AFFIDAVIT I, Diane Asato, being duly sworn, do hereby depose and say: INTRODUCTION 1.

I am a Special Agent (SA) with the Department of Homeland Security,

Homeland Security Investigations (DHS/HSI) and have been so employed since June 2003. I am currently assigned to the Child Exploitation Investigations Group (CEIG), where I investigate criminal violations relating to child exploitation and child pornography including violations pertaining to the illegal production, distribution, receipt, and possession of child pornography, in violation of 18 U.S.C. 2251(a), 2252(a) and 2252A. During my tenure with HSI, I have conducted and participated in numerous investigations of criminal activity, including investigations of sexual exploitation of children on the Internet and child pornography transmitted via computer. During the investigation of these cases, I have participated in the execution of numerous search warrants and seized evidence of such violations. I have had the opportunity to observe and review various examples of child pornography in all forms of media, including computer media. I have also successfully completed the ICE Special Agent Training Program at the Federal Law Enforcement Training Center. In this program, I learned about and was evaluated on a number of investigative techniques and subjects, including computer crimes and child pornography crimes. 2. Through my training and experience, I have become familiar with the methods of

operation used by people who are involved with offenses involving the sexual exploitation of children. I have attended training classes and seminars concerning computer crimes and the sexual exploitation of children on the Internet. This training has given me an understanding of how people involved with offenses relating to the sexual exploitation of children use the Internet to further those offenses. My experience in investigations in this regard has supplemented my 1

understanding of how people involved in offenses relating to the sexual exploitation of children use the Internet to further those offenses. PURPOSE OF AFFIDAVIT 3. This affidavit is made in support of a criminal complaint for Robert Dale

SCHRADER for violations of Title 18, United States Code, Section 2251 (production of child pornography). 4. The facts set forth in this affidavit are based upon my personal observations and

training and, where noted, information related to me by other law enforcement officials and witnesses. This affidavit is intended to show that there is probable cause for the requested arrest warrant, and does not purport to set forth all of my knowledge of or investigation into this matter. BRIEF SUMMARY OF INVESTIGATION 5. As set forth in detail below, SCHRADER communicated via email with an

undercover law enforcement officer in England. In these communications, SCHRADER discussed his sexual interest in young boys, discussed engaging in sexual activity with his threemonth-old son, and sent three images depicting the babys penis. A federal search warrant was executed on SCHRADERs home in Los Angeles County on January 29, 2013. The child pornography sent to the undercover officer were found, along with numerous additional child pornography images/videos of depicting SCHRADERs infant son. In various of these images/videos, SCHRADER poses with his penis on the boys face, fondles the babys genitals, and inserts his finger into the babys anus. SCHRADER was interviewed, and admitted to taking photographs of his sons genitals and sending them to others, via email.

PROBABLE CAUSE A. Robert Schrader Sent Child Pornography to Undercover Law Enforcement 6. Between on or about January 14, 2014, and January 28, 2014, United Kingdom

Police Detective Sergeant Andy Nash (Det. Nash), in an undercover capacity online, exchanged emails with an individual using an email address of kids00712@yahoo.com. I have reviewed reports provided by HSI SA Mark Zivilik regarding Det. Nashs investigation, and learned the following: a. On or about January 14, 2014, kids00712@yahoo.com sent an email to

Det. Nash that included an image depicting a boy, aged between 8 and 10 years old lying naked on a garden swing. He is on his back exposing his genitalia. b. On or about January 18, 2014, kids00712@yahoo.com sent an email to

Det. Nash. Kids00712@yahoo.com wrote in the email, Have u ever licked a babys ass. Mmmm then ball fucked. c. On or about January 19, 2014, kids00712@yahoo.com emailed a 22-

second video to Det. Nash, depicting a baby boy, approximately 2-to-3-months-old, lying on his back with his top pulled up so that his tummy and penis are exposed. An adult male penis is being rubbed against the babys penis and testicles. Kids00721@yahoo.com wrote, Do you like??? d. On or about January 22, 2014, kids00712@yahoo.com sent an email to

Det. Nash. Kids00712@yahoo.com wrote, Yes and Id like to put my finger up there butts when they fuck. Lube it up with your cum. I have a 3mo boy. Do u like boy? If so. Tell me what u want me to do to him. His ass is to tight to get my dick up. Only about 1 of my finger will fit up it. Hes uncut. Trying to brake his for skin.

After kids00712@yahoo.com claimed to have access to a three-month-old

boy, Det. Nash reviewed the images that he had received from kids00712@yahoo.com and observed three images that may have been produced by the user of that email account. I have reviewed redacted versions of the three images. All three images appear to depict a baby, approximately three months old, with the focus of the photographs being the genitalia. In one of the images, the toddler appears to be wearing an unsnapped jumper in multiple shades of blue with red trim. f. Det. Nash was able to pull EXIF information from these three

photographs. 1 According to the EXIF data, the photographs were taken with an iPhone5 camera-phone between January 15, 2014, and January 22, 2014. According to GPS coordinates embedded in the photographs, the images were taken at SCHRADERs residence located at 35906 85th Street E, Littlerock, California 93543 (the SCHRADER Residence). 7. On or about January 29, 2014, I reviewed the subscriber information and login

information for kids00712@yahoo.com. According to Yahoo!, this account was created on January 8, 2014 by john doe. Yahoo! is a free email service. When setting up an account, users are requested to provide their names, but Yahoo! does not verify the accuracy of subscriber information provided by the users of their accounts. Therefore, it is extremely common for users to provide inaccurate subscriber information to Yahoo! when setting up accounts, such as Santa Clause or Easter Bunny. However, while not verifying the accuracy of information

provided by subscribers, Yahoo! does automatically log the IP addresses used to access Yahoo!

Information may include dates and times photographs were taken, makes and models of the cameras, technical photograph data such as aperture speed, and Global Positioning System (GPS) coordinates in latitude and longitude of where the photographs were taken. 4

accounts. According to Yahoo!, when the account was created on January 8, 2014, the user of the account accessed Yahoo! from IP address 70.197.69.113. Between January 8, 2014, and January 26, 2014, the user of this account accessed it a number of times; the IP addresses used to access the account were 70.197.83.13, 70.197.64.152, 70.197.67.177, and 70.197.69.113 (the kids00712 IP Addresses). 8. According to Verizon Wireless, on the dates and times the kids00712 IP

Addresses were used to access the kids00712@yahoo email accounts, the kids00712 IP Addresses were assigned to Verizon Wireless subscriber ROBERT SCHRADER, at the SCHRADER Residence. This is the same location embedded in the three child pornography images sent to Det. Nash by kids00712@yahoo.com. 9. On or about January 29, 2014, SA Timothy Alon advised me that he spoke with

Raul Perez. Perez is an investigator for the Los Angeles County Department of Children and Family Services (DCFS). According to Perez, there is a three-month-old baby boy living at the SCHRADER Residence. Specifically, on or about October 21, 2013, SCHRADER was granted custody of his three-month-old infant son, and DCFS records establish that SCHRADER and the baby live at the SCHRADER Residence. B. SCHRADER Produced Numerous Child Pornography Images/Videos of His ThreeMonth-Old Son 10. On or about January 29, 2014, I went with other HSI Special Agents, as well as

law enforcement officers from the Los Angeles Police Department and the FBI to execute a federal search warrant at SCHRADERs Residence. SCHRADER and his three-month old infant

son were both present during the search. 2 Furthermore, we found and seized an iPhone5 cameraphone (SCHRADERs IPhone5) the model of phone used to take the images of child pornography sent to Det. Nash and the blue and white jumper depicted in at least one of these images. We also seized a Toshiba laptop computer (SCHRADERs Laptop). 11. Forensic examinations have begun on SCHRADERs IPhone5 and Laptop. The

email communications between kids00712@yahoo and Det. Nash, and the three images of child pornography that SCHRADER had sent to Det. Nash of his infant child have been recovered from SCHRADERs IPhone5. Further, SCHRADERs Laptop contained hundreds of additional sexually explicit images/videos of SCHRADERs three month old infant son. I have reviewed many of these images/videos. Some of these pictures included only the babys genitals, but others include the infants face. Some of the images/videos depict SCHRADER fondling the babys penis, inserting his finger into the babys anus, and performing oral sex on the baby. In the video depicting SCHRADER performing oral sex on the baby, his face is visible and SCHRADER is identifiable. Based on the EXIF data reviewed thus far, these images were taken in the SCHRADER Residence by SCHRADERs IPhone5. 12. Among the images/videos of child pornography I have reviewed from

SCHRADERs Laptop computer, which appear to depict SCHRADERs three-month-old son, are the following: a. An image filed entitled 1-23-14 062.JPG depicts what appears to be an

image of an adult penis touching the mouth of SCHRADERs son. The infant child is wearing a blue and red shirt. According to the EXIF data embedded in this photograph, it was taken with

I personally saw and interacted with SCHRADERs three-month-old son; any child pornography images/videos depicting this baby depict a real child. 6

an iPhone5 on or about January 22, 2014. According to the GPS coordinates embedded in the photograph, the image was taken at SCHRADERs Residence. b. An image filed entitled 1-23-14 095.JPG depicts what appears to be an

image of a finger digitally penetrating the anus of SCHRADERs son. The infant child is wearing a blue and white shirt and is nude from the waist down. According to the EXIF data, the photograph was taken with an iPhone5 on or about January 22, 2014. According to the GPS coordinates embedded in the photographs, the image was taken at SCHRADERs Residence. c. An image filed entitled 1-23-14 114.JPG depicts what appears to be an

image of an adult penis touching the scrotum of SCHRADERs son. The infant child is wearing a white shirt and is nude from the waist down. According to the EXIF data, the photograph was taken with an iPhone5 on or about January 22, 2014. According to the GPS coordinates embedded in the photographs, the image was taken at SCHRADERs Residence. d. A video file approximately four minutes in length entitled 1-27-14

015.MOV depicts what appears to be an adult hand stroking SCHRADERs three month old sons penis for the duration of the video. The infant child is wearing a blue and white shirt and is nude from the waist down. The video is focused in on the infants penis. According to the EXIF data, the video was recorded with an iPhone5 on or about January 26, 2014. 13. During the execution of the search warrant, SCHRADER agreed to speak with me

and HSI SA Jonathan Ruiz. The following information was provided by SCHRADER: a. SCHRADER and his three-month old son are the only individuals who reside at the residence. b. SCHRADER has an Apple iPhone5 and a laptop computer.

c.

SCHRADER uses his iPhone5 to connect to the internet and his service provider is Verizon Wireless.

d.

SCHRADER created email account kids00712@yahoo less than a month ago for the purpose of downloading and trading child pornography with individuals whom he had met on a website known as imgru. 3 SCHRADER stated that the imgru website contained nude and erotic photos of children.

e.

SCHRADER would transfer the images he took using his iPhone5 to his computer.

f.

SCHRADER admitted to taking photos and videos of his three-month-old sons penis and anus with his iPhone5. He also stated that he emailed those photos to individuals whom he had met on the imgru website.

g.

SCHRADER stated that he got caught up in the moment for the purpose of sexual gratification. He would communicate with people online about sexually abusing children and stated that it was just a game.

h.

SCHRADER denied touching his son in a sexual matter. 4

Based on my training and experience, I believe SCHRADER was referring to the website imgsrc.ru. Although it is rare to find graphic child pornography on this site, it is a well-known meeting place for the online child pornography community; it is a place to share links to child pornography elsewhere on the Internet and to meet likeminded individuals with whom to trade child pornography. As established by the images/videos later discovered on SCHRADERs IPhone5 and Laptop, this was not true. For the Courts information, SCHRADERs son was removed from the home by DCFS at the time of the search warrant on January 29, 2014. The next day, after the images/videos of SCHRADER touching his son in a sexual manner were discovered, SCHRADER was arrested by the Los Angeles County Sheriffs Department for lewd acts on a 8

The images described above were produced using an iPhone5 and a Toshiba

laptop computer. Based on my training and experience, these are materials that have traveled via interstate and foreign commerce, as neither the Apple iPhone5 or the Toshiba laptops is entirely produced in the state of California. CONCLUSION 15. Based on the above-described facts, I submit that there is probable cause to

believe that Robert Dale SCHRADER violated Title 18, United States Code, Section 2251(a) (production of child pornography) when he produced child pornography of his three-month-old son on or about January 22, 2014 and January 26, 2014 .
