Q: Who/what group initiated to make the necessary amendments to R.A. 545? A: From the beginning, UAP took the cudgels of trying to amend Republic Act No. 545 Q: Who initiated in bringing this to congress? A: UAP was the principal proponent and PIA was the collaborating partner. What brought about the repeal of R.A. 545 with the following reasons: To limit the practice of Architecture to architects. To rectify the use of obsolete terminologies. To address the need for globalization and keep attune to the needs of the time. R.A. 545 was inadequate in responding to the current needs of the architect and the architecture profession. To address the need for unity among architects in the country. Q: Can you list the sequence of events before the approval of R.A. 9266? A: The sequence of events (on the part of UAP) is as follows: A panel of negotiators from UAP and PIA started the dialogue involving R.A. 545. UAP initiated the move while PIA served as the collaborating partner. Dialogue between UAP and PIA and other organizations (AAIF, CCAPP, BOA) Joint Communiqu with PIA and 3 other organizations was crafted and signed on January 17, 2003. Joint resolution with PICE (September 23, 2003) and other allied professional organizations endorsing House Bill No. 5389 and Senate Bill No. 2710. Q: Why was R.A. 545 repealed and not just amended? A: Since most of the sections need to be amended and new sections are to be introduced for inclusion, it is best to repeal it. Q: Why is it called The Architecture Act of 2004 and not of 2003 when the amendment was initiated on the 28th day of July 2003? A: The reference is the year when it was approved and signed into law by the President of the Republic of the Philippines. Her Excellency Gloria Macapagal Arroyo on March 17, 2004. Q: Which government entity is responsible in regulating the practice of architecture? A: The government entity that is responsible in regulating the practice of architecture is the Professional Regulation Commission (PRC) through the Board of Architecture (BOA).

Q: How can PRC-BOA develop and nurture competent, virtuous, productive and well-rounded professional architects? A: Through regulatory measures, programs and activities that foster their professional growth and development such as Continuing Professional Development programs in coordination with IAPOA. Q: If architects take into account the environment aspect will this not be in conflict with the practice of Environmental Planners? A: The practice of architecture is not in conflict with the practice of environmental planners because the environmental aspect is a necessary requirement for the architects to consider. Q: Does a registered and licensed architect mean one and the same? A: Yes. An architect must be both licensed and registered. Q: How can an architect be academically qualified? A: He must be a holder of Bachelor of Science in Architecture conferred by school accredited by CHED. Q: Can the Architect-of-Record be held liable under Article 1723 of the New Civil Code of the Philippines? A: Yes. The Architect-of-Record shall be held liable under Article 1723 of the New Civil Code of the Philippines. Q: Can the term Architect and Architect-of-Record be used interchangeably? A: No. The Architect is a generic word while Architect-of-Record is a specific function of a professional architect. Q: Will the Architect-of-Record be criminally liable with regards to the plans, projects and contracts he signed and sealed? A: Yes. The Architect-of-Record assumes the civil liability for the plans, specifications and contract documents he has signed and sealed. Q: Can an Architect be the Architect-of-Record and Architect-in-Charge of construction at the same time? A: Yes. An architect can be the Architect-of-Record and Architect-in-Charge of construction at the same time. Q: If there are two architects on a certain project, the Architect-of-Record and the Architect-in-Charge of construction, the building collapses, who is more liable? Can one sue the liable party? A: It will depend on the investigation. Q: Who shall determine that a particular architect is a recognized expert of a certain field in Architecture? A: As of this writing, none yet. The IAPOA will devise a program for that. Q: Is the word author defined in this section the same as the Architectin-Charge? A: No. The Architect-of-Record is the Author.

Q: Diversified Architectural Experience has been defined as a post baccalaureate; pre-licensure experience is required and, as such, would an OJT or industry, immersion subjects offered in the curriculum be considered and be listed in the logbook? A: It will not be considered. This provision means that the experience gained during OJT can no longer be part of the diversified experience required before examination. The two years experience must be acquired after graduation. Q: Can experience obtained during their schooling years be credited as postbaccalaureate experience? A: No. Only 2005 graduates and thereafter are required to have the two-year post-baccalaureate experience. Q: What about a graduate who worked abroad and has acquired extensive training in the different phases of architectural works but has no Filipino architect to vouch for him/her? A: No. The mentor architect must have an IAPOA? Q: Why was structural designing as part of the general practice of architecture changed to structural conceptualization? A: A change was made because, essentially, the architect does the conceptualization or qualitative aspect of the structural design and not the quantitative analysis and computation. Q: What is an Architectural Company? A: An Architectural Company is a judicial entity that shall be synonymous with an Architectural Partnership registered with the SEC. Q: What is an Architectural Corporation? A: An Architectural corporation I a group of professionals in architecture and allied profession, incorporated with Architects for the purpose of delivering professional service in architecture and allied professions; in case an existing Architectural Corporation does not comply with the 75% composition requirement, it shall comply and register again with the SEC and the BOA. Q: What are Architectural Documents? A: Architectural Documents are architectural drawings, specifications, and other outputs of an Architect that only an Architect can sign and seal consisting, among others, of vicinity maps, site development plans, architectural program, perspective, drawings, architectural floor plans, elevations, sections, ceiling plans, schedules, detailed drawings, technical specifications and cost estimates, and other instruments of service in any form.

Q: What is Architectural Interiors? A: Architectural Interiors means a detailed planning and design of the indoor/enclosed areas of any proposed building/structure, including retrofit or renovation work and which shall cover all architectural and utility aspects, including the architectural lay-outing of all building engineering systems found therein. Q: What is Architectural Partnership? A: Architectural Partnership means a group of two or more Architects duly registered with the SEC and then with the Board of Architecture. Q: What is Architectural Plans? A: Architectural Plans means a two (2) dimensional representations reflecting a proposed development/redevelopment of an enclosed/ semi-enclosed or open area showing features or elements such as columns, walls, partitions, ceiling, stairs, doors, windows, floors, roof, room designations, door and window callouts, the architectural layout of equipment, furnishings, furniture and the like, specifications callouts, elevation references, drawing references and the like; the architectural plan is the representation of a lateral section for a proposed building/structure (running parallel to the ground) and at a height of from 1.0-1.5 meters above the finished floor; the term may also collectively refer to other architectural designs such as cross/ longitudinal sections, elevations, roof plan, reflected ceiling plan; detailed sections and elevations showing architectural interiors, other architectural finishing schedules and the like. Q: What is Building? A: Building means a structure for the purpose and function of habitation and other uses. Q: What is a Certificate of Registration? A: A Certificate of Registration means a certificate bearing a registration number, issued to an individual, by the Professional Regulation Commission through the Board of Architecture, signifying that the individual has successfully passed the Licensure Examination and is registered to practice his/her profession as Architect. Q: What is the Code of Ethical Conduct? A: A Code of Ethical Conduct means a document which forms part of the Architects National Code which contains the norms and principles governing the practice of the profession of architecture in the highest standards of ethical conduct. Q: What is a Consulting Architect? A: A consulting Architect is a registered and licensed Architect, who is academically and professionally qualified, and with exceptional or recognized expertise or specialization in any branch of architecture; the Consulting Architect assumes no civil and/or succeeds to interfere or contravene the legal and professional functions of the Architect-of-Record; the Consulting Architect assumes the normal civil liability under the service agreement he/she signs with a Client.

Q: What is Contract Documents? A: Contract Documents are the documents attached to the additions, deletion and modifications incorporated therein. These generally include the following documents: Special Provisions of conditions General Conditions Drawings Specifications Other Bid Documents Q: What is a Copyright? A: A Copyright or Copyright Ownership refers to the intellectual proprietary rights retained by an Architect over any architectural documents/ work that he/she prepares unless there is a written stipulation to the contrary, copyright in a work of architecture shall include the right to control the erection of any building which reproduces the whole or a substantial part of the work either in its original form or in any form recognizably derived from the original; however, the copyright in any such work shall not include the right to control the reconstruction or rehabilitation in the same style as the original of a building to which the copyright relates. Q: What is CPD Providers? A: CPD Providers means an entities, agencies, organizations and the like that have been accredited/registered with the Board of Architecture of the Professional Regulation Commission to deliver seminars, lectures, and other continuing professional education modules for architects, other than the Integrated and Accredited Professional Organization of Architects which is automatically accredited by the Board of Architecture as a CPD Provider. Q: What is a diversified Architectural Experience? A: Diversified Architectural Experience is a post-baccalaureate pre-licensure experience of two (2) years required of a graduate of architecture prior to taking the licensure examination, consisting of a variation of experiences in the different phases or architectural service. Q: What is a Foreign Architect? A: A Foreign Architect is an architect who is not a Filipino citizen nor an Architect registered and licensed in the Philippines but who is duly registered and licensed in his/her home country as an Architect. Q: What is a Filipino Counterpart? A: Filipino Counterpart is the local Philippine architect, partnership or corporation that must work in association with a foreign architect, partnership or corporation, on a project on Philippine soil. Q: What is Ownership? A: Ownership refer to propriety rights to an architectural work such as plans, designs and other documents by a person/juridical entity who commissions the Architect and whose ownership of an architectural work by such a person/juridical entity shall only be confined to the use of the architectural documents for executing/implementing the work described therein for one (1) or the original project; ownership shall not apply to the use of

a part of or of the entire architectural work/ architectural documents to repetitions or to subsequent projects. Q: What is Planning? A: Planning refers to physical planning at site, community or urban level by an Architect. Q: What is a Physical Planner? A: Physical Planner refers to an Architect who specializes in the detailed physical planning of land or property on which vertical structures such as buildings and/or structures and horizontal developments such as right-of-way, open spaces and recreational/ sports/ entertainment/ tourism and related facilities are to be proposed. Q: What is Physical Planning? A: Physical Planning is the detailed physical planning of land or property on which vertical structures such as buildings, monuments and/or structures and horizontal developments such as rights-of-ways, open spaces and recreational/ sports/ establishments/ tourism and related facilities are to be proposed. Q: What is Professional? A: Professional refers to a person whose name and registration/professional license number is entered in the Professional Regulation Commission registry book and computerized database as one legally authorized to practice. Q: What is Site Planning? A: Site Planning the detailed site development planning of all areas surrounding a building/structure and/or a group of buildings /structures but only within the property limits of the land on which such buildings/structures are to be erected. Q: What is Standards of Professional Practice? A: Standard of Professional Practice means a document embodied in the Architects National Code, which defines all aspects of professional service, prescribes minimum basic fees and establishes the rights and obligation of both the Architect and the client. Q: What is Sole Proprietorship? A: Sole Proprietorship means an individual Architect practicing and delivering architectural services, duly registered with DTI, BOA and the PRC. Q: What is Specialization? A: Specialization an expertise and special knowledge in the field of architecture acquired by an Architect through formal education and training or through continuing professional development and experience, for which the Architect may be engaged as Consulting Architect. Q: What is Syllabi? A: Syllabi is the outlines embodying topics and concepts of major subjects prescribed in specific course of study to serve as basis for test questions in the licensure examinations. Q: What is Technology Transfer? Q: What is Urban Design? A: Urban Design is a physical and systematic design undertaken by an Architect on a community and urban plane, more comprehensive than, and an extension of the architecture of buildings, space between buildings, entourage, utilities and movement systems. Q: What is the new procedure in selecting the Board Examiners? A: As far as the selection of the members of the Board of Architecture, it is well defined by Executive Order No. 490 which states that the selection of the members of the Board of Architecture rests on the shoulders of the five (5) Immediate Past National Presidents of the accredited national organization of architects who will screen and evaluate their qualifications. Once endorsed by the Accredited National Organization of Architects to the PRC, they will be interviewed individually by the Commissioners/s of the PRC who thereafter selects the three that will be submitted to the Office of the President for appointment. Q: During his term as an elevated officer of the IAPOA or other professional organization of architects, can he/she be a member of the Board of Architecture? A: No. The elective officer cannot be nominated as member of the Board of Architecture not unless he/she resigns from the said elective position prior to his/her appointment. Q: Can the incumbent members of the Board of Architecture be appointed as members of the First Board of Architecture under this Act? A: Yes, according to Rule 2 Section 6 of the IRR of the R.A. 9266, the incumbent members of the Board of Architecture may be appointed as members of the First Board of Architecture under this Act. Q: What are the official grounds for the suspension of removal of the Certificate of Registration of an Architect? A: The official grounds for suspension or removal of the Certificate of registration of an Architect are as follows: a. has signed and affixed or permitted to be signed and affixed his/her name or seal on all architectural documents or work not prepared by him /her or not executed under his/her immediate supervision; or b. His paid money except the regular fees provided for to secure a Certificate of Registration; or c. Has falsely impersonated a practitioner d. Has aided any person not duly authorized to practice architecture in the Philippines; or e. Has undertaken architectural services without a valid service agreement stating the compensation of services, or acts being prejudicial to other architects registered and licensed under his Act and inimical to the interest of the profession; or f. Has violated any provision of this Act, its IRR, the Code of Ethical Conduct and Standards of professional Practice. Q: Are the measures to monitor the conditions affecting the practice of Architecture in place? A: Yes. The Board of Architecture has already issued policies and measures to effectively monitor the practice of Architecture through the following: a. Issuance of Board Resolution No. 02, series of 2005 dated April 27, 2005 requiring registered and licensed architects to submit their valid certificate of UAP-IAPOA membership and Official Payment Receipts for annual/lifetime membership dues as a pre-requisite for issuance of

Certificate of registration and Professional Identification Card as architect or for renewal of the foregoing cards. b. Issuance of Board of Resolution No. 04, series of Domestic Construction, Construction Industry Arbitration; National Bureau of Investigation, Philippines National Police for the effective enforcement of the provisions of R.A. 9266 and its IRR including related laws and policies issued by the PRC and Board of Architecture. 2005 dated December 6, 2005, effecting the adaptation of the Logbook of Diversified Architectural Experience, a document formulated by the UAPIAPOA c. Issuance if Board Resolution No. 05, series of 2005 dated December 22, 2005, prescribing the design, size, and contents of the Dry Seal for use by a duly licensed architect. d. Issuance of Board Memorandum Circular No. 2005-08, series of 2005 dated July 5, 2005, enjoining all government departments, such as Justice, Foreign Affairs, Health, Interior and Local Government, Public Works and Highways, Budget and Management. Trade and Industry, Labor and Employment; these Commissions: Civil Service, Security and Exchange; these Boards: Philippines Q: Does the power of the Board to issue a subpoena include the power to cite a person in contempt? A: Yes. Refer to Rule II, Section 7, IRR of R.A. 9266. Q: Is CPD a mandatory requirement for the renewal of the Professional identification Card (PIC)? A: No although the CPD shall not be mandatory requirement for the renewal of the professional identification card, there is a new circular/memorandum from the PRC requiring all architects to have 60 units of CPD in three (3) years time. During a meeting of the CPE Council, the Council was informed that CPE units shall be a requirement to renew the professional identification card. The trend is that PRC is entering into Memorandum of Agreement with many institutions especially with big private corporations as well as those corporations owned by government, that, for an architect to be hired, he has to show proof that he is a professional by the way of the professional identification card. Q: Is the Board of Architecture supporting the full-computerization program of the PRC? A: On the matter pertaining to full computerization of the licensure examination, this provision was introduced by the PRC since the PRC aims for the full computerization of the licensure examination for all professional regulatory boards under the administration supervision of PRC. The Board of Architecture is strongly supporting the full computerization program of the PRC, including architectural design examination however, it would take time to implement due to academic and economic reasons. Q: Can the acts of a member of the Board be questions by the Commission? A: Yes Q: Is the adverse decision of the Commission appealable? A: Yes. At the Court of Appeals Q: What are the crimes involving moral turpitude? A: Rape, bigamy, falsification of public documents immoral acts, etc. Q: If a Board Member manipulated or rigged the licensure examination results, disclose secrets and confidential information, will the Board Member be criminally liable aside from the removal from office? Who has the right to file the case?

A: Yes anybody with evidence can file the case. Q: Can the PRC Board of Architecture conduct licensure examination outside Metro Manila? A: Yes. The phrase added to this provision was to be given by the Boards at least twice a year, such as in Metro Manila and other places as the Commission may designate in accordance with the provisions of R.A. No. 8981. The interior for the addition of this phrase is so that, under the law, it now allows the PRC-BOA to conduct licensure examination twice and outside of Metro manila. This specific provision is in due consideration of the clamor of our members in Cebu and the Board of Architecture might prepare itself to conduct examinations either in Cebu or in Mindanao. Q: Is it possible for a person who has earned a degree in Architecture to take up a Masters degree in Architecture even if he has yet to become a board passer? A: Yes Q: Will the applicant be allowed to take the examination if he has a case on appeal? A: If there is a court ruling on this matter, No. Q: If the examinee was convicted of a crime involving moral turpitude that was not final and executor and still on appeal, will the Board have the power to refuse the issuance of the Certificate of registration? A: Yes. Q: What are the documents to be submitted in applying for examination? Q: What is the description of the Theory and Principles of Planning? A: The rationale and description of the Theory and Principles of Planning Are: Analysis of the concepts and techniques in the general planning process, regional planning, land use planning, and human settlements planning; Understanding of the art and science of site planning with emphasis on ecological, socio-psychological, aesthetic, and functional basis of site planning. Q: What is the rationale and description of the Structural Design? Q: Why is there a need to include Structural Design in the examination wherein our law only provides Structural Conceptualization? A: a). Even there is no need for architects to do quantitative analysis but there is a need for architects to have a working knowledge in Structural Design. b). There are two schools of thought regarding this conceptualization because the question is How can you conceptualize structures if you do not know structural design? So, if you are conceptualizing structures, you must base it intelligently on structural theories. So, the agreement is that, structural subject is important in order to provide the architect tools for conceptualization of structures. Q: Can the Board revise or exclude any of the subjects and their syllabi? A: The Board, subject to the approval of the Commission, may revise or exclude any of the subjects and their syllabi, and add new ones as the need arises to conform to technological changes brought about by continuing trends in the profession. Q: If a successful candidate in the examination was not able to take his oath before any member if the Board of any authorized representative, can he/she still practice the profession? A: No. A successful candidate in the examination who was not able to take his oath before the Board of any authorized representative cannot practice the architecture profession? Q: Why is there a need to renew the Professional Identification Card when the registration issued to a professional is for lifetime? A: The reissuance or renewal of the Professional Identification Card is a requirement of the PRC. Q: What is the policy of the Board on the renewal or reissuance of the Professional Identification Card? A: A Professional Identification Card bearing the registration number, date of issuance expiry date, duly signed by the chairperson of the Commission, shall likewise be issued to every registrant who has paid the prescribe fee of annual registration for three (3) years; Provided, That, the reissuance or renewal of the annual of the said card shall be subject to payment of the annual registration fee for another and every after three (3) years. Q: Can anyone request from the PRC the roster of architects? A: Yes Q: In case of death of the Architect-of-Record, who can give official provisions to reproduce his plans? A: Nobody

Q: In case of a discontinue project, can anybody use the architectural documents without the consent of the architect? A: No. whether the object for which they are made is executed or not, it shall be unlawful for any person, without the consent of the architect or author of the said documents, to duplicate or to make copies of said documents for use in the repetition of and for other projects or buildings, whether executed partly or in whole. Q: Is the charitable act of pro bono included as violation? A: No. Q: It is stated therein that the decision of the Board with regards to the revocation of the Certificate of Registration is appealable with the Commission. While the appeal is being heard, will Architect be given a temporary or special certificate of registration? A: Yes, it depends on the violation. Q: Does the IAPOA have the power to file criminal and civil charges against a dishonest architect? A: Yes. Q: Can foreign architect practice architecture in the Philippines? A: Yes, however, a foreign architect or any person not authorized to practice architecture shall be deemed engaged in the unauthorized practice of architecture. Further, foreign architects may only engage on the practice of architecture in accordance with the provision of Section 39 of this Act. Q: Can a foreign citizen be allowed to take the Licensure Examination for Architects? A: Yes, a foreign citizen whether he studied in the Philippines or not, may be allowed to take the Licensure Examination for Architects through reciprocity. Q: How will the Board of Architects allow the foreign applicant to take the Licensure Examination for Architects? A: The foreign applicant shall initiate the establishment of reciprocity between his country/ state and the Philippines by presenting/ submitting a letter or any document signed and under official seal by the appropriate official of his country/ state requesting the Chairman of the Board of Architecture to allow a foreign applicant to take the Licensure Examination of the Board. Q: If the letter/ document and the copy of the law submitted by the applicant is Satisfactory to the Board, what are the necessary documents to be submitted by the foreign applicant to take the Licensure Examination for Architects? A: The foreign applicant shall be allowed to take the Licensure Examination for Architects by requiring him to file an application to take the Licensure Examination and by submitting the following documents that shall accompany the application: a. Situational Problems
1. A project is about 60% completed when the owner begins receiving field reports from the architect stating that the contractor is failing to properly supervise the job, resulting in incorrect work. After several weeks of this the owner becomes worried and asks the architect what to do. What should be done if the work is not being performed under the terms and conditions of the BUILDING CONTRACT? a. After receiving the architects field reports, the owner should stop the work and arrange for a meeting between the owner, architect and contractor to determine the cause of the problems and what the contractor intends to do. If the contractor does not correct the work, the owner should carry out the work with other contractors and deduct the cost by change order from the original contractors construction cost. b. The architect should recommend that the owner give the contractor written notice of non-conformance with the contract documents, and if, after seven days the contractor has not begun corrective measures, terminate the contract c. The architect and owner should discuss the problem to see if the owner would be willing to accept it in exchange for a reduction in the contract sum. If not, the owner should give seven days written notice to terminate the contract, and find another contractor to finish the job. d. The architect should, with the owners knowledge, reject nonconforming work and notify the contractor that it must be corrected promptly. The architect should then remind the owner can have the work corrected after giving the contractor two (2) seven day written notices to correct the work. Situation A: An architect administered apprentice A & B to be working for a 3-storey residence, apprentice A being the site supervisor and apprentice B in-charge of doing the production of working drawings, as the project for a design-build project. The architect was so busy with his other projects and that he trusted everything to both apprentice A & B. Upon the progress of the project, work went well until the architect found out that there was part of the house that was not followed as per plan because of some discrepancies that were present in the construction drawings.

Upon investigation, they found out that there were some discrepancies on the installation of the ceiling, the client was very angry and he is blaming the architect. The architect on his part blamed his staff the site supervisor and the workers, now everybody is pointing fingers.
