Acceptance of Terms of Use
By downloading, accessing or using RTL1090, RTL1030, RTL-DUO, RTL-UVD or any other
software downloaded from jetvision.de or other websites (the Software) you agree to
follow and be bound by these Terms of Use. IF YOU DO NOT ACCEPT ALL OF THESE
TERMS, DO NOT USE THE SOFTWARE.
Use of Software
The Software is the copyrighted work of jetvision.de and/or its licensors (if any). Your right
to download and/or use the Software will be subject to the terms and conditions of this Terms
of Use which you agree to when downloading and/or using the Software. Any use,
reproduction or redistribution of the Software not in accordance with this Terms of Use is
prohibited.
Limitations of Use
Unless otherwise specified in the Terms of Use the Software is for your personal and non-
commercial use only. Notwithstanding anything to the contrary in the preceding sentence,
only if you have obtained any Software pursuant to a seperate Licensing Agreement by
jetvision.de you may use the Software for your commercial purposes.
Limitations of Second Tier Use of Software, Beneficiaries
If you receive data, that were processed and/or decoded and output by the Software, through
data connections or any kind of data media from other users of the Software you are
considered a user of the Software yourself and you are subject to the Terms of Use, even if
you have not downloaded, accessed or run the Software. If you use these decoded and/or
processed data for commercial purposes you must enter into a Licensing Agreement with
jetvision.de, otherwise the commercial use of such data is prohibited. The private or non-
commercial use of such received data is not limited.
Disclaimers and Warranty
ALL SOFTWARE, MATERIALS AND SERVICES PROVIDED BY JETVISION.DE ARE
PROVIDED ON AN "AS IS" BASIS. JETVISION.DE, FOR ITSELF AND ON BEHALF OF ITS
SUBSIDIARIES AND AFFILIATES, AND THEIR RESPECTIVE LICENSORS (IF ANY) AND
SUPPLIERS, DISCLAIMS ALL EXPRESS OR IMPLIED CONDITIONS,
REPRESENTATIONS, AND WARRANTIES OF ANY KIND, INCLUDING WARRANTIES OF
MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, AND NON-
INFRINGEMENT OF INTELLECTUAL PROPERTY.

Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, IN NO EVENT WILL

INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNATIVE, OR EXEMPLARY DAMAGES,
INCLUDING BUT NOT LIMITED TO, DAMAGES FROM LOST PROFITS, LOST DATA OR
BUSINESS INTERRUPTION ARISING OUT OF THE USE, INABILITY TO USE, OR THE
RESULTS OF USE OF THIS SITE, ANY WEB SITES LINKED TO THIS SITE, OR THE

Indemnity

attorneys' fees, made by any third party due to or arising out of your submission, your
violation of the Terms of Use, or your violation of any rights of another.
Jurisdiction and Venue
These Terms of Use are to be governed and construed by the substantive law of the Federal
Republic of Germany. In the event of a dispute arising out of or relating to these terms and
conditions, litigation must be brought forward in a court of the Free and Hanseatic City of
Hamburg, Germany.
Waiver
A failure of jetvision.de to exercise or enforce any right or provision of the Terms does not
constitute a waiver of such right or provision. If a court of competent jurisdiction finds any
provision of the Terms to be invalid, the parties nevertheless agree that the court should
endeavor to give effect to the parties' intentions as reflected in the provision, and the other
provisions of the Terms remain in full force and effect. Regardless of any statute or law to the
contrary, any claim or cause of action arising out of or related to use of the Services or the
Terms must be filed within one (1) year after such claim or cause of action arose or be
forever barred.
