At issue is the current value of The Scooter Store Employee Stock Ownership Plan, or ESOP, of which the nearly 3,000 plaintiffs in the case have no idea. The ESOP was the plan that compensated Store employees with stock in the company, to make them feel like employee-owners. In 2008, it was worth $36.9 million. At the end of 2011, it was worth $7.5 million. Ouch. Like we said, nobody is saying what its worth now, but after an FBI raid and a bankruptcy filing, well, its probably not much. Harrison responded to the suit on social media with the following quote. As weve said before, this guy is good. Very, very good. He manages to say its not his fault, that he feels bad for everybody, and, as a coup de grce, puts the blame for the losses not on Store executives, but places it firmly on the heads of the people bringing the suit. Remember cult rules dictate that if someone holds the leader responsible, that someone is actually hurting you, and only because they are such a sad, little person, whom we should all pity. Anyway, heres what Doug had to say:

I know that you have all been deeply affected by the recent sad events at The Scooter Store and that you have many more questions than answers. I am considering the possibility of hosting a town hall meeting like we used to have in the good ole days . I cannot officially speak for the company, and I might not have answers to all of your questions, but I would be happy to share with you anything that I can. If you are interested, please post a comment to this message and I will pursue further. Last, but not least, while I believe that this misguided lawsuit has a very high probability of having a negative impact on your receipt of proceeds from your ESOP account, please do not hold this personally against the people involved. I can only assume that - like many of the rest of us - they are hurt, scared, and simply looking for answers. I will continue to reach out to them and Ive already spoken to their attorney to help answer many of their incorrect assumptions. Sincerely, Doug.

The event was part of the New Braunfels Hospitality and Visitors Association (HAVA) membership drive which was a huge success. Uncle Esel, Why is the city spending money to work on sidewalks in downtown? I live on the West End and the sidewalks my kids have to walk on are in horrible shape, and thats where there are sidewalks. In most places there are no sidewalks. Help Us, Melissa
Dear Melissa, The city spent thousands on consultants who made recommendations on the sidewalks, and then the city spent thousands to get specific recommendation on the sidewalks, then the city will spend thousands on engineering the sidewalks. Then they have to come up with the money to actually do the construction. Are you with me so far? The thinking is that sidewalks in the downtown bring in business (which they can) and increase foot traffic thereby creating stronger business environments and, get this, (its important), they generate more tax revenue. Its a sound thought process except for the part about the city also destroying opportunities to create stronger business environments downtown when they also vote down issues because they dont want their friends having to worry about competition or because they dont care for a particular person. This just sends a strong message to people trying to create a downtown business: Dont bother. As for your sidewalks, well, how do you expect to compete when you dont create revenue for the city? I mean if the new sidewalk came with a couple of new restaurants, a snowcone stand and some bail bond companies, then maybe you could get a study requested. Or not. To be fair, the city has at times begged the state or feds to give them money to create sidewalks in neighborhoods, but theyve never hired anyone to create a three inch thick binder on the subject, so those dollars are few and far in between. In reality, in many places like here, the property owner is responsible for their portion of sidewalk on their property but in the public right of way. We dont deal with this much or enforce it, but in the cold states, it is a crime to not shovel snow of the sidewalk in front of your home or to repair it if it is broken. Perhaps if we just required people to have and maintain the sidewalks on their property, then these businesses who profit from the sidewalks would pay for their own and keep them up instead of yet another case of re-distribution of our money. Problem is, that would mean that friends of certain officials would have to pay some of their money for that and we cant have that. Love, K Dear Satyaprakash There has been a lot of talk and allegations about the fact that the former CEO and family got out of the family business and then it falls like some house of cards with talk of fraud and FBI raids followed by the destruction of the lives of over 1500 people from massive layoffs (another lawsuit). I dont suppose a jury could spare much sympathy for those unemployed and penniless 1500 people and their allegation that a former CEO who lives in a multi-million dollar MEGA, MEGA mansion and takes vacations while that house of cards crumbles, after all arent juries made up of millionaires? No, you say? Well then maybe there is something for the former CEO to worry about. You know, sometimes the Securities and Exchange Commission has a problem with these sort of things and we all know what they did to poor Martha Stewart, and she didnt even get around to defrauding Medicare like the Scooter Store did. Dear Jose, I havent been on Facebook much lately and at my age, I dont even remember how to change the picture anyway. I have always been opposed to discrimination of gays and lesbians and I support their right to be treated the same as anyone else. I was always fine with extending benefits to life partners much like heterosexual couples who were common-law married. The only thing I can absolutely say on gay marriage is that it should be up to the states to decide their own issues and not the federal government. I think those boneheads make enough of a mess for us and I wish they would butt out of this idea that they have to define every moral code in this country. I say stand up for equality, ask for what you believe in and let us decide locally. You know the Esel family had two ancestors, both named Hamlin who lived as a gay married couple. Sadly they have no descendants. It is also being reported as I write this column that the first NBA player to come out as gay will be featured in the new Sports Illustrated. Reports say Jason Collins has come out and the impact of a veteran who has played on many teams with many, many players will be quite interesting to watch. Love, K

Dear Mexican: Although Im familiar with your column, I dont read it regularly. But today, I was struck by something you said in a recent column about how Mexicans can make Americans like Mexicans. People from Spain are Caucasian. But in the U.S., educators dont teach you anything about Spain. They downplay Spains impact on this country. Test questions in school always emphasized that the Spanish came here for glory and gold, not to settle this land. So I took 15 trips to Spain over a period of 20 years to explore Spain. Ive written and researched for years to learn who the Spanish really are. And I am here to tell you that I am proud to have a drop of Spanish blood! Do you know where to find the towns of Laredo, Reynosa and Durango? Not only in Mexico, but in the Basque Region of Spain! Yes. The conquistadores named New Spain areas after towns in Spain! So even if we are one-quarter Spanish, we are members of the white race. The Anglo-Americans have succeeded in many ways of shaming Mexicans about their heritage and their ancestry. But I am very proud of being Mexican. I know who we are and I know who I am. The blood in my veins is Indian and Spanish; we are Caucasian as well. If we cant call ourselves white, why can others? Why is it that my friends from Iran, Egypt and Albania check off white when faced with a U.S. application or legal form? How do these groups end up being white and Mexicans dont? Dear Mexican: As a student of history, I believe that Mexicans should be more attuned to speaking English. The Spanish did nothing but enslave and subjugate everybody on this continent. Speaking their language only gives them credit they dont deserve. For all the faults of the U.SA (and there are many, as you know), at least speaking and writing English can open some doors for you here and give you a chance in life. Every immigrant group that ever came over on a boat or crossed the border has had it tough in this country. The ones who couldnt speak fluent English naturally had it tougher. So, as a certified advice columnist, whether or not youre really an hombre or not, you should be advising everyone to at least sign up for the program here. If they dont like whats happening, they can always swear at their boss in Spanish and he or she will never know the difference. But ask for a big fat raise in English.

Like most everyone else, I imagine, I have governmental terrorism, to the argument that been caught up in the coverage of the Boston Israeli reprisals for terrorist attacks are terrorism Marathon bombing. Under no circumstances is themselves. In both cases, one could make a this an event over which to make political hay, legitimate argument that these actions were but the coverage of the bombing brought into poorly planned or even offensively callous, but focus two issues that I feel are worth talking it would simply be inaccurate to say that they about. In both cases, the issues are something targeted innocent civilians. we will have to come to grips with since our country will continue to face attacks like this. Similarly, other groups twist the definition of terrorism to fit their own ends. Both the Aurora, At the same time, I am concerned that we might go too far. In the Boston terror bombing, we have a suspect who is an American citizen, and like it or not, he has rights. We cant allow the government too much leeway, or well find ourselves with no rights at all. I now believe I made a mistake in supporting the passage of the Patriot Act. Like many others, I was convinced that it was needed. In many cases it was, but it has certainly been abused since its passage, and it hasnt solved our terrorism problem. I still support the idea of fighting terrorists and those who support them vigorously. Outside of our borders or when dealing with non-citizens, terrorism should be a foreign policy or even a military issue. That means that terrorists we catch should be treated as enemy combatants. They cant expect to receive the same legal treatment as American citizens. And when we are dealing with nations that support terrorists or sponsor terrorism, it should be clear to them that the consequences will be severe. Such acts are tantamount to war. Terrorists that have citizenship, however, need to be afforded their rights, with one glaring exception. Our government should withhold contact with any legal representation until such time that its convinced that any useful intelligence has been collected. As a trade-off, no evidence collected in such a manner should be available to prosecute the suspect, and the government should be held civilly liable in case where suspects are later found innocent. This would hopefully deter abuses. Interrogation will not be a means by which the government can avoid fair legal proceedings since any information gained will be inadmissible in court. It should also make the government wary about scooping up suspects with dubious evidence since false imprisonment charges would be almost certain to follow. I offer these ideas only as my own.
