Both party bring evidence consist of document of their prototype data, e-mail correspondence between two party and expert witnesses. The court pick 10 jury that will decide the court verdict. 24th August 2012, The jury decide that Samsung performed copyright infringement and fined them 1.05 billion dollar.
Apples win over Samsung in six out of seven patents will be considered a landmark case for the ongoing patent wars. Here, we discuss the marketing implications for customers due to the fight of Apple and Samsung.
Samsung released a statement that the ruling means fewer choices, less innovation, and potentially higher prices. The reduced choice and higher prices maybe a short- term effect, but that innovation will be greater in the long term.
As regards the impacts on emerging markets, the number of smartphones will rise significantly and emerging markets, particularly Asia, cannot be ignored. For many emerging markets consumers, the internet will be accessed mainly on these smaller screens rather than on desktops and laptops. This offers phone manufacturers considerable potential to sell to these consumers.
However, the patent war could bring prices up for manufacturers as the cost of handsets could rise with design feature requiring a patent payment per device. This opens up the opportunity for different operating systems (OSs) such as Microsofts Windows Mobile or Research In Motions BB10 that should not face these high patent prices per device. Both these companies are very popular in emerging markets already. A boost for Windows Mobile is a boost for Nokia, but still Android being the biggest operating system competitor in the Smartphone market.
