WHEREAS, separate motions were separately filed by the Senate of
the Philippines, the House of Representatives and the Office of the Solicitor
General for respondent Secretary Florencio B. Abad of the Department of
Budget and Management, all praying for the resetting of the oral
arguments from December 10, 2013 to January 28, 2014;
WHEREAS, the motions appear to be sufficient in form and
substance;
WHEREAS, considering the reasons for postponement raised in the
subject motions, it is necessary and proper to (a) GRANT the motions; (b)
CANCEL the oral arguments set on December 10, 2013; and (c) SET the
next oral arguments on January 28, 2014, subject to the following
conditions:
(a) The Senate and the House of Representatives
shall notify the Court of the names of their chosen counsels
within ten (10) days from today; and to have said counsels

formally enter their appearance in these cases for their
respective clients; and
(b) The Department of Budget and Management shall
furnish to the Court on or before January 21, 2014 a list of the

NOW, THEREFORE, You, parties, are hereby advised of the
resetting of the oral arguments from December 10, 2013 to January 28,
2014, Tuesday, at two o'clock in the afternoon, same venue, subject to the
foregoing conditions.

ADVISORY
For the orderly conduct of the oral arguments scheduled on
November 19, 2013, at 2 o'clock in the afternoon, at the En Bane Session
Hall, 2nd Floor, SC Main Building, the parties shall observe the following:
I. Petitioners, through their designated counsels, shall argue
sequentially and limit their presentation to the following issues, to wit:
Procedural Issue:
A. Whether or not certiorari, prohibition, and mandamus are
proper remedies to assail the constitutionality and validity of the
Disbursement Acceleration Program (DAP), National Budget Circular
(NBC) No. 541, and all other executive issuances allegedly
implementing the DAP. Subsumed in this issue are whether there is a
controversy ripe for judicial determination, and the standing of
petitioners.
Substantive Issues:
B. Whether or not the DAP violates Sec. 29, Art. VI of the
1987 Constitution, which provides: "No money shall be paid out of
the Treasury except in pursuance of an appropriation made by law."
C. Whether or not the DAP, NBC No. 541, and all other
executive issuances allegedly implementing the DAP violate Sec.
25(5), Art. VI of the 1987 Constitution insofar as:
(a) They treat the unreleased appropriations and unobligated
allotments withdrawn from government agencies as "savings"
as the term is used in Sec. 25(5), in relation to the provisions of
the GAAs of2011, 2012 and 2013;

(b) They authorize the disbursement of funds for projects or
programs not provided in the GAAs for the Executive
Department; and
(c) They "augment" discretionary lump sum appropriations
in the GAAs.
D. Whether or not the DAP violates: (1) the Equal Protection
Clause, (2) the system of checks and balances, and (3) the principle of
public accountability enshrined in the 1987 Constitution considering
that it authorizes the release of funds upon the request of legislators.
E. Whether or not factual and legal justification exists to issue
a temporary restraining order to restrain the implementation of the
DAP, NBC No. 541, and all other executive issuances allegedly
implementing the DAP.
II. The Office of the Solicitor General shall then present the
counter-arguments on the foregoing issues in behalf of the respondents.
III. Each side shall have an aggregate of35 minutes to present their
arguments on the foregoing issues.
IV. Counsels for each side are directed to coordinate with each
other and to submit to the Court on or before the close of office hours of
Friday, November 15, 2013, a manifestation stating: (a) the final list of the
presenting lawyers; (b) the specific issues to be respectively discussed by the
presenting lawyers; and (c) the time allotted for each presenter, the total of
which should not exceed the 35-minute time limit as stated in Item III.
VI. Interpellations by the Members of the Court shall immediately
follow after the complete presentation of each side. The Members of the
Court shall have the right to inquire into any matter they deem relevant and
necessary for the resolution of the issues in these consolidated cases. The
time allotted for each side shall be exclusive of the time devoted to the
interpellations by the Members of the Court.
VII. The Department of Budget and Management and the
Commission on Audit are required to attend the oral arguments through
their respective representatives, and pursuant to the Resolution dated
October 25, 2013 to report then and there on the unobligated allotments
withdrawn in 2013 under the DAP, and to answer all questions to be posed
by the Members of the Court.

VIII. All other matters not covered by the oral arguments shall not
be considered as eliminated issues but shall be discussed and argued in the
written memoranda to be required from the concerned parties.

Acting on the Urgent Motion for Issuance of Temporary Restraining
Order and/or Writ of Preliminmy Injunction filed by petitioner Augusto L.
Syjuco, Jr. in G.R. No. 209135 and the applications for the issuance of a
Temporary Restraining Order (TRO) and/or writ of preliminary injunction of
the petitioners in G.R. Nos. 209136. 209155, 209164, 209260, and 209287
to enjoin the implementation of the Disbursement Acceleration Program
(DAP), and the Opposition and Manifestation Ad Cautelam dated October
24, 2013 filed by the Office of the Solicitor General (OSG) praying for time
to be heard. on the application for TRO and file its consolidated comment,
the Court RESOLVES to
( l) DEFER the resolution of the applications for the
issuance of a TRO until after the oral arguments;
(2) MOVE the oral arguments, both on the merits of these
cases and the applications for TRO and/or writ of
preliminary injunction, from November 19, 2013 to
November 11, 2013, Monday, at 10:00 a.m. (and until
the afternoon, if necessary);

Solicitor General Jardeleza presented the arguments for the
respondents, and was interpellated by the Court immediately after his
presentation.
During the course of the hearing, the Chief Justice designated Senior
Associate Justice Antonio T. Carpio to preside over the hearing.
After hearing the issues and arguments raised, the Court Resolved,
in open Court, to require the parties to SUBMIT their respective
MEMORANDA within a NON-EXTENDIBLE period of seven (7) days
from date, or ON OR BEFORE October 17, 2013. The memorandum
shall discuss all matters covered by the oral arguments and all other
relevant matters necessary for the complete resolution of these
consolidated cases.
The Court further Resolved to request Chairperson Pulido Tan, as
amicus curiae, to SUBMIT her own memorandum within the same period
on matters with respect to which she was directed to expound in her
memorandum, including but not limited to the parameters of line item
budgeting. The parties were likewise directed to discuss this same issue in
their respective memoranda, including the issue of whether there is a
constitutional duty on the part of Congress to adopt line item budgeting."

and Prohibition (with a Prayer for Injunction and/ or Temporary
Restraining Order), the Court Resolved, without giving due course to the
