In a strongly-worded resignation letter to party president Rajnath Singh, who announced the appointment of Modi as chairman of the election campaign committee on Sunday in the BJP national executive, Advani rued that the BJP was no longer the "same idealistic party" created by Shyama Prasad Mookerjee, Deendayal Upadhyaya, Nanaji Deshmukh and Vajpayee. SRINAGAR, JUNE 10: Population growth in Jammu and Kashmir declined by around 6 percent while literacy rate improved by 12 percent from 2001 to 2011, a report by the Directorate of Census Operations says. The report also says that the overall child sex ratio, between age group of zero and six, has decreased from 941 in 2001 to 862 in 2011. The population growth of the state in 2011 stood at 23.64% as compared to 29.43% in 2001. The total population of the state in 2011 is 1,25,41,303 as compared to 10,143,649 in 2001 and 7,837,051 in 1991. "The population figure of 1, 25,48,925, which was released earlier was provisional, the present figure is final," said Joint Chief Principal Census Officer CS Sapru while releasing the report here.

SRINAGAR, JUNE 10: The population of Jammu and Kashmir has increased from 1,01,43,700 in 2001 to 1,25,41,302 in 2011 showing a decadal growth rate of 23.64 percent. Jammu district has left Srinagar far behind in population. As per the Census Data 2011, , the total population of Srinagar city is 12,36,829 while as the population of Jammu stands at 15,29,958 which accounts 12 percent of total population of the State. He informed that the total present population consists of 6640662 males and 5900640 females. Govt to setup single-window IT offices in Naxal-hit areas


NEW DELHI, JUNE 10: After mobile towers and special paramilitary recruitment rallies in Naxal-affected areas, the government has decided to set up 'Aaykar Sampark Kendras' (ASKs) in Maoist violence hit regions of the country. The ASKs are 'single window' Income Tax department offices where taxpayers are provided a host of services like filing of IT returns, obtaining refunds, getting PAN cards, obtaining tax certificates and documents and for conducting all types of communication with the taxman. Such offices are setup to reduce the grievances of taxpayers as they are not required to go to multiple offices for redressal of their complaints or requirements but get them done at one place. The Union Finance Ministry has recently approved a proposal submitted in this regard by the IT department. The department, according to its blueprint called the Results Framework Document, will set up a total of 57 such centres during the financial year 2013-14 with nine ASKs coming up in Naxal-affected regions of various Left Wing Extremism hit states. While two ASKs each will come up in Dhamtari and Rajnandgaon districts of Chhattisgarh, the others will come up in Karimnagar in Andhra Pradesh, Keonjhar and Phulbani in Odisha, Purulia and Bankura in West Bengal and one each in Bhagalpur and Gaya in Bihar. "This is the first time that these multi-utility centres are being opened up in small cities and districts including in Naxal-affected areas. The ASKs will be at the district or administrative headquarters of the area and will not only generate employment like training of tax return preparers but also spread awareness about payment of taxes," a senior I-T officer said. The department has already scouted locations for creating the office infrastructure at all these locations and a report in this regard has been submitted to the Central Board of Direct Taxes (CBDT), the administrative body of Contd. on page 2

"The present hot weather conditions are likely to continue over the next two days, and the maximum temperature is likely to rise further in this period," Sonam Lotus, director of the regional weather office said. "On June 13, we expect some relief as pre-monsoon showers are expected. The effect of the showers will be more pronounced in the Jammu region, but we are expecting some thundershowers from the evening June 12 onwards in the Valley," he added. Gold worth over Rs 50 lakh seized at IGI


NEW DELHI, JUNE 10: Gold worth over Rs 50 lakh has been seized by customs officials at Indira Gandhi International Airport here in two separate incidents. A customs official said 47-year-old Abdul Rahim Badshah Patel, resident of Karnataka, has been arrested for allegedly trying to smuggle about two kgs of gold jewellery worth about Rs 38 lakh into the country. Patel, who hails from Bhatkal in the southern state, was intercepted by customs officials after he arrived from Dubai yesterday, Neeta Lall Butalia, Commissioner (Customs), IGIA, said in a press release issued today. On detailed examination of his baggage and personal search, 1.9 kgs of gold jewellery was found concealed inside knee caps tied to his legs. The gold was seized and Patel arrested, she said. All these years, he has accused the Prime minister of ineffectiveness and even chided him as Nikkama. Now, if Congress pays him back by dubbing him a liar how will the eighty five year old stalwart react. Leave aside, Congress he even lied to his own party workers and deftly hid what was up his sleeve. The boil finally burst on Monday, when he resigned from three important posts in the Party. Was it his fate to wither under his own disciple will be left for future to explain but at present the Narendra Modi phenomenon has eclipsed LKA, the man who took Bharatiya Janata Party(BJP) from 2 seats to 182. In a moment when the whole nation is looking to Modi as leader of their choice because of his image as a man strong conviction bolstered with development policy, it did not befit a man of Advanis stature to resort to pressure tactics. His ambition to become secular face of BJP after Vajpayee came in full glare when in 2005 during his Pakistan visit, he declared Jinnah as secular leader. Once Modis mentor, LKA has harmed his chances and caused a huge bad taste which was never expected from him. It was Advani who saved Modi from dismissal when Vajpayee insisted on his resignation as Gujarat Chief Minister after Godhra incident. As Modi rose in popularity, Advanis ambition of becoming Prime Minister faded. The hate quotient grew which finally found full expression during the last three days. Eighty Five years and still ambition of becoming Indias Prime Minister is something that needs serious thought. The man who became one of the founders of the party has caused it more harm than good. Personal ambition and a fake faade of Hindutuva which Advani wore all these years has fell off leaving behind a different Advani, the real one who wants to become Prime Minister at all costs. Unfortunately, he has met more than his equal in Modi, his Frankenstein Monster. It is regrettably now only a matter of time when Advani will be history.

"We have conversations of Dawood Ibrahim with bookies and bookies used to fix the players, in which Sreesanth was found talking to one bookie Jiju Janardhan about the amount he will accept for favouring them," the prosecutor said.The court, while granting bail to the 19 accused, said it is prima facie not satisfied with the allegation that offences punishable under sections 120-B(criminal conspiracy), 420 (cheating), 409 (criminal breach of trust) of the IPC are made out against the accused at this stage.It also said it is also not satisfied that "culpability and mens rea (motive)" is made out against the accused. CANADA, JUN 10: Scientists have discovered how a liver enzyme protects cells from damage caused by jaundice, a find that may lead to development of new treatments for the condition. University of Guelph researchers in Canada believe the discovery may ultimately lead to an alternative treatment for jaundice, such as a new drug or supplement. Almost two out of three newborns contract jaundice, with its telltale skin yellowing. Normal treatment involves use of ultraviolet light but it doesn't always work. Although the condition is usually benign, severe cases can cause permanent brain damage and lead to cerebral palsy and hearing loss. Jaundice can also affect people with liver disease or increased breakdown of red blood cells, as in malaria. In all cases, a substance called bilirubin collects in the blood. High amounts can be

toxic and can cause permanent brain damage, said Gordon Kirby, co-author of the study. Previous research had found a naturally occurring enzyme that breaks down bilirubin. Called cytochrome P450 2A5, the enzyme is known to increase in people with liver ailments.

The Guelph team has shown that more bilirubin in the blood activates the gene to make this enzyme. The enzyme helps remove bilirubin and prevents liver cells from dying, said Kirby. The researchers used cultured liver cells from mice for their study. Scientists need to determine

safe and effective levels of the enzyme before developing any treatment, said Kirby. "We need to fine-tune our ability to manipulate this enzyme and fully understand its role in bilirubin removal," he said. The study was published in the journal Toxicology and Applied Pharmacology.

15 infants die in Purulia govt hospital


PURULIA JUNE 11: Fifteen infants, admitted with various complications, have died at a government-run hospital since Friday in West Bengal's Purulia district. Of the 15 infants mostly in the age group of 0-11 months, 10 were boys and five were girls, Superintendent of the Sadar Deben Mahato Hospital, Nilanjana Sen said on Monday. The superintendent said that the infants were to be brought in ambulances with oxygen from block level hospitals, but it was not always possible. All the infants had complications like low birth weight, malnutrition, dehydration and meningitis, she said. The infants were admitted with their mothers and were treated in general beds as the hospital's neonatal unit has only ten beds. On an average, 15-20 infants in a serious condition are referred to the Sadar hospital from block-level ones daily, she said. PSGA Guarantees registration of Industrial Units (IUs) within 5-day: Kichloo
SRINAGAR, JUNE 10: With a view to register new Industrial units of the entrepreneurs within the specified time frame and to facilitate faster industrialization in the state, three important services of the Industries and Commerce Department have been brought under the ambit of Public Services Guarantee Act (PSGA) 2011. The Single Window clearance mechanism is also being further revitalized to ensure faster clearance of cases regarding setting up of new industrial ventures on fast track basis. Stating this here today, the Minister of State for Industries and Commerce Department, Mr. Sajad Ahmad Kichloo said that issuance of NDC for the purpose of employment within stipulated time frame of five days has also been brought under the PSGA. He said registration of new industrial units within 5 days after submitting application along with required documents has also been brought under the PSGA adding that General Managers of the concerned DIC have been nominated as designated officers to provide these services. Likewise, formal registration of new industrial unit is to be issued by a designated officer within 15 days. He said check list for attaching documents with the application for having these services has already been notified. He said concerned Joint Directors and Directors of Industries and Commerce Department of both Jammu and Kashmir divisions have been designated as first Appellate Authority and Second Appellate Authority respectively. He said basic objective of bringing these services under the PSGA is to ensure prompt response of the administration for clearing cases regarding setting up of new industrial units to mobilize as much investment as possible in the state. He said the PSGA provides for imposing a fine of Rs 250 to Rs 5,000 on such designated officer found responsible for not providing the these services to the eligible persons within the stipulated time frame or has caused delay in providing the services or has provided service which is deficient in any manner.

English in DU no play on language
NEW DELHI: The first thing to remember while applying for English is that Delhi University's undergraduate English course is not meant to teach the language. It's a fullfledged literary and culture studies curriculum with no grammar component whatsoever. "What we look for is an interest in world literature and culture," says Shernaz Cama, associate professor of English at Lady Shri Ram College, "And the candidate should also have good grasp of the language and should, preferably, have done the higherlevel of English in CBSE." English has been a popular subject with applicants but cutoff marks for 2012 may not be reliable indicators of the situation this year as all the colleges that till last year subscribed to the central aptitude test, CATE, will now be issuing cutoffs. Northeastern students get a helping hand at DU


NEW DELHI: From special sessions to explain the new four-year undergraduate courses, helping in course selection to assistance in lodging, commuting and counselling their parents, unions and associations catering to students from the northeast in Delhi University (DU) are doing all they can to make aspirants from the region feel at ease as admissions commence. An estimated 20,000 students from the northeast, where facilities for higher education are limited, are enrolled with DU. Different unions representing the eight northeastern states have set up admission committees that are answering queries and providing important tips on the admission process. They are even guiding aspirants back home through social networking sites. "We have attended all the conferences and open days and have collected information to guide students who come to us and also to help those who are interested and are back home, including parents, about the new four-year programme," J. Mavio, vice president of the Naga Students Union, told. "Information and contact details of all the union members have been published in newspapers and news websites across all the seven states so that people can contact us any time," Mavio added. The "admission committee" of the Naga Students' Union is stationed at the Faculty of Arts in DU's north campus and in the office of the Dean (Students' Welfare) in the south campus. The four-year undergraduate programme will replace every existing undergraduate course in DU's 77 colleges. Apart from the main subjects, four applied courses offering a chance to use one's skills will also be taught to students. The applied courses will be taught in the second and third years. The unions are also providing refreshments to aspirants reaching the campus in the intense Delhi heat. "Samosas and cold drinks are free for the students and their parents," Mavio said. The introduction of the Optical Mark Registration (OMR) forms, which do not require a candidate to be present while submitting the form, has further helped students. "We have been submitting forms for students who have not been able to come here," Tado Koj of the Arunachal Pradesh Student's Union told. The unions have also been getting in touch with students through social networking sites like Facebook and Twitter. The Akhil Bhartiya Vidyarthi Parishad (ABVP) has also set up a helpline - 8802039831 and 8826512890 - for students from the northeast. "We have a team at the backend that has been helping the students. We have set up a separate helpline for students from the northeast to resolve all their queries," Awadh Nagpal of the ABVP told. Nineteen-year-old Pfokuhrii Puni, who is from Imphal, said the information provided by the unions has been very helpful.

Birla Edutech to open 50 schools in next three years


Birla Edutech Limited, a Yash Birla Group Company, plans to open 50 schools in the next three years and is also eyeing higher educationarea, said a top official of the company. "We are planning to open 50 school in the next three years of which 10 schools will be owned by us and the rest will be opened through franchise partners," said Yash Birla Group director Vedant Birla during the launch of its school, 'Open Minds,' in Hyderabad. The school has been built in association with DSR Educational Society, an educational arm of Hyderabad-based DSR Group. Birla Edutech Limited has three main educational initiatives namely Shloka, Open Minds and Globe Tot'ers. While Shloka and Open Minds are meant for students at the primary and higher secondary level, Globe Tot'ers is a preschool. "Of the 50 schools we are planning to launch in the next three years, 10 will be Open Minds and the rest will be Shloka," Birla Edutech chief executive officer Vijay Mishra said. Mishra explained that Open Minds caters to metros while Shlokas are meant for tier 2 and tier 3 cities in the country. He said, if one sets aside the cost of land, it takes an investment of around Rs 35-50 crore to set up an Open Minds school while Shloka requires Rs 20-30 crore. The company has 15 schools in the country and is also planning to set up schools in foreign locations. "We have got queries from Malaysia and Singapore but there are no concrete plans as such. It is at a very initial stage," Birla said. Talking about the future plans, he said, "We also plan to enter the higher education area. We have plans to open 1516 super speciality colleges but that is at an ideation stage and we hope to begin work in that front in the next one-to-two years."

School enrollment campaign in Gujarat to be from June 13


VADODARA: Gujarat education minister Bhupendrasinh Chudasma said that the launch of the three-day statewide school enrollment in rural areas of Gujarat would begin from June 13 and after seven days in urban days. Speaking after inaugurating a new building of 100-years-old primary school named after Bochasanvasi Pramukh Swami Maharat at his native village at Chansad near Vadodara on Sunday, Chudasama said, "The campaign will be launched with the twin objectives of attaining cent per cent enrolment and zero per cent dropout rates in the state's primary schools". Chudasama said a provision of Rs 8,000 crore has been made in the annual budget of the state to spend on primary education in the state.

DU makes admissions under sports quota simpler


NEW DELHI: Admissions under the sports quota into Delhi University (DU) have been made simpler this year following the introduction of the four-year undergraduate programme, a university official said Monday. "The candidates now seeking admission on the basis of chess, archery and shooting only need to qualify either in the 50-metre dash, standing broad jump or 1,000-metre race or walk," said Ram Dutt, DU deputy registrar, in a statement. Unlike the previous year, students who apply under the sports quota need not go through the difficult physical exercises, irrespective of the particular sports they play. "All the sports trials will also be video-graphed by all the colleges in order to ensure transparency," Dutt said. The sports trials will be held in different colleges, and candidates qualifying the fitness test would be issued certificates that would be accepted by all the colleges. "The sports trials in different colleges would begin after the announcement of the first cutoff list, scheduled to be announced June 26," Avinashi Kapoor, joint dean, students' welfare, told. DU reserves five percent seats in all courses for students who have won recognition in a range of sports activities throughout the country. DU has introduced, starting this academic year, the fouryear undergraduate programme under which students are required to study 11 foundation courses in the first two years.

Preference for CA leaves engineering colleges high and dry


VIJAYAWADA: Growing craze for the Chartered Accountancy (CA) course among MPC students is likely to bleed engineering colleges further. With many MPC students opting for CA, the demand for engineering seats will go down this academic year and a number of seats are likely to remain vacant. Already engineering colleges in the state are faced with crisis situation as the total available seats outnumber the qualified students. Managements of engineering colleges fear that students who have qualified in Eamcet may prefer CA to engineering. The state has witnessed a spurt in CA coaching centres of late. Rough estimates point out that about 20,000 MPC students, who have qualified in Eamcet, may go for the CA course. The state has about 3.5 lakh engineering seats, but only 2.30 lakh students have qualified in the Eamcet. About 27,000 students failed to clear the intermediate and thus the effective strength of candidates available for engineering counseling is only 2.03 lakh. This will further go down if the number of students who opt for IITs and NITs is taken into consideration. The diversion of MPC students to CA stream will make the matters worse for engineering colleges. "Every student counts for us. The diversion of MPC students to CA will have a detrimental effect on our survival," said the chairman of a private engineering college. The managements of engineering colleges feel that the aggressive campaign launched by the CA institutes with specific focus on MPC students has changed the trend. While the CA coaching institutes across the state are found packed with students, the engineering colleges are virtually searching for aspirants. The engineering colleges particularly in Krishna, Guntur and Prakasam district are faced with a tough time due to the strong imprint of the CA coaching institutes in the region. "It will be really difficult phase for about 10% of the new colleges as they are struggling to get both the students and faculty," said M Koteswara Rao, a representative of the Engineering Colleges' Association.

Rajasthan Technical University begins admission AICTE to open regional office in process, core branches emerge favourites
JAIPUR: With the announcement of the RPET (Rajasthan Pre Engineering Test) results, the race for admissions into top engineering colleges affiliated to the Rajasthan Technical University has begun. The process will commence from June 10 and the session will begin from August 1. "The seat matrix of affiliated colleges has been completed much in advance this year and we are hoping to begin the session on time," said R P Yadav, vice-chancellor, RTU. RTU offers courses in 26 branches. Leading the pack is electronics and communication (EC) which continues to be the most sought-after course among aspiring engineers with a maximum of 14,500 seats. Computer science, another favourite, is lagging behind with 11,453 seats. Earlier given a cold shoulder by meritorious students, the core branches have witnessed a gradual rise in popularity due to opening up of various attractive career options. In over 150 engineering colleges under the RTU, 61,000 seats are up for grabs. Of these colleges, 27 are evening colleges that can accommodate 12% of the total student strength at the varsity. Like previous years, the biggest challenge for the university remains to get maximum seats filled when a sizeable number of bright students opt to migrate to Karnataka and Andhra Pradesh for engineering studies. Many colleges are busy refurbishing the infrastructure to make their campus more attractive while others are busy recruiting faculty. Since RTU has been monitoring the status of teachers in each college, authorities are trying hard to meet the faculty standards before the commencement of the academic session. Aparna Shekawat, spokesperson of IIMET (International Institute of Management, Enginering & Technology) said, "We are organizing free counselling for students in our campus to suggest students on most suitable branches for them." A section of students are also eyeing diploma certificate courses in different branches of engineering for an early placement.

THIRUVANANTHAPURAM: The All India Council for Technical Education (AICTE) will soon open a regional campus here to meet the needs of technical institutions in Kerala. AICTE sources said Kerala affairs, now being looked after by a temporary office at the College of Engineering and Technology, will be shifted to the the new office, which would act as a guidance centre for over 300 technical institutions in the state. As technical institutions required to get AICTE approval every year, a centre had to be set up as a guidance centre for these institutions, the sources said. The state has a total of 321 technical institutions, including 150 engineering colleges, 80 MBA institutes and institutions offering ploytechnic, hotel management and pharmacy education.

Governments to comply with a set of seven directives so as to kick-start police reforms. The court's directives sought to achieve two main objectives: First, functional autonomy for the police through security of tenure, streamlined appointment and transfer processes, and the creation of a 'buffer body' between the police and the Government, and second, greater police accountability so as to enhance organisational performance as well as rein in individual misconduct. Yet, almost seven years later, the police reforms ordered by the Supreme Court are still to see the light of day. This is despite longstanding public pressure and continuing poor policing levels. The need for reform is, no doubt, acute, especially since the archaic Police Act of 1861 continues to govern policing even though there have been farreaching changes in governance. Without doubting the integrity of anybody, I must record here that there is a popular impression that an advocate of the state would never give any opinion which would be inconvenient for the Government of the day. This impression is quite possibly correct. Back in 1969, when I was working as an Under Secretary-level officer in the Union Ministry for Home Affairs, a tricky legal situation arose for me. So, I rang up my counterpart dealing with the subject to get his opinion. He asked me what kind of legal opinion I wanted. I said that I naturally wanted an opinion which would support my case. He said that I should send him the file and he would give the opinion. Anybody with a modicum of common sense can guess the legal opinion I received. The Government has essentially divided the bureaucracy into two classes. Those at the level of the Joint Secretary and above are like Brahmins against whom no inquiry can be started without the permission of the Government - forget about prosecution, which is required for filing a charge-sheet. But those below that level right down to Class 4 employees are like the Shudras, as no Government sanction is required to start any inquiry against them, as per the Central Vigilance Commission Act of 2003. This distinction was ostensibly made to protect those who do 'paper gymnastics' to please their political bosses. A good example is the Government's decision to turn down the CBI's request to question a former Coal Secretary, in connection with the coal blocks allocation scam. This was despite the investigative agency reasoning that questioning the former Coal Secretary was vital since he held that position between 2006 and 2009, the period that now is under the scanner. But the bureaucracy protects its own. In the meantime, corruption scams running into lakhs of crores of rupees continue to take place. It is a free for all lootfest these days. But the Government does not deal with the corrupt with a heavy hand. Instead, the Union Cabinet passed a resolution last month that effectively shields even retired officers. This makes one wonder if the Government wants to fight corruption or fight those who are fighting corruption. Perhaps, it should come out in the open and just abolish the toothless anti-corruption mechanisms it has set up. When I joined the Indian Police Service in 1961, corrupt officials and dishonest politicians could be counted on one's fingers. Today, the same can be said of upright officials and honest politicians. The Government regrettably has failed even to make a token start in fighting corruption. It is not that it cannot do it, but just that it won't. The reasons are not difficult to guess. Someone needs to bring to the Government's attention what Thomas Carlyle once said: "Fool! The Ideal is in thyself, the impediment too is in thyself: Thy Condition is but the stuff thou art to shape that same Ideal out of: What matters whether such stuff be of this sort or that, so the Form thou give it be heroic, be poetic?"

FUTURE ANSWERS
DANGEROUS POLITICS
It is not just preposterous but also shocking that the Uttar Pradesh Government has been straining every nerve to release a bunch of persons accused of terror charges. The fact that these persons happen to belong to the minority community explains Chief Minister Akhilesh Yadav's eagerness. Mr Yadav claims that he is only fulfilling the promise he had made to secure the freedom of 'innocent Muslims' entangled in criminal cases. But that is a fallacious explanation, because by no legal yardstick can the accused he is wanting released be called 'innocent'. They face cases under various provisions of anti-terror laws, including Central laws such as the Unlawful Activities (Prevention) Act and the Arms Act. Since they have not been acquitted by any court, how can the Chief Minister conclude that the accused are innocent? But for a public interest litigation which five lawyers filed in the Allahabad High Court, Mr Yadav might well have freed the accused allegedly involved in the 2007 serial blasts in Lucknow, Varanasi and Faizabad, that left more than 15 persons dead and over 60 injured. Staying the State Government's proceeding to set free the accused, the High Court has called the move a 'purely political decision' which it certainly is. The Chief Minister must feel abashed that the court has seen through his game, but sadly Mr Yadav continues to cling to his position that he is only fulfilling his promises. It does not matter to him that the court has condemned his Government's action in words that should shame the regime. The court said that the common man would not feel secure if terror suspects are released in such a casual manner. Given that Mr Yadav has repeatedly sworn by his commitment to the welfare of the common man and the maintenance of law and order, he must explain why he is proceeding with actions that are contrary to his commitment. If the Chief Minister believes that he can retain the support of the minority voters in the run-up to the Lok Sabha election through such indefensible acts, he is mistaken. He should instead be concentrating instead on implementing concrete and sustainable measures that will empower the minority community in the State . But, apart from the low politics that he has indulged in, Mr Yadav has in his zeal to be the messiah of 'innocent Muslims', even forgotten the legalities of the issue. Experts believe that the State Government cannot take a unilateral decision to release persons accused under Central laws without getting the Union Government's nod. From all accounts, neither did Mr Yadav approach the Centre for clearance nor has the Union Home Ministry given it. In fact, such has been the State Government's hurry that it even failed to supply the High Court the list of terror accused against whom the State decided to withdraw the cases, or other related details. All that the lawyers of the Uttar Pradesh Government did in the court when the PIL was being heard was to question the maintainability of the petition and argue that the State did not need Centre's permission. Now that the matter has been referred to a larger Bench of the Allahabad High Court, Mr Akhilesh Yadav has an opportunity to undo the damage his image has suffered and let the law take its course. It's not his job to release terror suspects.

PROTECTING ONE'S OWN, NO MATTER THE COST

ast month, the Supreme Court questioned the credibility of the Central Bureau of Investigation's probe into the coal block allocation scam. It called for a thorough and qualitative investigation, after it noted that, "The heart of the report was changed on the suggestions of the Government officials It is a sordid saga that there are many masters and one parrot. It needs to be ensured that the CBI functions free of all external pressures... If the CBI is not made independent, we will step in". The apex court also said that "the job of the CBI is not to interact with Government officials but to interrogate to find the truth CBI must know how to stand up against all pulls and pressures by Government and its officials". Then, while commenting on the role of the Union Minister for Law and Justice vis-a-vis the CBI, the Supreme Court said that while he may ask for a report but he cannot interfere in the agency's probe. An old saying comes to mind in this case: The devil can cite even the scriptures for his purpose. If a news report from a leading daily is to be believed, then the Group of Ministers (consisting almost entirely of lawyers) that is preparing a report on the issue of autonomy for the CBI that will be submitted to the Supreme Court will in fact vindicate the Government's position that giving greater independence to the country's premier probe agency will be unconstitutional. However, the arguments slated to be presented are going to be fallacious, to say the least. Since the last few decades, Governments have been taking this stand that blocks real autonomy to the country's premier probe agency. But one hopes the Government is fully aware that whatever the Supreme Court says, becomes the law. The opinion of legal luminaries, given in the past or present, ceases to be relevant. The Supreme Court's wisdom overrules the wisdom of the eminent Attorney General of India even. Recently, the country's top law officer had opined, "It is not open to the Central Government to constitute a CBI and confer on it powers which will impinge on all the powers of investigation of offences which are conferred to the State police." If push comes to shove, the Supreme Court may make a separate law for the CBI that will be applicable only to the Union Territories and extendable to the States with the latter's consent. In any case, the CBI only investigates cases that deal with officials of the Union Government, apart from cases that the States request it to take up and those that the courts order it to handle. Having said this, though, it must also be kept in mind that not all Supreme Court orders are implemented in the manner that they should be. For instance, on September 22, 2006, the Supreme Court had delivered a historic judgement instructing Union and State

anagers of the Indian economy face the challenge of the collapse of growth. There are four factors that are responsible: continuing inflation, fiscal deficit, declining investment and a record current account deficit. Poor growth is related to poor investment. Investment is sluggish. High interest rates and the declining foreign exchange value of the rupee are two reasons. Cuts in expenditures and subsidies and improved tax collection have reduced the deficit. But the unwillingness of the government to slash social welfare expenditures and improve administrative efficiencies remains. Ballooning social welfare expenditures, boosted by the looming annual Rs 60,000 to 100,000 lakh crore food security bill, remain as threats. Land acquisition delays, slow environmental and forest clearances, absence of timebound bureaucratic clearances and honest investigative practices, slow court judgments, to name a few causes, have kept away investment. The current account deficit is caused by high crude oil, coal and gold imports. Nationalized coal mining has been inefficient and unable to dig the coal out. Exports are depressed owing to the sluggish world economy and the scams that have affected major commodity exports like iron ore. The suspicions (now proven by Ranbaxy and Wockhardt) about falsification of trial results will affect pharmaceutical exports. Rising foreign investment can restore the balance of payments and stimulate the economy. Rising domestic investment (both private and public) would be an economic stimulus. But domestic investment is actually going overseas. Foreign investment is not as confident about India as it was some years ago. The Reserve Bank of India categorizes foreign investment into direct and portfolio investments. Direct investment is in equity or debt and recently has been redefined to include foreigners holding above 10 per cent in any venture. Portfolio investment is in debt, securities through the foreign direct investment route, is up to 10 per cent of the securities traded in both primary and secondary capital markets including shares, debentures, warrants, and units of mutual funds, government securities and derivative instruments. Between 2000-01 and 2011-12, direct investment rose from $3,270 million to $22,006 million; and portfolio investment from $2,590 million to $17,171. Our dependence on the latter is high. They are volatile and inflows and outflows seesaw the stock market and rupee exchange rates. Compared to China, India comes out poorly on consistent gross domestic product growth, low inflation, current account surplus, superlative infrastructure and FDI. China has grown primarily because it was such an attractive destination for FDI. Low wages, productive labour and practically non-existent labour legislation made it a great manufacturing destination. From housing mere assemblers, China has moved over the years to producing important manufacturers of basic industrial goods. It had no restrictions on technology imports or royalties. It is known that a significant amount of foreign investment was money belonging to Chinese residents sent illegally abroad and brought back as foreign investment. Another chunk was from overseas Chinese in Taiwan, Hong Kong, the United States of America and elsewhere. But it also came from Japan, Korea and Europe. Most of the foreign investment was direct. In recent years, as the stock markets developed in China, investment has also come as portfolio investment. Return on FDI has been poor in China; copying is common and patent protection weak. India has all of China's faults, not its strengths. We encourage round tripping of Indian funds by treating investments from countries like Mauritius to their tax laws (no capital gains tax). For years, technology imports were controlled, royalties low, bureaucratic approvals were many and time wasting. The implicit policy was to encourage institutional portfolio investments. Foreign investment has been mainly as foreign institutional investment, external borrowings and non-resident Indian remittances. Foreign direct investment in building new factories has been poor for some years, and more in buying existing businesses, not adding fresh industrial capacities. The conditions imposed, changing rules and regulatory frameworks, tax issues and transfer pricing create uncertainty. Many prospective investors are wary of investing in India. Foreign investment is still suspect with many politicians and others. Decades of hostility to private investment, private profit, and foreign investment created a mindset. Society believes essential services (water, electricity, road transport and so on) must be free or cross-subsidized by suppliers. This has led to unbridled increases in deficits of state-owned enterprises in infrastructure. Infrastructure investments must produce adequate returns for maintenance and further investments. India has done much to stimulate foreign institutional investment into equities, debt, and other financial instruments. This has been encouraged by politicians and bureaucrats as well as businessmen. It has helped black money from India to go out by hawala and return to be laundered in Indian stock markets. The money laundry not only whitewashes black, it also rewards the money laundry. This arrangement enables Indians with illegal funds (black money) to send it out by hawala, bring it back for equity investment and legally send it out again. Black has become white money. A genuine forensic investigation will perhaps show We can become an important FDI destination and build a current account surplus, like China. For that to happen, we should remove all restrictions on foreign investment including that in defence industries. There should be no compulsory cap or compulsion to have local investment participation. Clearances must be simplified. Taxation should be stable, clear, and consistent. For this the bureaucracy and individuals in it should be made responsible and accountable for timebound clearances. Land acquisition should be made easier even if it requires an ordinance in the absence of legislation. Present legislative changes will not help. Inflation should be cut and for this government deficits must come down. This requires a pruning of much misspending and theft of wasteful social welfare and other expenditures. So much of it is stolen or reaches people who are not among the defined poor for whom the scheme was designed. The Centre must provide incentives to state governments that create the

Dear Editor, It has now become amply clear that LK Advani is not proving to be a mentor in the BJP. Ever since the 'Jinnah episode' Advani's actions and statements have cast a huge doubt on his position over various matters. After the debacle in the last general election, one would have expected him to step aside and allow and support the new generation of leaders to take over. But not only has he not done that, he has been consistently running down the achievements of Gujarat Chief Minister Narendra Modi. He did it most recently in Madhya Pradesh while addressing party leaders in the State. Now what kind of a leader would try and run down the sole hope of the party? Certainly not one who has the party and its interests in mind. While Modi was named the Bharatiya Janata Party's central poll campaign committee head Sunday, Gandhi was picked in November last year to head the Congress election coordination committee. This happened two months before Gandhi was made the vice president, second only to his mother and party chief Sonia Gandhi. Though neither Rahul Gandhi nor Modi have yet been named the prime ministerial nominee of their parties, it is clear that both will lead the charge ahead of the next general election. Modi and Gandhi are contrasting personalities. While Modi, 62, has an advantage of winning three assembly polls and administrative experience since 2001, Gandhi, 42, has not held any position in the government since he was elected to the Lok Sabha in 2004. Blasts in Bangladesh's Shahbag as Jamaat enforces nationwide strike


DHAKA: Much of Bangladesh was paralysed on Monday by the latest strike called by Jamaat-eIslami, with two powerful explosions rocking Shahbag Square, the epicentre of a massive campaign demanding toughest punishment for leaders of the fundamentalist party for war crimes during the 1971 war. Two homemade bombs exploded at Shahbag Square just after a procession, staged by youngsters belonging to Ganajagaran Mancha, protesting the strike passed the scene. "None was hurt as the bombs were blasted near the Shahbag Police Station," said a police officer, adding that two motorcyclist hurled the bombs and fled the scene immediately. Protesters clashed with police in several towns and set several vehicles on fire to enforce the strike. Shops and schools were closed here and major roads were largely deserted. Two police officers were injured in the northern town of Ullapara after protesters threw a homemade bomb into their vehicle, police said. Violence was also reported from some other parts of the country, including southeastern town of Laksam, where police fired rubber bullets to disperse right-wing activists. The latest Jamaat shutdown comes a day after a special tribunal which deals with war crime cases, sentenced two Jamaat leaders to three months in jail for their derogatory and contemptuous remarks about the trial of several stalwarts of the party which was opposed to Bangladesh's struggle for independence. Jamaat lawmaker Hamidur Rahman Azad and the party's acting deputy Rafiqul Islam Khan were sentenced in absentia by the controversial International Crimes Tribunal, which is trying Islamists and others for war crimes. The country's main opposition party and Jamaat's crucial ally, Bangladesh Nationalist Party (BNP) said unlike previous several such occasions, they did not support the shutdown called by their fundamentalist partner in the 18party opposition alliance. "BNP has not given a formal support to today's hartal," said spokesman of the party and opposition leader Khaleda Zia's adviser Shamsuzzaman Dudu. The opposition parties, including Jamaat, have called more than 30 strikes this year, protesting at what they say are "show trials" of leading Islamists and demanding elections under a caretaker government. Junior minister for law Quamrul Islam on Monday said Jamaat could have appealed against the verdicts before the high court, but instead they called the shutdown which indicated their mentality about the rule of law. He said the tribunal verdict would strip the Jamaat lawmaker off his membership in the current parliament, where the ruling Awami League has three fourths majority. Jamaat was opposed to Bangladesh's 1971 independence while most of their top leaders were accused of siding with Pakistani troops constituting militia and auxiliary forces like Razakar and Al Badr to carryout atrocities. In the past several months, the party spearheaded violent street campaigns to thwart the trial of their stalwarts particularly in certain areas of their stronghold, while the deadly clashes over the war crimes trial left at least 100 people including policemen dead. Since the constitution of the first war crimes tribunal three years ago, 12 people were indicted so far nine of them being Jamaat leaders, two of main opposition and Jamaat's crucial ally BNP and one being a junior leader of ruling Awami League. The tribunals already issued judgements handing down death penalties to three and life imprisonment to another while they wrapped up hearing against two more - then chief of Jamaat's erstwhile East Pakistan unit Ghulam Azam and incumbent secretary general of the party Ali Ahsan Mohammad Mojaheed.

5 killed as militants' fire at NATO containers in NW Pakistan


ISLAMABAD: At least five drivers and conductors were killed when some unknown insurgents opened fire at two NATO containers in Pakistan's northwest tribal area of Khyber Agency on Monday morning, report. According to report, that the containers were on their way to Afghanistan from the country's southern port city of Karachi when the gunmen attacked them in Jamrud area of Khyber Agency, a semi- autonomous restive area at Pakistan-Afghan border. The militants torched containers after killing the two drivers and three conductors, and fled the scene. Local political administration officials and security personnel reached at the site to collect evidences. Security forces cordoned off the incident site and kicked off a search operation in the area. 40 killed in Sri Lanka storm


COLOMBO: Sri Lanka said the death toll from a heavy storm over the weekend has risen to 40 people, while 30 others are missing. Pradeep Kodippili a spokesman for the Disaster Management Center said Monday that 29 people were hurt in the storm. All but one of the dead were fishermen, and Sri Lanka's navy and the air force have rescued about 15 other fishermen. US representative to the International Atomic Energy Agency (IAEA), Joseph Macmanus, has expressed concerned about Iran's intentions as it has refused to provide requisite reactor design information. Macmanus said that Iran is not cooperating in providing the crucial details so that the IAEA is assured of absence of undeclared nuclear materials and activities because the heavy water reactor can be reprocessed to produce weapongrade plutonium. The report added that Iran says it has only peaceful intentions with the nuclear programme.

MUMBAI: Reserve Bank of India (RBI) today penalized top three private banks - ICICI Bank, HDFC Bank and Axis Bank for violating its instructions on know your customer (KYC) and anti money laundering (AML) guidelines. Axis Bank has been penalized Rs 5 crore, HDFC Bank has been penalized by Rs 4.5 crore and ICICI Bank has been fined for Rs 1 crore. "The scrutiny of these three banks revealed violation of certain regulations and instructions issued by "The investigation did not reveal any prima facie evidence of money laundering" RBI said however it added, "any conclusive inference in this regard can be drawn only by an end to end investigation of the transactions by tax and enforcement agencies." Based on the scrutiny these banks were issued show cause notices and based on the replies of the banks Reserve Bank of India came to the conclusion that some of the violations were substantiated and warranted imposition of monetary penalty, central bank said. NEW DELHI: Within days of hiking import duty on gold, Chief Economic Advisor Raghuram Rajan today said government could take more steps to curb demand for the precious metal amidst widening current account deficit. "We have taken number of measures to curb the import of gold. The government will never say its end of it," he told reporters on sidelines of a workshop here. Last week the government increased import duty on gold to 8%, the second such hike within six months. The monthly gold imports have averaged 152 tonnes in first two months of the fiscal as compared to an average of 70 tonnes seen in the 2012-13 financial year. High gold imports is one of main reasons behind high CAD, which touched a record high of 6.7% of GDP in December quarter of last fiscal. The CAD is likely to be in the range of 5% for the 2012-13 fiscal. As per experts a CAD of 2.5% is sustainable. KOLKATA: The public dispute between YES Bank promoters - Rana Kapoor and Madhu Kapur (widow of co-founder Ashok Kapur) - might be settled outside of court as both the parties appear to be in favour of such an option, according to people familiar with the development. "It will be nice as nobody wants a situation like this. We will certainly favour an out-ofcourt settlement," a person close to Madhu Kapur told. In 2009, a few months after Ashok Kapur died in the 26/11 Mumbai terror attack, Madhu Kapur had requested the bank for a board position but the proposal was rejected. Earlier this month, she requested the bank to appoint her daughter Shagun Kapur Gogia as her nominee board member. Kapur then filed a petition in the Bombay High Court requesting a stay on the bank's annual general meeting (AGM) and alleged that she was not consulted, as mandated by the bank's articles of association, on appointment of three directors - Diwan Arun Nanda, Ravish Chopra and MR Srinivasan. That right needs to be protected," the person said adding that the dispute could be resolved if the bank allows Madhu Kapur to nominate directors. NEW DELHI: The Supreme Court today asked the petitioner who wanted cancellation of the licence of drug manufacturer Ranbaxy to bring solid evidence to show that its medicines are adulterated. The petition was moved by a lawyer M L Sharma, stating that since the US authorities have found the medicines produced by the Indian company unfit there, the company should not be allowed to function in India also. However, the bench consisting of Justice Gyan Sudha Misra and Madan Lokur asked him to provide some prima facie evidence for making his charges by Wednesday, when the case will be taken up again. They said the matter was serious, but they could not act on newspaper reports.

India's coffee exports down by 2.85% so far in 2013


NEW DELHI: India's coffee exports have declined by 2.85% to 1,72,480 tonnes so far in the 2013 calender year due to weak global prices, according to the Coffee Board. "Coffee exports have come down slightly as global prices were less attractive," a senior Coffee Board official said. While international prices have been falling for much of the year, global supplies have exceeded demand. Since last month, prices have further come under pressure as farmers in Brazil are harvesting new coffee crop even as they have not finished selling last year's supplies, the official explained. The export realisation was down at Rs 1,47,555 per tonne between Jan and June first week of this calendar year, as against Rs 1,46,991 per tonne in the same period last year. In terms of value, total coffee exports were down at Rs 2,545 cr as against Rs 2,609 cr in the review period. As per the Coffee Board data, the shipment of robusta coffee bean fell marginally to 93,213 tonnes till first week of June 2013, as against 98,863 tonnes in the year-ago period. Similarly, the export of arabica coffee declined to 35,560 tonnes from 36,843 tonnes in the review period. However, the country re-exported 32,701 tonnes of coffee in the said period, higher than 26,558 tonnes a year ago. The Board has pegged coffee production at 3,15,500 tonne in the 2012-13 crop year (OctSept), a marginal increase of 1,500 tonne over the final estimate of 314,000 tonne in 2011-12.
