Sub: Implementation of Maharashtra Fire Prevention and
Life Safety Measures Act, 2006 and Rules, 2009
Si mplification of process for grant of Fire approvals and'
Renewals there-under.
Ref: (1) Section 3 and Section 10 of Maharashtra Fire
Prevention and Life Safety Measures Act, 2006 &
D.C. Rules of MIDC.
(2) Office Order issued by CEO, MIDC vide
No. 1114 of 2009 dated 17/8/2009.
(3) Office order issued by Directorate of Fire Services
vide No. 876/ MFS dated 11th October, 2010.
PRESENT PROCEDURE:
With reference to No. (1) above, it is mandatory to provide fire prevention and
life safety measures as per the provisions of Development Control Rules of MIDC
and Maharashtra Fire Prevention and Life Safety Measures Act, 2006 (Fire Act).
With reference to No. (2) above, CEO, MIDC has delegated powers for grant
of fire approvals to SPA Engineers working in the field for administrative purpose
due to non-availability of required no. of fire officers in the field .
With reference to No. (3) above, Directorate of Maharashtra Fire Services has
issued revised requirements for fire protection systems for
Group-G occupancies i.e. industrial occupancies having low, moderate and high
hazard classification given in Annex-B of Part 4 of NBC, 2005. As per the provisions
of Section 3 (3) of Fire Act, it is the responsibility of owner and occupier to provide
fire prevention and protection arrangements to industries through Licensed Agencies
approved by the Directorate of Maharashtra Fire Services. At present there are 236
Licensed Agencies are appOinted by the Directorate and the list is available on
Directorate's website www.mahafireservice.gov.in. As per the provisi onal fire
approval issued by MIDC, industries carry out installation work through Licensed
Agencies and submit Form-A to Fire Deptt. Or SPA for grant of final fire approval. It
is expected that the installing agency or any other licensed agency should carry out
operation and maintenance of the system installed in the industries and should issue
certificate to that effect in the Form-B. On the basis of Form-B, renewal of fire
approvals will be issued by Fire Deptt Or SPA as the case may be.
At Head Office level, through Industries Association, various micro, small and
medium entrepreneurs are expressing their difficulties for submission of Form -A for
obtaining final fire approval and Form-B in a month of January and July in case of
renewal of fire approval. Considering the above difficulty, the issue was discussed
and as per the provisions of Section 10(1), the following orders are issued .

ACTION FOR EAS E OF BUSINESS:
To provide relief to micro, small and medium entrepreneurs having low hazard
activities having proposed total built-up area upto 3000 sq.mtrs. and height less than
15 meters at the ti me of granting provisional fire approval , it is decided to follow
followi ng procedure for simplification of process of granti ng final fire approval and
renewal of fi re approval.
(1) The provisional fire approval which is a prescription/ recommendation of
fi re prevention and protection arrangements for industries should be issued
considering the revised office order issued by Directorate of Maharashtra
Fire Services for Group-G occupancies i.e. industries. The li st of low
hazard industries is made amply clear in Annex-B of Part 4 of NBC,2005.
The copy of both is enclosed for ready reference.
(2) At the time of granting final fire approval for low-hazard industry, as per the
provisions of section 10(1), the fire officer attached to local MIDC Fire
Station should carry out inspection as per the check-list and ensure the
availability of fire protection systems as per provisional fire approval and
record the observations in writing reasons of non insisting the approved
license agency and issue final fire approval or renewal, as the case may
be.
(3) At the time of renewal of the fire approval, in case of low-hazard industry
having built-up area upto 3000 sq. mtrs. and height less than 15 meters,
Form-B from the licensed agencies should not be insisted.
The fire officer of local MIDC fire station should carry out inspection as per
standard check list and issue Renewal to industries.
(4) This procedure will be made applicable to all low-hazard industri es as
specified in Annex-B of Part 4 of NBC, 2005 and the same will be
applicable to all industries situated in MIDC Areas having proposed built-up
area upto 3000 sq. mtrs.
(5) The recovery of fire protection fund fee as per the offi ce order issued by
CEO, MIDC vide No. MIDC/Fire/1078 dated 1ih July, 2006 should be
followed . .
The above orders should come in force with immediate effect and the
guidelines mentioned above shall be followed scrupulously by all SPAs and Fi re
Officers in MIDC.
