THE COORDINATION MECHANISM


FOR DOMESTIC SOLID WASTE MANAGEMENT IN BINH DINH PROVINCE (Enclosed to the Decision Nr.06/2013/QD-UBND dated April 16, 2013 of Binh Dinh PPC)

Chapter I.

GENERAL POINTS

Article 1: The scope of application The coordination mechanism regulates the coordination of the state management towards domestic solid waste for the relevant provincial departments, agencies, the People's Committees of districts/provincial towns/cities (hereinafter called DPC) and the Peoples Committees of communes/ward/district towns (hereinafter called CPC). Article 2: Stakeholders for the coordination mechanism The coordination mechanism applies to the relevant provincial departments, agencies, the DPCs and the CPCs with the state management functions for the implementation of domestic solid waste management Article 3: Coordination principles Establish effective coordination arrangements between the Department of Construction and the relevant provincial departments, agencies as well as the DPCs, CPCs to improve the effectiveness and efficiency of the state management of domestic solid waste management in Binh Dinh province. The coordination of state management towards domestic solid waste management is based on the functions, roles and responsibilities of the provincial departments, agencies, the DPCs and the CPCs, and developing the role of these departments, agencies and committees in providing advice and direction in domestic solid waste management. Chapter II. STATE MANAGEMENT MANAGEMENT OF DOMESTIC SOLID WASTE

Article 4: Promulgating policies and legal documents on solid waste management, disseminating, popularizing and educating about the law on solid waste management and guiding the implementation of these documents

1. DoC is responsible for the preparation of regulations, guidelines, mechanisms and disseminating, popularizing and educating about the law on domestic solid waste management in urban areas. 2. DoNRE is responsible for the preparation of regulations, guidelines and mechanisms and disseminating, popularizing and educating about laws on the protection of the environment in domestic solid waste management. 3. DARD is the lead agency and responsible for the coordination of DoC for the preparation of regulations, guidelines and mechanisms and disseminating, popularizing and educating about the law on domestic solid waste management for rural areas. 4. DPI is the lead agency and responsible for the coordination of relevant departments and agencies for developing mechanisms, incentive policies and the socialization of domestic solid waste management. 5. DoF is the lead agency and responsible for the coordination of relevant agencies for preparing a proposal and advice for the PPC to submit to the Provincial People's Council to decide the fee levels for solid waste management services; proposing the expenditure from the state budget to pay for organizations that provide services in the collection, transport of domestic solid waste in the case that that revenue from fees collected is not sufficient to cover the cost. 6. DoJ is the lead agency and responsible for the coordination of DoET, information and media agencies, DPCs and CPCs for disseminating, popularizing and educating about the law on domestic solid waste management. Article 5: Guideline and assessment for the implementation of technical specifications and standards applicable to domestic solid waste management 1. DoC is responsible for the guidance and assessment for the implementation of constructional technical specifications and standards applicable to domestic solid waste management in master plans, project design and the construction of domestic solid waste treatment projects. 2. DoNRE is responsible for the guidance and assessment for the implementation of environmental technical specifications and standards applicable to domestic solid waste management during the construction and operation of domestic solid waste treatment projects. 3. DoST is responsible for the advise on technology and equipment for investment projects in domestic solid waste treatment; DoST is also the lead agency and responsible for the coordination of DoC to select technology options for reusing, recycling and treating in domestic solid waste management in Binh Dinh province. Article 6: Master plans for solid waste management and master plan for construction of solid waste management treatment

1. DoC is responsible for master planning, elaboration and announcement of plans on solid waste management; appraisal of master plan for the construction of solid waste management projects in Binh Dinh province. 2. DARD is responsible for the coordination of guidance to the DPCs and CPCs for planning the rendezvous points and transfer points at communes and linking to master plan for the development of the new countryside (Nong thon moi). 3. The DPCs organize the preparation of detailed plans, announcement of construction plans for solid waste treatment in the territory under their management and control. Article 7: Managing the process for investment in solid waste collection and transportation and building of solid waste disposal facilities 1. DoC is responsible for the review and assessment of the implementation of the Provincial Master Plan for Solid Waste Management; checking and negotiating locations for domestic solid waste management projects; leading and coordinating with DoF to prepare the official price list for public services for solid waste management services, and to instruct and regulate the application of rate and unit prices, prepare the cost estimation for solid waste treatment public services; proposing investment projects; appraising basic designs for projects. 2. DoNRE is responsible for the appraisal of Environmental Impact Assessment reports of investment projects on solid waste treatment and then the submission of these reports to PPC for approval. 3. DoF is responsible for guidance in the annual appraisal of revenue and expenditure balance for public services in domestic solid waste treatment. 4. DPCs are responsible for preparing investment plans according to the approved plans, establishing annual estimates for public services on domestic solid waste management; recruiting construction contractors and service suppliers in line with the Law on Procurement; managing the implementation of contracts according the legal framework. Article 8: Inspection, overseeing and handling law violations in the course of domestic solid waste management 1. DoNRE is responsible for the inspection, overseeing and handling law violations towards the environment in domestic solid waste management. 2. DoC is responsible for the inspection, overseeing and handling law violations towards the master plan and investment in solid waste treatment projects. 3. Chairmen of Peoples Committees of all levels, specialized inspectors, environmental policemen are responsible for administratively handling with environmental pollution behaviors in solid waste management in general according the legal framework. Article 9: Information management

1. DoC is responsible for the collection, aggregation and storage of data and information for domestic solid waste management in general and in urban areas in particular. 2. DARD is responsible for the collection, aggregation and storage of data and information for domestic solid waste management in rural areas. 3. DoNRE is responsible for the collection, aggregation and storage of data and information related to environmental quality in the province, particularly in solid waste treatment facilities. Chapter III. COORDINATION RESPONSIBILITIES OF RELEVANT STATE MANAGEMENT DEPARTMENTS AND AGENCIES Article 10: Responsibilities of the Department of Construction 1. The Department of Construction has overall responsibilities for planning and strategy development in domestic solid waste management; maintaining effective linkages among provincial stakeholders and district and commune stakeholders; ensure the implementation of an effective assessment and evaluation system and report system. 2. DoC's specific responsibilities include the following: a. Advisor to the PPC on the implementation of the Provincial Solid Waste Master Plan (PSWMP) b. Lead agency for the following: Provide guidance on the implementation of the Coordination mechanism on domestic solid waste management. Prepare, elaborate the master plannings on solid waste management, appraise the construction plannings on solid waste treatment, prepare the action plan for the master plannings on solid waste management and submit it to the PPC for approval. Organise cooperation among province, district and commune levels to supervise the implementation of the PSWMP. Select suitable sites for sanitary landfill construction and organize the establishment or upgrading of domestic solid waste collection and transportation systems, implement organic recycling. Aggregate city, provincial town, district proposals for domestic solid waste management and prepare a proposal on infrastructure investments related to domestic solid waste management for submission to the PPC. Collect, aggregate and store data and information about domestic solid waste management. Establish a data and information storage facility and information sharing mechanism for domestic solid waste management.

Disseminate technical specifications and standards for the construction of infrastructure in relations to domestic solid waste treatment.

Article 11: Responsibilities of the Department of Natural Resources and Environment 1. The Department of Natural Resources and Environment has the overall responsibility for the regular supervision of environmental impacts related to the implementation of the PSWMP. 2. DoNRE's specific responsibilities include the following: a. Prepare annual environmental monitoring reports and the environmental narrative reports in the province including domestic solid waste management in urban and rural areas. b. Support the content of the capacity development and awareness raising programmes relating to environmental protection in the area of domestic solid waste management. c. Disseminate legal documents and guidelines to implement environmental standards in solid waste management, particularly focusing on sanitary landfills. d. Do the inspection and assessment; monitor the environment quality in sanitary landfills during its operation and after its closure. Article 12: Responsibilities of the Department of Planning and Investment 1. Lead agency to cooperate with other departments and agencies to allocate appropriate investment funding for the implementation of domestic solid waste treatment projects according to the annual plan and master plan for solid waste management for Binh Dinh province; and submit this allocation to the PPC for approval. 2. Lead agency for developing incentive policies to encourage private and public investment in the development of domestic solid waste management. Article 13: Responsibilities of the Department of Finance 1. Lead agency for the appraisal and submission to the PPC for approval of service fees for the collection, transport and treatment of domestic solid waste in the province; and coordinate with the Tax Department to propose to the Provincial Peoples Council for approval of service fees and rates. 2. Lead agency to prepare a Roadmap for the implementation of fees for users of solid waste management services. Article 14: Responsibilities of the Department of Agricultural and Rural Development 1. The Department of Agriculture and Rural Development is responsible for the state management towards domestic solid waste in rural areas; applying the indicators issued by the NTP on rural water supply and sanitation and the NTP on building a new countryside.

2. DARD's specific responsibilities include the following: a. Lead agency for guidance in the implementation process of domestic solid waste management programs in communes. b. Lead agency and coordinate with DoC and DoNRE to prepare a programme and detailed plan for solid waste treatment in communes. c. Coordinate with the Peoples Committees of districts and communes to organise the IEC and awareness raising in domestic solid waste management in communes. Article 15: Responsibilities of the Provincial Police Strengthen the anti-criminals activities in environmental regards in domestic solid waste management in the province. Article 16: Responsibilities of the District People's Committee 1. The District People's Committee is responsible for the allocation to district office leaders and officials for the cooperation to plan, implement and evaluate domestic solid waste management in the district territory. 2. The District People's Committee's specific responsibilities include the following: a. Prepare, organise and implement the District Domestic Solid Waste Plan in the district in conjunction with the Master Plan for Domestic Solid Waste Management. b. Arrange actively the State budget and receive different funds (if any) for the implementation of the District Domestic Solid Waste Plan in the district. c. Implement the capacity development and awareness raising programs on domestic solid waste management. d. Establishing and upgrading of domestic solid waste collection and transportation systems and hygienic landfills for domestic solid waste management. e. Implement organic waste recycling at households and at public places to reduce the landfilled waste. f. Implement the assessment and evaluation system for the process of domestic solid waste management in the district and submit annual reports to the DoC.

g. Inspection and handling with legal violations in collection, transportation and treatment of domestic solid waste in the district. Article 17: Responsibilities of the Commune People's Committee The Commune People's Committee has overall responsibility for coordinating with district departments and agencies for the implementation of awareness raising, for the collection of data and information and periodical reporting; supervising the collection and treatment; mobilizing the households to pay

collection fees and handling with any violation relating to domestic solid waste management in the commune. Chapter IV. IMPLEMENTATION ORGANIZATION

Article 18: Implementation Organization 1. The DoC is responsible for organizing the implementation and providing guidance for this coordination mechanism, aggregating the information and reporting to the PPC annually. Relevant provincial departments, Peoples Committees at district and commune levels are responsible for implementing this coordination mechanism. 2. During the implementation of this coordination mechanism, if there is any problem, relevant departments and levels are requested to inform the DoC who will aggregate the received information and report to the PPC for steering.
