Further Simplication of Procedure for Pesticide Registration for Export GUIDELINES FOR STAR EXPORT HOUSES ACCREDITATION SYSTEM

M 1. Objective:
To recognize established exporters as STAR EXPORTS HOUSES and lay down a fast track registration system based on self certification, to encourage the export of pesticides from India. Such houses should operate as highly professional, legally complaint and responsible, environmental friendly genuine institutions and act as important instruments of export growth for the Indian Pesticide Industry. 2. Eligibility: All such pesticide manufacturing companies shall be eligible to apply for accrediting as Star Export House; a) whose average annual total FOB/FOR export @ performance during the past three financial years is not less than 75 crores b) who must have been in the pesticide manufacturing activity for the last 10 years, with established manufacturing facilities in India. c) who should not have been convicted for the offences under the Insecticides Act, 1968.

i. Export made on re-export basis shall not be counted for the purpose of recognition. ii. Exports made by a subsidiary of a limited company shall be counted towards export performance of the company, only if the limited company has a majority share holding in the subsidiary company. iii. Actual realized export earnings will alone be considered for the performance. 3. Application for the grant of Star Export House Status : a) The company shall apply for the star export house status on the prescribed application format, along with such application fee as prescribed, along with an affidavit of self declaration and a demand draft for Rs. 50,000 as security deposit to the Secretary (CIB & RC). b) Such application shall be made by the registered office of a company. c) Such application shall be accompanied by a certificate from the CA of the company that 95% of the foreign exchange proceeds have been realized in respect of exports in the preceding 3 years. d) The Secretary, on the basis of the information provided by the applicant, will decide whether Star Status is to be granted to the applicant or not. The applicant will be communicated about the decision within 7 days. e) An applicant who is not satisfied with the decision taken under the guidelines, regarding non grant of star status, cancellation/suspension of the star status, he may file an appeal before the Plant Protection Advisor, Directorate of Plant Protection, Quarantine & Storage, Faridabad, who shall be the appellate authority under the guidelines, within 30 days of the date of such decision. The decision of the appellate authority shall be final.

Processing of Applications submitted by Star Houses: a) The application for grant of export permit in the prescribed form, as per rules, along with an affidavit of self certification, addressed to Secretary (CIB & RC) should be submitted. All such applications of accredited star export houses will be examined by a team of two experts on a fixed day of the week (Wednesday of the week). The experts, while examining the applications, may see the prima-facie correctness of information provided, fulfillment of documents required etc. After this scrutiny, the Secretary (CIB & RC) shall issue a certificate of registration for export, for the applied molecule/formulation, within the same week. If some discrepancy is noted by the experts and registration is not granted, the same shall be intimated to the applicant, within the same week. b) All such cases of issuing certificate of export will be placed before the next RC, for post facto approval. i) Detailed scrutiny will be done by the experts, as per the procedure, before taking the matter to RC, for post facto approval. ii) If the scrutiny by the Secretariat reveals any deficiency, the applicant will be asked to furnish clarifications. If no clarification is sought by the Secretariat, no additional information will be entertained by the Secretariat regarding the amendment in the application. The clarification shall reach the Secretariat within 15 days of issuing such communication. If the same is not received within the stipulated time the case will be processed presuming that the applicant has nothing to furnish with respect to the clarifications sought by the Secretariat. iii) The Secretariat shall consider the information provided by the applicant and the proposal will be taken to RC for post-facto approval. c) If the RC rejects the application, the registration issued will deem to have been withdrawn. This information will be placed on public website and communicated to all countries concerned for exports. The appellate provisions under the Insecticides Act, 1968 will not have any bearing on this action. Further action will be decided based on the outcome of the appeal. d) If second such instance of rejection takes place for the same company, the star status of the company will be withdrawn along with forfeiting the security deposit and the company has to apply afresh for the accreditation after a gap of one year. 5. Obligations of the Company: a) Submit all forms duly filled, with correct information at the first instance itself as no further communication in this regard will be entertained. b) Submit an affidavit that all the information provided by the applicant is correct and the applicant will be fully responsible for any lapse and the consequences if any for providing erroneous information. c) The Company shall be liable as per the Provisions of the Insecticides Act, 1968 for any violation of the provisions of the Act.

No 6 the clause (b) has been amended to substitute the words affidavit from a Judicial Magistrate of First Class with undertaking that the applicant has not been convicted for offences under the Insecticides Act 1964 #2 To facilitate export of pesticides for earning valuable exchange, annual accreditation fees has been fixed to Rs. 1,000/- (Rupees 0ne thousand only). Hence, the words Rs. 25000 may be substituted with Rs. 1000
