LESSON 2 Financial Compensation CASE STUDY Avelina Cruz has been employed as a Bank Teller for the past ten years. From the Head Office, she was assigned to work in one of the bank branches in Metro Manila. After one year in branch A as a Bank Teller, the Branch Manager told her to perform the job of a Telephone Operator in addition to bank tellering, which now became an occasional job function. Her pay remained unchanged so Avelina Cruz did not mind working as a Telephone Operator. Six months ago, the Branch Manager told Avelina Cruz that since they would no longer need the services of a Telephone Operator, she was being terminated. However bank tellers were being hired in the Head Office and as well in some branches. QUESTIONS 1. What do you think o the services of Avelina Cruz? If you were the Vice President for Human Resource of the Bank, what would you do? If you were Avelina Cruz, what actions would you take (assume that a labor union exists in the company)? 2. Comment on the personnel management practices of an organization like the bank in this case problem. What would you like to work in such organization? Module IV page 1

3. Did Avelina Cruz have any reason for not respecting the job of a Telephone Operator? Please justify your answer.

ANSWER (query 1) Employees embrace not only those who are usually and ordinarily considered employees, but also those who have cease as employees as a consequence of a labor dispute. What I think of the services of Avelina Cruz is an unfair labor practice of employers in which employers are making a way to get rid of employees without paying dues to be paid defined under the law. If I were the Vice President for Human Resource of the Bank, I would not do such kind of action and prevent those for the Bank may be prosecuted for such actions. However, if I were Avelina Cruz, I would ask for assistance to the labor union where I belong. Assistance in such a way that I would ask for just compensation for the termination Ive experienced.

ANSWER (query 2) The personnel management practices of the company were I think against the public policy since what they have done was a simple demotion of work labor to Avelina Cruz. I would like to work in an organization like a bank however I would not like to work in an organization with an unfair labor practice. I would not want to because I dont like to get some disputes that may affect my personality at the same time my attitude towards other people and other organization as well.

ANSWER (query 3) Avelina Cruz does not have any reason I disrespecting the job of a Telephone Operator because I was morally favorable and a lesser work load. But taking on the side of Avelina Cruz, what I thought was she was maybe Module IV page 2

discouraged about the decision of the Personnel Management because she was synonymously demoted from her previous position which is a Bank Teller.

LESSON 3 Conditions of Employment CASE STUDY Case Study Number 3A At a meeting o the Board of Directors of LIWANAG DRUG COMPANY, the Personnel Manager, Salvador Malabanan, presented for board resolution proposal for change of policy in the payment o salaries. The proposed changes are: 1. From maintaining the pay scale of competing firms to the practice of paying employees t least 10 percent more of the prevailing wage rate, giving a seniority pay of P20.00 monthly pay increases for every year of service for all employees with the company paying the full insurance premium of all employees. 2. From no formal employee training to that of providing all employees a training seminar conducted in-house and held during company time with mandatory attendance requirement of all employees. QUESTIONS 1. As a member of the Board of Directors, explain your reactions to the two proposed changes of Salvador Malabanan. 2. What do you think would be the advantages of the two proposals? Please explain your answers. ANSWER (query 1) If I am a member of the Board of Director of Liwanag Drug Company, at first I would be shocked about the proposals then consider the financial stability of the company if it would be feasible to enact the proposed Module IV page 3

projects. The projects I know will create a big impact on the financial status of the company thus it would be favorable or unfavorable to the management.

ANSWER (query 2) The advantages of the two proposals are producing well-trained employees and in the end will benefit the company by producing end-products that are competitive in nature. It will also lessen the labor turnovers because of the salary increase for it would give an idea to the employees to remain at their work for a yearly salary increase and other incentives. A better workforce and a better end result so the company will benefit lot in the end. A little investment and sacrifice at first but a big return of investment in the end.

Case Study Number 3B Because of the sudden increase in workflow due to a temporary additional production brought about by increased orders of RTW garment for exports, all the workers have been required to work an additional of four hours daily. This brings a total of 12 hours of work daily Mondays through Saturdays to some 150 workers. QUESTIONS 1. What do you think of the requirement for overtime work? Can an employee be compelled to work overtime? Explain your answer. 2. Should this workload be the case for at least six months, would you as a Personnel Manager recommend the hiring of additional workers? Please explain your answer/s.

ANSWER (query 1) I think the requirement of overtime work to employees is with due course provided that they will receive an incentive from the management in terms of overtime pay and other types of incentives that will motivate an employee to incur overtime work and when the nature of work require requires continuous operations and the stoppage of work may result in irreparable injury or loss to the employer and when the employer cannot resort to other measures. An employee can be compelled to work for overtime provided that it is indicated in his/her contact beforehand and at the same time if he/she is available on the time he/he was asked by his employer to have an overtime work. An employer should pay the required payment stated under the law the minimum overtime pay. ANSWER (query 2) It is a must to employ additional workforce if this will be the case within six months because employees may no longer take the hard work and the workload and sooner or later they will be force to file a resignation to avoid hard work. Additional workforce may lessen the overtime pay in which the companys expense may increase and may lessen the profitability. It may also give chance to unemployed population at the same time a benefit to the company and its existing employees.

LESSON 5 Grievances and Complaints and Disciplinary Procedures CASE STUDY Case Study Number 5A As Francisco Maculit, Machine Shop Supervisor, was walking around inspecting the workers in his work unit, he discovered that Pedro Tigasulo was not using the prescribed helmet while doing some electric welding job. This is the third time Pedro has violated this safety requirement. First time, Pedro was given a written reprimand for the same offense.

Problems: 1. If you were Francisco Maculit, what disciplinary actions would you take to make Pedro Tigasulo follow the safety requirements? 2. What are the consequences legally speaking; I Pedro would be involved in an accident due to his non-use of his safety required helmet?

ANSWER (query 1) If I were Francisco Maculit I would give a disciplinary action that will make Pedro Tigasulo to know his mistakes. On the first violation, I would just give her a verbal reprimand and on the second a written reprimand. If in case he will not till obey the companys rules and regulations I will be forced to suspend her for 3 days and next is a suspension for 7 days. All kinds of suspension will be without pay. And if still his having a hard time to obey the companys policies and regulations I would give him a show cause memo and in the end a termination. Under the problem, I would give him a suspension for three days without pay since he was already given a written reprimand beforehand.

ANSWER (query 2) The secretary of Labor and Employment shall, by appropriate orders, set and enforce mandatory occupational safety and health standards to eliminate or reduce occupational safety and health hazards in all workplaces and institute new, and update existing, programs to ensure safe and healthful working conditions in all places of employment. If in case Pedro Tigasulo incurred an accident due to his non-use of the safety required helmet, the company or even the state insurance fund will not be liable for the damages and compensation to the employee and his dependents. Under the law, the limitation of liability is when the death or disability was occasioned by the employees intoxication, willful intention to injure or kill himself Module IV page 6

or another, notorious negligence, or otherwise provided. It is clearly stated and defined that negligence is included in the limitations under the law where the actions of Pedro Tigasulo can be classified under it.

Case Study Number 5B The employees under the supervision of Linda Masuerte, Hotel Housekeeper of Hotel Silangan, have been going on for the past six months. As a result, Linda Masuerte has availed of skilled people to do the household work and carpentry job in her residence and for which he employees do not charge any amount of wages. Problems: 1. What is wrong with this practice of Linda Masuerte? 2. If you were one of the employees, would you allow yourself to be required to work in the residence of Linda Masuerte without pay? Why? Please explain your explain.

ANSWER (query 1) The practice of Linda Masuerte is unfair and ungrateful. It is inhuman in character to do such thing to an mployee. Sine the Constitution mandates to have a Social Justice in which it means that the poor or the oppressed should be protected under the law, thus, Linda Masuerte should be prosecuted for doing such things. What is wrong on Lind Masuerte is that she is compelling her employees to work beyond the ounce of their duties which is ding household work and carpentry jobs in her house. Linda Masuerte should give additional pay for services done beyond the bounce of the nature of their job description.

ANSWER (query 2) If I were one of Linda Masuertes employee I would not allow myself to work in her residence without pay. I would not allow it because first I do not have any pay, second is that it is not what I applied for beforehand and it is beyond my job description and lastly, if I would allow it to happen then I would be saying that it is okay for me to work without pay and I would allow her to do whatever she wanted without the approval of the higher management. Approval of the management should comes first before I allow myself to work in her residence and with pay of course. Case Study Number 5C The company policy on promotion states that Qualified employees shall be given preference over outsiders in matters of thing, transfers, and promotions yet the above policy has not been the practice in the past three vacancies that have occurred in XYZ Company. Outsiders were hired because there were relatives or recommended by politicians to the dissatisfaction and surprise of the employees. Problems: 1. What are the effects of these recent situations of outsiders being hired in XYZ Company on the morale and productivity of the employees? 2. If you were one of the employees who were being considered for one of the positions that were vacated when incumbent retired but was filled from the outside, what would you do? Why? Please explain.

ANSWER (query 1) There are different effects of the recent situations such as an impact on the management, as to the employees, as to the stockholders, and as to the rivals in terms of market. The Module IV page 8

impact on the employees is that they will have later confidence to the management and as a greater result a large number of labor turnover. O the impact of management, the management may suffer lesser profit in terms of financial stability of the company because of lesser production due to the outsiders which do not have proper training unlike on ladderized promotion that the employees have undergone proper training. The impact on the stockholders is that they will have problems on proper managing due to the family first attitude of the management handling so a change of management most likely will happen. The impact on the market is that the competitor will have a greater chance to pirate employees who are very well-trained and capable to do work in a manner with a lesser supervision.

ANSWER (query 2) I would ask the help of our union to file a written complaint addressed to the management so that the management may know what is happening in their downlines. Thereby, with a written complaint the management may react and I myself may also know the reason why their company policy was violated by themselves. If in case I was dissatisfied with the result I may file a resignation letter or we as employees with the help of our union may file for a strike out and have a collective bargaining agreement.
