Bond. In every case a bond represents debt its holder is a creditor o the corporation and not a part o!ner as is the shareholder. The !ord "bond# is so$eti$es %sed $ore broadly to re er also to %nsec%red debt instr%$ents.

Appearance bond

This is a bond that assures you will appear in a court proceeding' (t is not a catchall bond that co!ers e!erything that will come up in the case' To get the appearance bond you ha!e to gi!e your word )bond* that you will appear to finish settling the accounting' (t is issued by the hearing officer$ if it is re+uested and if there is no contro!ersy' (f you are honorable enough not to start arguing with the hearing officer or the /omplainant$ or the prosecuting attorney$ you can get this bond' There must be no contro!ersy' That fact is established by your !oluntary act of accepting the charging (nstrument for !alue and returning it' (n doing so$ you are e8changing your e8emption )credit* for the discharge of the charge)s*' -ou are bonding your pledge to appear and settle' (f it were not !oluntary$ that would be bondage' -ou must tell the hearing officer that you are not disputing any of the facts' Disp%te; 0 conflict or contro!ersy3 an assertion of a right$ claim$ or demand on one side$ met by contrary claims or allegations on the other' The sub?ect of litigation3 the matter for which a suit is brought and upon which issue us ?oined$ and in relation to which ?urors are called and witnesses e8amined' .hen you enter a dispute$ you ?oin the issue and confirm the e8istence of what was ?ust an idea$ making it materiali<e and gi!e sub?ect matter that can be tested by a ?ury or witnesses' 6nce you ask for the bond$ it is yours' (f you ask for it again$ it will appear that you do not know you already ha!e it$ and the hearing officer will proceed as though he is talking to a debtorKstraw man' 0 debtorKstraw man does not automatically get an appearance bond' (t may be re+uired to pay for a bail bond' 0n appearance bond with conditions incorporates a cost to you' (f you ha!e re+uested the appearance bond at no cost to you$ there will be no conditions to the release' (f you do not ask for it that way$ there may be conditions C like drug testing$ re+uired meetings with court officers$ or re+uired daily or weekly phone calls' Those are a cost to you$ as they take your time and your property' (f you dont appear 04D settle the accounting$ you will be in dishonor of your word )your bond*$ and the appearance bond will be re!oked' They will not tell you it has been re!oked' -our dishonor will then be used to carry out the presumption that you are representing the straw man in a fiduciary capacity$ and that you are in breach of your fiduciary duty' That is not allowed in e+uity' Then the debt of the straw man will be put on you' (f there is not enough property held in the name of the straw man to co!er the dishonor$ or if you as trustee refuse to turn o!er the trust property to settle the debt' They will take your body as surety for the debt' (t is the trustees body being taken' -ou !olunteered to be the trustee' Char(in( order* 0 statutorily created means for a creditor [9laintiff] of a ?udgment debtor [Defendant] who is a partner of others [you] to reach the debtors beneficial interest in the partnership [your /redit]$ without risking dissolution of the partnership' >niform 9artnership 0ct$ ss EJ' The purpose of the court case is for the ?udge to test the facts of an accounting' 7e is the auditor in a possible dispute between a creditor and a debtor' The creditor always wins' (t is a matter of how much the debtor will pay that is being determined in a court case' A%dit; ,ystematic inspection of accounting records in!ol!ing analysis$ tests$ and confirmations' The hearing and in!estigation had before an auditor' 0 formal or official e8amination and authentication of accounts$ with witness$ !ouchers$ etc' [= audit he hears$ a hearing$ from audio C to hear-

Case bond
