FOREWORD History This comprises the recodification of the Ordinances of the Township of Lower Swatara. The original Code of Ordinances of the Township was prepared by Penns Valley Publishers and was adopted by the Board of Commissioners on February 10, 1982, by Ord. 1982-3. The Township of Lower Swatara was incorporated as a Second Class Township on March 18, 1840, from parts of Swatara Township. On November 7, 1961, the Township of Lower Swatara become a First Class Township. The Recodification of the Ordinances of the Township of Lower Swatara was prepared by Penns Valley Publishers, a division of Fry Communications, Inc., and adopted by the Township Board of Commissioners on November 15, 2000, by Ord. 448. Organization The Code contains four Parts which are; (1) the valid current Ordinances of the Township of Lower Swatara contained in Chapters 1 through 27, (2) the Appendix, which lists by abstracted title all Ordinances of a temporary or "one time" nature, (3) the Key to the disposition of each Ordinance ever enacted by the Township of Lower Swatara, and (4) the Index, which is an alphabetical arrangement of subjects. In the Code each Chapter is separated by a divider tab, and specific Ordinances can be located by subject on the contents page at the beginning of each Chapter. The Index may also be used to search for a subject when one is looking for general information on a particular subject, or if it is not known in which Chapter the subject might be found. The Appendix consists of several general categories containing a chronological listing of short subject descriptions along with a reference to the original Ordinance and its date of enactment, if known. The Key to disposition indicates what action has been taken by the Township Board of Commissioners with regard to every Ordinance ever enacted. An Ordinance has either been (1) specifically repealed, (2) superseded by another Ordinance, (3) is located in a Chapter of the Code book, or (4) is located in the Appendix. Annual tax rate and budget Ordinances are located only in the Key. The Key is a cross reference to the original Ordinance books of the Township Board of Commissioners, and to the location within the Code of each Ordinance by number.

ORDINANCE NO. 448 AN ORDINANCE ADOPTING THE CODE OF ORDINANCES OF THE TOWNSHIP OF LOWER SWATARA, DAUPHIN COUNTY, PENNSYLVANIA; CONSOLIDATING, REVISING, AMENDING AND REPEALING CERTAIN ORDINANCES; ENACTING CERTAIN NEW PROVISIONS; PROVIDING A PROCEDURE FOR AMENDING THE CODE AND FOR THE CITATION OF THE CODE AND THE EFFECTIVE DATE THEREOF; ESTABLISHING RESPONSIBILITY FOR MAINTENANCE OF THE CODE; SAVING CERTAIN PROVISIONS FROM REPEAL; AND PRESCRIBING PENALTIES FOR VIOLATION. Key to the Disposition of All Ordinances Index The Appendix of the volume lists, by subject matter, in chronological order, the titles (or an abstract of title) of enactments of special nature or of historical interest, for the complete text of which the official records of the Township of Lower Swatara shall be authoritative. Section 2. Citation and Effective Date. The codification referred to in Section 1 of this Ordinance shall be known and cited officially as the "Township of Lower Swatara Code of Ordinances," and all future Ordinances shall make reference thereto. This Ordinance shall become effective immediately upon publication of notice of final enactment as required by law. Section 3. Saving Clause. The provisions of the Township of Lower Swatara Code of Ordinances, so far as they are the same as those Ordinances and Regulations in force immediately prior to the adoption of said Code, are intended as a continuation of such Ordinances and Regulations and not as a new enactment. The provisions of the Township of Lower Swatara Code of Ordinances shall not affect any suit or prosecution pending or to be instituted to enforce any of the prior Ordinances or regulations. The penalty provisions have been revised where necessary to comply with the Pennsylvania First Class Township Code, Vehicle Code, Municipalities Planning Code and the Local Tax Enabling Act.

Section 9. Amending the Code of Ordinances. The procedure for amending the Code of Ordinances shall include the citation of the Chapter, Part, Section and subsection to be amended, revised, repealed or added as follows: A. B. C. Section 10. Responsibility for Code of Ordinances. It shall be the responsibility of the Township Secretary to maintain an up-to-date certified copy of the Code of Ordinances. This copy shall be the official copy of the Township of Lower Swatara Code of Ordinances and shall be available for public inspection. Section 11. Penalties. It shall be unlawful for anyone to change, alter or tamper with the Code of Ordinances in any manner which will intentionally misrepresent the laws of the Township of Lower Swatara. Whosoever shall violate this Section shall, upon conviction thereof, be sentencd to pay a fine of not more than $600 and costs or, in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. Section 12. Severability of Parts of Codification. It is hereby declared to be the intention of the Board of Commissioners that the Chapters, Parts, Sections, paragraphs, sentences, clauses and phrases of this codification are severable. If any Section, paragraph, sentence, clause or phrase of this Code is declared unconstitutional, illegal or otherwise invalid by the judgment or decree of a court of competent jurisdiction, that invalidity shall not affect any of the remaining Chapters, Parts, Sections, paragraphs, sentences, clauses or phrases of this codification. FEE RESOLUTION
SUBJECT Bad Check Charges A $25 fee will be imposed on bad checks issued to Lower Swatara Township or any departments thereof and the Lower Swatara Township Tax Collector. [Res. 2003-R-1] Appeals Board 1. For all hearings, residential, commercial or industrial in nature, held before the Appeals Board, a fee of $500 payable in advance, shall be paid by the applicant or appellant to Lower Swatara Township to cover compensation for the secretary, compensation for Board members, notice and advertising costs, administrative overhead for the hearing, the appearance of the stenographer and any transcription costs. Upon conclusion of the proceedings and determination of the actual costs of the above items, any unused portion of the fee will be returned to the applicant or appellant. When multiple hearings are necessary, a determination will be made by the Township as to whether additional fees in increments of $500 should be deposited with the Township. In the event that the actual costs exceed the amount of the original deposit, such additional costs shall be paid to the Township by the applicant or appellant prior to the rendering of any opinion on the application or appeal. No hearing shall be conducted before the Appeals Board before and until the above fees have been paid.

[Res. 2005-R-15] Building Construction Permits 1. Purpose. Permit fees are collected to cover the costs associated with the Code Enforcement Department that include in part permit application, plan review, the issuance of the permits, required on-site inspections and the issuance of a Use and Occupancy Certificate as required by the Uniform Construction Code. Value of New Construction. The Building Valuation Data, as part of and contained in this Resolution (p. xxi), shall be used to compute the minimum value of new construction. The Building Valuation Data represents the current average construction costs per square foot. The average costs include structural, electrical, plumbing, mechanical, sprinkler systems, interior finish, and normal site preparation. This Building Valuation Data (BVD) was developed and is published by the International Code Council. The BVD will be updated and printed at 6-month intervals. The construction cost per square foot is calculated based on the average cost (published in the July-August, 2008, Building Safety Journal).

Building Permit Fees.1 Building permit fees shall be based upon the greater of contract price or the minimum estimated value of construction determined by this Section of this Resolution, using the following schedules to compute the permit fees: PERMIT FEE MULTIPLIER - First $150,000 estimated value of construction or fraction thereof at $6 per $1,000 - Next $150,000 estimated value of construction or fraction thereof at $5 per $1,000 - Remainder of estimated value of construction or fraction thereof at $4 per $1,000

Every applicant shall pay to the Township Secretary the recording fee which is based on the Dauphin County Courthouse schedule of fees. Recording fees shall be paid for all plans and documents as set forth in the provisions of the Lower Swatara Township Stormwater Management Ordinance [Chapter 26]. Should the aforesaid fees be insufficient to cover the cost of the Townships professional consultants or engineer for review of the plan, the applicant shall, when called on to do so, furnish additional amounts to cover all such review charges.

EQUIVALENT DOMESTIC UNIT (E.D.U.) - a measure of volume or flow or expected flow of sanitary sewage or industrial waste from an improved property as determined by the consulting engineer to the Authority or Township, as applicable, in accordance with sound engineering practices; each such equivalent domestic unit being equal to 228 gallons per day; and, further defined as follows: (a) (b) One E.D.U. equals 228 gallons per day. Each residential unit, including single-family apartment units and mobile homes, but not limited thereto, shall be equivalent to one E.D.U. and charged as such when connected to the sanitary sewage system. All other users, including commercial/industrial users, but not limited thereto, shall be charged a minimum tapping fee equal to one E.D.U. for each separate tenant within the building and in addition to this minimum fee shall have their tapping fee computed as follows: Number of E.D.U.s = Average Daily Flow or Estimated Average Daily Flow 228 Gallons per day Note: 0.01 to 1.0 E.D.U.s shall be billed as 1.0 E.D.U. 1.01 to 2.0 E.D.U.s shall be billed as 2.0 E.D.Us, etc. Equivalent Domestic Units (E.D.U.s) applicable to all users other than residential units shall be computed on the basis of average daily flow used during the calendar quarter preceding connection. Should there be no consumption figures available for the preceding quarter, the flow shall be estimated by the Authority Engineer and the owner of such property billed accordingly. However, the Authority reserves the right to adjust the number of E.D.U.s estimated based on the actual consumption figures obtained for such property at such time as construction of the building is fully completed and the building is fully occupied and for a period of one year after the completion of the structure and full occupancy of the same. For example, if the Authority estimates 25 E.D.U.s and actual consumption figures indicated 30 E.D.U.s, the property owner would be responsible for an additional 5 tapping fees. Likewise, if the Authority estimates 25 E.D.U.s and the actual consumption is 15 E.D.U.s, but there are 20 separate tenants within the building, the Authority would rebate five tapping fees.

TOWNSHIP - the Township of Lower Swatara, Dauphin County, Pennsylvania.

Connection. No person shall connect any improved property with any part of the sewer systems without first making application for and securing a permit, in writing, from the Township as provided by the Connection Ordinance [Chapter 18, Part 3]. Such application shall be made on a form provided by the Township. [Res. 2002-R-7] Tapping Fee. There is hereby fixed and imposed a tapping fee upon the owner of each improved property and whenever such owner hereafter shall connect said improved property with the sewer system. The tapping fee shall be imposed upon any connection to the sewer system regardless of whether such connection is direct or indirect, including changing the type of use of property previously connected or connecting one or more new uses to an existing connection, regardless of whether such property is connected separately or through one or more existing or new laterals or service connection lines owned by the Authority or by any person other than the Authority. Amount of Tapping Fee. The amount of the tapping fee payable with respect to each connection of each improved property to the sewer system shall be determined in accordance with the following: (1) Background. Burkholder, Inc., $169 per E.D.U. for each connection of improved property to the sewer system whose ultimate flow passes through that portion of the sewage system constructed by Phoenix Contact, Inc., $200 per E.D.U. for each connection of improved property to the sewer system whose ultimate flow passes through that portion of the sewage system constructed by Balu Patel, and $262 per E.D.U. for each connection of improved property to the sewer system whose ultimate flow passes through that portion of the sewage system reconstructed by Messick Construction, Inc. These fees shall not be applicable to any residential properties in existence as of the date of this resolution, nor shall this fee apply to any users that the Authority transfers from one treatment facility to another treatment facility. [Res. 2002-R-19] Allocation of Tapping Fee/Maximum Permissible Tapping Fee. With respect to the tapping fee set forth above in the amount of $2,600 per E.D.U., the capacity part of said tapping fee shall be $1,500 (58%), and the collection part shall be $1,100 (42%). Imposition of Special Purpose Part-Cherry Alley Interceptor (Highspire). With respect to the special purpose part for the Lumber Street interceptor, all further development within the drainage basin served by the Cherry Alley Interceptor shall pay a special purpose part component of $1,000 per EDU at the time of permit application. The Municipal Authority of Lower Swatara reserves the right to enter into specific agreements with owners and developers to do specific construction upgrades to the Cherry Alley interceptor in lieu of the special purpose part. The special purpose part shall be in addition to all other connection and tapping fees and shall be payable at the time of sewer permit application. [Res. 2002-R-7]

Connection and Inspection Fees. This Authority does hereby impose a connection fee against the owner of the improved property whenever such owner hereafter shall connect any such improved property with the sewer system. The connection fee is charged for the connection of each improved property by the owner of such improved property to the sewer system. (1) Connection Fee ($500). A connection fee for each improved property, utilizing the average cost of similar or previous connections, is hereby established at $500 for the construction of the stub and the inspection of the same from the Authoritys main sewer to the property line or curb stop. Said connection fee shall include the cost incurred by the Authority in constructing that portion of the lateral from the Authoritys sewer main to the property line or curb stop and the cost of inspection of the lateral from the property line or curb stop to the owners building. Inspection Fee ($250). Owners required to tap into the sewer system of the Township who have previously had a lateral run from the sewer system to the edge of the Township right-of-way at the owner developers expense shall be required to pay an inspection fee of $250 payable at the time of application of permit.

Mobile Home Reinspection Fee ($50). In the case of a connection of a mobile home to an existing and previously improved house connection, each owner or customer shall pay a mobile home reinspection fee of $50 to defray the cost of inspection and administration required by regulation. Should the aforesaid fee be insufficient to cover the cost of the Townships professional consultants or engineer for review or inspection, the applicant shall, when called on to do so, furnish additional amounts to cover all such charges. Other Reinspection Fee ($50). In the case of a sewer lateral, which needs to be repaired, replaced or reconnected, each owner or customer shall pay a repair permit charge of $50 to defray the cost of inspection and administration required by regulation. Should the aforesaid fee be insufficient to cover the cost of the Townships professional consultants or engineer for review or inspection, the applicant shall, when called on to do so, furnish additional amounts to cover all such charges. All fees, and inspection fee or mobile home reinspection fee, shall be due and payable at the time application is made to the Township to make such connection to the sewer system, as provided in subsection (B). officer or representative of this Authority as shall be authorized, from time to time, by resolution of this Authority, to accept payment thereof. Solid Waste and Recycling Program An administrative service fee is set at $2 per quarter ($8 per year) per residential unit as bid by the contractor and shall be reflected on and collected with the contractor's quarterly billing. [Res. 2011-R-15] Street Openings and Excavations. 1. Improved Roadway Surface. Permits issued for trenching, tunneling, boring or drilling from one side of a street, alley or thoroughfare to the other shall be $35 for a length not to exceed 25 feet, plus $1 for each additional foot or fraction thereof. Unimproved Roadway Surface. Permits issued for trenching along a street, alley or thoroughfare shall be $35 for a length not to exceed 25 feet, plus $5 for each additional 100 feet or fraction thereof. Curb or Sidewalk Cuts. Permits issued for curb or sidewalk cuts shall be $5. Curbs and sidewalks shall only be removed in sections extending from expansion joint to expansion joint. In the event that the actual costs exceed the amount of original deposit, such additional costs shall be paid to the Township by the applicant prior to recording of plans or documents. Should the aforesaid fees be insufficient to cover the cost of the Townships professional consultants or engineer for review of the plan, the applicant shall, when called on to do so, furnish additional amounts to cover all such review charges.

Zoning Fees (27-2705) 1. Zoning Permit. The fee for a zoning permit (or for a temporary zoning permit) shall be as per schedule below. [Res. 2011-R-12] [Res. 2005-R-15] 2. Hearings and Appeals before the Zoning Hearing Board. A. For all hearings, residential, commercial or industrial in nature, held before the Zoning Hearing Board, a fee of $500, payable in advance, shall be paid by the applicant or appellant to the Township of Lower Swatara to cover compensation for the Secretary, compensation for Board members, notice and advertising costs, administrative overhead for the hearing and one-half of the appearance fee of the stenographer, and transcription costs. Upon conclusion of the proceedings and determination of the actual costs of the above items, any unused portion of the fee will be returned to the applicant or appellant. When multiple hearings are necessary, a determination will be made by the Township as to whether additional fees in increments of $500 should be deposited with the Township. In the event that the actual costs exceed the amount of the original deposit, such additional costs shall be paid to the Township by the applicant or appellant prior to the rendering of any opinion on the application or appeal. No hearing shall be conducted before the Zoning Hearing Board before and until the above fees have been paid.

For every application for a change or amendment to the Zoning Ordinance or Map, a fee of $500, payable in advance, shall be paid by the applicant to the Township of Lower Swatara to cover the actual costs incurred for advertising, mailing notices, and services of attorneys, stenographers, engineers and consultants as may be required to properly process the application. Upon conclusion of the proceedings and determination of the actual costs of the above items, any unused portion of the fee will be returned to the applicant. In the event that the actual costs exceed the amount of the original deposit, such additional costs shall be paid to the Township by the applicant prior to the rendering of any opinion on the application. Home Occupation License. A. The license fee for all applications for home occupation use shall be $25. This fee shall be required for any original license issued to any applicant, as well as the annual renewal of each license. All residents within the Township of Lower Swatara, Dauphin County, Pennsylvania, desiring to operate a home occupation use, shall apply to the Township in writing prior to the issuance of each original license and each annual renewal license.
