Constitution of Local Oakland ARTCC, NATCA

As Amended January 25, 2006

ARTICLE 1 NAME The designation of this Local shall be NATCA-ZOA, constituting a Local of the National Air Traffic Controllers Association (NATCA). ARTICLE 2 OBJECTIVES The objective and purpose of this Local shall be: (1) To improve working conditions for air traffic controllers within the United States, its territories and possessions, and to represent its members in dealing with the Department of Transportation/Federal Aviation Administration and/or Department of Defense and its operating agencies; To insure and enhance the safety of air traffic movement within the air traffic control jurisdiction of the United States, its territories and possessions. ARTICLE 3 MEMBERSHIP SECTION 1. Candidates for membership shall be eligible for membership subject to and in accordance with applicable provisions of the NATCA National Constitution, and such rules as may be adopted by the National Executive Board. SECTION 2. The members of this Local shall be entitled to all rights and privileges of local membership and shall be subject to such duties and responsibilities, including the payment of dues as provided in the National Constitution and as may be properly established by the Local. SECTION 3. Membership in the Local shall be limited to those controllers assigned to the facility. Only members in good standing of the Local may serve as officers of the Local.

ARTICLE 4 STRUCTURE OF LOCAL SECTION 1. The officers of this Local shall be President, Vice President, Secretary and Treasurer. At the option of the Local, the offices of Secretary and Treasurer may be combined into one position.

SECTION 2. There shall be an Executive Board consisting of, at least, the President, Vice President, Secretary, Treasurer, and an Area Representative from each area of specialization (including Staff and Traffic Management). Additional Board Members may be added subject to selection by the President and the consent of a majority of the existing Executive Board Members.

ARTICLE 5 COMMITTEES/LIAISONS SECTION 1. At the option of the Local, the following committees may be established. (1) (2) (3) (4) Safety Committee Communications Committee Balloting Committee Legislative Committee

SECTION 2. The President of the Local may appoint special Committees. SECTION 3. Chairpersons of committees and Local Liaisons will be appointed by the President of the Local subject to consent by a majority of the Executive Board Members. ARTICLE 6 DUTIES AND POWERS OF OFFICERS AND COMMITTEES SECTION 1. The President shall be the executive head of the Local. He or she shall preside at all meetings of the Local. He or she shall maintain contact with regional officers and national officers through the Regional Vice President. He or she shall countersign all checks drawn against the funds of the Local. He or she shall oversee the functioning of the Association, and shall provide them with membership information. He or she shall attend all National Conventions as a primary delegate of the Local. SECTION 2. The Vice President shall assist the President in the discharge of his/her duties. In the Presidents absence, the Vice President shall act in his/her stead. He or she shall perform other appropriate duties as assigned by the President or by the Executive Board. SECTION 3. The Secretary shall keep a record of the proceedings of the Local, the attendance and minutes of local meetings, and all matters of which a record may be deemed advisable. He or she will provide a copy of the minutes of all meetings to all Executive Board Members within twenty (20) days following the meeting. He or she shall make these records available for inspection at all reasonable times to any member. He or she shall keep a list of names, addresses, and phone numbers of all members. He or she shall maintain current information and insure that any changes are coordinated with NATCA Headquarters Field Services Department. He or she shall keep and file all documents, records and communications connected with the business of the Local. At the expiration of his/her term of office, he or she shall turn over to his/her successor all documents and records pertaining to his/her office in this Local.

SECTION 4. The Treasurer shall keep a record of all financial transactions and be responsible to the President for all monetary matters pertaining to the Local. He or she shall countersign all checks drawn against the funds of the Local. In the absence of the Treasurer, the Vice President of the Local may countersign checks drawn against the funds of the Local, however, in no case shall the Vice President countersign for the both the Treasurer and the President on the same check. He or she shall file appropriate LM forms in a timely manner. He or she shall keep adequate records which shall be available for inspection by any member at any reasonable time. He or she shall perform other appropriate duties as assigned by the President. At the expiration of his/her term of office, he or she shall turn over all monies, records, and documents pertaining to his/her office to his/her successor. SECTION 5. The Executive Board shall assist the President in the general supervision and control over the business, funds, and property of the Local. It shall have regularly scheduled meetings and shall have special meetings at the call of the President or on call by one-half or more of its members. Those Board Members present shall constitute a quorum. SECTION 6. The order of attendees to the National Convention shall be first, The President, second, The Vice-President, third, The Secretary, and fourth, the Treasurer. If one or more of the above can not attend, a vote of the Executive Board will determine whom, of the general membership interested, will attend. The Local will absorb the necessary expenses of its representatives at the National Convention. SECTION 7. Officers of the Local shall be bonded, if required by law, at the expense of the Local. SECTION 8. The President shall insure that a copy of the Local Constitution is on file at the NATCA National office and that NATCA Headquarters is provided the names and addresses of the local officers of the union.

ARTICLE 7 - TERMS OF OFFICERS SECTION 1. The President, Vice President, Secretary, Treasurer shall hold office for a two-year period, commencing January, 2002. Elections shall be held during ODD numbered years with terms of office commencing at the beginning of the next leave year. There shall be no restriction on the number of terms that may be held. SECTION 2. In the event of a vacancy in the office of President, the Vice President shall assume the office of President until the next regular election. In the event of a vacancy in the office of Vice President, Secretary, or Treasurer, the Executive Board shall appoint a member to fill the vacancy until the next regular election. Section 3. Area Representatives (including for Staff and Traffic Management) shall represent their areas on the Executive Board for a period of two (2) years and will be selected by a preference poll from within their respective areas. The preference polls shall be held during EVEN numbered years with terms on the Executive Board commencing at the beginning of the next leave year.

Section 4. In the event of a vacancy for an Area Representative with more than 120 days to the next regular preference poll, a special preference poll will be held. If there is 120 days or less until the next regular preference poll, the President shall appoint an Area Representative. Section 5. The length of the terms of the additional board members shall be for the remainder of the current President's term. Section 6. The length of the terms of Committee Chairpersons and Local Liaisons shall be, for the remainder of the current President's term.

ARTICLE 8 - INTERNAL GRIEVANCES Section 1. Any member who has a grievance or complaint concerning the actions of the Local, its officers or any fellow member shall have recourse only through the internal grievance procedure contained in the National Constitution, Article 13 and Bylaws. Section 2. Local officers subjected to internal grievances against them shall remain in office and retain all rights and responsibilities until final resolution of the grievance or the expiration of their term of office, whichever occurs first.

ARTICLE 9 - MEETINGS Section 1. There shall be a minimum of one (1) regular meeting of the membership each quarter. Additional meetings may be called at the discretion of the President or on call signed by a majority of the members of the Executive Board. Section 2. A minimum of fifteen (15) calendar days notice shall be given to the members of any regular meeting; provided however, the president or the Executive Board, as provided in Section 1, may in emergency situations waive the fifteen calendar day notice requirements. ARTICLE 10 - NOMINATIONS AND ELECTIONS Section 1. All candidates for office, as defined in Article 4, Section 1, shall be selected and certified in accordance with applicable laws, rules and regulations. Section 2. Election of officers shall be completed by December 15th of the election year. Section 3. All balloting, for Officers, as defined in Article 4, Section 1, shall be by secret ballot and in accordance with regulations established by the Department of Labor. Section 4. Any and all challenges to election campaigns and/or elections shall be conducted in accordance with the NATCA National Constitution, Article 13.

ARTICLE 11 - AMENDMENTS Section 1. This Constitution may not be amended except by a two-thirds majority vote of the complete NATCA-ZOA Executive Board. Section 2. Challenges to interpretations of this Constitution shall be accomplished in accordance with the National Constitution, Article 14. ARTICLE 12 - GOVERNING RULES Section 1. In the event this Constitution is in conflict with the National Constitution, By-laws or Resolutions, the National Constitution, By-laws or Resolutions shall prevail. Section 2. All regular and special meetings of the Local shall be governed by the National Constitution, By-laws, Resolutions, this Constitution, and by Robert's Rules of Order, Newly Revised.

Oakland Center NATCA Bylaws


1. The President of the Local is authorized to spend $500 for business and $250 for social expenditures. The Executive Board may donate no more than $100 to any individual charity and no more than $1000 total per year to all charities. These limits can only be exceeded by a two-thirds majority vote from the entire Executive Board. The Treasurer shall be responsible for tracking our yearly charitable donations. Any business expenditure over $500 shall be approved by a majority vote of the entire Executive Board. The NATCA-ZOA Travel and Expense Policies and Procedures are incorporated into these bylaws in their totality. The President of the Local is responsible for maintaining the current policies and procedures, as amended. As the NATCA-ZOA Travel and Expense Policies and Procedures are part of these Bylaws, they shall not be amended except in accordance with Article 11, Section 1, of our Local Constitution.

NATCA TRAVEL AND EXPENSE POLICIES AND PROCEDURES


1. INTRODUCTION

This document outlines the NATCA policy with respect to travel and expenses incurred while on NATCA business that will be reimbursed by the local. The types of expenses discussed are Transportation, Accommodation, Meals, and Incidentals. 1.1 Purpose This document provides guidance to NATCA members who will be traveling on behalf of NATCA and sets out the procedures for completing the associated documents (i.e. expense report, travelers profile, etc.). 1.2 Policy The policy is that a member should be reimbursed for all reasonable business expenses incurred while traveling on NATCA business. 1.3 Scope This document is to be used by NATCA-ZOA for travel. The approved traveler shall be provided a copy of this document prior to approved travel. 2. TRAVEL AUTHORIZATION

Any out of town travel requires prior approval of the local President or Vicepresident. Purchases and charges will be reimbursed when submitted on an expense voucher form. Members making unauthorized arrangements may be liable for those amounts personally. 3. EXPENSE VOUCHERS 3.1 Submission of Expense Reports Expense reports shall be submitted to the NATCA-ZOA Treasurer within 30 days of the completion of the trip. The NATCA-ZOA Treasurer will make every reasonable effort to reimburse travelers within 20 working days of receipt of travel voucher(s). Expense reports not properly filled out may cause delays in processing. Travelers are encouraged to keep a copy of their expense reports for their records. Vouchers for expenses not reported within 30 days of travel need not be reported, as they are not eligible for reimbursement. 3.2 Receipts All expenses will be documented with an original receipt attached to the expense report. All expenses whether paid out of pocket or charged to a personal credit card shall be accounted for with a receipt. Department of Labor regulations require a receipt for every reimbursed expenditure.

Expenses not accompanied by a receipt will not be reimbursed. Expenditures should be recorded on the date that they were incurred. 4. TRANSPORTATION 4.1 Air Travel Air travel will be in economy class and efforts must be made to obtain special rates by advance bookings or any other means to reduce the overall travel expenditure. Where possible, it is encouraged that you accept the alternate flight and savings potential. At times, significant savings can occur when taking a connecting flight vs. a direct flight. When this is the case, you are encouraged to take a connecting flight. 4.2 Frequent Flyer Programs NATCA travelers are permitted to retain benefits of a non-cash nature received from frequent flyer programs, but are not permitted to alter travel plans in order to accumulate additional bonus point or other benefits. 4.3 Car Rental The method of transportation (rental car, airport limousine, taxi, and other ground transportation) is dependent upon the location, duration, and nature of the business trip. Cars may be rented when: Local transportation is not available The cost of local transportation exceeds the cost of renting an automobile Scheduling does not permit the use of local transportation Rental car usage must be justified as an economic need and not a matter of personal convenience. When traveling in groups sharing of cars will be practiced to minimize costs. Midsize cars are to be rented unless the size of the group or equipment to be transported makes them impractical. Reimbursement for car rental will be made at the midsize rate. Exceptions must be approved by the President. 4.3.1 Incidental Auto Expenses Receipts must be provided for all purchases of gasoline when utilizing a rental vehicle. Receipts for parking and tolls are required. The employee is responsible for any fines as a result of a traffic violation.

4.3.2 Automobile Accidents All travelers are required to provide automobile collision and liability insurance, or purchase Collision Damage Waiver (CDW) Insurance. All fees for CDW will be reimbursed by NATCA-ZOA.

4.3.3 Personal Car Use Personal automobile usage for an approved business purpose will be reimbursed at a rate equal to the current government POV mileage reimbursement rate, up to the equivalent of the lowest cost commercial air fare to the destination from the point of origin. 5. ACCOMMODATION

Under normal circumstances, travelers should stay at economy hotels: i.e., Courtyard, Hampton Inn, etc. The employee is responsible for arranging the cancellation of guaranteed rooms if the room is not required. The detailed hotel bill is required for use when completing the Travel Expense Voucher. Meal and other charges appearing on your hotel bill should be claimed in the appropriate column on the expense report. 6. MEALS & INCIDENTALS Meal & Incidental expenses shall be reimbursed at the prevailing per diem rate for the area of travel. As Department of Labor regulations limit individual members from being reimbursed more than $600 in any one calendar year without a receipt, members who will exceed that amount will be allowed to be reimbursed for Meals and Incidentals with receipts.

7. TELEPHONE CALLS In many cases, long distance phone calls from hotels are subject to significant surcharges. These surcharges can sometimes be avoided by the use of Telephone calling cards. If you do not have a calling card, please obtain and use one. 8. MISCELLANEOUS EXPENSES 8.1 Tips Tips associated with business travel are included in the per diem.

9. NON-REIMBURSABLE EXPENSES The following are considered to be personal items and are not reimbursable though this should not be considered an exhaustive list. Items of a personal nature such as clothing, shoes, hair cuts, newspapers, magazines Air Travel Insurance Fees associated with obtaining or possession of credit cards Interest charges on your personal credit cards used for business Personal medicine and dental expenses Entertainment expenses (such as airline headsets, movies) Traffic fines, court costs, or bail bonds

Unauthorized club or other membership dues or fees Repairs, maintenance, or insurance on personal cars Mini-bars in hotel room In room movies Personal bar bills 10. CANCELLATIONS NATCA travelers who cancel or otherwise do not attend the scheduled meeting for which they were primarily travelling will not be reimbursed for travel expenditures. For travel extending over a period of more than 1 day, travelers shall be required to attend the majority of each days scheduled meeting(s) in order to be reimbursed for that days travel expense, except in the case of illness or NATCA business of a higher priority. The NATCA Executive Board must individually approve all exceptions to this rule.
