INTRODUCTION

This report was issued to clarify the development of telecommunications structures that do not meet specifications outlined by the Technical Agencies or Local Authorities. It is related to the rules, regulations and guidelines issued by Technical Agencies and Local Authorities are to be followed by developers to build telecommunications structure. This report also provides a clear picture of the current state of the site and the matters that lead to noncompliance with the guidelines. In addition, this report also stated the solutions which can be considered by the client to make a decision about the particular site.

EXISTING SITUATION

The site which located in Pekan Kuala Perlis have been developed with a 45 meters high 3-legged tower type of telecommunication structure.

However, the telecommunication tower structure is placed too close to the existing residential building. There is a requirement from Malaysian Communications and Multimedia Commission (MCMC) that the developer need to follow for the submission to be accepted by the MCMC as well as the Local Authority, in this case Majlis Perbandaran Kangar. According to Malaysian Communications and Multimedia Commission (MCMC), the minimum distance between a telecommunication tower structures to a nearest house building is 30 meters for a tower height 45 meters and above. The highlighted cell in table below shows the requirement of MCMC for this site. (BRIEFLY EXPLAIN ABOUT THE GUIDELINE)

From the site visit conducted, our team found out that the distance between the telecommunication tower structure and the nearest residential building is less than 30 meters. This will cause problems in the future for not following the provided guideline and the Local Authority will simply reject the legalizing application for this site. (WHAT HAVE YOU FOUND ON THE SITE)

SOLUTION

There are two (2) solutions that can be considered for this site. (THE SOLUTIONS MAY VARIES DEPENDS ON EACH WHICH GUIDELINE THAT IT FAILED TO COMPLY) 1. SEARCH FOR A NEW SITE First option is to search for a new potential land to replace the existing site. There are several vacant lands around the existing site. The developer could find a potential site in the area to determine the suitable land for site replacement.

DISMANTLE Second option is the developer need to dismantle the telecommunication tower structure because the site cannot be on that particular land and obtain approval from the Local Authority without complying with the guideline.

CONCLUSION

In order to obtain approval from Local Authorities, developers should follow the guidelines set by the Local Authorities and the related Technical Agencies. In this case, the developer must comply with the MCMC guidelines to provide 30 meters distance from the nearest residential building so the telecommunication tower structure will bring no harm in terms of physical and material to the public around the structure. Solution provided only as a guide and suggestions to the developer to decide. However, the best results are final and shall be made by the developer to give extensive coverage to the residents and to ensure the continuity of telecommunications network services in the area.
