IMPLEMENTING GUIDELINES ON CHILD
PROTECTION AND ANTI-BULLYING
I. INTRODUCTION
Pursuant to the 1987 Constitution, the State shall defend the right of
children to assistance, including proper care and nutrition, and special protection
from all forms of neglect, abuse, cruelty, exploitation, and other conditions
prejudicial to their development !rticle "#, Section $%&
San 'uan (lementary School, together )ith the *epartment of (ducation,
recogni+es that cases of abuse and bullying against school children may arise as
a result of the difficult situations faced by co,pupils, teachers and other officials
)ithin and outside the school& -n lieu of DepEd Order No. 40 s. 2012 and
Republic Act No. 10627 (An Act Requiring All Elementr! nd "econdr!
"c#ools to Adopt $olicies to $re%ent nd Address t#e Acts o& 'ull!ing in
(#eir )nstitutions*, this School has adopted the policy and guidelines to provide
special protection to children )ho are gravely threatened or endangered by
circumstances )hich affect their normal development and over )hich they have
no control, and to assist the concerned agencies in their rehabilitation&
.ith this guideline, San 'uan (lementary School reiterates a +ero tolerance
policy for any act of child abuse, exploitation, violence, discrimination, bullying,
and other forms of abuse&
II. OBJECTIVES
/his guideline focuses on the follo)ing objectives0
1& /o create a school guiding principle )hich encourages students to disclose
and discuss incidents of abuse bullying behavior by the school head,
teachers, staff, and pupils1
2& /o raise a)areness of bullying and any form of abuse as an unacceptable
form of behavior )ith school management, teachers, students,
parents3guardians1
$& /o create a school ethos that ac4no)ledges, accommodates and respects
a diversity of learners )ith regard to physical, mental, emotional, and
economic factors1
5& /o ensure that the school6s Social, Personal and 7ealth (ducation program
raises a)areness of the factors associated )ith child abuse and bullying
behavior and develops appropriate 4no)ledge, s4ills and behaviors1
8& /o ta4e practical actions to prevent incidents of abuse and bullying behavior
e&g& to ensure comprehensive supervision and monitoring measures
through )hich all areas of school activity are 4ept under observation1
9& /o develop procedures for reporting and recording incidents of abuse and
bullying behavior1
7& /o develop procedures for investigating and dealing )ith incidents of abuse
and bullying behavior1
8& /o develop a program of support for those affected by any 4ind of abuse
and bullying behavior and those involved in aforementioned cases1 and
9& /o )or4 )ith, and through, the various local agencies in countering all
forms of abuse, bullying and anti,social behavior&

IV.THE SCHOOLS PREVENTIVE MEASURES TO ADDRESS CHILD
ABUSE, EXPLOITATION, VIOLENCE, DISCRIMINATION,
BULLYING, AND OTHER ACTS OF ABUSE
1& Conducting sessions, trainings, and seminars on positive peer relationships
and enhancement of social and emotional competence for both teachers
and pupils1
2& =rienting all teachers, parents, and pupils on the Child Protection Policy
and the !nti,>ullying !ct during pupils6 orientation and 7omeroom P/!

$& -ntegrating and teaching Children6s ?ights in all subjects in the classroom1
and
5& -nitiating programs in and outside the school that are intended to promote
positive and non,violent discipline&
V. PROTECTIVE AND REMEDIAL MEASURES TO ADDRESS CHILD
ABUSE, EXPLOITATION, VIOLENCE, DISCRIMINATION,
BULLYING, AND OTHER ACTS OF ABUSE

1& -n any case )here it has been determined by the classroom teacher that
bullying behavior has occurred0
1&1/he parents of the parties involved should be contacted at an early
stage to inform them of the matter and shall be immediately reported to
the principal and he3she )ill be the one to meet )ith the parents of the
offended and the offender&
1&2/he victim and the offending child shall be referred to the Child
Protection Committee for counseling and other interventions&
1&$/he penlt! o& reprimnd shall be imposed by the Principal in the
presence of the parents or guardians&
1&5-f bullying occurred for second or subse@uent time, after the offending
child has received counseling or other interventions, the penlt! o&
suspension for not more t#n one (1* 5ee6 shall be imposed by the
Principal& *uring the period of suspension, the offending child together
)ith his3her parents or guardian )ill be re@uired to attend further
counseling&
2& -f the bullying resulted in serious physical injuries or death, the case shall
be dealt )ith in accordance )ith the provisions of ?epublic !ct 9$55 and its
implementing rules and procedures0
2&1/he child and the parents or guardians must be informed of the
complaint through )riting&
2&2 /he child shall be given the opportunity to ans)er the complaint in
)riting, )ith the assistance of the parents or guardians&
2&$ /he penalty to be given by the Principal could be suspension,
e7clusion, or e7pulsion& 7is37er decision should be in )riting, stating
the facts and reasons for his3her decision& 7o)ever, the said decision
may be appealed&

1& /he follo)ing acts are prohibited and shall be penali+ed in administrative
proceedings as :rave or Simple ;isconduct depending on the gravity of
the act and its conse@uences0
a& Child abuse1
b& *iscrimination against children1
c& Child exploitation1
d& #iolence against children in school1
e& Corporal punishment1 and
f& !ny analogous and similar acts&
2& Apon the receipt of the complaint, the Principal must for)ard the said
complaint )ithin forty,eight hours 58 hrs&% to the *isciplining !uthority for
the conduct of a fact,finding investigation& /he aforementioned time frame
must be strictly observed, except )hen justified by circumstances beyond
his3her control&
$& -f a complaint is not sufficient in form, the Principal shall immediately inform
the complainant of the re@uirements of a formal complaint&
5& Apon the referral of the Principal or :uidance Counselor, the child victim
must be provided )ith an assessment and psycho,social intervention to be
given by a ;unicipal Social .elfare and *evelopment =fficer ;S.*=% to
help the child recover from )hatever trauma he or she has experienced as
a result of the abuse& /he offender shall li4e)ise undergo psychosocial
intervention&
8& !ll complaints must be )ithin the jurisdiction of the school and the
*epartment of (ducation and shall not be brought to amicable settlement
before the >arangay, subject to existing la)s, rules and regulations&
9& /he identity or other information that may reasonably identify the pupil,
)hether victim or offender, shall be )ithheld from the public to protect his or
her privacy& Bi4e)ise, the ;agna Carta for Public School /eachers protects
the rights of the teachers and no publicity must be given to any disciplinary
action against a teacher during the pendency of his or her case&
7& Criminal and civil case arising from child abuse, discrimination, exploitation,
violence and other acts of abuse are separate and distinct, and shall not be
a bar to the filing of an administrative case under these guidelines&
