(1)(a) A, a builder, contracts to erect and finish a house by the first of January , in order that B may give possession of it at that time to C, to whom B has contracted to let it. A is informed of the contract between B and C. A builds the house so badly that before first of January, it falls down and has to be rebuilt by B.In the consequence, B loses the rent which he was to have received from C, and is obliged to make compensation to C for breach of contract. Advise B, of his rights against A. 4 (b) Unpaid seller can exercise his right of lien only till the ownership is passed to the buyer. Comment. 1 (2) (a) Mr. Rich, holds 30% shares of XYZ Ltd. The Board of Directors of XYZ Ltd. in its collective wisdom wants to sell a plot of land belonging to it and lying idle, admeasuring 100 acres, to ease the company of the difficult cash flow situation, the company is facing. Mr. Rich argues that since he holds 30% shares of the company, he is also a part owner of the aforesaid property and consequently his consent should also be obtained before the sale. Please advise the Board of Directors suitably. 4 (b) Contract of Indemnity covers all the losses suffered by the Indemnified. Comment. 1 (3) (a) A is the tenant in a building of which B is the landlord. The lease agreement entered into between A and B did not contain any provision for cleaning, repairing and maintenance of building by the landlord B. A wants to file a consumer complaint against the landlord for compensation for omission to render the said services. Advise A whether he can file a consumer case. (b) State whether a winner of the lottery is a consumer. (c) State whether the purchaser of equipment for using it by himself in the practice of a profession himself is a consumer . (4) (a) An open order cheque has been drawn in favour of Parag, and Parag, in turn, signs on the back of it, without mentioning any specific name above his signature. Can Hiranya, the holder of the cheque, receive the cash payment of the cheque from the paying banker, without his name being mentioned as an endorsee thereon? Give reason for your answer. (b) State whether the following statements are true or false with skeleton answers:(i) illegal agreement and void agreements are the same. (ii) A voidable contract is valid till the aggrieved party opts to avoid it
