Standard Terms & Conditions


Acceptance of a quotation from Spec 3 Group constitutes total acceptance of our Standard Terms & Conditions, whether signed or not Spec 3 Group reserves the right to change or modify any of the terms and conditions contained in this Agreement at any time and from time to time in its sole discretion, and to determine whether any such changes apply to either existing or future customers. Company may make changes or modifications to referenced policies or guidelines without notice to you. Your continued use of the Services following Company's posting of any changes or modifications will constitute your acceptance of such changes or modifications Spec 3 Group aims to carry out works to a very high standard and in accordance with current legal and building regulations. Any changes to the regulations which were not in existence at the start date of this project; Spec 3 Group will not be liable for. These term words importing the masculine gender also include the neuter and feminine gender and words importing the singular number include also the plural number, where the context so requires. The Term word, The Contractor(s), includes Spec 3 Group, its Contractor(s), sub-contractor(s) and all employees.

SPEC 3 GROUP STANDARD TERMS & CONDITIONS

1.

QUOTATIONS
1.1 The quotation we are providing is based on the information that we have been supplied. It relates to the works requested by the client to whom the estimate is addressed and is in respect of the property indicated. We reserve the right to alter our quotation if the detailed information varies from the original enquiry. 1.2 The quotation will remain open for acceptance for a period of 30 days. If the quotation is accepted, a deposit of 50% (in most cases) will be required to commence work. 1.2.1 Deposit percentage may be amended at the discretion of the contractor(s) 1.3 The quotation is based on the visual inspection and assumed condition of the land/building, unless stated otherwise with evidence of a written description or detailed plans from the structural engineer or architect. Any change to those conditions found to exist as work proceeds may result in additional charges to those initially indicated and Spec 3 Group will not be held liable 1.4 The quotation is subject to the availability of materials, plant and labour at the time required. Liability cannot be accepted for delays or their effects either whole or part to causes out of our control. 1.5 The quotation provided is based on known costs for materials etc., at the time of preparation. Occasionally the building trade experiences sudden price increases. Whilst we aim to keep within the quoted costs, we may be forced to increase charges when situations like this occur. We will notify the client of any such increases. 1.6 Any changes or alterations to the quoted works or to the materials requested by the client may result in an alteration to the costs. All additional works instructed to be carried out during the course of works will be subject to additional charges based on standard rate plus day rate and any extra materials will be charged accordingly. 1.7 Unless specifically indicated, when repainting of existing surfaces is required by the quotation, the preparation will consist of minor filling of small holes and cracks prior to the application of two coats of paint. If the condition of the wall or wood surface is such that it requires further remedial work, the Contractor will provide a quotation for the additional preparation required. 1.8 Unless specifically indicated, the quotation price does not include the cost of rectifying damage to the existing premises caused by dry rot, mould, ants or termites, mitigation or removal of substances such as asbestos or lead, or other pre-existing conditions that were unknown at the time the quotation was accepted 1.9 It may be found that the existing structure is out of plumb and/or out of level. The proposed work does not include levelling or straightening of the existing structure unless it is specifically mentioned 1.10 The Owner shall not contract any work directly with the subcontractors, suppliers or sub trades. All business related to the renovation will be conducted through the Contractor at the contractors discretion 1.11 Spec 3 Group shall not be held liable for any works undertaken at the clients instructions if that work requires planning or other consents, which the client has not obtained. Unless requested as part of the quotation, it is the responsibility of the client to apply for and pay all appropriate fees, for such consent prior to the commencement of works.

2. SERVICE
2.1 The client, in accepting this quotation, agrees to Spec 3 Group carrying out the described works on his/her property, and he/she shall make reasonable provisions to protect his/ her fixtures and fittings not subject to the described works and other possessions left in the property whilst the works are undertaken. The client shall also make safe, suitable and uninterrupted access 2.2 The Owner / Client accepts that there may be inconveniences from time to time, and the Contractor agrees to keep such inconveniences to a reasonable minimum. It is the responsibility of the Owner to take reasonable steps to provide a work area free of household obstructions, and to remove or protect household items in areas where it may be reasonably anticipated by the Owner that they may be subject to dust, damage or vibrations. In some cases, reasonable access to a clients home for the renovation work may mean that the homeowner may have to vacate the premises, this will be communicated to the Owner/Client before commencement of work 2.3 Where present, it will be assumed that the supply of water, electricity and toilet facilities will be made available the use of all workman on site. If not an additional charge may be made to provide these services to comply with health & safety 2.4 The Owner acknowledges that space will be needed and provided at the site for the storage of material and equipment. The space requirement will be established during a meeting between the Owner and the Contractor, prior to the start of construction.

3.

WARRANTY
3.1 The Contractor will convey to the Owner/Client any warranties by manufacturers or suppliers on individual materials, products or systems supplied by the Contractor. 3.2 The Contractor does not warrant labour and/or materials supplied by the Owner or the Owner's subcontractors. 3.3 All disputes between the parties shall be submitted for amicable discussion and resolution. 3.4 The Contractors warranty excludes remedy for damage or defect caused by abuse, modifications not executed by the Contractor, improper or insufficient maintenance, improper operation, or normal wear and tear and normal usage 3.5 The Contractors warranty excludes defects resulting from misuse, willful act, or faulty workmanship by the Client, his employees, agents or any third party working for or under the direction of the Client 3.6 The Contractors warranty excludes services and/or work that were interrupted by the client, or any parties instructed by the client, without advance notice given to the Contractor(s). 3.7 The Contractor shall correct, at its own expense, any defects in the Work due to faulty materials (6 months) and workmanship (6 months) pursuant to this Contract from the date of Full Completion, unless otherwise indicated. 3.7.1 The Owner / Client shall give the Contractor written notice of such defects within a reasonable time, and in any event within the warranty period 3.7.2 When the contractor is not available immediately; The Owner / Client shall give the contractor reasonable time to attend to possible defects, after a full investigation by Spec 3 Group Investigation at contractors discretion

3.8 The Contractor reserves the right not to carry out work under guarantee where the Client cannot provide evidence that the work was originally undertaken by the Contractor or where payment has not been made for the work undertaken
3.9 The Client shall inspect the work as far as it is reasonably possible to do so immediately upon its

completion and if it considers that the work or any part thereof is not in accordance with the contract, it shall within 7 days give detailed written notice thereof. The absence such notice within the specified 7 day period will invalidate any claim made subsequently. The absence of any such notice, the work shall be conclusively presumed to be free from any defect which would be apparent on reasonable examination
All refunds, at the digression of Spec 3 Group may carry additional charges for processing and returning your payment or partial payment.

EXCLUSIONS
4.1 Unless specifically indicated, the contract price does not include re-routing of vents, pipes, ducts or wiring conduits that may become necessary during removal of walls or cutting of openings in walls 4.2 The Contractor is not responsible for uncarting and installing appliances, unless specified. 4.3 The Contractor is not responsible for the quality, performance or condition of Owner supplied appliances 4.4 Reasonable effort will be taken to protect the driveway/parkway/walkway. However, normal use of heavy equipment, waste bins and/or trucks may cause damage to some driveways. All repairs to the driveway/parkway/walkway, other than as the result of the Contractors negligence, will be the responsibility of the Owner and will be charged as an extra to the quotation/invoice. 4.5 There may be features of the house that do not meet current code requirements. Where such features are not included in the scope of work for the renovation, the Contractor is not responsible for them. 4.6 The Contractor cannot be held responsible for any issues with neighbouring properties movements caused as a result of works damage to drainage systems caused by root penetration or any other outside force.

SAFETY
5.1 All visitors to the site where works are being carried out including owners of the property do so at their own risk. Spec 3 Group will not accept any liabilities for injury should an accident occur. 5.2 When needed, visitors might be required to wear hard hats and/or safety goggles. This will be communicated by the contractor to the owner(s)/clients before the start of the project.

PAYMENT
6.1 Terms of payment are 50% deposit, 25% progress payment and the balance on completion, unless otherwise specified by quote. 6.1.1 Provision could be made at the contractor(s) discretion for late(r) payment. Not exceeding 14 days from the date of invoice. Late payment may result in an interest charge calculated on a daily basis. 6.2 All goods, for whatsoever supplied, shall remain the property of Spec 3 Group until paid in full. Notwithstanding that risk in the goods shall pass to the buyer(s)/client(s) upon delivery, full legal and equitable title and interest in all and any goods supplied by Spec 3 Group to the buyer(s)/client(s) shall remain vested in Spec 3 Group, Including where such goods have been affixed to the land or property and shall not pass to the buyer until Spec 3 Group have received payment in full of all amounts due and owing from the buyer(s)/client(s) to Spec 3 Group for the time being (including any interest accruing and owing to Spec 3 Group.) 6.3 Any disputes with the invoice must be raised in writing within 7 days of the date of invoice. Failure to do this will result in the full invoice amount being made payable.

THE CONTRACTOR
7.1 The Contractor agrees to undertake all Work diligently in good and workmanlike manner, in accordance with good quality residential standards and practices, and in compliance with any applicable Building Code and all other authorities having jurisdiction 7.2 The Contractor agrees to supply all labour, materials and supervision to complete the Work in accordance with the quote supplied / accepted.

DISCLAIMER
8.1 Any feedback, data, answers, questions, comments, suggestions, ideas or the like which Referrer sends to Company relating to the Services will be treated as being non-confidential and non-proprietary. Company may use, disclose or publish any ideas, concepts, know-how or techniques contained in such information for any purpose whatsoever.
