NATIVE AMERICANS AT DARTMOUTH CONSTITUTION Article 1. Name of Organization 1.01.

The name of the organization shall be Native Americans at Dartmouth, which hereafter shall be referred to as NAD. Article 2. Objectives and Purposes 2.01. The purposes for which NAD is to be organized shall be consistent with the aims and objectives of a liberal arts education as pursued by Dartmouth College. No purpose or objective of the Organization shall be in conflict with applicable state or federal laws presently in force or hereafter enacted. 2.02. The specific purposes and objectives which Native Americans at Dartmouth shall be organized to pursue include: to serve as a community for all interested Native American students at Dartmouth College, and any others; to foster, advance and promote Native American cultures and heritage; and to serve as a line of communication between members of other organizations and offices on campus and/or other organizations at other campuses. 2.03. Hazing practices within the organization are prohibited pursuant to New Hampshire State law as stated in the Handbook. Article 3. Membership 3.01. Membership in NAD shall be open to all members of the Dartmouth Community without regard to race, color, creed, sex, physical ability, sexual orientation, or national origin. The organization must have at least ten (10) undergraduate members. In no event shall more than twenty-five percent (25%) of the Members be non-Dartmouth students. All officers must be Dartmouth undergraduates. 1. The Secretary shall keep a list of confirmed Members, which shall serve as the basis of an email list. Members may declare their membership to the Executive Board if they choose not to subscribe to the email list. 2. If questions arise about an individuals membership in NAD, the Executive Board shall have the ability to confirm his or her membership. 3.02. All Members (herein so-called) shall have equal rights and privileges with respect to the election of the Officers of NAD. Membership may be taken away from any person who, in the opinion of the other members, is a threat to the good and welfare of NAD community and its members by the following procedure:

1. A written statement including an explanation must be submitted to the most senior

Officer not being charged. 2. At the Executive Board meeting immediately following receipt of the complaint, both parties will be invited to present their case. 3. There must be a (or closest corresponding percentage) majority vote of the Executive Board to bring the complaint before the Members. The complaint is to be brought before the Members in the following manner: 1. The Co-Presidents shall set a meeting date and notify all Members on campus at least one (1) week in advance. 2. Official written notification of the action and explanation and date of Meeting shall be given to all Members on campus at least one (1) week in advance. 3. A (or closest corresponding percentage) majority of Members present at the Meeting is necessary to terminate Membership. Termination of membership entails revocation of voting rights, removal from email lists, and retraction of ability to attend official NAD events. The appropriate College authorities shall also be contacted, should the situation warrant it. Article 4. Officers and Duties 4.01. The Officers of NAD shall consist of Co-Presidents, a Secretary, a Treasurer, Co-Social Chairs, a Historian, and a representative to the appropriate cross-community organization. These Officers, with the exception of the cross-community representative, shall constitute the voting members of the Executive Board (herein so-called) of NAD. 1. The Co-Presidents should, as far as it is possible, be on campus during the entirety of their tenure. In the extreme event that they are not on campus during any term of their tenure, the membership of NAD shall have the ability to empower the Summer Term President of the most recent or closest upcoming Summer Term to serve as an interim Co-President. a. During elections, the membership of NAD shall be notified of the above provision. 2. For summer term, a one-term executive board will be elected. There shall be at least a President, Treasurer and Secretary. 4.02. No non-Dartmouth undergraduate student shall be eligible to be an Officer of the Organization 4.03. Any Dartmouth undergraduate eligible to be an Officer of the Organization shall not be permitted to hold more than one office in that organization at any one time.

4.04. The Co-Presidents shall call all meetings of the Membership, regular or otherwise, and shall serve as the chairman of such meetings. In case of a tie vote that requires a simple majority, the Presidents shall act as tiebreakers. The Presidents shall open and close all meetings, one Co-President must be present in order to hold a NAD meeting. The Presidents shall also be responsible for receiving incoming correspondence and presenting relevant materials to the Voting Membership for consideration. The Presidents with the Treasurer shall prepare and present a termly budget request to COSO. In addition, the Presidents shall attend all Native American Council Meetings. 4.05. The Treasurer shall be responsible for maintaining complete, up-to-date, and accurate financial records of NAD and shall be solely allowed to request checks or purchase orders on behalf of NAD. The Treasurer, with the Presidents, shall prepare and present a budget to COSO in the beginning of each term for which elected and will meet with COSO at their request to discuss any other financial matters which might arise. In addition, when requested, the Treasurer shall present the current financial statement at the Meeting. The officers shall insure that all funds are properly kept within the College accounting system. No outside accounts are permitted. 4.06. The Secretary shall be responsible for recording accurate, permanent and complete minutes (including Membership) of any Meeting, regular or otherwise, of the Membership or the Executive Committee. The Secretary shall also record all votes of the Membership or Executive Committee. The Secretary shall be responsible for the writing and distribution of a newsletter or other notices to the Membership informing them of any Meeting or other gathering of NAD, and furthermore shall at all times maintain an accurate and complete list of the Membership of NAD. 4.07. The Co-Social Chairs shall organize routine NAD functions, including social gatherings not already outlined as a duty for other Officers. Furthermore, the Co-Social Chairs is responsible for all funds issued to him/her for official social activities of NAD. 4.08. The Inter-Community Council Liaison shall attend all I-CC Meetings on behalf of NAD. If the Liaison cannot attend meetings the Co-Presidents may contact the I-CC Co-Chairs to ensure the voice of the community is being heard and represented. The Native community liaison shall apply to the I-CC Executive board in order to be elected. 4.09. Historian is in charge of all visual aspects of NAD, meaning the board at the NAH and NAP lounge and social media. The Historian should also take photos of events as requested by Executive Board members. In Spring Term, the Historian should help to assemble visuals for an end of the year slide show.

4.10. Any Officer of NAD may resign at any time by delivering a written notice of such resignation to the Executive Board ideally with one weeks notice. 4.11. The Executive Board shall invite the individual who received the second-most number of votes to assume the vacated position. If that individual should decline or not be on campus, an election shall be held at the earliest opportunity, adhering to the rules set out in Article 6, to fill the position. In extreme cases the Co-Presidents may appoint an individual to fill the position. 4.12. Any Officer of NAD may be removed without the individuals consent from such office by a majority vote by the Executive Board. 4.13. All Members, including Officers, are not to make official statements on behalf of NAD, unless specifically authorized by the Executive Board. 1. The Co-Presidents shall have authority to make official statements on behalf of NAD at any time, but should consult with the Executive Board whenever possible. 4.14. The Advisor to NAD shall be a Dartmouth faculty member. The Advisor shall provide guidance and administrative assistance according to the need of NAD as determined by the Executive Board. Article 5. Quorum and Meetings 5.01. A quorum shall exist at any Executive Board meeting where no more than 1 member is absent. Business not requiring a vote of the Executive Board shall not require a quorum. 5.02. Regular Meetings (herein so-called) of NAD shall be held at least once per week at such time and place to be determined by a simple majority vote of NAD. 5.03. Any member in residence at Dartmouth may request a Special Meeting (herein so-called) of the Membership. To request a Special Meeting a written statement must be given to the Executive Board, to hold the Special Meeting a simple majority vote of the Executive Board is required. 5.04. All members shall be notified of any Special Meeting and the nature of the business to be transacted at least one day before such Special Meeting. No Special Meeting shall be called with the intent to exclude any one member or any portion of the Membership. 5.05. The Executive Board of NAD shall meet at least once before any meeting of the Membership at such time and place to be determined by the Executive Board. At such meetings

of the Executive Board a quorum shall be present as detailed in Article 5, Section 1. Executive Board meetings shall be open to NAD as a whole unless otherwise stated for special purposes. Article 6. Voting 6.01. Voting rights will be granted to general members who attend two NAD meetings and/or events during the term which voting takes place. (If you are off campus during the term in which the voting takes place, you are eligible to vote if you have fulfilled these requirements during the last term you were on campus). 6.02. Each voting member shall have one (1) vote. 6.03. Voting shall take place, to the extent possible, in person with voting privacy. No online voting shall take place save for special circumstances with the approval of the Executive Board, votes shall be sent in to the NAD email account. 1. The Secretary shall have the responsibility of confirming that voting individuals are members of NAD. 2. In the event that the Secretary questions the eligibility of a voter or suspects any sort of fraud, the Executive Board shall have the authority to develop an appropriate response, including rejecting inauthentic votes or holding a new election. 6.04. In the event of conflicting interpretations of this Article, the Executive Board shall have the final interpretive authority and may exercise that authority by a vote of the Board. Article 7. Miscellaneous 7.01. In order to hold a vote to ratify, amend, or repeal this Constitution, a quorum consisting of two-thirds of the voting membership of NAD, adhering to the rules of Article 6, shall be established.
1. Once a quorum has been established, this Constitution may be amended or

repealed by a two-thirds majority vote of the voting members of NAD as verified by a referendum of the Membership to be held at the earliest opportunity, as determined by the Executive Board. 2. Once a quorum has been established, this Constitution may be ratified by a twothirds majority vote of the voting members of NAD as verified by a referendum of the Membership to be held at the earliest opportunity, as determined by the Executive Board. 7.03. This Constitution and any amendments and changes hereto shall be kept on record with the appropriate College authorities and shall be available to any Member of the Organization for inspection during reasonable office hours.

7.04. In the course of an election, no candidate for an Executive position may speak for more than 2 minutes.
