States December the Seventh, 2013 RE: Cease and desist from Unwanted Disruption To Whom It May Concern: This CEASE AND DESIST ORDER is to inform you that your denial of service to the victim and to the Mobility Corporation has caused unwanted disruption to both parties. You are ORDERED TO STOP such activities immediately as they are being done in violation of the federal law.[1] Again, you must IMMEDIATELY STOP the unlawful denial of service to AT&T consumer Ryan Germinaro, and send a written and faxed confirmation that you will stop such activities. You risk incurring some very severe legal consequences if you fail to comply with this demand. This letter acts as your final warning to discontinue this unwanted conduct before legal actions will be pursued against you. At this time, there has been no civil suit filed against you. The victim and AT&T LLC are not under any circumstances, however, waiving any legal rights they have presently, or future legal remedies against you by sending you this letter. This order acts as ONE FINAL CHANCE for you to cease your illegal activities before legal action can and will be taken. To ensure compliance with this letter, and to halt any legal action that may be taken against you, you are required to fill in and sign the attached form and mail it back to the law office of Dewey & LeBoeuf within 10 days of your receipt of this letter. Failure to do so will act as evidence of your infringement upon the victim and AT&T LLCs legal rights, and the law office of Dewey & LeBoeuf will immediately seek legal avenues to remedy the situation. CEASE AND DESIST COMPLIANCE AGREEMENT I, Andy Shullman, do hereby agree to stop the unlawful denial of service which are in violation of the rules and regulation standards created by AT&T LLC. I understand that this is my final chance to cease these activities. I understand that Ryan Germinaro, AT&T LLC, and the law office of Dewey & LeBoeuf potentially has the right to pursue legal action against me relating to my engagement in these activities, but Ryan Germinaro, AT&T LLC, and the law office of Dewey & LeBoeuf will not pursue those rights in contemplation of my compliance with this written demand. I further understand that Ryan Germinaro, and AT&T LLC have not waived their rights and may pursue legal remedies against me if I fail to abide by this agreement. I understand that this agreement is not specifically limited to the activities named herein. I will not engage in any activity now or in the future done for the purpose of denying service to the AT&T LLC licensed user Ryan Germinaro. I furthermore agree not to engage in any activity, regardless of its official title, that is done in violation of Ryan Germinaro, AT&T LLC, or the law office of Dewey & LeBoeufs legal rights. If I fail to cease performing these activities, Ryan Germinaro, AT&T LLC, and the law office of Dewey & LeBoeuf may pursue legal action against me in accordance with their legal rights as a citizen of the United States, a corporation and a law firm respectively. This agreement acts as a contract between Andy Shullman and the victims of the unlawful denial of service, Ryan Germinaro and AT&T LLC. Forbearing enforcement of legally enforceable remedies is sufficient consideration to support this agreement. This agreement represents the entire agreement between the parties. Any statements made orally, written, or otherwise which are not contained herein shall have no impact on either parties rights or obligations elaborated in this agreement.
