Chapter - I ( Preliminary )

1. (1) This Act may be called the Architects Act, 1972. (2) It extends t the !h le " India. In this Act, #nless the c ntext ther!ise re*#ires, a. ,architect, means a )ers n !h se name is " r the time bein+ entered in the re+isterb. ,$ #ncil, means the $ #ncil " Architect#re c nstit#ted #nder .ecti n 3c. ,Indian Instit#te " Architects, means the Indian Instit#te " Architects re+istered #nder the . cieties /e+istrati n Act, 1012-

d. ,rec +nised *#ali"icati n, means any *#ali"icati n in architect#re " r the time bein+ incl#ded in the .ched#le r n ti"ied #nder secti n 13e. ,re+ister, means the re+ister " architects maintained #nder secti n 23". ,re+#lati n, means a re+#lati n made #nder this Act by the $ #ncil-

Chapter - II ( Council of Architecture )

3. (1) The $entral % &ernment shall, by n ti"icati n in the '""icial %a(ette, c nstit#te, !ith e""ect "r m s#ch date as may be s)eci"ied in the n ti"icati n, a $ #ncil t be 4n !n as the $ #ncil " Architect#re, !hich shall be a b dy c r) rate, ha&in+ )er)et#al s#ccessi n and a c mm n seal, !ith ) !er t ac*#ire, h ld and dis) se " )r )erty, b th m &able and imm &able, and t c ntract, and may by that name s#e r be s#ed. (2) The 5ead '""ice " the $ #ncil shall be at 6elhi r at s#ch ther )lace as the $entral % &ernment may, by n ti"icati n in the '""icial %a(ette, s)eci"y. (3) The $ #ncil shall c nsist " the " ll !in+ members, namely78 a. "i&e architects ) ssessin+ rec +ni(ed *#ali"icati ns elected by the Indian Instit#te " Architects "r m am n+ its members-

(3) The >resident and the @ice8>resident " the $ #ncil shall exercise s#ch ) !ers and dischar+e s#ch d#ties as may be )rescribed by the re+#lati ns. 3. (1) 9lecti ns #nder this $ha)ter shall be c nd#cted in s#ch manner as may be )rescribed by r#les. (2) ?here any dis)#te arises re+ardin+ any s#ch electi n, the matter shall be re"erred by the $ #ncil t a Trib#nal a)) inted by the $entral % &ernment by n ti"icati n in the '""icial %a(ette in this behal", and the decisi n " the Trib#nal shall be "inal7 >r &ided that n s#ch re"erence shall be made exce)t n an a))licati n made t the $ #ncil by an a++rie&ed )arty !ithin thirty days "r m the date " the declarati n " the res#lt " the electi n. (3) The ex)enses " the Trib#nal shall be b rne by the $ #ncil. 1. (1) The $ #ncil shall meet at least nce in e&ery six m nths at s#ch time and )lace and shall bser&e s#ch r#les " )r ced#re in re+ard t the transacti n " b#siness at its meetin+s as may be )rescribed by re+#lati ns. (2) Bnless ther!ise )rescribed by re+#lati ns, nine members " the $ #ncil shall " rm a *# r#m, and all the acts " the $ #ncil shall be decided by a maA rity " the members )resent and & tin+. (3) In the case " an e*#al di&isi n " & tes, the >resident, r in his absence, the @ice8>resident r, in the absence " b th, the member )residin+ &er the meetin+, shall ha&e and exercise a sec nd r castin+ & te. 12. (1) The $ #ncil shall c nstit#te "r m am n+ its members an 9xec#ti&e $ mmittee, and may als c nstit#te ther c mmittees " r s#ch +eneral r s)ecial )#r) ses as the $ #ncil deems necessary t carry #t its "#ncti ns #nder this Act. (2) The 9xec#ti&e $ mmittee shall c nsist " the >resident and the @ice8>resident " the $ #ncil !h shall be members ex8 ""ici and "i&e ther members !h shall be elected by the $ #ncil "r m am n+ its members. (3) The >resident and the @ice8>resident " the $ #ncil shall be the $hairman and @ice8$hairman res)ecti&ely " the 9xec#ti&e $ mmittee. (=) A member " the 9xec#ti&e $ mmittee shall h ld ""ice as s#ch #ntil the ex)iry " his term as a member " the $ #ncil b#t s#bAect t his bein+ a member " the $ #ncil, he shall be eli+ible " r re8electi n. (3) In additi n t the ) !ers and d#ties c n"erred and im) sed n it by this Act, the 9xec#ti&e $ mmittee shall exercise s#ch ) !ers and dischar+e s#ch d#ties as may be )rescribed by re+#lati ns. 11. The >resident, the @ice8>resident and ther members " the $ #ncil shall be entitled t s#ch "ees and all !ances as the $ #ncil may, !ith the )re&i #s sancti n " the $entral % &ernment, "ix in this behal". 12. (1) The $ #ncil shall 8 a. a)) int a /e+istrar !h shall act as its .ecretary and !h may als act, i" s decided by the $ #ncil, as its treas#rerb. a)) int s#ch ther ""icers and em)l yees as the $ #ncil deems necessary t enable it t carry #t its "#ncti ns #nder this Actc. !ith the )re&i #s sancti n " the $entral % &ernment, "ix the )ay and all !ances and ther c nditi ns " ser&ice " ""icers and ther em)l yees " the $ #ncil. (2) : t!ithstandin+ anythin+ c ntained in cla#se(a) " s#b8secti n(1), " r the "irst three years "r m the "irst c nstit#ti n " the $ #ncil, the /e+istrar " the $ #ncil shall be a )ers n a)) inted by the $entral + &ernment, !h shall h ld ""ice d#rin+ the )leas#re " the $entral % &ernment.

(3) All the )ers ns a)) inted #nder this secti n shall be the em)l yees " the $ #ncil. 13. (1) There shall be established a ;#nd #nder the mana+ement and c ntr l " the $ #ncil int !hich shall be )aid all m neys recei&ed by the $ #ncil and #t " !hich shall be met all ex)enses and liabilities )r )erly inc#rred by the $ #ncil. (2) The $ #ncil may in&est any m ney " r the time bein+ standin+ t the credit " the ;#nd in any % &ernment sec#rity r in any ther sec#rity a))r &ed by the $entral % &ernment. (3) The $ #ncil shall 4ee) )r )er acc #nts " the ;#nd distin+#ishin+ ca)ital "r m re&en#e. (=) The ann#al acc #nts " the $ #ncil shall be s#bAect t a#dit by an a#dit r t be a)) inted ann#ally by the $ #ncil. (3) As s n as may be )racticable at the end " each year, b#t n t later than the thirtieth day " .e)tember " the year next " ll !in+, the $ #ncil shall ca#se t be )#blished in the '""icial %a(ette a c )y " the a#dited acc #nts and the re) rt " the $ #ncil " r that year and c )ies " the said acc #nts and re) rt shall be " r!arded t the $entral % &ernment. (1) The ;#nd shall c nsist " 88 a. all m neys recei&ed "r m the $entral % &ernment by !ay " +rant, +i"t r de) sitb. any s#ms recei&ed #nder this Act !hether by !ay " "ee r ther!ise. (7) All m neys standin+ at the credit " the $ #ncil !hich cann t be immediately be a))lied shall be de) sited in the .tate Can4 " India r in any ther ban4 s)eci"ied in c l#mn 2 " the ;irst .ched#le t the Can4in+ $ m)anies (Ac*#isiti n and Trans"er " Bnderta4in+s) Act, 1972. 1=. (1) The *#ali"icati ns incl#ded in the sched#le r n ti"ied #nder secti n 13 shall be rec +nised *#ali"icati ns " r the )#r) ses " this Act. (2) Any a#th rity in India !hich +rants an architect#ral *#ali"icati n n t incl#ded in the sched#le may a))ly t the $entral % &ernment t ha&e s#ch *#ali"icati n rec +nised, and the $entral % &ernment, a"ter c ns#ltati n !ith the $ #ncil, may, by n ti"icati n in the '""icial %a(ette, amend the sched#le s as t incl#de s#ch *#ali"icati n therein, and any s#ch n ti"icati n may als direct that an entry shall be made in the sched#le a+ainst s#ch architect#ral *#ali"icati n declarin+ that it shall be a rec +nised *#ali"icati n nly !hen +ranted a"ter a s)eci"ied date. >r &ided that #ntil the "irst $ #ncil is c nstit#ted, the $entral % &ernment shall, be" re, iss#in+ any n ti"icati n as a" resaid, c ns#lt an ex)ert c mmittee c nsistin+ " three members t be a)) inted by the $entral % &ernment by n ti"icati n in the ""icial %a(ette.

13. (1) The $entral % &ernment may, a"ter c ns#ltati n !ith the $ #ncil, direct, by n ti"icati n in the '""icial %a(ette, that an architect#ral *#ali"icati n +ranted by any #ni&ersity r ther instit#ti n in any c #ntry #tside India in res)ect " !hich a scheme " reci)r city " r the rec +niti n " architect#ral *#ali"icati n is n t in " rce, shall be a rec +nised *#ali"icati n " r the )#r) ses " this Act r, shall be s nly !hen +ranted a"ter a s)eci"ied date r be" re a s)eci"ied date 7 >r &ided that #ntil the "irst $ #ncil is c nstit#ted the $entral % &ernment shall, be" re iss#in+ any n ti"icati n as a" resaid, c ns#lt the ex)ert c mmittee set #) #nder the )r &is t s#b8secti n (2) " secti n 1=.

(2) The $ #ncil may enter int ne+ tiati ns !ith the a#th rity in any .tate r c #ntry #tside India, !hich by the la! " s#ch .tate r c #ntry is entr#sted !ith the maintenance " a re+ister " architects, " r settlin+ " a scheme " reci)r city " r the rec +niti n " architect#ral *#ali"icati ns and in )#rs#ance " any s#ch scheme, the $entral % &ernment may, by n ti"icati n in the '""icial %a(ette, direct that s#ch architect#ral *#ali"icati n as the $ #ncil has decided sh #ld be rec +nised, shall be deemed t be a rec +nised *#ali"icati n " r the )#r) ses " this Act, and any s#ch n ti"icati n may als direct that s#ch architect#ral *#ali"icati n, shall be s rec +nised nly !hen +ranted a"ter a s)eci"ied date r be" re a s)eci"ied date. 11. : t!ithstandin+ anythin+ c ntained in s#b8secti n (2) " secti n 1=, the $entral % &ernment, a"ter c ns#ltati n !ith the $ #ncil, may, by n ti"icati n in the '""icial %a(ette, amend the sched#le by directin+ that an entry be made in res)ect " any architect#ral *#ali"icati n. 17. : t!ithstandin+ anythin+ c ntained in any ther la!, b#t s#bAect t the )r &isi ns " this Act, any rec +nised *#ali"icati n shall be a s#""icient *#ali"icati n " r enr lment in the re+ister. 10. 9&ery a#th rity in India !hich +rants a rec +nised *#ali"icati n shall "#rnish s#ch in" rmati n as the $ #ncil may, "r m time t time, re*#ire as t the c #rses " st#dy and examinati ns t be #nder+ ne in rder t btain s#ch *#ali"icati n, as t the a+es at !hich s#ch c #rses " st#dy and examinati ns are re*#ired t be #nder+ ne and s#ch *#ali"icati n is c n"erred and +enerally as t the re*#isites " r btainin+ s#ch *#ali"icati n. 19. (1) The 9xec#ti&e $ mmittee shall, s#bAect t re+#lati ns, i" any, made by the $ #ncil, a)) int s#ch n#mber " ins)ect rs as it may deem re*#isite t ins)ect any c lle+e r instit#ti n !here architect#ral ed#cati n is +i&en r t attend any examinati n held by any c lle+e r instit#ti n " r the )#r) se " rec mmendin+ t the $entral % &ernment rec +niti n " architect#ral *#ali"icati ns +ranted by that c lle+e r instit#ti n. (2) The ins)ect rs shall n t inter"ere !ith the c nd#ct " any trainin+ r examinati n, b#t shall re) rt t the 9xec#ti&e $ mmittee n the ade*#acy " the standards " architect#ral ed#cati n incl#din+ sta"", e*#i)ment, acc mm dati n, trainin+ and s#ch ther "acilities as may be )rescribed by re+#lati ns " r +i&in+ s#ch ed#cati n r n the s#""iciency " e&ery examinati n !hich they attend. (3) The 9xec#ti&e $ mmittee shall " r!ard a c )y " s#ch re) rt t the c lle+e r instit#ti n and shall als " r!ard c )ies !ith remar4s, i" any, " the c lle+e r instit#ti n there n, t the $entral % &ernment. 22. (1) ?hen #) n re) rt by the 9xec#ti&e $ mmittee it a))ears t the $ #ncil 8 a. that the c #rses " st#dy and examinati n t be #nder+ ne in, r the )r "iciency re*#ired "r m the candidates at any examinati n held by, any c lle+e r instit#ti n, r b. that the sta"", e*#i)ment, acc mm dati n, trainin+ and ther "acilities " r sta"" and trainin+ )r &ided in s#ch c lle+e r instit#ti n, d n t c n" rm t the standards )rescribed by re+#lati ns, the $ #ncil shall ma4e a re)resentati n t that e""ect t the a))r )riate % &ernment. (2) A"ter c nsiderin+ s#ch re)resentati n the a))r )riate % &ernment shall " r!ard it al n+ !ith s#ch remar4s as it may ch se t ma4e t the c lle+e r instit#ti n c ncerned, !ith an intimati n " the )eri d !ithin !hich the c lle+e r instit#ti n, as the case may be, may s#bmit its ex)lanati n t the a))r )riate % &ernment. (3) 'n recei)t " the ex)lanati n r !here n ex)lanati n is s#bmitted !ithin the )eri d "ixed, then n the ex)iry " that )eri d, the .tate % &ernment, in res)ect " the c lle+e r instit#ti n re"erred t in cla#se(b) " s#b8secti n (3), shall ma4e its rec mmendati ns t the $entral % &ernment.

(=) The $entral % &ernment 88 a. a"ter ma4in+ s#ch "#rther en*#iry, i" any, as it may thin4 "it, in res)ect " the c lle+e r instit#ti n re"erred t in s#b8secti n (3), r b. n recei)t " the ex)lanati n "r m a c lle+e r instit#ti n re"erred t in cla#se (a) " s#b8secti n (3), r !here n ex)lanati n is s#bmitted !ithin the )eri d "ixed, then n the ex)iry " that )eri d, may, by n ti"icati n in the '""icial %a(ette, direct that an entry shall be made in the .ched#le a+ainst the architect#ral *#ali"icati n a!arded by s#ch c lle+e r instit#ti n, as the case may be, declarin+ that it shall be a rec +nised *#ali"icati n nly !hen +ranted be" re a s)eci"ied date and the .ched#le shall be deemed t be amended acc rdin+ly. (3) ; r the )#r) ses " this secti n, ,a))r )riate % &ernment, means 88 a. in relati n t any c lle+e r instit#ti n established by an Act " >arliament r mana+ed, c ntr lled r "inanced by the $entral % &ernment, the $entral % &ernment, and b. in any ther case, the .tate % &ernment. 21. The $ #ncil may )rescribe the minim#m standards " architect#ral ed#cati n re*#ired " r +rantin+ rec +nised *#ali"icati ns by c lle+es r instit#ti ns in India. 22. (1) The $ #ncil may by re+#lati ns )rescribe standards " )r "essi nal c nd#ct and eti*#ette and a c de " ethics " r architects. (2) /e+#lati ns made by the $ #ncil #nder s#b8secti n (1) may s)eci"y !hich &i lati ns there " shall c nstit#te in"am #s c nd#ct in any )r "essi nal res)ect, that is t say, )r "essi nal misc nd#ct, and s#ch )r &isi n shall ha&e e""ect n t!ithstandin+ anythin+ c ntained in any la! " r the time bein+ in " rce.

Chapter - III ( Registration of Architects )

23. (1) The $entral % &ernment shall, as s re+ister " architects " r India.

(2) The $ #ncil shall #) n its c nstit#ti n ass#me the d#ty " maintainin+ the re+ister in acc rdance !ith the )r &isi ns " this Act. (3) The re+ister shall incl#de the " ll !in+ )artic#lars, namely 78 a. the "#ll name !ith date " birth, nati nality and residential address " the architect b. his *#ali"icati n " r re+istrati n, and the date n !hich he btained that *#ali"icati n and the a#th rity !hich c n"erred it c. the date " his "irst admissi n t the re+isterd. his )r "essi nal address - and e. s#ch "#rther )artic#lars as may be )rescribed by r#les.

2=. (1) ; r the )#r) ses " )re)arin+ the re+ister " architects " r the "irst time, the $entral % &ernment shall, by n ti"icati n in the '""icial %a(ette, c nstit#te a /e+istrati n Trib#nal c nsistin+ " three )ers ns !h ha&e, in the )ini n " the $entral % &ernment, the 4n !led+e ", r ex)erience in, architect#re- and the /e+istrar a)) inted #nder secti n 12 shall act as .ecretary " the Trib#nal. (2) The $entral % &ernment shall, by the same r a li4e n ti"icati n, a)) int a date n r be" re !hich a))licati n " r re+istrati n, !hich shall be acc m)anied by s#ch "ee as may be )rescribed by r#les, shall be made t the /e+istrati n Trib#nal. (3) The /e+istrati n Trib#nal shall examine e&ery a))licati n recei&ed n r be" re the a)) inted day and i" it is satis"ied that the a))licant is *#ali"ied " r re+istrati n #nder secti n 23, shall direct the entry " the name " the a))licant in the re+ister. (=) The "irst re+ister s )re)ared shall therea"ter be )#blished in s#ch manner as the $entral % &ernment may direct and any )ers n a++rie&ed by a decisi n " the /e+istrati n Trib#nal ex)ressed r im)lied in the re+ister s )#blished may, !ithin thirty days "r m the date " s#ch )#blicati n, a))eal a+ainst s#ch decisi n t an a#th rity a)) inted by the central % &ernment in this behal" by n ti"icati n in the '""icial %a(ette. (3) The a#th rity a)) inted #nder s#b8secti n (=) shall, a"ter +i&in+ the )ers n a""ected an )) rt#nity " bein+ heard and a"ter callin+ " r rele&ant rec rds, ma4e s#ch rder as it may deem "it. (1) The /e+istrar shall amend, !here necessary, the re+ister in acc rdance !ith the decisi ns " the a#th rity a)) inted #nder s#b8secti n (=). (7) 9&ery )ers n !h se name is entered in the re+ister shall be iss#ed a certi"icate " re+istrati n in s#ch " rm as may be )rescribed by r#les.
