Rangkuman Indonesia-Japan Economic Partnership Agreement (IJEPA) Sektor Jasa dan MNP
Di dalam Indonesia-Japan Economic Partnership Agreement (IJEPA) terdapat persetujuanpersetujuan yang telah disepakati bersama antara pihak Indonesia dan pihak Jepang sejak diratifikasi pada tahun 2008. Persetujuan-persetujan tersebut disusun dalam 15 chapter dengan 154 article dan 12 annex. Adapaun rangkuman berikut berisi catatan ringkas tentang persetujuan perdagang jasa (Trade In Services (TIS)) dan persetujuan pergerakan orang perseorangan (Movement of Natural Person (MNP)) dalam kerangka IJEPA. A. Text Persetujuan Perdagangan Jasa (TIS) Pembahasan persetujuan perdagangan jasa (Trade In Services (TIS)) dalam IJEPA terdapat dalam Chapter 6. Chapter 6 ini berisikan 16 article yang terdiri atas article 76 sampai dengan article 91. B. Annex TIS Ada 3 annex yang terkait dengan persetujuan perdagangan jasa (TIS). Ketiga annex tersebut adalah annex 7 mengenai Fianacial Services, annex 8 mengenai Schedules of Specific Commitments in relation to Article 81, dan annex 9 mengenai Lists of Most-Favoured-Nation Treatment Examptions in realation to article 82. 1. Financial Services (Annex 7) Lampiran financial services ini berlaku untuk tindakan-tindakan yang mempengaruhi pemasokan jasa keuangan. Dalam annex 7 ini terdapat 4 section (bagian). Section 1 mengenai scope and definition, secton 2 mengenai domestic regulation, section 3 mengenai recognition, dan section 4 mengenai dispute settlement 2. Dalam Schedule of Specific Commitment Indonesia terdapat horizontal commitments untuk semua sektor jasa yang tercakup dalam schedule. Horizontal Commitments tersebut terkait moda 3 dan moda 4 baik dalam limitasi market access maupun limitasi national treatment. Untuk moda 3 dalam market access, penyelenggara jasa asing bisa hadir dalam bentuk perusahaan usaha patungan dan/atau dalam bentuk kantor perwakilan. Jika dalam bentuk perusahaan usaha patungan harus berbentuk perseroan terbatas (PT) dan kepemilikan saham modal asing dibatasi hanya sampai 49 %. Sedangkan untuk moda 4 dalam market access pekerja asing yang dizinkan hanya direktur, manajer dan ahli/penasehat teknis. Mereka diijinkan untuk tinggal selama dua tahun dan ijin tinggal tersebut bisa diperpanjang maksimal dua kali. Ijin

masuk dan tinggal sementara (para) pengunjung usaha diijinkan selama jangka waktu 60 hari dan ijin tinggal tersebut bisa diperpanjang selama maksimum 120 hari. Untuk moda 3 dalam national treatment para wajib pajak non-residen akan dikenakan pajak sebesar 20% jika mereka memperoleh pendapatan dari bunga, royalti, dividen ataupun upah dari jasa yang dilaksanakan di Indonesia. Selain itu ditambahkan terkait dengan akuisisi tanah mengikuti Undang-Undang Pokok Agraria No. 5 tahun 1960. Sedangkan untuk moda 4 dalam national treatment menyatakan bahwa para pekerja asing dikenakan biaya yang dipungut oleh pemerintah sentral dan lokal. Serta berdasarkan hukum dan peraturan perburuhan para pekerja asing harus mendapatkan ijin kerja yang masih berlaku yang dikeluarkan oleh Kemenakertrans.

Pembahasan persetujuan Pergerakan Orang Perseorangan (Movement of Natural Persons (MNP)) dalam IJEPA terdapat dalam Chapter 7. Annex 10 (Specific Commitments for the Movement of natural Persons) merupakan lampiran sebagaiaman yang disebut di dalam Chapter 7. Annex 10 ini memiliki 2 bagian (part). Part 1 mengenai Specific Commitments of Japan dan Part 2 mengenai Specific Commitments of Indonesia. Dalam bagian-bagian (part) ini terdapat beberapa sub-bagian di dalamnya.
