A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA
ADOPTING THE FEBRUARY 2013 SPEED SURVEY COMPLETED BY HATCH MOTT
MCDONALD IN COMPLIANCE WITH STATE LAW AS OUTLINED IN CALIFORNIA
VEHICLE CODE SECTION 40802.


WHEREAS, the City has conducted a traffic and engineering survey to determine the
prima facie speed limits on certain streets within the City; and

WHEREAS, based on said survey, the city finds justification for existing speed limits
in accordance with California Vehicle Code Sections: 235, 240, 515, 22350, 22352, 22357,
22358, 22358.3, 22358.4 &40802; and

WHEREAS, the City states that no significant changes to roadway or traffic conditions
have occurred or are intended to occur, including, but not limited to, changes in adjoining
property or land use, roadway width, or traffic volume.

WHEREAS, the City further finds and declares that the speed limits set forth herein
are most appropriate to facilitate the orderly movement of vehicular traffic and are reasonable
and safe.



NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE
CITY OF CARMEL-BY-THE-SEA DOES:

Hatch Mott MacDonald (HMM) has prepared a vehicle speed survey update for the City of
Carmel-By-The-Sea. This survey was conducted along ten roadways within the City, in
accordance with the requirements of the latest Cal ifornia Vehicle Code (CVC) and the
2012 California Manual on Uniform Traffic Control Devices (CA MUTCD).
A. Project Approach
Speed surveys were conducted at the following ten locations:
l) Delores Street, between City Limits and 4th Avenue;
2) Mountain View Avenue, between Ocean Avenue and Forest Road;
3) San Antonio Street, between gth Avenue and Santa Lucia Avenue;
4) San Antonio Street, between 2"d Avenue and 4

6) Ocean Avenue, between Junipero Street and Carpenter Street;
7) Ocean Avenue, between Monte Verde Street and San Antonio Street;

9) Carpenter Street, between 1st Avenue and Ocean Avenue; and
1 0) Rio Road, between Santa Lucia A venue and Atherton Drive.
Exhibit 1 graphically depicts the locations of the surveyed roadways.
This speed survey was conducted in accordance with the requirements of the latest California
Vehicle Code (CVC) and the 2012 California Manual on Uniform Traffic Control Devices
(CA MUTCD). A minimum of l 00 radar gun speed-readings were obtained at each collection
point (i.e. a minimum of 50 readings in each travel direction). The speed surveys were conducted
in good weather conditions and under normal vehicle operating conditions, and in off-peak travel
periods where possible. In addition, each survey location was visited and driven, in order to
identity current posted speed li mits and roadway geometric data that may affect the speed limit
recommendations (e.g. horizontal and vertical curvature, shoulders, driveway density, pedestrian
and bicyclist activity, adjacent land uses, etc.).
B. Collision History
Collision histories along the ten study segments were obtained from the City of Carmel-By-The-
Sea. Table 1, below, summarizes the collision histories for each segment between February 2011
and January 2013, including the total number of collisions, and the number of collisions where
pedestrians, bicyclists or speed were a primary collision factor. Table 1 also includes collision
rates for the study road segments, along with the corresponding statewide average collision rate
for that type of roadway (e.g. two-lane conventional).

Colli sions with Pedestrians/Bicyclists or Speed as a primary coll ision factor were rather
infrequent along the study roadway segments- only six of the 33 coll isions had any of those as a
primary collision factor.
Most of the study roadways have collision rates well below their statewide average. The two
highest are Delores Street and Mountain View Avenue. Both roadways have cons iderably higher
numbers of collisions in proportion to their relatively low traffic volumes (approximately 400
vehicles per day for each roadway). The exact reason for these high rates is unclear, but a
possible reason is relatively narrow pavement width along both roadways (each is less than
25 feet in drivable width).
C. Speed Survey Frequency
CVC Section 40802 contains rules regarding the frequency of updating speed surveys. Under
normal circumstances, speed surveys of a jurisdiction's roadways must be updated every five
years for a speed limit to remain valid. (The sole exceptions to this rule are local streets, streets
in business di stricts, and school zones, which by law are to be signed at 25 MPH. The CVC
specifically defines each of the street types.) However, there are two exceptions that allow for a
longer frequency between survey updates:
Exception # 1: If speed enforcement officers have at least 24 hours of radar training and their
radar equipment has been calibrated within the past 3 years, speed surveys only need to be
updated every seven years. (If an agency uses lidar, then an additional 2 hours of training is also
required to meet this rule.)
Exception #2: If Exception #1 is met and there have been no significant changes to a roadway,
then speed surveys only need to be repeated every ten years. ("Significant changes" is defined in
the eve to include changes to adjoining properties, land use, roadway width, or traffic volume.
The 2012 CA MUTCD further clarifies that "significant changes" can also include additi on or
removal of driveways, addition or removal of on-street parking restrictions, changes in roadway
lane configurations, additions or removal of bicycle lanes, changes in traffic control , or addition

or removal of signal coordination.) Note that the CVC requires that the determination of "no
significant changes" must be made by a Registered Engineer.
Note that these rules apply on a street-by-street basis. Thus, if a particular roadway that has been
previously surveyed has significant changes, it may need to be re-surveyed in seven years, but an
adjacent roadway with no changes may only need to be re-surveyed every ten years.
Finally, note that these rules apply to updates to a speed survey. If a roadway is not a local street,
business district or school zone, a speed survey must be performed and adopted by a local agency
prior to enforcement of its speed limit.
D. Speed Limits by Statute
The CVC identifies a three specific instances where a specific speed limit may be established
without a speed survey if certain conditions are met. They are business districts, local streets, and
narrow streets. Each of these instances are described below.
1. Business Districts - CVC Section 235 describes a business district as an area which at
least 50 percent of the properties are used for business for a minimum distance of 600
feet on one side or 300 feet on both sides of a roadway. As previously noted in Section
2.1 of this document, speed limits within business districts are defined in the eve as
25 MPH. Section 235 of the CVC describes a business district as an area which at least
50 percent of the properties are used for business for a minimum distance of 600 feet on
one side or 300 feet on both sides of the highway.
2. Local Streets
CVC section CVC Section 40802(a) defines local streets and roads as ones that are
functionally classified as "local" on the California Road System Maps approved by the
Federal Highway Administration and maintained by the California Department of
Transportation (Caltrans). Exhibit 2 depicts the current California Road System Maps
covering the City of Carmel-By-The-Sea.
If a local street or roadway is not indicated on the California Road System Maps, CVC
Section 40802(b) also allows local streets and roads to be defined as those roadways that
meet the following four conditions:
Primarily provides access to abutting residential property;
Roadway width of not more than 40 feet;
Not more than one-half mile of uninterrupted length. Interruptions shall include
official traffic control devices; and
Not more than one traffic lane in each direction.
As noted in CVC Section 40802(a), roadways meeting either of the above CVC
definitions for local streets and roadways are categorically exempt from any of the speed
trap provisions within Section 40802. This means that the City of Carmel-By-The-Sea
may enforce speed limits on local streets and roads meeting either definition without first
performing an engineering and traffic survey (i.e. speed survey). However, enforcement
on local streets would still be based upon the Basic Speed Law (i.e. 85th percentile).

Note: A jurisdiction' s functional classification of a local street or roadway has no
bearing on whether the roadway actually meets either of the CVC definitions. For
example, if there is a discrepancy in functi on classification between the city's General
Plan and the California Road System Maps, the California Road System Maps is the
controlli ng definition. It is therefore important that cities submit their roadway
classifications to Cal trans after adoption of city General Plan revisions.
3. Narrow Streets
CVC Section 22358.3 states that roadways not exceeding 25 feet in width that are also
located in business districts, residential districts, or in publ ic parks can be signed at either
20 or 15 MPH if a speed survey identifies that such speed limits are reasonable and safe.
In addition, school speed zones can be established along roadways that border schools. Per CVC
Section 22352, school speed zones can be signed at 25 MPH for a distance of up to 500 feet in
either direction of the school grounds. If the posted speed limi t outside of school hours on a
roadway bordering a school in a residential district is 30 MPH or less, CVC Section 22358.4
allows for the school speed zone to be signed at either a) 15 MPH; or b) for the school zone speed
limit signs to be placed within I ,000 feet of the school grounds if signed at 25 MPH. CVC
Section 22352 also allows speed li mits to be established at 25 MPH in front of senior centers.
Note: School speed zones are only in effect when students are near or in the vicinity of the
roadway. During other times, the speed limit defaults to the amount otherwise established by a
speed survey or statute.
E. Procedures to Establish Speed Limits
The CA MUTCD summari zes the CVC procedures to select an appropriate speed limit for a
roadway. Normally, the speed limit is to be establi shed at the nearest 5 mile-per-hour (MPH)
increment of the 85

-percentile speed, a.k.a. critical speed. (The 85

"-percentile speed, also
known as the critical speed, is defined as the speed at which 85% of all surveyed drivers are
traveling at or below.) Note that this procedure could result in a speed limit either below or
above the critical speed. Two examples follow:
Example I: For a criti cal speed of 27 MPH, the nearest 5 MPH increment is 25 MPH, and thus
the speed limit would be established at 25 MPH.
Example 2: For a critical speed of 28 MPH, the nearest 5 MPH increment is 30 MPH, and thus
the speed limit would be established at 30 MPH.
The CA MUTCD and CVC provide for three speed reductions that can supplement these
procedures. Each reduction method is summarized below.
Reduction # 1 -Residential Density:
CVC Section 627 allows for the consideration of residential and commercial building densities
when determining speed limits, as long as said densities meet or exceed specific thresholds. The
CA MUTCD provides further guidance, allowing for a specific speed reduction of 5 MPH to be
applied to the nearest 5 MPH increment of the criti cal speed if either of the foll owing buildi ng
densities currently exists along a roadway:
I . The density of separate dwelling houses or business structures contiguous along one
side of a roadway is at least 13 houses or structures per 0.25 miles; or

2. The density of separate dwelling houses or business structures contiguous along both
sides of a roadway is at least 16 houses or structures per 0.25 mi les.
Note that the above speed reduction can only be applied after the critical speed has been initially
adjusted. For example, for a critical speed of 28 MPH, the critical speed would normally be
adjusted to 30 MPH. If the densities 'hithin Reduction #1 are applicable, then the initial 30 MPH
speed recommendation could be reduced by 5 MPH to a final recommendation of25 MPH.
Reduction #2 - Pedestrian and Bicycle Safety
The eA MUTeD and eve Section 627 state that pedestrian and bicyclist safety can also be used
as justification for keeping a speed limit low. No specific criteria is provided in either document
for use in this justification; however, in the spirit of the other guidance and statutes in the
eA MUTCD and eve, it is recommended that reductions be limited to no more than 5 MPH and
that they be limited to roadways with moderate to heavy pedestrian and bicycle activity, such as
near schools, parks, and other public gathering areas, as well as along obvious and established
routes to schools. The factors which can enter into this decision process can include roadway
geometry (including changes in horizontal and vertical profile); colli sion histories; lack of
sidewalks or bicycle lanes, and any highway, traffic, or roadway conditions not readily apparent
to the driver.
Similar to Reduction #I, Reduction #2 can only be applied after the critical speed has been
initially adjusted.
Reduction #3 -Exception for Adjustment of Critical Speed
The CVe contains an exception to the eA MUTeD procedure to establish a speed limit from the
critical speed (i.e. 85

h percentile speed). Section 21400(b)

of the CVC allows for the speed limit
of a roadway to be rounded down to the nearest 5 MPH increment below the critical speed, as
long as the speed limit would have otherwise been rounded up to the 5 MPH increment above the
critical speed. If this reducti on is applied to the critical speed, no additional reductions can be
made. This means that if Reduction #3 is applied, neither Reductions # 1 or #2 could be applied
afterwards, regardless of whether or not the criteria for those other reductions are met. Two
examples ofthis reduction follow:
Example 1: For a critical speed of 28 MPH, instead of rounding up to 30 MPH (the nearest
5 MPH increment), the speed limit could be rounded down to 25 MPH using Reduction #3, but
no further reductions could be taken.
Example 2: For a critical speed of27 MPH, the nearest 5 MPH increment would be 25 MPH - a
speed lower than the critical speed - and thus Reduction #3 would not appl y. However,
Reductions# I or #2 could still be applied if their criteria are met.
Finally, theCA MUTCD also states that other factors can be used in establishing speed limits on
city and county roadways, including the most recent 2-year coll ision record, roadway design
speed, sight distance, intersection spacing and offsets, and commercial driveway characteristics.

F. Recommended Speed Limits
Table 2 summari zes the recommended speed limits along the ten study locations. Conditions and
recommended speed limits are discussed below, including factors that explain the reasoning
behind any speed reductions taken. The existing speed limits are indicated in parentheses next to
each segment. (See Appendix A for individual field survey sheets.)
The speed limit recommendations are as follows (with existing speed li mits in parentheses) :
1. Delores Street- City Limits to 4th Avenue (15 MPH)
This roadway is in a residential neighborhood near a school and has an average pavement
width of24 feet along its entire length. On-street parking is allowed sporadically in both
directions of the roadway, more so at the more northerly end of the segment.
No sidewalks are present along the street. Due to the relative narrowness of the roadway,
continued use of a 15 MPH speed limit is considered reasonable and safe, in accordance
with CVC Section 22358.3. For these reasons, it is recommended that the speed limit
remain at 15 MPH.
2. Mountain View Avenue - Ocean Avenue to Forest Road (15 MPH)
This roadway is in a residential neighborhood. On-street parking is generally allowed in
both directions of the roadway, although parking is limited in certain directions at the
more central and southeasterly ends of the street. No sidewalks or bicycle lanes are
present on the street. Sight distance at some of the intersections along this street is
constrained due to the skewed angles at which Mountai n View Avenue intersects its cross
streets. Although the total pavement widths along the street vary between 28 and 30 feet,
designated on-street parking spaces have been carved out from this width in both
directions. The presence of the on-street parking reduces the traveled way (i.e. drivable
width) of the street to between 15.5 and 19 feet. Due to the narrowness of the traveled
way, continued use of a 15 MPH speed limit is considered reasonable and safe, in
accordance with eve Section 22358.3. For all these reasons, it is recommended that the
speed limit remain at 15 MPH.
3. San Antonio Street- ff" Avenue to Santa Lucia Avenue (25 MPH)
The critica l speed is between 26 and 27 MPH, which would require a speed limit of 25
MPH - thi s matches the existi ng signed speed limit. Therefore, it is recommended that
the existing 25 MPH speed limit be retai ned.
4. San Antonio Street- 2nd Avenue to 4th Avenue (20 MPH)
This roadway is in a res idential neighborhood and has an average pavement width of
25 feet along its entire length, with some areas as narrow as 22.5 feet in width. On-street
parking is not allowed on this roadway, likely due to the lack of any shoulders along the
street. While there is a southbound path adjacent to the roadway, there is no northbound
path or sidewalk. Most driveways are partially hidden by small private walls of about
two feet in height along the property edge fronting the street. Due to the curvature of the
roadway at its southern end, two driveways are completely hidden from the view of
northbound vehicles; a sign alerting traffic to this condition is posted at the far south end
of the street (facing northbound traffic). Due to these issues and the relative narrowness

ofthe roadway, continued use of a 20 MPH speed limit is considered reasonable and safe,
in accordance with eve Section 22358.3. For all of these reasons, it is recommended
that the speed limit remain at 20 MPH.
5. Junipero Street - I 2

A venue to I J" A venue (2 5 MPH)
The critical speed is between 28 and 31 MPH, 3 to 6 MPH above the current speed limit;
thi s would normally require a speed limit of 30 MPH. No sidewalks are present along the
street in either direction. However, the roadway is in a residential neighborhood of
sufficient building density to meet the requirements of eve Section 627; therefore, it is
recommended that the existing speed limit of25 MPH be retained.
6. Ocean Avenue - Junipero Street to Carpenter Street (25 MPH)
The critical speed is between 30 and 31 MPH, 5 to 6 MPH above the current speed limit;
this would normally require a speed limit of 30 MPH. However, the roadway is in a
residential neighborhood of sufficient building density to meet the requirements of eve
Section 627 and largely lacks sidewalks in both directions of the roadway; therefore, it is
recommended that the existing speed limit of25 MPH be retained.
7. Ocean Avenue- Monte Verde Street to San Antonio Street (25 MPH)
The critical speed is between 24 and 26 MPH, which would require a speed limit of 25
MPH- this matches the existing signed speed limit. Therefore, it is recommended that
the existing 25 MPH speed limit be retained.
8. San Carlos Street - (jh Avenue to Santa Lucia Avenue (25 MPH)
The critical speed is between 32 and 33 MPH, 7 to 8 MPH above the current speed limit;
this would normally require a speed limit of 30 MPH. However, the roadway is in a
residential nei ghborhood of sufficient building dens ity to meet the requirements of eve
Section 627 and largely lacks a southbound sidewalk or side path; therefore, it is
recommended that the existing speed limit of25 MPH be retained.
9. Carpenter Street - 1"

Avenue to Ocean Avenue (25 MPH)
The critical speed is between 31 and 33 MPH, 6 to 8 MPH above the current speed li mit;
this would normally require a speed limit of 30 MPH. However, the roadway is in a
residential neighborhood of suffici ent building density to meet the requirements of eve
Section 627, and the roadway lacks a northbound sidewalk and the southbound sidewalk
is large di scontinuous; therefore, it is recommended that the existing speed limit of 25
MPH be retained.
I 0. Rio Road - Santa Lucia Avenue to Atherton Drive (25 MPH)
The critical speed is between 30 and 31 MPH, 5 to 6 MPH above the current speed limit;
thi s would normally require a speed limit of 30 MPH. However, thi s roadway, which
fronts an elementary school , lacks pedestrian sidewalks/pathways for much of its length
and does not have any bicycle lanes. In addition, the roadway segments to the north and
south of this segment are also signed at 25 MPH - changing the speed limit to 30 MPH

would create a discontinuity in travel speeds. For these reasons, it is recommended that
the speed limit remain at 25 MPH.
G. Conclusion
In summary, it is recommended that the speed limits on all ten evaluated roadways remain at their
current levels.

10.12.010 Miscellaneous Streets.
The speed limits set forth in this chapter are determined to be reasonable and
safe, and most appropriate to facilitate the orderly movement of vehicular traffic
in the City. The prima facie speed limit for these streets, or portions thereof, shall
be as follows when signs are erected giving notice thereof:
A Fifteen Miles per Hour.
1. Dolores Street- That portion of Dolores Street, between Vista Street and
Fourth Avenue.
2. Fourth Avenue - That portion of Fourth Avenue, between Lincoln Street
and Dolores Street.
3. Lincoln Street- That portion of Lincoln Street, between Fourth Avenue
and Fifth Avenue.
4. Mountain View Avenue- That portion of Mountain View Avenue,
between Ocean Avenue and Forest Avenue.
5. Scenic Road- That portion of Scenic Road, between Ocean Avenue and
Santa Lucia Street.
B. Twenty Miles per Hour.
1. San Antonio Avenue- That portion of San Antonio Avenue, between
Fourth Avenue and Second Avenue.
C. Twenty-Five Miles per Hour.
1. Camino Del Monte Avenue- That portion of Camino Del Monte Avenue,
beginning at a point on the Carmel-by-the-Sea City limits line, north of First
Street and thence running southerly for a distance of 1 ,944 feet more or
less to the centerline of San Carlos Street.

2. Junipero Avenue- That portion of Junipero Avenue, between Rio Road
to Camino Del Monte Avenue.
3. Ocean Avenue- That portion of Ocean Avenue, beginning at a point on
the Carmel-by-the-Sea city limits line, east of Carpenter Street and thence
running westerly for a distance of 4,856 feet more or less to the centerline
of Del Mar Avenue.
4. San Antonio Avenue- That portion of San Antonio Avenue, between

10. Second Avenue -That portion of Second Avenue, between Carpenter
