The District Court Action has been tentatively settled. A drat Settlement Ageement and
Stipulation of Dismissal approved by Defndants Norther Flowers, LLC, Plaa I, Inc. and Daniel
L. Gelb (the "Settling Defndants") were conveyed to Plaintift's counseL M. Cargll, who, in tur,
reviewed the same and indicated to me that he thought his client would approve. (Plaintif and the
Settling Defndants had already reache an oral ageement on the basic settlement terms). However,
as of this morng, I have not heard back fom M. Cargill, who is attending a two-day CLE
seminar, and the Settlement Agreement has not yet been executed.
Subject to the Settlement Ageement (in the frm transmitted to M. Cargill on Tuesday, May 25)
not being executed by Plaintif on or befre the hearng on the objection set frth herein, the Settling
Defndants hereby ofer to purchase fr $5,000.00, the Interc;:t domain names descrbed in that
