78 during the volatile period marked by the Chamberlain-Hampton election controversy in South Carolina. General Ruger then saw service on the Great Plains at the apex of the Indian Wars commanding the District of Montana for six years starting in 1878. After twenty years in grade he was promoted to Brigadier General, Regular Army, on March 19, 1886 following which he was put in charge of the now staid Department of Missouri that included command of the Infantry and Cavalry School at Fort Leavenworth. In 1888 General Ruger became chief of the Department of Dakota, but had been replaced by Nelson Miles before the massacre at Wounded Knee in December 1890 brought an ignominious end to the Indian Wars. At age 60 Ruger was advanced to Major General on February 8, 1895 and posted to head the coveted Department of the East. By seniority second in command of the United States Army, he was placed on the retirement list April 2, 1897 at the statutory age of 64 following thirty-six consecutive years of military service, just before the onset of the Spanish-American War. Thomas Ruger had married the former Helen Lydia Moore in Janesville, Wisconsin in 1857. Two daughters were born, Helen M. in 1859 and Anna M. in 1867. In retirement Mr. and Mrs. Ruger maintained a private life in Stamford, Connecticut where he died suddenly on June 3, 1907. General Ruger was afforded the rare honor of burial in the Post Cemetery at West Point (Section 26, Row C, Grave 29). Consigned directly by Rugers descendants, we are pleased to offer an unprecedented range of rare cameo material associated with this important historical personality. Comprising over 55 lots, the Ruger collection includes the generals full complement of service swords, his unfired Colt SA Army revolveramong the finest pedigreed cased pistol ever to reach the market, military books, a wide selection of photographs and ephemera, uniform insignia and silver, all intact and, incredibly, untouched 102 years after the generals death.

14 colt single-action army revolver Presented to general thomas h. ruger as suPerintendent of west Point, .45 caliber, 7.5" barrel, serial number 1504. German silver front sight, early italic barrel address, two-line patent markings on left side of frame; with an obviously incorrect.22cal stamped on frame at rear of trigger guard. Varnished deluxe burled walnut grips. Blued barrel, ejector, cylinder, backstrap, triggerguard and trigger. Hammer and frame are case colored. The revolover is housed in a mahogany factory casing that is partitioned and lined in purple velvet with wood cartridge block holding 56 original cartridges. All cartridges unspent. This lot is further accompanied by a January 7, 1874 letter on Colt factory letterhead to Ruger as Superintendent of the United State Military Academy at West Point, from W.B. Franklin, Colt Firearms Vice President : My Dear General, I have intended to send you one of the new Army pistols for a New Years gift, but I could not get it ready until yesterday, when I sent it to Gen. K.O. Tyler of New York, to be sent from there to you. I hope that you will be able to give it a good test and develop all of its weak points, which however I hope are few. Certainly Your Friend, W.B Franklin We interpret Franklins admonition for Ruger to give it a good test to be a sort of inside joke from one friend and seasoned vet to another. Both Franklin and Ruger had been career military men, thoroughly familiar with the arms of the Federal government. For Ruger to have missed the stamping .22cal would have been inconceivable. In addition, at the time of the gift, the U.S. Army Quartermaster had just signed a contract with Colt for 3,000 of the new single-action .45 caliber pistols. More than likely Ruger never fired the revolver; it appears to be in untouched condition. An outstanding, and historically important weapon. Barrel and ejector rod housing retain ca 97% original blue with some light wear at left side of muzzle and scattered very light pinprick-size brown spots. Cylinder finish is a pleasing mixture of blue thinning to brown. Backstrap and triggerguard retain ca 95% original blue with some very minute flaking. Frame and hammer retain ca 98% original case color. Grips retain most of the original varnish with some tiny nicks on the bottom. Top of case lid has an age crack. Left side of case has some dings. Case still retains most of the original finish. The heirs pried the lid open to find what was inside. Since they did not have a key, there is evidence of their actions. The top latch pulled way and could be easily restored. The interior is in excellent condition. The outline of the revolver shows and the hammer has cut into the lining. The outline of the cartridges can be seen inside the lid. Descended directly in the family of General Thomas H. Ruger $30,000 - 50,000

15 cased civil war Presentation sword of colonel thomas h. ruger, 3rd wisconsin, 30.5" blade etched with military motifs, shagreen and brass wire wrapped handle, gold gilt knuckle bow with eagle flags and stars. Very fancy floral gold gilt design hilt and pommel. Gold gilt scabbard has cast fittings of floral ornament and inscribed between two bands Presented by the Officers of the 3rd Regmt. Wis. Vols. to their Col. Thos. H. Ruger Feb. 15th, 1862. Housed in a green leather-bound coffinshaped case with original sash, sword belt with 1851 belt plate with silver wreaths, sword hanger and sword knot. Case is lined in blue velvet and the lid is white silk with an M.W. Galt Washington, D.C. label. Case is French fitted around the knuckle bow and handles, the rest of case is partitioned with compartments to hold the sash, belt and knot. Top exterior case lid with an inscription plaque with Col Thomas H. Ruger. Lot includes a cabinet card of the General. A fine sword symbolic of the confidence and trust expressed by the officers of the 3rd Wisconsin. Case has darkened and has some scuffs and very light flaking of leather. Inside case the white silk lining in top of case lid has some stains and a tear caused by the hilt. The belt has some staining and is a little stiff. The scarlet sash is in excellent condition with one small stain. The sword knot is in excellent condition. The gold on the scabbard has tarnished on the exposed side and the other side has dulled. Gold on the fittings is bright. Blade has three small areas that were lightly cleaned to remove some storage rust. The entire group has a nice, uncleaned, attic look. Brass knuckle bow and pommel. Shagreen and brass wire wrapped handle. Blade etched with military motifs. Metal scabbard with brass bands and carrying rings. Scabbard marked Ames Mfg. Company, Chicopee, Mass. This sword, along with the following M1850 foot officers sword, was likely carried in the Civil War by Ruger. Handle has nicely tarnished and has not been cleaned. Blade retains a lot of the original polish with some staining. Scabbards fittings still retains some of the gold gilt and blue finish. Missing throat. .33 WCF caliber, 24" matted top round barrel, take-down, serial number 151483. F-style checkered pistol grip, shotgun buttstock and forearm are of hand-made oil-finished English walnut. The left side of the stock has a Roosevelt-style cheek piece outlined by three tiered scrolls. Checkering is very fine, thirty-two lines to the inch. Rifle has a checkered trigger. The left side of the receiver is engraved and inlaid in gold with images of a buck, doe and fawn. The right side is engraved and inlaid in gold with a bull moose and cow. The underside of the receiver, forward of the lever carries a raised gold monogram composed of the letters J.F.D. ca 1.25" in length. Balance of the receiver, lever, barrel at breech, muzzle, forearm tip, top of breech bolt, upper and lower tang, buttplate, screw heads, magazine plug, takedown lever are all highly engraved. Rear sporting sight with untouched Sheard medium gold bead front sight. The Winchester Factory letter specifies: One hundred ninety-five grams of gold, $1 25.00 for engraving by (J. Ulrich), $25.00 for checkering by (C. Ulrich). There has been research done on vintage factory engraved Winchester rifles with $100.00 or more of engraving. Cowans Auction researcher found only nine such rifles in the Winchester firearms records. Of the nine, two had more than $100.00 worth of engraving on them. This rifle is one of these two listed in the Winchester factory records. All of this information regarding the work in making the Model 1886 rifle #151483 is detailed in the factory letter from the Cody Museum. This firearm was made exclusively for John F. Dodge, co-founder of the Dodge Automobile Company. The rifle is truly a work of art and a one of a kind Winchester Model 1886 rifle. Seldom does a collector find a Winchester factory letter that has details listing all of the unique features of creating a special ordered rifle so thoroughly documented. Furthermore, it is unusual to find a Winchester rifle that has been engraved by one Ulrich and checkering rendered by another Ulrich and properly documented. Barrel, magazine tube and takedown lever retain ca 98% original bright blue finish. Receiver retains ca 97% original blue finish with a small spot on the left side of receiver at the top border around the panel has a very small, minute area of loss of finish, otherwise the frame does retain ca 99%. Lever retains ca 98% of its case coloring, but thinning. Buttstock and forearm retain all of their original oil finish with a few storage nicks, but does not distract from the beauty of the rifle. This rifle has never been seen by firearms collectors or photographed for the public until now. 44 excePtional sPringfield model 1868 sPecial order sPorting rifle, .50-70 caliber, 28" round barrel, no barrel proofs, serial number 16574 on receiver and barrel. 1869 dated breechblock, 63 dated lockplate. The following work has been done by Springfield Armory to sporterize this model by thinning the hammer and centering it on the breechblock; sidelock screws have been rounded; stock with checkered wrist and fore end; well-detailed around lock mortise and on the reverse side; silver-plated fancy triggerguard and nose cap, double-set trigger, fly on tumbler; white metal tip poured in place and portholes on the inside of stock identical to that of later Springfield officers rifles; rear band was modified with and eye and eyelet placed on bottom of stock between triggerguard and buttplate for sling. Remnants of three military cartouches on the left flat of stock. All internal lock parts are sub-inspected with a later gold shield behind tang with engraved initials TED. This rifle was the subject of two investigations in the 1960s, one by the late Graham Burnside; the other by the late Archer Jackson (1967). Mr. Burnsides (1966) article maintains that this rifle was found in Iowa, where Grenville Dodge retired. The Springfield records list a Sporting rifle ordered by General Dodge which cost $70.00 with a request to ship on 3-17-1870. Burnside believed this to be that sporting rifle that was ordered from Springfield Arsenal by General Dodge. In Archer Jacksons talk to the American Society of Arms Collectors in the fall of 1967, he stated that he could not prove this was General Dodges rifle. However he concluded that it was definitely a Springfield Sporter, since parts of this rifle were identical to Springfield Sporters in his collection. Dr. Vance Haynes has examined this rifle and agrees that it is identical to the few other existing special order Springfield Sporters made from 1866-1875 (personal communication to J. Lewis). Included with this lot is a copy of the Springfield Special Order Register. Barrel retains ca 90% of the original blue finish. Receiver and breech block have a nice mottled grey-to-brown look. Hammer has traces of case colors in the protected areas blending to a nice soft brown. Checkering is very sharp and crisp. Wood has a nice dark red feathered look with nice opened grain. Behind triggerguard is marked with stock makers initials AL. Blued barrel; case harden receiver finished in a blue-grey mottled finish. Walnut stock and handguard, 1902 rear sight marked C on sight base. Blade front sight on ramp. Buttplate with trap in butt. This rifle was once owned by Col. Berkley R. Lewis, a noted gun collector and author. It was purchased by him from William Larue. Mr. Larue then in turn sold it to Bob Penny. Mr. Pennys firearms collection was sold on the West coast in the late 1960s at auction. Cowans researcher has examined two 01 carbines at Springfield Arsenal. Both specimens are cut-down rifles to carbines. This 01 carbine incorporates characteristics of the Krag carbine and transitional parts of the 03 rifles. (i.e., the double lug bolt and receiver). This carbine is one of the greatest Springfield collectors pieces. Its condition and rarity will make it a centerpiece of a Springfield collection. Barrel retains ca 98% of the original blue. Receiver retains ca 98% of the mottled grey-to-blue finish. Trigger guard and floor plate retain ca 90% blue with some light scratches. Front band retains ca 90% original blue with some brown. Rear sight retains most of its original blue finish. Body of bolt is polished bright. Cocking piece and safety retains most of the original blue finish. Buttplate retains ca 50% original blue, but thinning and turning brown. Ramrod cover in butt retains ca 80% case colors, but thinning. Wood has nice red open grained look with normal dings and mars. Signed by Abraham Lincoln (1809-1865) as President (1861-1865); also signed by E[dwin] Stanton as Secretary of Defense, matted and framed with archival mat to 22" x 25.5". Sold with M1860 Staff & Field sword, 31" length, with engraved initials JAS on the folding quillon and tip of scabbard. Strong, a native of Vermont, served a little over a year, before mustering out in July 1865. Appointment with folds and slight fading, both signatures still quite clear. Blade has been lightly cleaned with areas of light salt and pepper staining. Brass handle has been lightly cleaned. Shagreen handle has some areas of scuffing. 106 civil war archive of john williams, 34th & 36th o.v.i., Piatts zouaves, archive includes a post-war manuscript account, a Model 1816 .69 caliber musket, two tintypes of Williams, and a GAR metal identification tag. The archive also includes a manuscript account written by John Williams after the war. This account, A Brief History of My Army Life as I Saw it, undated, is written in a 4to ledger book with marbled boards. While working on a farm near Bantam, Ohio, John Williams learned of the outbreak of the Civil War and together with a one-armed veteran of the Mexican War, he helped raise and outfit a company of volunteers for state service. After the company was refused in the federal service, however, Williams enlisted in the 34th Ohio Infantry (the Piatt Zouaves), one of Foxs 300 Fighting Regiments. The Zouaves did most of their fighting in the comparatively obscure engagements in West Virginia, though they were drawn into the famous struggles in the Shenandoah Valley. Williams memoir is part personal narrative, part scrapbook, and may have been written with the intention of reading before his comrades in the Grand Army of the Republic. He wastes little time before diving into a stirring account of his first significant action, the sharp engagement at Chapmansville, W.Va., in Sept. 1861: our advanced guard were attacked by the rebels under command by Colonel Davis the fight now commenced. We were in a gap with high hills on either side, the Johnies were on the hills volley after volley were poured into us. As brave men we returned the fire and drove the rebels who retreated into their breastworks. The Battle now commenced in earnest. The Rebs poured volley after volley into our ranks. We gave them the best we had a charged was ordered. You ought to have heard the yell of the zouaves. We charged the breast works and routed the rebels. The day was ours we were successful in our 1st Battle The memories of those months of grueling marches in the Kanawha Valley punctuated by skirmishes remained sharp for Williams, whose writing reveals a strong recollection of events coupled with often colorful writing. In addition to several smaller incidents, he provides an effective view of the painful campaign of May 1862 under J. D. Cox, during which Williams reports the 34th lost 130 men killed and wounded. In May 1863, the 34th Ohio was converted to Mounted Infantry, and in July, they had their first engagement on horseback during an expedition on Wytheville, Va., where, he reported, after a desperate fight [they] captured the place with all the enemys artillery and burned the town. Colonel Toland was killed, the Colonel of the 2nd Va. Col Powell was wounded, Capt Delano was killed. The loss of the 34th in this engagement was 4 killed, 1 wounded, 33 missing. On the day previous to the 3 fight at Wytheville Company C of the 34th which was acting as a rear guard was attacked by guirrillas [sic] losing a number of men, including Capt. Cutter and 15 men who were taken prisoners Williams also describes the brutality of the Shenandoah Campaign of 1864: when within 4 miles of Winchester near Stevensons depot on the widow Carter farm we were attacked by the enemy, fought them for some time and drove them from the field we entered Winchester and fought the enemy for 2 days. The rebels received heavy reinforcements and were commanded by Gen. Jubal Early on the 24th of July we were attacked by Earlys whole force. The fighting was fearful if ever I heard the rebel yell I heard it that day. Our regiment lost heavy. Col. Shaw was killed, owing to superior numbers we were forced to give way. The 34th was the last regt to leave the field which it did under a galling fire His account continues through the fight at Martinsburg the next day.

Throughout the memoir are passing references to Rutherford B. Hayes (Division Commander), Philip Sheridan, and George Custer, among others, and Williams includes some excerpts of letters written while in the service. At the end, he notes that he was one of the charter members of the Killpatrick Post no. 189 of the GAR in Goshen, Ohio, in 1882, and he includes a list of engagements for the 34th, a Brief sketch of my early life, and an account of Freemasonry. A marvelous relic of patriotic sentiment, the album was used partly as a scrapbook, with large numbers of American flags and similar patriotic devices pasted in as decoration, along with newspaper clippings. It is further decorated with some GAR-related printed items: two of Williams Masonic calling cards, a printed announcement of the 23rd annual reunion of the 34th OVVI (1888), and a roster of the 34th OVVI (1902), a flier from the reunion of Chase Macacheek Piatt Zouaves, 1900; and three additional reunion notices. Of special note is a printed letter signed by Capt. Aug. F. Ward, 36th OVVI (the 34th was consolidated with the 36th in January 1865), July 31, 1865, bidding his company (F) farewell and congratulating them on their service. More unusual still are two lithographs in the scrapbook depicting camp scenes of the Piatt Zouaves, undated, but probably rendered during the war. The first is a handsome lithograph of Barboursville, Nov. 1861, 34th OVI depicting the regiment in town led by commanders on horseback; and a litho of Fayetteville, Sept. 10th 1862, 34th, 37th OVI depicting soldiers in earthwork fortifications overlooking a valley. A Model 1816 .69 caliber musket, converted from flint to percussion is also included with the archive, along with two cased tintypes, one of a shockingly young-looking John Williams in uniform (not Zouave) and the other of Williams and his two daughters. Both images have glass, mat, and preservers, but are housed in half case. Finally, there is a dog tag reading John Williams, Veteran Co. E, 34 and 36 Regiments OVVI, 1861-1865 and on verso: 8th Corps, Army of Va. An unusual Civil War collection pertaining to an under-documented part of the conflict. Shows the wear and condition issues of many scrapbooks, but on balance very presentable. Stock of musket in fine, original finish with faint inspectors mark, metal with uniform pitting and brown cover, there is remnants of a cartouche. $1,000 - 2,000

According to descendants of the consignor, this flag was fort in the backwater of the Florida panhandle dubbed Fort Hodgson in honor of its commander reportedly the last flag to fly over Fort Moultrie, South Carolina, one of the forts protecting Colonel Joseph Hodgson of the 7th Alabama Cavalry. In a sharp fight, the Alabamians were put to Charleston harbor and the fortification that opened fire on Ft. Sumter at the start of the war. It was flight, resulting in the capture of Hodgsons official papers and muster rolls, a considerable amount supposedly captured by a soldier in the 7th Vermont Volunteer Infantry. of commissary stores, 18 sabers, 18 guns, 23 head of cattle, and a regimental flag. (Official Records of the War of the Rebellion, Series I, Vol.35, Part I, pp 413-416.). Whether this is the flag captured This story would appear to be apocryphal on several counts. First style lockplate with coarse knurled hammer and 1873 dated lockplate, front band with no stacking swivel. Long wrist short comb stock. First type buttplate. This firearm has been in the same family since 1921. The consignors grandfather most likely purchased this firearm at the Oakes Home in Denver, CO. The Oakes home was a famous tuberculosis clinic that flourished from 1893-1939. It was customary for locals to donate items to help fund the hospital. The grandfather kept this firearm through the Depression and the rest of his lifetime with the firm belief that this was an important historic firearm. All metal surfaces are a brown patina with just a hint of traces of original finish and covered in a light storage crust. Bore could be cleaned out to better, but grades good. Stock is covered in nicks and dings from use with fully visible ESA cartouche on left side of stock. Firing proof circle P behind triggerguard. Stock has never been cleaned and still retains the open grained look. Missing the saddle ring. $4,000 - 6,000

11 2 excePtionally rare gardner gun, .50-70 caliber, 32" barrel, Gardner Patent Gun Serial Number 2 is a single barrel with single feed guide and operated by hand. William Gardner is believed to have had Serial No. 2 manufactured, based upon his patents of 1876 and 1879, by the Pratt & Whitney Company. The weapon offered here is the Patent Gun that William Gardner had tested by the U.S. Navy, tried by the British Admiralty and British War Office, and other European governments. This is the very gun that Alexander Gardner took with him to Paris in 1878 for and exhibition in Paris with similar inventors machine guns in which Mr. Gardners gun took first place. This gun was used in competition against the Gatling gun. Mr. Gardner's gun won in Europe, but not in America. Overall length 45", height 38". Accompanying this lot are three 4" x 6" albumen photographs at the machine gun trials in 1887. The information on this gun comes from an article in the 2004 American Society of Arms Collectors Bulletin No. 89 by James W. Alley. The article was entitled Rifle Caliber Artillery; The Gardner Battery Gun. The exterior of the barrel has turned a plum brown and the action exterior has a very pleasing untouched brass patina. The internals are brass with the exception of a few pins and the bolt, which are in the white. The internals are almost in the same condition as when the gun came from the factory. In addition the archive includes three different crossed rifles, collar and hat plates with the number 1, hat plate with letter D; a miniature Spanish American War veterans medal with flag ribbon; his aluminum Id tag with chain; a pair of cuff links with crossed document for a Road-Charting Apparatus invented by Nichols, dated 1929; an early analog rifles; and two enameled medals, non-military issue, one a crest with Latin motto of 3rd U.S. Army computing machine; and 20+ partially printed or typed documents from Nichols Army service (Semper Primus/Always First). Col. Ode C. Nichols led an eventful life. His military carrier clipping on Nichols. began with Teddy Roosevelts Rough Riders in Cuba, where he was ordnance officer. He enlisted in The oil on canvas shows Nichols seated in his WWI uniform holding his sword and bedecked with regular army as private and saw service during Philippine Insurrection, and was promoted to 2nd numerous medals. Back of canvas signed Estelle Claussen 6100 Afton Place. In a gilded wood frame. Lt. He later saw service during the Mexican Insurrection and WWI in Siberia with the 31st Infantry. 36" x 30" (w/o frame); 41" x 35" (w/frame). Estelle Claussen was from the state of Washington and He retired in 1929 at age 69. He was a member of National Geographic Society, Faculty Club Univ. active especially in the early 1930s. of California, inventor and friends with Marshall, Roosevelt, and MacArthur. He died in 1949. Archive also includes an autopen-signed Lyndon Johnson award to Col. Nichols for services The American misadventure in Siberia during WWI was ostensibly to protect supply lines, but in rendered, and a wonderful illustrated four-page manuscript account in Nichols hand giving fact was an attempt to support the anti-Bolshevik forces. The 31st Infantry regiment received one a detailed account of how one goes about putting on your eye glasses in full field dress and Medal of Honor and 15 Distinguished Service Crosses while in Siberia. For its service in Siberia, the mounted - quite humorous, but ending in disaster. A captioned illustration of him on horseback 31st Infantry became known as The Polar Bear Regiment, adopting that bear as its insignia. Painting highlights the letter in which he ends up dropping things, including his pipe, which starts a grass fire, has severe crazing to the sitters right resulting in some paint loss. Paint on canvas is thinning on left. which spooks his horse. rare uniforms and accoutrements of the Polar bears lots 170-181

The 1st Battalion, 310th Engineers was part of the famous North Russia Expedition comprising 5,000 American troops among an international force that landed at Archangel in September 1918 as part of an anti-Bolshevik campaign instigated by the British. The Americans, mostly Michiganers of the 85th Division, were immediately committed to successful combat operations but became overextended with the onset of the Arctic winter and thereafter assumed defensive positions in the inhospitable frozen north. News of the Armistice in November coupled with persistent supply problems caused moral to plummet and the American contingent was withdrawn in June 1919. Over 200 Americans became casualties with most of the dead not repatriated until 1934. Many were re interred beneath the Polar Bear Monument in White Chapel Cemetery, Troy, Michigan. The self-styled Polar Bears bonded by their unique Russian service identified themselves with distinctive insignia forming a comradeship that lasted well into the 1960s, the last Polar Bear having died in 2003. The Polar Bear moniker and insignia were not officially authorized until the summer of 1919 shortly before the men were demobilized and mustered out. The earliest unofficial insignia may have been made-up in France while the Polar Bears were waiting to ship back to the United States. Several variations of the typically rough-cut cloth blue and white Polar Bear are known including a post-war (reunion?) version probably from the later 1920s found applied to WWI era uniforms.

Specialty insignia were not introduced until later in 1918 and generally speaking were not worn by the AEF in the field. The four primary missions of this group were to first destroy the German Air Force in the air and on the ground; second, to destroy German airplane manufacturing plants and refineries; third, to attack Italian communication; and fourth, to weaken the German position in the Balkans. This group flew 191 missions over southern Europe, shot down 97 German aircraft and dropped 10,528 tons of bombs. All insignia are with expected worn condition, the most weathered insignia being the left eagle insignia. Breast insignia with lighting bolt is ca 25% severed from the jacket. 197 twenty-seven Pieces of hitlers formal silver by bruckmann, ca 1938, struck for Bruckmann & Sohn, Heilbronn, each having a National Eagle with wings folded and displayed, the talons holding a wreath with a swastika, flanked with the initials A.H., surrounded by a stepped border. All marked with the Bruckmann eagle and content marked with the crescent moon, crown and 800. Includes 2 tablespoons, 8.5", 5 dinner forks, 8.5", 4 luncheon forks, 7.25", 4 demitasse spoons, 4.5", 5 bouillon spoons, 5.625", 3 teaspoons, 5.75", 2 dessert forks, 5.75", an ice cream fork, 5.5" long and a gravy ladle, 7.5". The Bruckmann formal pattern of presentation silver flatware was made as a spectacular 50th birthday present to Adolf Hitler, and appears to have been used exclusively by the firms of Bruckmann and Wellner. There are believed to be six complete sets of 500 pieces, or possibly five sets of 600 pieces, that were distributed among the places Hitler frequented the most: the Berghof (Hitlers Mountain home); Der Adlerhorst (the Eagles Nest); the Gasthaus (Guest House) at Obersalzberg: the Braune Haus (the Brown House); the Prinzregentenplaz apartment in Munchen: and the Reichskanzlei in Berlin. Service pieces were of .925 silver and the matching tableware, which needed to be harder and more durable, was made of .800 silver. Hitlers mountaintop chalet, the Eagles Nest, was another gift in celebration of his 50th birthday in 1938. It was an extravagant lodge and compound of 80 buildings that served as Hitlers second seat of government, was where the major decision leading up to WWII was inspired, and which was his planned refuge of last resort. It included a complex underground bunker system which included meeting rooms, offices and archives for the government, and lavish living quarters for Hitler connected by four miles of tunnels cut through solid rock by slave labor. All was stripped bare after the war, and almost everything was destroyed by the victorious allies. Family legend purports that these pieces were found in the bunker system of Der Adlerhorst (the Eagles Nest), Obersalzberg, Berchtesgaden, Germany, by Staff Sergeant Walter E. Neal, who served for 15 months in France, Germany and Austria with the 232nd Infantry Regiment, 42nd Rainbow Division, and brought back to the States following the War.(Historical information courtesy of www.hitlersnest.co.uk and www.ricksteves.com). Curly maple stock with checkered wrist. Phillip Creamer worked in Taneytown, Maryland from 1792-1805 and then in St Louis, Missouri. He later worked in Illinois. (See Sellers, 1983: 71). Engraved back-action percussion lock marked G. Goulcher. Curly maple stock with silver escutcheons and double-set triggers, brass patchbox, buttplate, triggerguard and nose cap. Silver escutcheon on cheek piece with owners name J.L. Barkhurst. (See Sellers 1983: 122) John L. Gorsuch was born October 7, 1821. The father, a farmer, served for nearly three years in the War of 1812 under General Harrison, and died April 18, 1861, at the age of 76. John L. Barkhurst was born near Little york, Jefferson County, OH and raised on the farm. In August 1844, he was married to Louise Parkinson, daughter of Jacob and Polly Parkinson of Jefferson County. In 1872 Mr. Barkhurst left the farm and purchased Udegraff Mills and became a successful miller. Mr. Barkhurst later moved to Dillon, OH. Barrel is nicely browned with some areas of salt and pepper pitting. Stock as well as the furniture with nice patina. Very fine Ohio-made rifle. $1,000 - 1,500

Single-set trigger. Extra fancy select walnut buttstock and forearm with ebony tip. This outstanding rifle is engraved on frame, upper and lower tang. Lever, buttplate and front and rear portion of barrel. Engraved in a Winchester pattern. Ram in panel on one side of frame. Opposite side with a buffalo in a panel. Beautifully scroll engraved with gold bands. Engraving on both the front and back of barrel as well as the lever and buttplate. Frame was finished in case colors. Blued barrel and buttplate. This rifle was assembled at Winchester, engraved by Joseph and signed on the under lever with a cursive J. Bottom tang marked Joseph 93. This rifle was used to raise money at a charity event for the Cody Museum. The workmanship in this rifle is of the highest quality and could not be duplicated at this estimate. L.O.P. over period pad, barrels have been reworked by Wesley Richards and are marked Wesley Richards, Sleeved. Automatic ejectors, 2.75" chambers, cocking indicators, full coverage receiver and triggerguard scroll engraved with panels featuring a fox, deer, and three woodcock on the triggerguard, serial numbers are hand-cut. The word Safe is inlaid in gold on rear of tang. Barrels retain all of the blue finish applied by Wesley Richards. Receiver is very sharp and crisp with a nice silvery look and some original case colors in the protected areas. This is a high-grade shotgun which is worthy of restoration. The buttstock has a 1.5" crack at the wrist and is partially hidden by the checkering. This could be repaired by a good craftsman. The period solid pad has deteriorated and needs to be replaced. The screws on the bottom of the action are slightly misshapen, but the metal surfaces are still nice. Wood-to-metal fit is excellent. Bores are excellent. $2,500 - 3,500

329 Pair of bavarian holster flintlock Pistols with shoulder stock, ca 1750. .49 caliber, 10.5" swamped barrels with micro-groove rifling. Barrels are signed in silver on the sighting flats Iacob Kuchenreuter. Inlaid with three clusters of silver scrollwork and spider fore-sights. The rear of barrel has a gold cartouche with the initials IIK. Fixed rear sight with two-leaf folding sights. Single-set triggers. Finely figured full-length stocks highly raised carving around the locks, tangs, triggerguards, and rear ramrod ferrule. Both the pistol stocks and the ramrods are tipped in horn. Tampions are made of wood and covered in a green wool material. Iron furniture and all metal parts are engraved in light border lines. Metal escutcheon in the rear of stock for wood shoulder stock. Johan Jakob Kuchenreuter (1709-1783) was appointed gunmaker by the Prince of Thurn and Taxis. Locks and furniture have a very sharp and crisp look with dried grease which is beginning to lightly patinate. Barrels have some traces of original blue mixing with a light patina. One pistol has a strong blue finish on the tang and the other is lightly faded. One of the hammers has had some restoration done. Stocks are a nice honey color and were re-varnished many years ago. A very fine set of flintlock pistols that are difficult to find in this condition. $6,000 - 8,000

Lock is rounded, and early style tail, engraved with vines and mythical figures, signed Tangvy LB Gvern A Paris. A rounded engraved cock, iron furniture. The silver side plate is of serpentine form with floral accents. Walnut full stock is raised carving around the tang, triggerguard, and the rear ferrule. Incised lines follow the barrel and ramrod. Ball butt with engraved spurs. All metal is grey and lightly pitted. Barrel has been chemically aged to hide a barrel extension. Restorer added 3" to the barrel and added the new front sight. Fore end has had 7" added. Some very tiny old chips missing around the tang. The hammer is an old replacement and it has also been restored. Ramrod is a replacement. $1,000 - 1,500

358 german 17th century style raPier, 37.5" blade with raised central rib. Ricasso with floral engraving with vestige of gilt highlights. Ricasso is signed Peter Munich inside an oval which further contains a bishops head appearing on both sides of the blade. The large hilt is constructed by a large section of bars with scrollwork design forming the rear quillion, loop guard and knuckle guard. The ring loop incorporates a thumb loop. The pommel is in the form of a disc with two notches near the finial. Both the guard and pommel with floral engraving. The replaced wood grip has a spiral pattern. Peter Munich (1595-1651) is listed as a Soligen, Prussia bladesmith. (See Gardner 1963: 359.) Light rust and pitting with vestige of gilt remaining on the blade and the guard. Overall good condition. $600 - 800

359 lot of two scottish regimental dirks, ca 1879. 1 1.75" blades are notched on the back edges, edged with thistle foliage and makers details Robt Mole & Sons, Birmingham. Wood grips carved with a basket weave pattern with brass nails at the intersections. Pommel caps are of iron with cast raised crowns. Further marked with a double R back to back and stamped Robt Mole & Sons on the ricassos and with a crown. One dirk has a Birmingham proof on the back edge. One of the dirks has a slightly loose cap. One of the blades etchings is crisper than the other. $700 - 900

367 kingdom of two sicilies grenadiers helmet, extremely rare Model 1824 pattern spiked helmet to a grenadier of the guard. After the conclusion of the Napoleonic Wars the Bourbon house ruled the Kingdom of Two Sicilies which encompassed all of southern Italy from Naples south and the entire island of Sicily. The royal family, in this case Ferdinand II (1830-1859), ruled from their palace in Naples. In 1847, it was one of the first cities in Italy where Unitarian riots broke out. In 1848 it rebelled openly against the reigning Bourbons, but was heavily suppressed again. Only in 1860, after the Battle of Milazzo, did the troops of Garibaldi free the city. The helmet has a large helmet plate on the front with Messina in large letters surmounted by the numeral 2. Above the plate is the distinctive three-legged running figure and Medusa head of the Trinacria. Trinacria is both an alternative name for Sicily and its national symbol, an ancient form of the Triskelion, which also appears on its flag of Sicily. The Medusa in the center implies the protection of the goddess Athena, the patron goddess of the isle. In early mythology, Medusa was the destructive aspect of Athena, later, a monster slain by the hero Perseus, who adorned Athenas shield. This helmet is of the 1824 pattern which was also used by the Royal Guards of the household of Tuscany. It is a black leather body with brass furniture and red horse hair plume. The style is similar to Russian, German, French and British helmets of the same period. This is among one of the rarest spiked helmets in the world. By registering and bidding in an auction conducted by Cowans Auctions, Inc. (Cowans), bidders (whether present in person, by telephone, by agent, by written or telephone absentee bid instruction, or through a live internet connection) agree to be bound by these terms. These are the complete and only terms and conditions on which all property is offered for sale. Cowans retains the right to bar any bidder from participating in any auction and to exclude or reject any bid. 1) registration. All bidders must register their name, permanent street address (no P.O. Boxes), and telephone number prior to the auction. Unless known to Cowans, all registrants are required to present two forms of identification, at least one of which must include a current photograph. Bidders may be required to present a valid Visa or MasterCard. By registering with Cowans or submitting an absentee bid form, a individual registrant authorizes Cowans to obtain a copy of his or her consumer credit report and authorizes Cowans, at its sole discretion, to use the information contained therein to make business decisions regarding the registrants participation in the bidding process. 2) accePtance of terms. Bidding on any item, whether in person, by phone, by absentee bid or via a live internet auction indicates the bidders agreement to be bound by these Terms and Conditions for Bidders. Any right of bidder under this agreement shall not be assignable and shall only be enforceable by the original buyer. The rights and obligations of the parties shall be governed by the laws of the state of Ohio. All bidders submit to the personal jurisdiction of the state and federal courts in Ohio. 3) terms of sale. Announcements made the day of auction take precedence over any previous communication. The auctioneer reserves the right to withdraw any lot at any time before its final sale and to reject any bid for any reason. The highest bidder for each lot acknowledged by the auctioneer shall be the buyer. If any dispute arises as to any bidding, or between two or more bidders, at the sole discretion of the auctioneer, the successful bidder will be determined or the disputed lot shall be put up again at the last undisputed bid and resold. 4) buyers Premium. Buyers shall pay the final bid price (the hammer price) of the lot, plus a buyers premium for the lot equal to 15% of the hammer price up to and including $200,000, plus 10% of the amount by which the hammer price exceeds $200,000. Un-catalogued auctions and purchases made though live online auctions may have different buyers premium calculations. 5) estimates and reserves. Presale estimates are intended to be guides and may or may not reflect the ultimate hammer price of a lot. Cowans retains the right to change estimates on any lot up to time of sale. A reserve is a confidential minimum price agreed upon by the seller of the lot and Cowans. In the case of reserved lots, the seller has authorized Cowans to bid on sellers behalf until the reserve price is reached. In no case will the reserve be higher than the low presale estimate. Cowans standard house reserve on all property at auction is one-half of the low estimate. 6) warranties and disclaimers. Cowans makes a limited warranty only to the original buyer of record concerning the authenticity of each lot for a period of 14 days after bidders receipt of the purchased lot. If a buyer is not satisfied that the lot purchased is genuine, the buyer may, at his or her own expense, obtain the opinion of two mutually agreed upon recognized experts in the field of the disputed lot. If these experts determine that the item is not genuine, the buyers sole and exclusive remedy shall be the rescission of the sale and refund of the amount paid for the item. It is specifically understood and agreed that the rescission of the sale and refund is exclusive and in lieu of any other remedy which might otherwise be available as a matter of law or in equity, and such remedy is conditioned upon the buyer returning the property in the same condition as at the time of sale. Cowans shall not be liable for any incidental or consequential damages. All sales are final, with no returns or refunds except as provided in this limited warranty. In order for Cowans to efficiently serve the needs of those who wish to bid by phone, please note the following: To participate in the auction by telephone, potential bidders must complete and sign the absentee bid form and check I WISH TO BID By TELEPHONE for the designed lots. Telephone bidders are advised to indicate an insurance bid, which amount will become an absentee bid, pursuant to the absentee bidding process set forth above, if Cowans can not reach the bidder by telephone for a particular indicated lot. Telephone bidders must disable any caller ID or other call blocking mechanism. Cowans sells about 100 lots per hour, so telephone bidders should plan accordingly. Cowans will attempt to reach each telephone bidder, but Cowans is in no way responsible for missed calls. All reservations for telephone lines must be received no later than 6:00 p.m. eastern standard time the day before the start of each auction session. 1 internet bidding. Internet bidding via ebayliveauctions.com may be 1) available for certain auctions. There may be terms which apply to internet bids that should be reviewed on line at the time of sale. Cowans is not responsible for any failure to execute a bid and shall have no liability to any bidder for any technical or other failure associated with an internet auction. 1 bidding increments. The following increments are used at the auction. 2) Absentee bids must fall within these increments. Cowans will automatically reduce any absentee bid to the closest increment if the bid falls outside the published range of increments. The Purchase Price for each lot shall equal the hammer price, buyers premium, sales tax and, if applicable, all packing, handling, insurance and shipping costs. Payment may be made with cash, personal or travelers check, Visa or MasterCard. Cowans reserves the right to hold a purchased lot until a check has cleared. Buyers who are present at the auction must pay the full Purchase Price at the time of the sale. Buyers who bid by telephone or who are absentee bidders will be invoiced within 5 days after the close of the auction and must pay the full Purchase Price for each purchased lot within 14 days after the date of the auction. By signing the absentee bid form or placing a bid by telephone, an absentee bidder authorizes Cowans to charge the Purchase Price for each lot for which such bidder is the successful bidder to the credit card number provided by telephone or on the absentee bid form, unless payment in full or alternative payment instruction is received within 14 days after the date of the auction. No property will be released by Cowans unless the Purchase Price has been paid in full. Institutional billing may be available, and should be arranged prior to the auction. Cowans may impose late charges of 1.5% per month (or the highest interest rate allowed) on any amount owed to Cowans that remains unpaid after 30 days. Buyer shall be liable for any collection costs or attorneys fees incurred by Cowans to collect payment, to the extent permitted by law. 15) sales tax. Buyers are required to pay any applicable state and local sales tax. 16) shiPPing. At the request of the buyer, Cowan's will authorize the shipment of purchased items through our agent, Wrap-it Postal, LLC. Wrap-it Postal operates independently in Cowan's facility and usually ships within two weeks after payment has been received. Shipment is generally made via UPS or Fed-Ex Ground. Unless buyer gives special instructions, the shipping method shall be at the sole discretion of Wrap-it Postal. Cowan's is in no way responsible for the acts or omissions of independent handlers, packers or shippers of purchased items or for any loss, damage or delay from the packing or shipping of any property. ADVICE TO INTERNATIONAL BUyERS: Cowans will not ship any package containing a firearm to any location other than within the United States. Buyers outside the United States must make their own shipping arrangements taking full risk for the transportation of any firearm. 17) shiPPing charges. Buyers are required to pay for all packing, shipping and insurance charges. Overseas duty charges are the responsibility of the successful bidder. Be aware that for larger and/or valuable items, shipping charges can be substantial. 18) removal and storage of ProPerty. If purchased property has not been removed, or Cowans has not received shipping instructions within 21 days after the auction date, a $10 per item per day storage fee may be charged to the buyer. 19) cancellation of sale. If purchased property remains in the custody of Cowans for a period of 60 days following the auction, Cowans may, at its option, cancel the sale, retaining as liquidated damages any payments made by the buyer, or resell the property at auction or by any other commercially reasonable means, for the account and at the risk of the buyer, and in such event, buyer shall be liable for the payment of all deficiencies plus all of Cowans costs, including but not limited to storage and costs of both sales.
