These Su554ementa4 Terms sha44 su5ersede any inconsistent or conf4icting terms in the Binary Code License Agreement, or in any 4icense contained 1ithin the Soft1are. A. Su2<ect to the terms and conditions of this Agreement and restrictions and e8ce5tions set forth in the Soft1are +"%A$M%+ fi4e incor5orated herein 2y reference, inc4uding, 2ut not 4imited to the Ja3a Techno4ogy "estrictions of these Su554ementa4 Terms, Sun grants you a non7e8c4usi3e, non7 transfera24e, 4imited 4icense 1ithout fees to re5roduce interna44y and use interna44y the Soft1are com54ete and unmodified for the 5ur5ose of designing, de3e4o5ing, and testing your Programs. B. License to $istri2ute Soft1are. Su2<ect to the terms and conditions of this Agreement and restrictions and e8ce5tions set forth in the Soft1are "%A$M% fi4e, inc4uding, 2ut not 4imited to the Ja3a Techno4ogy "estrictions of these Su554ementa4 Terms, Sun grants you a non7e8c4usi3e, non7transfera24e, 4imited 4icense 1ithout fees to re5roduce and distri2ute the Soft1are, 5ro3ided that *i, you distri2ute the Soft1are com54ete and unmodified and on4y 2und4ed as 5art of, and for the so4e 5ur5ose of running, your Programs, *ii, the Programs add significant and 5rimary functiona4ity to the Soft1are, *iii, you do not distri2ute additiona4 soft1are intended to re54ace any com5onent*s, of the Soft1are, *i3, you do not remo3e or a4ter any 5ro5rietary 4egends or notices contained in the Soft1are, *3, you on4y distri2ute the Soft1are su2<ect to a 4icense agreement that 5rotects Sun@s interests consistent 1ith the terms contained in this Agreement, and *3i, you agree to defend and indemnify Sun and its 4icensors from and against any damages, costs, 4ia2i4ities, sett4ement amounts and:or e85enses *inc4uding attorneys@ fees, incurred in connection 1ith any c4aim, 4a1suit or action 2y any third 5arty that arises or resu4ts from the use or distri2ution of any and a44 Programs and:or Soft1are. Source Code. Soft1are may contain source code that, un4ess e85ress4y 4icensed for other 5ur5oses, is 5ro3ided so4e4y for reference 5ur5oses 5ursuant to the terms of this Agreement. Source code may not 2e redistri2uted un4ess e85ress4y 5ro3ided for in this Agreement.

In addition to any terms and conditions of any third 5arty o5ensource:free1are 4icense identified in the T/I"$PA"T)LIC%#S%"%A$M%.t8t fi4e, the disc4aimer of 1arranty and 4imitation of 4ia2i4ity 5ro3isions in 5aragra5hs ' and B of the Binary Code License Agreement sha44 a554y to a44 Soft1are in this distri2ution. . Termination for Infringement. %ither 5arty may terminate this Agreement immediate4y shou4d any Soft1are 2ecome, or in either 5arty@s o5inion 2e 4i6e4y to 2ecome, the su2<ect of a c4aim of infringement of any inte44ectua4 5ro5erty right. .. Insta44ation and Auto7&5date. The Soft1are@s insta44ation and auto7u5date 5rocesses transmit a 4imited amount of data to Sun *or its ser3ice 5ro3ider, a2out those s5ecific 5rocesses to he45 Sun understand and o5timiHe them.
