Procedure to be adopted in India to curb crime drastically.

Crimes in India have been happening very rampantly and frequently. The very essence of Article 21 seems to have lost its hold. The meaning of safety has faded from the hearts of the people forget the victims and their families. The law in India needs to be envisaged in a manner which could curb the menace rampantly occurring here. The legislative made laws seems to be a safe haven for many crimes. For instance, the recent case with Nirbhaya famously known as Delhi Rape Case, she was brutally injured and made an animal for the fulfillment of a juveniles fantasy by sodomizing her with iron rod and much more which the public is darkened with. Now if we happen to believe the speculation going around then as per the law due to person being juvenile would escape the wrath of the court and punishment with very light sentencing. Now if we are to judge and measure the quantum of his role in that case with the punishment to be apparently given to him, would it be justified to leave him for the havoc that he created? People world around have been condemning the death given to the accused who deserve death. The one question that really bewilders me is the fact that, dont the pity the family who are made the victim of such an act? And dont they wish to seek a better society a better world for the people to live in? and even if my questions do not suffice them, then they must give a proper solution as to how the crimes can be suppressed drastically. Which they have failed to give all the while. They have been advocating many views on the basis of exceptions which should be ignored in the larger interest of the peace sought by the society. Laws have been made and people have consented to form the government for the only reason of safety. Life existed even during the brabourous regime when the so called development of the society impeded. And to get rid of the hardsips faced then that the people started forming society and governance. If the government and the law are ineffective in giving the basic requisite element to live life freely for which the government and the law evolved, then whats the option left for the society to resort too? We have many lacunas in our law and legal system. The legislatures have been successful in only holding the hands of the civilized people who knock at the doors of the court for the violations of their rights, whereas the corrupt go unescorted and walk as the mighty kings on the roads.

The laws need change for the better society that it needs to see tomorrow and the effect must be given to it immediately before the hearts of the society sees its way only by corrupt means. The people are infiltereated with vengeance and it is to hamper the country and the system very soon if not changed. I would like to submit my views on the Delhi Rape case that recently shook the country. Crimes are further increasing every day, does it mean in any way that our laws are affective or its giving a negative meaning? Various theories of punishment has been mentioned to be given to the person guilty of the crime, Are those effective in any manner and if yes, then to what extent? The laws are ineffective due to lame punishments executed here. And the punishments in itself are not able to deter the people to remain an example which the legislation intends to seeks. The impact of deterrence can only be felt by public if they witness the execution. Public have been witnessing punishments only by way of Hearing. The object that needs to be sought goes soft on people. Now, lets rewind ourselves back to the execution of Ajamal Kassab and the impact of his life that must have caused on the people to refrain the people from committing grievous offence of murder. We have so far been successful only in inheriting laws from country where itself the laws have been ineffective in curbing crime in the interest of society. Like the laws of Ireland, English Laws and the American Laws. The essences of laws are felt in the soils of Arabia. I am not opining that the crimes are absent there, but the crimes are nearly minimal. At least the grievous offence such as those of murder and rapes. The only reason is the esecution of punishment in public. If we are to imagine the carrying out the punishments of the people in the busy public area of every state like those of Saudi, then the kind of impact it would have in any country in the world would be very different. The laws of Saudi are different then the laws which originally prevailed in India and the rest of the world.
