This responds to item 14 in the Commission's Document Request No. 5 to the FBI, which
requested information about the Department's declinations pursuant to 18 U.S.C. 2339A or
2339B during the period from 1996 through September 11, 2001.
Department records indicated that 37 United States Attorneys' Offices had declined cases
under Section 2339. Since the additional requested information was not readily retrievable in the
Department's computerized systems, the Executive Office for United States Attorneys contacted
those United States Attorneys' Offices to obtain the particular information responsive to your
request. The data is collected on a fiscal year basis, October 1 through September 30. There
were 23 declinations under section 2339A and nine declinations under section 2339B between
October 1, 1994 and September 30, 2001. The breakdown by Fiscal Year is as follows:

As part of the FBI's rolling production, enclosed are draft financial spreadsheets in
both paper and electronic format responsive to the Commission's Request for Production of
Documents No. 5. The electronic version is formatted in Microsoft Excel. Final versions will be
produced to the Commission in the near future. This production is subject to the understanding
that this draft version, both written and electronic, will be returned to the FBI when the final
versions are produced to the Commission.
The spreadsheets contain Moussaoui-related materials and are thus covered by the
terms of the non-disclosure agreement executed between the Commission and the Department of
Justice.

RE: Informal Request for Information from the Commission
Dear Mr. Marcus:
Recently a request for documents was received orally from John Tamm. In order
to accommodate field interviews scheduled by the Commission, the request was processed
without the formality of a written request. Attached please find documents responsive to Mr.
Tamm's request. A copy has also been delivered directly to him.
Because the responsive documents contain Moussaoui-related materials, they are

covered by the terms of the non-disclosure agreement executed between the Commission and the
Department of Justice.

Enclosed herewith please find documents responsive to FBI Request for

Production of Documents 7.
Responsive documents have been reproduced on the enclosed disks. The FBI
302s are in searchable .txt format and the lab reports are in TIFF image format. An index of
each is included. As previously discussed, we are amenable to putting the materials in
Concordance or other format in the future. Alternatively, we are also amenable to establishing
workstations with the materials at FBIHQ if you would prefer. Please advise us of how you
would like to proceed in the future.
Documents included on the disks are as follows:
1) Disk NCTA-001 contains approximately 1,942 FBI 302s responsive to your requests;
2) Disk NCTA-002 contains approximately 74 additional FBI 302s responsive to your requests,
which have been redacted to protect sensitive sources or methods. Upon your review of these
materials, we are amenable to further discussion of these redactions on a case-by-case basis;
3) Disk NCTA-003 contains approximately 500 lab reports responsive to subpart C of requests
I-V.
As you have discussed with the Department of Justice, these materials are subject
to the terms of the Moussaoui nondisclosure agreement. All handling of the enclosed materials
must be in accordance to the terms of that agreement.
