Elpedes 2010-33140 June 28, 2014 Arch 159 HWX-1 THE 1987 PHILIPPINE CONSTITUTION The 1987 Philippine Constitutions sole purpose is to set the standards for the laws and ordinances to be passed in the republic of the Philippines. It relays information to the people on how a certain law has managed to uplift the peoples rights or how it could have lessened them. It also declares if a certain bill is lawful or not. The Philippines is a democratic and republican State. Sovereignty resides in the people and all government authority emanates from them. (Section 1 Article II) Being both a democratic and a republican State, the Philippines will always be open for changes in the future and remembrances of the past to become a great nation. Because of this, we have lawmakers who pass bills to innovate and recapitulate things for the betterment of the state as a whole. As an example, RA 10533 also known as the Enhanced Basic Education Act of 2013 promotes change in the educational system of the country. The law was established and was passed to complement the weakness of the previous educational system by which the students were given just a 10-year period in the basic education. So, to be able to let the students to grasp his lessons well, the law is passed. This law is grounded in Article XIV of the constitution with the title of Education, Science and Technology, Arts, Culture and Sports Arts. Section 1 reads The State shall protect and promote the right of all citizens to quality education at all levels, and shall take appropriate steps to make such education accessible to all. Quality education as stated should be given to the people and with the advancing technology in this fast-changing world with a fast-changing society, such law is surely a need. Being a democratic state, the Philippines is provided a law as this to move on and move forward for the betterment of the nation. Another example is RA 10066 also known as the National Cultural Heritage Act. This law promotes remembering the past as a key to national identity. For purposes of protecting a cultural property against exportation, modification or demolition, certain artworks shall be declared important cultural property. RA 10066s sole purpose is to preserve the identity of our nation through protecting olden arts and artifacts. This law is also grounded in Article XIV of the constitution. Section 16 reads All the country's artistic and historic wealth constitutes the cultural treasure of the nation and shall be under the protection of the State which may regulate its disposition. Being a republican state, the Philippines is provided a law as this to hold fast to our nations imagery to the world. However, as some laws reflect the very essence of the constitution, there are still laws which for some are a blatant refusal of the constitution. One of which is RA 10175 also known as the Cybercrime Prevention Act of 2012. This law has been a big issue for it is argued by some that it defies Section 4 Article III which reads No law shall be passed

abridging the freedom of speech, of expression, or of the press, or the right of the people peaceably to assemble and petition the government for redress of grievances. This issue is specifically focused on the condition for libel by which some are fearful to having been arrested for liking an opinion on face book. This issue, however, has been ended as the bill finally became a law after sets of revisions. All in all, the constitution guards the people from the cruelty of the hateful some. It is the fortress of the Filipino people. It preserves, it innovates, it protects for the Philippines will never be unless there live a YOU and a ME.
