Gas safety briefing:


The aim of the campaign is to increase the awareness of local business operators with respect to the dangers of gas appliances used by catering establishments In the first quarter of 2009 the Health and Safety Team investigated two serious incidents involving Tandoori oven explosions. In both investigations it was found that cleaning and maintenance were found to be considerable causal factors. The investigations revealed shortcomings in restaurant owners knowledge with regard to the legal responsibilities to maintain ovens and also with the level of maintenance offered by the gas fitters. These two incidents have not been in isolation; in fact experts at the Health and Safety Laboratory have been concerned for some time and have commissioned research into both Tandoori and duck ovens.

The Inspections
The inspections are to run between the months of September to November 2010. However officers may wish to carry out inspections prior to this. As this briefing session is not intended to make anyone an expert in gas safety there is no expectation that officers carry out enforcement action where they are unsure. You are advised, therefore to contact the Health and Safety Team for further advice if you are unsure about any particular appliance, etc. An inspection form is contained within this pack and it is expected that officers carrying out inspections during the campaign complete the form and return them to James Rudman, HST. Draft notices are attached for officers to use as deemed necessary. They are included for advice only and can be altered to suit the circumstances as you see fit. Also, a guidance sheet is attached, showing photographs of common issues. Flame Failure Devices(FFDs)


A flame failure device is a control that detects the presence of a flame and in the absence of a flame, prevents the uncontrolled release of gas to the burner. (source: Technical Buletin 044, Gas Safe Register, June 2010) 1. The valve controlling gas flow which in this picture, is taken from a tandoori oven.

Electromagnet actuator inside valve controls gas flow

Inside the valve is an electromagnet actuator controlling the flow of gas into the valve. The gas control knob pushes down on the valve allowing gas to enter the pipe feeding the pilot light assembly.

3. An ignition source is applied (in this case a spark) to light the pilot light.

Once lit, the pilot light heats the thermocouple, which sends an electrical signal back to the actuator causing the electromagnet to open the valve fully. The gas control knob can then be turned to full which allows gas to flow into the burner, igniting on the pilot flame.

5. Normal operating state.

6. Should the pilot light extinguish then the thermocouple cools, the electric signal ends and the electromagnet deactivates thereby closing the valve and shutting off supply of gas to the burner and pilot light. This prevents uncontrolled release of gas. 7. In the event that the main burner flame goes out then it will be relit by the pilot light as soon as gas re-enters the burner.

Guidance information
Further information on accidents
Accident 1: On 13th November 2008 an employee was working at Chandni Chowk Restaurant and Sweets. At the start of his shift he began to light the gas appliances in the ground floor kitchen. He successfully lit the ovens and fryers then began to light the tandoori oven. The igniter on the oven was not working, so he lit a paper serviette and began to throw it into the tandoori oven clay pot, when an explosive ignition occurred. The employee suffered burns to his hand, face and eyes, and was taken to hospital for treatment. The explosive ignition occurred because the tandoori oven had a gas leak on the main supply pipe into the oven. This meant that when the gas was turned on at the mains, unburnt gas would leak into the clay pot of the oven. Therefore when a naked flame was applied, the unburnt gas explosively ignited, causing a fireball to come out of the top of the oven and burn the employee. The tandoori oven was examined by a specialist inspector from the Health and Safety Laboratories. He found that the leak of gas was coming from a loose nut on the supply side of the control knob. He also found other defects on the oven: the igniter was not working as the wire had burnt through, there was silver tape on the end of the igniter wire which appeared to be an attempted repair job, there was silver tape partially blocking the air inlet hole, there was grease and debris blocking the ports of the burner and there was evidence that the oven had not been maintained in a safe condition. Sukhdevs Catering Services Ltd admitted that they had not had the appliance serviced or maintained since they purchased it in March 2007. They did not have the appliance installed by a Corgi registered engineer (now Gas Safe Register), In fact it had been installed by a chef and repairs had been made by someone who was not a competent registered engineer. Sukhdevs Catering Services Ltd pleaded guilty in magistrates court for failing to maintain the oven (Regulation 35, Gas Safety Installation and Use) Regulations 1998) and were fined 3,500 and ordered to pay 2,500 in costs. Accident 2: On 12th March 2009 the Head Chef at a restaurant in Sutton Coldfield, began his shift by lighting a Tandoor oven when it exploded in his face causing burns to his face and arm. He was taken straight to hospital as a result of his injuries, where he remained for a number of days on a ventilator before being released. The tandoori oven being lit by the employee was found to be defective in the following ways: 1. The ignition cable, connecting the piezo ignition button to the pilot light assembly was missing (ZAL/01) which is why the ignition switch failed to work and why injured person had to use a lighter.

3. The test nipple at the rear of the oven was leaking gas because the screw cap was missing. 4. The tray containing the oval pebble like coals situated above the burner was badly corroded and had been dropping debris from the coals and cooking residue onto the top of the burner. 5. Ignition of the main burner by the pilot light was poor due to the dirty burner and poor maintenance. (TM/01 & TM/04) 6. The flame failure device did not operate. This meant the main gas supply could be turned on without the pilot light being lit, which would allow for a big build up of gas in the oven if it was not lit immediately. (TM/03) 7. The flame failure device was inoperable because the spring from the device actuator and its seal had been deliberately removed. (TM/03)

8. When lit the flame picture for the main burner was very poor with long orange and yellow flames. The primary air inlet and burner tube were restricted by debris and dirt indicating poor maintenance.

Enforcement advice
The following enforcement advice is intended to give a brief overview of what actions officers can take It doesnt consider all of the circumstances likely to be encountered and of course, officers should consider each deviation from the legislation on a case by case basis as they would with any other type of enforcement action. If officers are unsure then it is recommended that they contact HST / Gas Safe Register before taking action.

In the event that a natural gas appliance is unsafe then officers may wish to consider contacting the gas supplier (National Grid) on 0800 111 999 who have the power to disconnect the supply of gas from a premises. Emergencies involving LPG Contact should be made to the LPG provider (Details normally found on cylinders 4 main providers: Calor 08457 444999; BP 0845 6076118; Flogas 0845 7200100; and Shell 0870 7539 999. For advice on non emergency situations then Gas Safe Register can be contacted on 0800 4085500.

A non CE marked appliance must not be installed by a registered engineer A faulty or disabled FFD is also RIDDOR reportable by the engineer. A second hand non CE marked appliance can be retrofitted. Legislation
Below are some of the main pieces of legislation relating to Gas Safety: Gas Safety (Installation and Use) Regulations 1998: Reg 3: - Qualification and supervision (1) No person shall carry out any work in relation to a gas fitting or gas storage vessel unless he is competent to do so. (2) The employer of any person carrying out such work for that employer, every other employer and self-employed person who has control to any extent of such work and every employer and self-employed person who has required such work to be carried out at any place of work under his control shall ensure that paragraph (I) above is complied with in relation to such work. (3) Without prejudice to the generality of paragraphs (1) and (2) above and subject to paragraph (4) below, no employer shall allow any of his employees to carry out any work in relation to a gas fitting or service pipework and no self-employed person shall carry out any such work, unless the employer or self-employed person, as the case may be, is a member of a class of persons approved for the time being by the Health and Safety Executive for the purposes of this paragraph. Reg 4 - Duty on Employer Where an employer or self-employed person requires any work in relation to a gas fitting to be carried out at any place of work under his control or where an employer or self-employed person has control to any extent of work in relation to a gas fitting, he shall take reasonable steps to ensure that the person undertaking that work is, or is employed by, a member of a class of persons approved by the Health and Safety Executive under regulation 3 (3) above. Reg 36(4) Duty on Landlord Places duty on Landlord to ensure that any work is carried out by a person who is a member of a class of persons approved by HSE. Reg35 Duties of employers and self-employed persons It shall be the duty of every employer or self-employed person to ensure that any gas appliance, installation pipework or flue installed at any place of work under his control is maintained in a safe condition so as to prevent risk of injury to any person. Reg 27 (4) No person shall install a power operated flue system for a gas appliance unless it safely prevents the operation of the appliance if the draught fails.

Provision and Use of Work Equipment Regulations 1998 Regulation 10 Requires employers to ensure that equipment has been designed and constructed in compliance with essential safety requirements and conforms to community requirements in the case of Gas appliances conforms to Gas Appliance (safety) Regs. WHICH: Applies to work equipment first provided for use in the workplace after 5 December 1998 Gas Appliance (Safety ) Regs 95 require large scale kitchen appliances to be fitted with Flame failure safeguards. - Enforced by HSE at supply. Reg 12(3) Duty on employer to prevent exposure to specified hazards. PUWER 19: Isolation from sources of energy (1) Every employer shall ensure that where appropriate work equipment is provided with suitable means to isolate it from all its sources of energy.

To comply with this Notice complete EITHER items 1 and 2 OR item 3:

1) Arrange for a competent person to inspect the tandoori oven located in the kitchen. Carry out any necessary repairs or maintenance to ensure that the appliance is in a safe condition so as to prevent risk of injury to any person. When carrying out the work, reference should be made to the designer/manufacturer instructions for the appliance. N.B. A competent person is a person that is registered on the Gas Safe Register for work on commercial catering systems and the appropriate category of appliance. AND 2) Provide proof of competence of the person carrying out the work (i.e. Gas Safe registration number) to this Department. Provide a copy of the report of inspection to this Department, detailing the works carried out and confirming that the gas appliances are in a safe condition so as to prevent a risk of injury to any person. OR 3) Any other equally effective measures may be used to comply with the Notice.
