Historically, jehez is an old custom spawned by ancient laws of inheritance in the subcontinent which denied daughters their due

share from their parents estates. To compensate the deprived daughters, parents devised a system which enabled them to find a way of avoiding the law to give them large chunk of their wealth. Gradually taking root in the society, the practice of doling out expensive items in dowry become a component of Hindu society. The custom then gradually became an incumbent aspect of Muslim culture as well. We seem to have forgotten the noble traditions set by The Holy Prophet (pbuh) who gave only a few items to his daughter Fatima (ra) shortly after her marriage was solemnised with Hazrat Ali (ra). The items gifted to her by the Holy Prophet (pbuh) included a manual grinding mill, a pillow, a chader, a mashkeeza and a few utensils made by of clay. The Holy Prophet (pbuh) gave those items to his daughter, for the reason that Hazrat Ali (kaw) did not seem to have much to start a new life with. Why have we not succeeded in purging this social evil? Should not the government enforce strong legislative measures to combat this menace. If we are serious in our desire and efforts to eradicate jehez, we should first try to prevail upon the rich to stop indulging in an unnecessary show of wealth. Educating the people backed by the personal example of the powerful such as politicians will bring about the desired change in attitude to eradicate the social evil.

DOWRY (JAHAIZ), A CURSE


Dowry (jahaiz) is the curse that gives the helpless death to the thousands peoples. In many homes where young girls are stays in their parent s home for long time just because of this curse. If without Dowry (jahaiz) any girl get married after few days her burnt death body would giving to her parents and her parents cannot say a single word because they don t have enough money to fight with. An innocent girlwhose parents nourish her with lots of love and care would be the victim of Dowry (jahaiz). The course of Dowry (jahaiz) mostly present in India, Pakistan as well as Bangladesh. In Pakistans villages and towns mostly people kill the baby girls without any reason. The abuse rewinds the memories of illiterate era when girls lively buried. They use to bury girls just on the name of honor, and now we are killing girls just for the Dowry (jahaiz) How long this curse will goes on and how long parents will suffer due to this curse. The fear of Dowry (jahaiz) makes the birth of the girls a disappointing event and they afraid to give birth to girls. Rich people make that tradition to give the heavy Dowry (jahaiz) to their beloved daughter due to which grooms families make it their business of income. For the purpose of income they kill or burn the bride and would become free to remarry with new one and they give it a picture of an incident. Where those brides have gone? Few of them have burnt, few of them compelled to suicide, few of them have divorced and they Confiscated their whole Dowry (jahaiz) and the parent stay quite just because of disgrace.

What is dowry (jahaiz)?


Dowry (jahaiz) is the process for the bride family to provide grooms money and expensive goods in exchange of their daughters marriage. According to the survey, the Dowry (jahaiz) is equal to the seven years salary of an employer. It is hardly affordable by parents but they are compelled to give Dowry (jahaiz) with their daughter if they want to marry their daughter.

Why grooms parent demand dowry (jahaiz)?

Because they want to fulfill their needs and demand which cant be possible in their sons income and they want to lift up their living standard in society. Due to these circumstances some educated people have come up and speak about this curse that they dont want Dowry (jahaiz) May majority will get thisawareness. And our daughters will marry honorably without Dowry (jahaiz) Then it will be very good for many and poor parents. No girl will stay at their parents home. Our HOLY PROPHET HAZRAT MUHAMMAD SALLALLAHU ALAIHI WASALLAM has also given Dowry (jahaiz) to his daughter but that Dowry (jahaiz) consists of necessary thing. But we cant give the practical application like HOLY PROPHET HAZRAT MUHAMMAD SALLALLAHU ALAIHI WASALLAM A hadith said about this Dowry (jahaiz) as:

The most advantageous Nikah (wedding) is the one which is the easiest.
The summary of the hadith is an easy and advantageous is that in which there is no extra burden on the shoulders of brides parents by the useless demand of grooms family. If we try and try harder there will be a law that to give Dowry (jahaiz) and to take Dowry (jahaiz) is a crime. Today well established people arrange marriages of many girls just for the pleasure of ALLAH and also give necessary thing to bride through which they help poor parents. In the end I pray to ALLAH that may the curse of Dowry (jahaiz) will remove from our country and as well in our culture, and the live of many married girl will may save and secure.

As time passed, human greed turned it into a social ill. People started demanding Dowry, before marriage and also after marriage as if it was their right. Poor people were forced to take loans or had to sell off their land, in order to meet these demands. This practice later further degenerated and brides started facing trouble and torture after marriage, to bring in additional +dowry. Many a time torture would turn it into bride burning. They would make up a story saying it was akitchen accident just to save their face. The government woke up to this problem and the +Dowry +Prohibition +Act was passed in 1961. The practice had such deep social roots, that nothing much could be done. In a few cases the accused could be actually punished. It is very difficult to prove a dowry case. The dowry cases have dipped , but the nightmare is far from over. +Brides are still burnt for dowry in some parts of our country. According to the +Dowry +Prohibition +Act, any person who takes or gives dowry, or abets in taking and giving dowry, shall be punished with fine or jail, or both. Any agreement of taking and giving of dowry is void. +Dowry can be demanded in any form, property or valuables, given or agreed to be given either directly or indirectly, by one party in the marriage to the other party. Beside the +Central +Dowry +Act, +State +Governments have enacted their own laws to deal with the dowry issue. For example, the +Himachal +Pradesh +Government prohibits more than 25 people in the marriage party and +Punjabhas restricted the number of meals to be served to the guests in the marriage party to two meals. The +Indian +Penal +Code strictly punishes in bride burning cases, other cruelty and torture to brides. +Section+498A is a strong provision in the court. +Section +198A of +Criminal +Procedure +Code fixes the procedure for theenforcement of such provisions. The +Indian +Evidence +Act provides that the accused has to bear the burden of proof. When a case involves a suicide by a woman within seven years of her marriage or a death of a woman within seven years of her marriage, under suspicious circumstances, the court will presume that the accused is guilty of abetment of suicide and the +Magistrate can hold an enquiry of his own , apart from the police enquiry. The dowry system is a curse for the society. It is really a blot on our society. The evil of dowry is a deep rooted one. The system has made the condition of women in Indian society very miserable. Unless this system is abolished, Indian society can make no progress. The dowry system is not new for India. It is very old system. It was also present in the days of Gautam Buddha and Mahavir. But in those days there was no compulsion. The parents willingly gave presents, ornaments and money to their daughters at the time of their marriage, but in modern times this system has taken a very ugly shape. It has now become a compulsion. It is now demanded and settled after a hard bargain. The boys are now sold in the open market on the highest price. The parents have to purchase them for their daughters. Even if the girl is equally or highly qualified and career girl still boys parents in terms of dowry demand what they have spent on their sons education, career, business etc. When parents are unable to meet dowry demand their daughters are compelled to accept unmatched marriages. As a result of this system, many young brides commit suicide. This system has made the lives of poor parents of girls miserable. If they are unable to arrange a rich dowry, they find it difficult or rather impossible to marry their daughters to suitable young boys. Thousands of poor girls are compelled to pass unmarried life on account of this evil. The birth of the daughter in the house becomes a cause of great worry for the parents. Their lives become miserable. Sometimes they have to take loans and remain in debt throughout their lives. Some parents earn money by immoral means for the marriage of their daughters. Some parents are compelled to give their daughters in marriage to old men or widowers. Brides who do not bring rich dowry with them are ill-treated. They are insulted and beaten and sometimes even killed. There is an awakening in the society against the dowry system now. It has drawn the attention of the government. Anti-dowry Act was passed in 1961, but it could not bring any major change in the society. During the emergency, the government again showed deep interest in rooting out this evil. Many State Governments passed Dowry Acts. Now public meetings are often held in towns and cities to consider ways and means of checking this evil. The youth should appose the direct and indirect ways of offering and accepting dowry. Anti-dowry Act which passed to check the evil, is now being misused by many girls. In many cases it has been found that after marriage girls use this Anti-dowry Acts as a means of blackmailing their in-laws for not fulfilling all their unreasonable demands. Hence there is need to make some amendments in the Act and no investigate anti-dowry cases seriously. In short, no law will be able to abolish this menace. It is a social problem and can be fought on the social level alone.

The dowry system is an age old system and a peculiar phenomenon of the Indian society. It is, as today, a curse to the society. Dowry is the name given to all that, the parents of a girl give to her when she gets married. At the face of it, the system seems quite appropriate, healthy and logical, for, in this simple way, the parents of the girl help her in setting a new home. So far, so good and, originally also the purpose of dowry was very justified and understandable. Let us now analyze how and why this system took birth at all? In the earlier times of Indian society, the daughter had no share in the father's property so, by way of dowry the girl would get at least some portion of her share. Besides this, in those days, the girls were not educated so, this dowry could serve the girl as a back up support system in case of any emergency after her marriage. Seeing this as the ground reality and the reason for the system for having taken birth, no right thinking people would call the system wrong or unjustified. However, with the passage of time this same fine system has taken the ugly shape of begging for dowry, bargaining for dowry, auctioning the boy to the highest bidder and finally suicides. This is because, taking advantage of the system, the parents of the boys, have started demanding dowry. This was never done in the original shape of the system. The girl's parents would give whatever they could and, there would be NO - yes, NO demands from the boy's side. Besides demanding items of dowry, now parents of the boy's family keep items of the dowry for their own use. This was also not in the original system for, whatever was given was for the girl only - and never for the boy's family. These two additions in the original system have converted the blessing for the girl into a curse for her. The parents who cannot afford to meet the demands of the boy's family are forced either into taking loans that they can never return, or use unfair means of corruption to make money to meet the demanded expenses. In turn, this has led to even committing suicides by the girls or murders of girls by the in-laws. At times even before the marriage, the girl is led to kill herself to save her parents from the trauma of collecting money for her marriage. Thus, we see that, a system that was at one time very wise and discreet, has taken an ugly shape just because of the greed of men and women in to-day's world. This system of dowry has become a slur on the Indian society. Besides being a shame, in to-day's scenario, the system as it was even in the initial stages of its existence, has become quite irrelevant. This is because, both the reasons for its birth are now not in vogue. These days, girls are usually educated and can earn a livelihood if need arises, and, they now also have a share, an equal share as the brothers have in the father's property.

That means the necessity of the girl having an amount to reach out in the days of crisis or emergency does not hold good any more. So, when the very basis of the system does not exist, the system should be scrapped altogether. This is because, the system instead of bringing solace, only generates greed and even crime in several cases. My view is that, the system as it exists should be put to an end and all those who indulge in it should be punished severely.
